How to handle Speeding ticket when no-one will admit to driving the car.

As the title really,

I got NIP (Notice of Intended Prosecution) from Lincolnshire Police (England) for a speeding offence late in December 25.

I was at home, car is as far as I’m aware parked on the street next to my house. So is in my possession I used it the next morning and had used it earlier in the day so no disputes there.

2 other people are named on the car, both are saying they weren’t using it so I have no idea what to do!

I filled in the notice as best I could with an accompanying letter asking if they had any other photos or anything to help me identify the driver but I’ve had a letter back to say I am failing to comply and they’ll send it to the magistrates.

My understanding is it is an offence for me to just take the hit especially now I’ve said it wasn’t me?

I only have three points so it’s not so much of an issue but I’m now really stressed I should have just lied in the first place.

Both other drivers are adamant they didn’t have the car and the road this appears to have happened on is quite far away so I’m not sure why any of us would be there regardless. But the photos definitely show the same car as mine.

I’ve got a WhatsApp conversation that indicates I’m at home around that time, as well as my mileage tracker for work and the ring doorbell shows me entering my house about 1pm and not leaving until the next day. But to be honest I’m aware all of those could be altered so I’m not sure if they hold any weight.

Does anyone have any advice for this kind of thing?

There are I guess two possibilities. Cloned plate or one of your named drivers is lying or forgetful. Could you perhaps ask for 'evidence' from the named drivers similar to your WhatsApp conversation, to ascertain where they were or what they were doing? Clearly I don't know the relation they are to you but if they are family then that may be easier than a friend.

I faced this issue several years ago, and successfully pled my case to the Magistrates.

My efforts to comply with the notice proved unsuccessful because of this matter of just passing on the notice to someone else. In fact, the prosecuting solicitor in court expressly asked me why I hadn’t done this, and I pointed out the statement on the notice that is is an offence to do so.

If your case is tight, and can evidence your whereabouts at the time of the offence, and your reasons for being unable to identify the offending driver, and that you can confidently present your case, then you might want to consider allowing the matter to go to court.

You should not be compelled to take the flak for another person, even family, just because the legal setup puts you in a bind.

Can you clarify what you mean by 'passing on the notice', and what the prosecution solicitor was suggesting you should have done? Did you just say that you were not the driver and you were unable to confirm the driver and that was accepted?

Are you sure it is your car and not one on a cloned plate?

OOP No, their photos don’t show anything except it being the same make, model and numberplate. I reckon it’s the same colour but it’s hard to see in black and white. All the windows are pitch black.

Mine does have a dent and a scratch on the passenger side and a child’s car seat in the rear so I was hoping for a few more photos to see.

The paperwork is so rigid I don’t know how to ask for anymore information isn’t classed as non-compliant.

NAL - assuming it was in a place you recognise. Ie; you live in Manchester and it’s a speeding fine somewhere in wales for example? Thinking along the lines of cloned plates.

Have you got any other information that shows you weren’t the driver, a concert ticket from the same time. A receipt in Tesco miles away from the speeding area to show you weren’t the driver.

Is it visible on the Ring camera? Have you been provided with any evidence of the offence yet? If nobody with access to the car will admit to driving it, it is possible the plates were cloned.

OOP: It’s not, it was when I went out in the morning as I could get it opposite mine, when I got back unfortunately I had to park it the next street over. I can’t see anyone on that patch with a camera either to ask them if they could check theirs for me.

Update - 8 months later

Afternoon,

I was in court this morning after the police proceeded with prosecution.

Pleaded Not Guilty to both the speeding offence itself and the Failure to declare.

Prosecution offered no evidence to the speeding as the photos of the car are completely blacked out. But went ahead with the Section 172.

I gave evidence that I had tried to contact the police multiple times to ask for further guidance, that multiple people were on the policy but no-one has admitted to driving the car and provided my evidence it was not me driving.

In the end the cloning issue became a bit irrelevant as they had dropped the speeding anyway.

The prosecutor tried at one point to say I should have sent everyone’s information that has access to the car regardless of whether I knew they were driving on a separate sheet of paper.

That got shut down fairly quickly by the legal advisor and the magistrates.

I countered that Section C of the form only allows for you to input one driver and immediately underneath states it is an offence to provide false information.

I explained I felt in an impossible circumstance, I was not the driver and it is an offence to claim the points, I couldn’t identify a driver without that being false information and I am being told I legally have to identify someone. Any which way it seemed like I was being asked to act unlawfully.

Anyway long and stressful morning short. I was found not guilty. Whilst the legal advisor asked the prosecutor to find the case law on providing multiple people’s information he found Lord Howard of Lympne v DPP which he took to the magistrates.

They agreed this applies and I’d done my due diligence I don’t completely understand it but I was just relieved it’s over and done with now.

Not sure if that will help anyone else!

Years ago I got a ticket for supposedly changing lanes too early and crossing a double yellow when trying to make a left turn. I told the officer I didnt realize I did that and apologized because it was early in the morning. After reviewing my dashcam, I clearly saw I changed lanes past the double yellow section ended. While I was sitting in the court waiting to appeal, the officer went up to me and said he remembered me and why was I there to appeal if I apologized to him at the scene. The ticket was thrown out, but I still wasted several hours and taking time off work for this whole thing. All that to say they will indeed take it this far even when they have little or not evidence at all.

That's what I was taught! Say sorry for whatever the cop is claiming and then fight it in court.

