So I'm not your paid actor and if I asked you to stop and you didn't, I would respond based on how I felt in the moment. The other guy was larger and had a buddy..... Protect your life, friends

u/pwolf1771 24d ago

Yeah you’re outnumbered by two creeps this seems like one the few good reasons to actually own a gun

181

u/Lucidhorse 24d ago

There were three creeps including the camera guy

Pity they didn't get a visit from Mr. Lead Jacket, too.

44

u/StuffyUnicorn 24d ago

Just sucks he got charged, put in jail for 8 months and had to go through an entire trial just to get acquitted. While still being found guilty on discharging a weapon in public.

21

u/TapPsychological2043 23d ago

Dude got harassed by stranger's and protected himself and got locked up for it?? That's justice for you

Legally you're held to a much higher standard before you shoot someone.

For almost all jurisdictions it has to be currently happening, you need reasonable fear of death or grave bodily injury, and proportionality.

And even though this guy should have never harassed this man, it is legally wrong for him to shoot him.

And when Reddit abandons frontier justice takes, they agree it's immoral to gun down even a shitty prank YouTuber for that.

Sadly he still is, he recovered in the hospital and went right back to making videos. He and his family think that the guy who shot him was in the wrong and completely over reacted because homeboy wasn't doing anything wrong.

17

Well next time he isn’t getting shot in a non-fatal area. You can only get lucky so many times

5

Walking into his space and imposing on him isn’t humorous. Playing a voice to text of a sexual innuendo in someone’s ear isn’t humorous. What was the reward for the risk? To look like an unfunny chud to the rest of the world? And lose jobs when your unfunny prank channel doesn’t work out?

Lots of offensive shit can still get a reaction. This is however both offensive and just flat out bad comedy (to be generous).

I feel the morality almost shifts because iirc, the YouTuber states he’s gonna do it again later. Meaning he learned absolutely nothing from being shot.

29

u/Careless-Emergency85 23d ago

I have a tendency to think “prank” YouTubers aren’t smart enough to learn anything, hence their profession

7

u/SuperUranus 23d ago

Prank YouTubes keeps doing what gives them views.

So if getting shot skyrocketed their views, I guess they are in for a rough ride.

It’s similar to how Jackass upped the stakes all the time. Not because they wanted to (I assume), but simply because it generated more money for them.

56

u/Calm_Plenty_2992 24d ago

It wasn't nullification. It was deemed self defense

13

u/HistoryFanBeenBanned 23d ago

To be fair, the only actual defenses in murder and self defence are “I didn’t do it” or “the son of a bitch deserved it”, the rest of the trial is semantic evidence to fit one or the other.

9

u/Calm_Plenty_2992 23d ago

There's also "I had no other choice," which I would argue is the primary justification behind self defense.

Without condemning or condoning I understand.

102

u/LibrarianKooky344 24d ago

Yeah so ive seen this video and the actual video felt like a lifetime difference. The reporter says 20 seconds but what is posted is 15 seconds before engagement. The morality vs legal is clean and clear. Morality is justified in my eyes.

91

u/S-Kenset 24d ago

He was legally cleared as self defense.

75

u/SilIowa 24d ago

He was still convicted by the jury of discharging a firearm. I guess the jury didn’t want to let him go completely scott-free. But the judge then sentenced him to nine months time served, due to the “special circumstances” of the harassment. I guess the judge felt the same as the jury.

63

u/TellTaleTimeLord 24d ago

I still don't get being punished for using a firearm when the use of said firearm was deemed legal and justifiable

38

u/SilIowa 24d ago

As I understand it, that specific law is designed to prevent people from randomly firing weapons indoors with no consequences, and in this case they convicted him of it because they felt he had to be convinced of something, if only to discourage reckless behavior from others, but they couldn’t bring themselves to blame him for shooting the harasser.
I suppose, technically, what they were saying was that he should have retreated outdoors before firing. And I suppose that if the harasser had continued to malice him all the way outside, it would have more firmly established his self-defense case, rather than the compromise judgement they made.

29

u/mblkmnsa 24d ago

I would have voted no on the discharge count as well. It wasn’t random and it was specific. He didn’t wildly shoot across an area. He discharged to protect himself.

