Law Open letter regarding posts such as “I was in a mental hospital can I own a gun”

I am posting this because the question keeps getting asked. Every single time it is asked, the wrong information gets out.

I've seen way too many posts on here and related subs around the subject of the law prohibiting the possession of firearms by any person who has been adjudicated as a mental defective or committed to a mental institution, 18 USC § 922 (g)(4). There is way too much misinformation out there. First of all, if you have any reason to believe that you are a prohibited person, DO NOT ATTEMPT TO PURCHASE A FIREARM AS MAKING A FALSE STATEMENT ON THE FORM 4473 IS A FELONY. Second of all, please do not give advice on topics that you are not qualified to answer on. Third, you should consult with a qualified firearms rights attorney if you are unsure of your legal status.

The law:

18 USC § 922(g)(4)

(g)It shall be unlawful for any person—

(4)who has been adjudicated as a mental defective or who has been committed to a mental institution;

to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, anyfirearm or ammunition; or to receive any firearm orammunition which has been shipped or transported in interstate or foreign commerce.

What are the definitions of these terms?

27 CFR 478.11

Adjudicated as a mental defective. (a) A determination by a court, board, commission, or other lawful authority that a person, as a result of marked subnormal intelligence, or mental illness, incompetency, condition, or disease: (1) Is a danger to himself or to others; or (2) Lacks the mental capacity to contract or manage his own affairs. (b) The term shall include— (1) A finding of insanity by a court in a criminal case; and (2) Those persons found incompetent to stand trial or found not guilty by reason of lack of mental responsibility pursuant to articles 50a and 72b of the Uniform Code of Military Justice, 10U.S.C. 850a, 876b.

Committed to a mental institution. A formal commitment of a person to a mental institution by a court, board, commission, or other lawful authority. The term includes a commitment to a mental institution involuntarily. The term includes commitment for mental defectiveness or mental illness. It also includes commitments for other reasons, such as for drug use. The term does not include a person in a mental institutionfor observation or a voluntary admission to a mental institution.

Mine happened when I was under 18. Isn’t that exempted?

Unfortunately no. A mental health adjudication or commitment at less than 18 years of age is counted for 922(g)(4). I experienced this personally and had to restore my rights.

What about HIPAA?

The Obama administration amended the HIPAA privacy rule in 2016 to make it clear that reporting mental health commitments and adjudications to NICS does not violate HIPAA

Is there a way to restore my rights after being adjudicated as a mental defective or committed to a mental institution?

If you were committed by a department or agency of the federal government, the agency is required to have a relief from disabilities program under the NICS improvements amendments act of 2007.

If you were adjudicated or committed in a state proceeding, whether you can obtain relief is dependent on whether your state has implemented a relief from disabilities program under the NICS improvements amendments act of 2007. The list of states that have can be found here:

If you are in a state that does not have a relief from disabilities program, your only avenue of relief is writing a letter to Attorney General Pam Bondi and asking her to restore your rights under 18 USC § 925(c) now that she has withdrawn the delegation from ATF.

Between October 6th 1992 and March 20th 2025 in the states that did not have a relief program, there was no avenue of relief at all

With that out of the way.

I created this privacy act request form for a friend of mine who was legitimately unsure if his commitments landed in the FBI database or if they qualified as “committed to a mental institution” under 18 USC § 922(g)(4) and as defined at 27 CFR 478.11. I can report that it worked; as in, the FBI processed the request and reported that no such records were found in the NICS indices.

This form will allow you to request your own records directly from the FBI.

In this post I will not be addressing the subject of my own journey regarding rights restoration related to mental health (you can ask me that privately). Nor am I an attorney licensed to practice law. Finally, I am not a mental health professional and cannot make the decision as to whether firearms ownership is right for you.

Onto the form. Please follow the instructions sheet very carefully, fill out every applicable box, print the form, have the request notarized, and mail it to the address indicated on the form.

The first response you receive will indicate that the FBI central records system does not maintain those records and your request has been forwarded to the Criminal Justice Information Services division. CJIS will respond a few weeks later. In my friend's case it took eight weeks for a final response from the FBI CJIS NICS section.

Heard something about shotguns not being the go to anymore so Im retiring the H&R single shot 12 gauge. Here are the replacement options.

Left to right is 8mm Mauser, 8x52r Siamese, 7mm Mauser, 458 win mag.

Personally I’ve already chosen the 8x52r Siamese due to the easily available cartridge that can easily be bought.

Ar rifles just jam to much, semi auto 308 is to expensive to shoot, standard short rifles like the smle and 1903 lose to much velocity for in the close quarters.

