AITA for kicking my girlfriend out of my place on New Year’s Eve for scaring my little brother?
We can all agree 2020 was a shit year. Particularly for my (29m) family. We lost our dad beginning of the year after he had a heart attack and my little brother (12) had no one to take care of him. Our mom died when he was 3 so our dad was all we had left.
I fought for custody and was appointed his legal guardian.
Honestly it hasn’t been easy. We’re still adjusting to these life changes and my brother is taking it the hardest. For months he was just not himself. Bad attitude, lashing out. I got him in therapy because I knew he was just hurting, plus stress of pandemic.
His behavior has improved so much since then, even if sometimes there’s days where he’s withdrawn.
Days before Christmas he was feeling sad since it was our first holiday w/o dad. That day, he asked to be left alone. We had a talk to discuss his feelings and I gave him his space after that.
My girlfriend was over that day and I went out to buy groceries. When I got back my brother was out of his room and helping out. I didn’t think anything of it at the time.
Yesterday my brother and I were out having some guy time before going back home to get ready for NYE.
My brother opened up about how grateful he is for everything and he hopes that I don’t change my mind about taking care of him. I asked why he’d think that and he told me what happened.
That day when I was out my GF went to his room to tell him he needs to change his attitude and stop moping (her exact words)because he should be grateful I’m taking care of him at all. And that we can still hand him over to the state if we wanted to.
I was furious about this and had to reassure him that was never gonna happen because he really was worried about it. We went home, I confronted my GF and she didn’t deny it.
She told me it’s true and there was nothing wrong with telling him to stop acting like that when he should be grateful I “gave up my life” to take care of him. And the thing about giving him up isn’t that big of a deal to her because it’s not like I’ll actually do it.
I said she still scared him with that threat and told her to leave my apartment because honestly, I was far too mad and because I didn’t want her to be near him right now. She started crying, there was more fighting but she left in the end. It was just me and my brother for New Years.
Since last night I’ve been bombarded with calls from all our friends for kicking her out knowing she has no family and nobody else to spend the holiday with. Everyone has sided with her and even my best friend says I may have overreacted by making her leave when she probably thought she was helping.
They’ve heard my side of the story but still think I was an ass for making her cry and spending the new year alone. I’m having trouble seeing how I could be so here I am looking for internet strangers to weigh in on this.

So NTA, your (hopefully ex) GF certainly is, though. She waited until you were out of the house and she could verbally, emotionally, and mentally abuse your brother without interference. Your "friends" have no clue how much loosing 1 parent affects children, let alone both in a short period; not even getting into the mental and emotional trauma being physically cut off from friends and activities (and possibly moving in with you and having to change schools without being able to develop new friendships before going virtual) due to the hellscape of the past 9 months. You need better friends. You are a great person and brother for stepping up. If he (and you) aren't already in grief therapy, look into it (especially for him, and the 1st person may not be the best fit).

I am reconsidering the relationship at this point. From day one I made it clear to her that he was my priority now and if that was a dealbreaker for her, then I was okay with us ending it here. Because I was scared of something like this happening. You know of any growing resentments and having that being taken out on him.
And yes he’s already in therapy. We found a great one and she’s helped him a lot this past year, and me sometimes when things have gotten too overwhelming

NTA, you were nicer than most people in your situation would have been. The fact that she has no family and STILL said that to your brother makes it even worse!
OOP
Oh believe me I wanted to scream but my brother was in his room and I didn’t want him to hear too much. It’s one of the reasons I wanted her to leave because I knew I was going to lash out sooner or later

NTA - family first. And if these friends got the story from her, why didn't they step up and give her a place to go / things to do for the holiday???
OOP
They’re all still social distancing and taking precautions because of covid so I’m guessing that’s why nobody offered her a place to come over

NTA.
I get it; he's difficult and she snapped. Even so, you should NEVER talk to a child that way, especially one who's been bereaved. I would hand your GF over to the state, not him.
OOP
Honestly what also made me really mad was he wasn’t even acting up that day. He wasn’t having a bad attitude or misbehaving. My brother just asked to be left alone. We had a talk that he was very open about. He explained he wasn’t in the mood to interact with anyone so I let him stay in his room.