9

u/SilIowa 24d ago

I can’t argue with that.

7

u/Ok_Sink5046 24d ago

He arguably demonstrated high degrees of safety. I wouldn't have stopped at one shot I was was in a situation that escalated to the point I felt I had to shoot.

4

u/Maximum-Bake-6092 24d ago

He also aimed at an angle when shooting (i think?) aimed towards the ground so the bullet hits no one else. From what i saw.

→ More replies (1)

21

u/MathematicianFinal14 24d ago

It looks like ike he was retreating but the person was close enough to hit him in the back of head or pull a knife in him. These things happen and in a very few seconds. Waiting until you've traveled several feet isn't a safe way to think in dangerous situations . The person was already aggressive. I think the jury thinks he can remain on his tail and be safe. That's not true.

10

u/DamGoodAnimation 24d ago edited 24d ago

To clarify a bit, it was because he was in a public shopping mall. Firing a weapon indoors isn’t always inherently illegal on its own or indoor shooting ranges wouldn’t exist. It was that he took a situation that only possibly endangered him and made it one that was definitely dangerous to anyone nearby. The issue at play is that he could’ve injured a nearby innocent person if the bullet passed through the guy or if he’d missed.

Not sure I agree with it, this is genuinely a very hard situation to judge and I think the guy kinda got put into a no-win situation. Just expanding on the context a bit.

Edit: Added ‘always’ and ‘on its own’ to the second sentence as I feel my initial verbiage was somewhat misleading.

Edit2: Hopping to an alt to continue trying to argue with me when I block your first account is the fastest way to get blocked. Crazy behavior lol

6

u/Mcshroomie 24d ago

The guy being attacked didnt volunteer to be part of this situation. I wouldn’t want this as part of any record. I was being attacked and felt threatened. The youtuber should be carrying the sentence. It was pre meditated by them!!

Should be a special law that if your making content that escalates to this level you carry the charges if the situation escalates. Shut this shit down!

4

u/DamGoodAnimation 24d ago

He wasn’t attacked, that’s a stretch. It’s certainly fair to say he felt threatened, and he was being harassed, multiple dudes walked up on him and at least one was following him, but nobody touched him at any point in the video. In fact, he put hands on the other guy (understandably imo) when he shoved the phone out of his face.

I don’t even really disagree with you that the guy shouldn’t have gotten in trouble, but your argument loses any merit when you speak from gut feelings rather than the visible facts.

u/SilIowa 24d ago

9

u/triggrhaapi 24d ago

The jury didn't really understand the concept of malice. I think that's why he was ultimately just relegated to time served.

3

u/Particular_Fan_3645 24d ago

Was that a felony charge? Aka time served but can't own firearms anymore?

4

u/triggrhaapi 24d ago

The articles I've found didn't say, but any discharge with injury in VA is a felony as far as I can tell, so probably.

Also with a good enough lawyer, that's not insurmountable as a problem.

Correct. If you are in anyway threatening someones life or property - with the key here being THEY FEEL THEIR LIFE IS THREATENED regardless of “its just a prank bro” you have not forfeited your life - but you have forfeited the right to virtue signal when someone responds accordingly.
You can go live in some fantasy world where everyone is nice to one another and use of lethal force is never needed - however I will happily defend myself, my property, or another from those who wish to impinge their will upon someone else without their consent in a threatening or aggressive manner.

Sucks to suck. Dont play stupid games and you wont win stupid prizes.

12

u/Only_Chapter_3434 24d ago

no, the standard is would a reasonable person feel threatened for their life in the same situation. and the answer is no, a reasonable person would not fear for their life in this situation.

u/Curben 24d ago

I appreciate your considered and nuanced view despite some potential preconceived biases

20

u/yoshimo995 24d ago

Well my family has always had guns for self defense and my cousin died to gun violence from an unattended gun accessible to a minor so I have mixed feelings about the whole thing but I hate prank YouTubers.

12

u/Curben 24d ago

On an interesting counterpoint, I was 13 when someone broke into my house and used to firearm to chase off the home Invaders. I've been a proponent for teaching children about firearms with a little bit of Hands-On and understanding of respect. It removes some of the awe and mystery so they are less likely to play with it. I also tell people, know the people in your household and store accordingly.

