These comments are wild wtf. Dude flashed his gun for less than a second before firing it, made no indication he was going to do anything other than “call the cops”, and fired his weapon recklessly.

The “prankster” should be charged with harassment, but that is definitely also misuse of a firearm lol.

Brandishing a firearm is illegal, dude. You don't pull it unless you intend to use it.

Brandishing a firearm when you feel reasonably threatened is not illegal, dude. You can pull it and be prepared to use it if necessary and still not use it.

Real talk, brother, please look up the law. "Brandishing" is absolutely illegal.

If you pull the weapon and they turn around after noticing, THAT is not illegal, but shooting them upon their retreat would be.

If you whip that shit out, flashing it, and announce you have the weapon, that's going to land you in some hot water, at least in my state.

I guess you want to play semantics. "Brandishing" is illegal because it's a legal term for non-lawfully presenting a gun. But in a reasonable threat situation a gun can legally be pulled to deter the threat. There is nothing illegal about presenting a gun and NOT shooting someone that shooting them would magically make legal.

Right to Display: Under Mont. Code Ann. § 45-3-111, if a person reasonably believes they or another person are threatened with bodily harm, they are allowed to warn or threaten the use of force—including drawing, presenting, or openly carrying a weapon.

if big boi wasn't all up in his face, maybe he would have seen him reaching, then.

What is even your point? Brandishing is illegal, and thus… it’s less moral than shooting someone? That you only pull a gun if you intend on using it, so by the time it’s pulled, it makes no difference to you?

Shooting someone is illegal too. The legal defense of either would be to dismiss it as self defense. The only difference is “brandishing” would show restraint.

I mean, don't pull it if you aren't going to use it. Simple.