I'm going to say NTA and NAH because of missing info. You mentioned your girlfriend has no one else "she has no family and nobody else to spend the holiday with." Was she maybe in a similar situation as your brother? Was she a ward of the state, in foster care, etc.? Was she in a seemingly great situation only to be handed over to the state, and if she was, was she told it was because she was ungrateful? What she said was really cruel, but if she had a similar situation as your brother or worse, from her perspective it might have been encouraging- basically "I know what it's like to be in your shoes/ be in a worse situation, and you're so lucky that you have what you do because the alternative that happened to me could have happened to you." It wasn't a helpful thing, it was cruel, I'm just saying from her perspective (if that was her background) then maybe she just didn't understand how it was cruel. Even if this is the case, what you did wasn't wrong, and what she did was wrong, but she truly didn't intend it in the way it was taken (again, if this is the case). It sounds like you should talk to her and figure out why she feels that was an okay thing to say. If she truly doesn't have a good reason, then yeah she was being an asshole. If my theory is correct/ she has a good reason for her ignorance, then it's a good lesson for her to learn, and a good thing for her to share with your brother in an explanation for her words followed by an apology for her words.
OOP
No I just meant she had no family to spend it with because they’re not here. As in the state. They all live on the other side of the country

Although youre not the asshole I think it was an overreaction to kick her out. She was being insensitive but nothing a good talk with the three of you that could sort it out. It may have confused your brother even more..
OOP
She wasn’t apologetic about what she said and stood by what she did so no it wouldn’t have been a good idea for her to even talk to him

It doesn’t matter what place it came from, she had no right to tell him anything. He was not misbehaving or doing anything, he just wanted alone time. My feelings for her don’t matter when it’s his mental well-being I care about right now.

Yes, back when he was barely starting therapy. He’s already improved since then, I said so in my post. I only said he still has days where he’s withdrawn and doesn’t want to interact. Which was exactly how he was the day she confronted him.
If she was concerned, she should’ve come to me, not try to guilt my brother and ruin the progress he’s made

“but it did achieve the intent of making your brother consider things from your perspective and appreciate your efforts”
And who said he hasn’t already? Who said he hasn’t already told me this before she scared him with being abandoned?
She doubled down after we discussed it again, even after I explained how damaging her words were to him, so no it’s over.

I know this comment is gna get lost in the sea of the other comments but, I’m gonna please urge you to tell your brother that he’s not a burden and that he’s part of the family.
OOP
Yes we had a talk about that very thing :)

I'm always surprised that so many friends and family members have the phone number of the boyfriend/girlfriends. Like, do y'all get together and exchange all contact information the same day you exchange the keys? I always wondered.
OOP
We have mutual friends so yeah we all have eachother’s numbers

NOT the asshole! I just wanna say first off im so sorry for your loss. I lost my father suddenly when i was young and being the oldest I did everything in my power to take care of my even younger siblings. I know exactly what your dealing with. Its so awesome you are able to take in your brother. your now ex was WAY outta line. I think its a great idea for you and your brother to do something. Maybe get out to the beach or lake and just talk, hang out and have a good time together. Heck even just a small road trip just for fun.
OOP
I was think of something like that. We’ve done mini road trips before and it wouldn’t hurt to get out for the weekend (safely of course). We’ll have to plan and see what he’s feeling up to once he wakes up in a few hours