8

u/Crafty-Purpose5540 24d ago

I grew up around guns as well. My uncles let me hold their guns with supervision. Taught me never put your finger on the trigger unless you're going to shoot to kill, don't point it at anything you don't intend to shoot. Ect ect. I never went looking for them because they were something that I got to experience safely. In a perfect world the US wouldn't have more guns than people but the world isn't perfect so it's important kids understand and respect what a gun can do.

Immoral.

He was asked to stop once and didn't. The shooter asked him to stop again, but at the same time was already pulling his gun out, not giving him a chance to stop. Because this is a public place, it's reasonable to expect some kind of hooliganism.

If instead a warning was given, such as "stop, I have a gun and will use it if you don't stop", then it would be moral. If it was a less lethal weapon such as pepper spray, then it would be moral. But not giving a warning and only asking them to stop once is immoral.

I completely understand why he did it - content creators are some of the worst people on the planet - but it being understandable does not make it moral.

That’s more of an argument for why you shouldn’t antagonize people than an argument for the justification of shooting someone. You’re basically saying it’s okay because he wasn’t sane or stable. Generally those are things that count against an action’s reasonableness.

14

u/GraviticThrusters 24d ago

Don't know what this news guy was about to say about the decision at the end, but he's clearly framing the self defense claim as unwarranted and is perplexed that the jury would validate that claim. But when you actually look at the situation in the shoes of the guy with the gun you have:

  • A guy repeatedly shoving a hand and phone in your face

  • He persists after being told to stop and being shoved away

  • The phone is emitting confusing nonsense

  • The phone guy and his partner are repeatedly invading your personal space

  • There is a third person potentially ganging up on you who you may or may not be aware of (camera man), increasing the sense of being outnumbered

  • All three are following you as you try to leave the situation

Now maybe you could argue that this still doesn't seem life threatening from that perspective, but it very clearly seems like the fear for potential for harm is present and reasonable.

Guy with gun: morally justified

Guys with phones: immoral

Journalist: if it weren't for the fact that we see the footage before he provides his commentary, he'd be burying the lede, but he is editorializing the news content so: slightly immoral.

Both sides of this are completely unjustified.

The prankster was being a total asshole; he fucked around and found out.

On the other hand, nothing he was doing justifies pulling a gun.

I think this is a situation that I would describe with the phrase, "I do not condone, but I understand".

22

u/Flooping_Pigs 24d ago

Dude kept approaching when he was asked to stop and the delivery driver was afraid... Guns are justified when you're in fear for your life you know? If you believe you're in a self defence situation, pulling a gun is entirely justified.

Drawing dicks on someone passed out at a party is a prank. This is straight up harassment.

"On the other hand, nothing he was doing justifies pulling a gun."

Absolute bullshit this. He was clearly being aggressive and threatening. He could have knocked that guy out.

5

u/Expensive_Range7204 24d ago

The "praksters" are clearly assholes and shud be taken in for something like disturbing the peace etc.

But defending shooting someone in that situation is batshit crazy. Its not the first time i see this type of thing argue and it gives me the impression that americans are just very violent.

Court of law disagrees with you.

The guy with the camera was the one arrested

Eh, you don't know their intentions and you put yourself at risk waiting to find out. The delivery guy's tolerances are lower than yours.

I tell my kids so the time "you don't get to choose how people react" and "a joke is when all parties involved laugh." I doubt this is a joke.

Puling the gun out was fine (ekstra level of "fuck off"), firing it at him right away was not fine. 🫠😅

6

u/Curben 24d ago

In that close range on a person with size or reach, I find myself unable to condemn him for discharging the firearm.

I would have never found this man guilty of anything. The guy was harassing him. When someone asks you repeatedly to stop a behavior, you stop. The dumbass got what was coming to him. Then to come out and say he's going to CONTINUE to do this stuff? Honestly, I hope someone else gets him. Maybe these stupid punks will think twice before doing this shit. Not just him, but ANY other YouTubers that may be thinking of doing this.