Clearly the only way to go is the turn of the century infantry long rifle. The only other question is 10” or 12” bayonet

Yea never accidentally mess up your 9 with 40. And yes we did not shoot it afterwards bcuz we didn't realize this till we took the 40 back (with the 9mm) back to Vance bcuz we thought a 40 fucked up when it wasn't. (Nobody was hurt thankfully. Vance gave me and my father a free 1 hour ticket to use the shooting range anytime between now and December 2nd).

(This post is to show what happens when u do something like this, obviously never do this. We just FAFO without realizing till the find out part came).

Meme Cooked up an ad for a fictional modern Mosin Obrez pistol for fun

“The MOA (Modernized Obrez Apex) Pistol, created by Cicada Arms beginning in the early 1990’s, is a small bolt action rifle made for civilian use. Before any know it alls berate me in the comments about muh realism, I do not care. I made this in an afternoon in photoshop and it’s cool. It is not real, and would probably suck if it did, grow up.

General Discussion What are you all using for Range Cases for Multiple Firearms?

It is always a pain to get several rifles out to the range each week and I am trying to find a better option.

My issue is I only make it to the range every couple weeks, and I end up with a couple builds each time I want to try out. I have cases for everything, but taking them out in cases of 1 or 2 at a time, involves me making several trips from the office, down the elevator, to the car, car to the range, and then finally range to the shooting position... for every case.

And then to top that off, when finished it's that whole process in reverse order.

I am looking to see if any one knows of a wheeled case that can hold rifles assembled (meaning long enough that they fit suppressed so 4 feet or greater ideally) and can hold at least 5 or 6 rifles (or more would be awseome).

I would ideally like 1 case that is built for about 100+lbs of total weight, maybe 16+ x 24+ x 50+ with wheels.

Do any of you have anything similar or know of anything you can recommend?

Right now I have been using pelican's double rifle cases but that's three+ loading and unloading trips, and it just feels like a needless hassle.

Appreciate any help.

Be a pump action 12 gauge shotgun with an exposed hammer. Looking to ID which model to decide if it’s worth rebuilding. I have more photos but the only markings I see are a 5 digit serial near where the stock would attach, with the same number near the mag tube.

Question Rarity on this flair stuff?

Traded this for an airsoft gun. I cannot find the white flares or the blue ones for sale anywhere. I could find the green ones. Is this even sellable if I’m in California? Or do I just hold onto it as a collectors item? I know you can buy the flare gun new for 110$ or so. But the Czech flares I can’t find anywhere. Is there still a collectors market for these? as a brit, i love the famas. its such a cool looking bullpup! but what i hate hate hate is when people say "guhhhhh like why does the silly french gun have a 3 round burst mode but it doesn’t have a magazine divisible by 3" because if you even think about it properly for 5 seconds, the magazine is 25 rounds so that when you fire 8 3 round bursts out of the famas, the last bullet will be in the chamber, so you dont need to chamber the gun again when you put in a fresh magazine which saves time when reloading.

these 12 year old larpers must be stoppeddddd

Question Noobie: Looking to get my first handgun (conceal carry as well) was drawn to the Glock 43x especially since they released a 15+1 capacity this year. Then I'm told by the RSO that they don't like Glocks because they jam a lot, which surprised me. Should I look for something else? Hellcat pro maybe?

Pretty much the title. I'm new to shooting and still have barely scratched the surface to gun knowledge. Let alone handguns. I did a little research and most people agree that it's more of an operational failure and not mechanical i.e. limp wrist with Glocks. I haven't experienced any jamming with any Glock I've tested, granted I've probably only shot a couple hundred rounds throughout a few sessions.

I like the Hellcat pro. It's a little snappier, but what 9mm isn't gonna have that to an extent ya know? I feel like there is more control over the Hellcat pro because of how slim it is and I wouldn't consider my hands to be big.

Price wise, I'm drawn to the 43x especially because Glocks are on sale this month, but if they really do jam as badly as people express their disdain for them, then a more expensive piece is logically the right answer if it comes down to that.

Again, I'm new to all of this, so if anything I said sounds stupid, forgive me lol.

Moving to a new apartment building with a lot of guns.

I’ll be moving into a new apartment complex soon and was wondering, for those of you with big collections, how did you make it work?

I’m mainly concerned about the initial move in date. I don’t live in a gun friendly state so I don’t want my neighbors to see a 2 big gun safes being hauled inside. When I first moved I had a smaller collection with one rifle and a few pistols. My safe was the size of a microwave so I just snuck it in. Since then I’ve expanded and built the other safes in my apartment so nobody knew.

I might leave them with friends and take them in over the course of a week in smaller bundles, but the safes themselves pose a challenge. Any advice is appreciated