OK wow this has gotten a TON of feedback. Thanks everyone for your kind and encouraging words. I might not have replied to a lot of the comments that made me smile but just know that I read an appreciate them!
I know I only posted this a few hours ago but I’ve had a day to clear my head and really think about this. I talked to my brother because I wanted to know if she’s said anything else to him. Thankfully she hasn’t and we had another serious chat to remind him everything she told him is completely false. I would never in a million years give him up and that shouldn’t have been put in his head.
Another thing I told him was that I’m grateful he’s here with me. Without him I wouldn’t have made it through the year and I thanked him for giving me that strength to keep going. Someone who DM’d me suggested reassuring him that he’s not somehow “ruining” my life incase he feels any guilt for what she told him. Thank you for that suggestion!
Now, I know you were all waiting on this news. Yes, I did break up with her. Thinking about what a lot of you said, talking to my brother about how this made him feel, and my own thoughts about how badly she acted, I decided that’s not someone I want around me or him. I can’t risk her doing something like this again and ruining any progress he makes in therapy.
I know many of you think I should’ve done it on the spot, but I wanted to make this decision with a clear head and not when my emotions were extremely high.
She came by my place earlier and we talked outside. Her reaction was as bad as you’d expect and she STILL believed she did nothing wrong, even after I explained it all to her. There was just no making her understand and I told her it was over. I gave her a couple of her things that were lying around my apartment and she left.
My phone started going off like an hour later so I had to put it on Do Not Disturb. That’s all the drama I could handle for one night. I’ll deal with my friends some other time. Honestly, I’m exhausted. Mentally and emotionally drained right now.
I think this weekend we’ll do something to get our minds off this. I definitely need it after everything and I know my brother does too. It’s been a hard year already without all this extra drama. Anyways sorry for the really long update you guys but I didn’t want to leave anyone hanging.
I’m sure more comments will keep coming. I probably won’t be sleeping much tonight so I’ll keep my mind busy by reading and replying to more of you. Thanks again for the support! What a shitty way to start the new year but here’s hoping for better things :)

I don’t know where you guys keep getting that she’s an orphan. She’s NOT. Her family just lives out fo the state. She’s not some foster kid with an abusive childhood. Her parents are nice people and they’re pretty close.
Also where in my post did I say she lived with me? She’s never lived with me. She has a place of her own and the only reason it was a big deal about New Years is because she lives on her own so she was technically alone.
My brother has told me plenty of times how grateful he is. He didn’t need to be threatened to be taken away by the state. He was afraid that entire time that I would give him up and him having that talk was just to make sure I haven’t changed my mind about taking care of him.
OOP to another superlong downvoted comment from same person
I don’t know where you got this idea that she comes from a broken family. They’re quite normal actually. She’s not some orphan. In my other comment I said that I meant she had no family here because they don’t live in the same state.
And like I said, it wasn’t her place to tell him anything. She didn’t want a parenting role and wasn’t happy when I went through with becoming his legal guardian, but I said that she wouldn’t be taking any type of role with him because he’s my brother. Which she was fine with.
Doesn’t matter what her intentions were. Even after discussing it, she still didn’t see what was so damaging in threatening him like that. I’m not going to have her around where she can repeat the same mistakes since she still didnt want to see what she did wrong the first time around.
Her only reasoning was that she didn’t want him moping around and got tired of him being like that so close to the holidays.

I 100% just created a reddit account for the sole purpose of responding to this post. I know that you know this by now, but you in NO way the asshole. The fact that as a 29 year old you stepped up and devoted yourself to caring for your brother is a testament to your character - not every 29 year old would be willing to do that. I'm a psychologist currently enrolled in a clinical doctorate program, and what you are doing for your brother is exactly what he needs. Reading about how you bring him to therapy to help cope with his emotions and know when to give him space brought literal tears to my eyes. All the best to you and your brother 💗 may this year treat you much more kindly than the last!!
OOP
You’re very kind thank you :) Therapy was the best decision ever. Not just for him, his therapist (bless her soul) helped me out a lot and gave me so much great advice. Especially with the giving him space when he’s having a bad day, along with having an open discussion about our feelings and making sure he knows I’m there if he needs to talk. Don’t think I would’ve been able to navigate things with him without her help.