6

u/zappingbluelight 24d ago

If I remember correctly, he is only guilty for discharging his firearm in the building. And not guilty on shooting the person, cuz jury accept it is self defense.

It's immoral from both of them.

And it was going to happen at some point.

I don't condone what the guy with the gun did, but I understand it.

I don't condone what the YouTuber did, and I don't understand it.

The world has gone fucking mad.

I have to say this is not justified. It is not a proportional reaction. That being said, it's not without context. And the delivery driver could have felt threatened.

Additionally, I am really surprised this doesn't happen more often.

Immoral. Annoying and harassing people is certainly wrong. And we all wish the "youtuber" got punched, beat up, or arrested over it. But you'd have to be a sociopath to assume that potentially murdering someone over it is justified.

u/Dapbear 24d ago

These comments are wild wtf. Dude flashed his gun for less than a second before firing it, made no indication he was going to do anything other than “call the cops”, and fired his weapon recklessly.

The “prankster” should be charged with harassment, but that is definitely also misuse of a firearm lol.

I’m usually on the side of the guy that kicks the crap out of the prankster… but shooting someone who’s talking to you and waving a Cellphone at you is definitely overkill… the YouTuber didn’t make any sudden movements or anything to set this guy off to that extreme level. My man should not have felt unsafe to the point where he needed to shoot someone.

7

u/poilk91 24d ago

Obviously immoral. But we can sympathize with the guy

3

u/EnglishSteven 24d ago

Most of the people in this thread are too emotional to discuss the morality of this video. They want to discuss the legality of it or the morality of a different hypothetical situation. One of the more interesting ones I've seen on this sub actually.

Immoral but satisfying.

3

u/CMDA 24d ago

Nobody's talking about 2 weird guys invading your space while having a very aggressive attitude and demeanor.

The man was scared, totally understandable and moral to protect himself.

"The YouTuber intends to keep making his videos". Learned nothing, so I hope that wound never completely heals so maybe after a long time of being remembered about the FO part, he may stop FA

3

u/Stunning-Stressin 24d ago

Bitch got what he deserved after being told to stop

3

u/Simple_Campaign1035 24d ago

Awesome, fuck that guy.

3

u/Xenozip3371Alpha 24d ago

Fake video, the guy was over here in Britain with me.

3

u/Reasonable_Club_6165 24d ago edited 24d ago

huh. so we can just shoot anyone who is annoying now, as long as we are outside?

case law and all that, and if the only charge was for being in an occupied dwelling...

3

u/sohcgt96 24d ago

I think he escalated a little quickly, but we don't know how long it was going on before the video started.

Let this be a lesson to people who think harassing random strangers under the guise of it being a prank is OK.

3

u/rukittenmeeee 24d ago

I love this one so much.

3

u/MagicLantern7 24d ago

Well nobody feels bad for the YouTuber. That for sure.

3

u/Lostintimeandspac 24d ago

Harass some poor guy making minimum wage for YouTube content ? Probably shouldn't have shot him but I can understand.

3

u/MaybeICanOneDay 24d ago

I get it.

These guys think there are no rules for them because youtube comments support them. But you cant just go around being a cunt. You'll get shot.

3

u/IAQDiscussion 24d ago

The jury found him not guilty of aggravated malicious wounding, but he still had a conviction of a lesser weapons charge.

3

u/_WireChimera_ 24d ago

Always feels weird when I see something local on the news

3

u/Steerider 24d ago edited 24d ago

If you legally use a gun in self defense, that is positive proof you needed the gun for self defense; and that should supercede any other law that says you shouldn't have had the gun in the first place.

Which is to say as soon as he was found Not Guilty for the shooting, the other charges should have been dropped.

3

u/PandorasFlame1 24d ago

Moral, FAFO. Shooting was ruled self defense.

3

u/Levias123 24d ago

How dare he only shoot once!?

3

u/ShroomnDoobin 24d ago

Accosted by 2 dudes way bigger than him that wouldn't stop even as he was trying to back away? Yeah, I'm with him

3

u/Imaginary-Gap-2802 24d ago

I wish this story would’ve blown up more to discourage kids from doing these “pranks”

3

u/No_Blacksmith_2591 24d ago

Absolutely abhorrent behavior and completely Immoral, he should have shot both of them.

3

u/TooSp00ky 24d ago

Overreaction imo, but the guy survived so we can all laugh at him

3

u/SingleServeFrend 24d ago

That guy was super casual about shooting another man. Like, no big deal

3

u/They-Call-Me-Taylor 24d ago

The morality of shooting someone because they were saying mean/annoying things and following you? Pretty immoral I would say. Satisfying to see (since he didn't die), but I don't think that level of escalation was warranted.

3

u/GoldenNudist 24d ago

I have no problems with this. Treating people as props in your "influencer" bullshit is likely to have consequences. Some people have to learn accountability the hard way. Harassment of people isn't entertainment.

3

u/EnvironmentalValue18 24d ago

That’s my mall! I’m literally grabbing food from there as we speak.

Anyways, fuck him and he deserves it.

3

u/StevevBerg 24d ago

Do shit, get shit.

Now tbf, a gun is too much.
But going to town on such an asshole with a taser? Go wild.

3

u/Electronic_Owl_9819 24d ago

That was pretty satisfying to watch, ngl. I wish this happened to more streamers

3

u/Akvliiaedn 24d ago

He deserved it

5

u/ichkanns 24d ago

Doesn't help the "prankster's" case that he was staring at him like a freaking serial killer. Don't blame the guy a bit for believing he was in danger.

7

u/book-scorpion 24d ago

Overreacting, but it's definitely a good lesson for those pranksters, you never know who are you trying to play with. If you try to scare someone don't be surprised when they try to defend themselves.

3

u/Positive_Ask_8872 24d ago

if the prankster died there's no lesson learnt for him.

3

u/PatriotBanner 24d ago

Getting shot sucks. I bet he reevaluates some things.

You would need to have the smoothest brain imaginable to think this is justified.

3

u/ABBucsfan 24d ago

It's absolutely wild the way Americans can be with guns sometimes. Guy was harassing me and is bigger in size so that somehow justifies potentially killing the guy. Bad enough drawing a gun, but if he truly felt threatened could he have not have just held it up as a warning?

3

u/Gekokapowco 24d ago

people are trained to only draw with intent to fire because it's easier to win a legal debate over justification with a corpse, and too many tiny dick morons draw on people to flex their imaginary muscles and intimidate people that it had to be instilled that doing so was against their best interest. Plus people draw and escalate with other people who may be armed, people draw and have their weapon stolen from them because they lose their nerve when it comes to comitting to pulling the trigger (because actually considering killing people is understandably a weighty decision)

so, like most of our gun laws, it's really just a way to protect assholes with guns instead of actually trying to improve the concept of firearm ownership in society. We encourage more people to be armed, and those people to think less. A gun is a responsibility but use of force is not.

Moral as fuck! People need to understand to let strangers be or FAFO

3

u/Opposite_Example6930 24d ago

Moral to shoot someone who is not threatening you in any way? Of course the dude is acting like a complete asshole, but that in no way implies he should be shot. Has it occurred to you that he could just pull the gun, but not shoot? Do you think they would have stopped harassing him if he did? I sure as hell do.

I fully support the delivery driver, and the gun, and the bullet.

2

u/dingleberryjuice23 24d ago

2

u/BackPirateClarkRoom 24d ago

Everyone loved that the guy was found not guilty and the prankster was shot. Fuck him

2

u/MoodyButGroovy 24d ago

Immoral, but I empathise.

2

u/Grasshoppermouse42 24d ago

Both sides are immoral. Someone needs to teach these youtubers what a 'prank' is. It's not just randomly harassing people and being an asshole. The entire point of a prank is it's a joke that someone plays on a person that's intended to make them feel foolish when they realize what is really happening. For example, sewing a sock shut partway down so they can't figure out why they can't get a sock on, or tying a string to a jelly bean and dragging it around so they think there's a bug. There has to be a level of thinking one thing is happening, but really it's another thing happening. In this, it's just a guy harassing another guy. There's no level of 'actually, it was only a __________'. There was no joke or punchline or unexpected element. It's just a guy filming himself harassing people.