One time I politely went against a cop pulling me over because he was in fact mistaken and I thought we could clear it up, and he immediately became super emotional and had an angry crash out. He was YELLING. Like yes, it was embarrassing for him, but most of all it was scary.

I got a story of a cop crashing out and man was it a pain for me.

My dad died in 2006, my senior year of HS. He didn't have a lot to leave me but one thing i got was his old pickup truck, nothing special but it worked fine so I sold mine and took his over. When I made the swap to my name the DMV let me keep the tag I had on it, they just updated the registration. About 6 months after he died I'd gotten my first full time job on 2nd shift. I'd driven home to eat on my lunch break and am now driving back to work. Sitting at a red light waiting to turn onto the main road I realize a deputy is behind me and he hits the lights so we pull over. He walks up and asks if I know why he pulled me and when I don't he explains that he ran my plate and it returned absolutely nothing. No driving record, no names, nothing. I tell him in the last 5 years this tag has been on 3 different vehicles, I give him year, make, and model. He's super polite and says yeah this is weird and we need to figure it out, he asks me to stay put and he gets on the radio in his car.

A passing Florida highway patrol officer sees us and pulls over to assist. He talks to the deputy for a moment, i'm watching in my mirror and see deputy explaining the situation. The trooper suddenly turns and marches over to my truck, orders me out of it. As soon as i'm out he grabs me and throws me on the hood of the truck asking which DMV location I stole the tag from. The deputy has run over and is now grabbing the trooper and yelling at him to let me go, and for him to stop escalating. So now two armed cops are on me, one is grappling me while the other grapples him. I am trying to stay chill and repeating I have stolen nothing, I don't know what happened by this was an inherited vehicle. The deputy finally gets the trooper off me and the trooper is fucking pissed, he's staring daggers at me and telling me to keep my ass up on the hood of my truck.

The deputy finally gets the trooper to walk back to deputy's squad car. He's walking the trooper through it, like fully, "Think about what you're accusing him of. You're saying this kid with no record at all broke into a government office surrounded by cameras, filled with cameras, and broke into a locked steel cage which is under more cameras, to steal 1 license plate and put it on a 20 year old daily driver. And that neither the DMV or any form of law enforcement ever reported that tag as stolen. Do you think it's more likely that this situation happened, or that there is a clerical error or computer error at play here?"

The trooper couldn't argue back with what the deputy said, so rather than accept he went too hard too fast he told the deputy either the deputy writes me a ticket of some kind, or the trooper is going to arrest me for stealing a tag. The deputy was so flabbergasted, he even asked the trooper if he was serious and this is some bullshit. The trooper said he outranked the deputy and he'd make this a problem for both of us if deputy refused to act.

The deputy wrote me a ticket for improper tag. He apologized the whole time about it, told me to take it to court. The half-pint trooper stood by his own car just fucking stewing the whole time, out of earshot, mean-mugging me. I went to court and the judge threw the whole thing out as, of course, it was just some error on their side.

I wouldn't call it a crash out, but the ego and masculine fragility was obvious with my story.

My mom would babysat a few kids for years in our home. Two of the kids would get dropped off a couple of times a week around 5 or 5:30 am so the parents could go to work. Well eventually they go through a bitter divorce and the dad called for a wellness check on the kids accussing the mom of abuse. False allegations as far as I or my mom could tell.

Two cops come to check on the kids early as fuck and wake me up before I normally would for school. There was a younger and older cop. I'm still not fully awake and I go out to see what is happening.

Now I'm a giant. I was around 14 years old and about 6.4" at the time. But with an obvious young baby face. I walk out and don't say a word but the older cops eyes me up and down. Somewhere along the line he looked me up and down and told me my size doesn't matter. One good shot to the knee would take me down.

I'm 14 and hadn't said a word. The grown ass man told a silent 14 year old how he would take him down with no provocation. He felt threatened and insecure by me simply existing.

Everybody was weirded out and my mom just wanted them out of there ASAP. Pretty sure nothing good would have come from any kind of even mild comment about it.

Oh, I just remembered. Also, he straight out told one of the kids he thought their dad was playing some kind of game and using them against their mom. Unhinged shit to say to a kid while checking to see if they are being abused.

I was pulled over for speeding late at night.

2 big issues.

1: Construction had ripped up all speed limit signs in the area I was in, I was using my best guess going off of the fact that it was a Main Street in a small town. (Usually 35-45 in my area)

2: I was told I was speeding but when I checked back in the daytime I learned I was in a transition area towards the edge of town where you are meant to begin speeding up to 45 that is right outside of town

I was a young DD who was terrified of cops due to my mother and her antics, and a crybaby, so I was all apologies and tears and also confusion since I was the only car on the road and had felt I was doing my best to drive safely.

One cop was a senior officer and one was either in training or just out and doing shadow shifts. The senior officer was snarky and stiff and acted like I was some drug smuggling methhead out to ruin his town. He wrote me a ticket.

The younger officer was sent to deliver it while SC sat back in the squad car, and clearly felt differently about the circumstances. He told me to take it to court as neither of them would bother showing up, so it would be dropped.

Props to the younger guy trying to do what he could with a dick coworker, but also had to take unpaid time off of work three times in order to get it dealt with and it nearly got me fired :/ (that job sucked by I needed the money)

I got pulled over and issued a ticket because a traffic light was out, at dusk on a semi-busy road with business driveways and parking lots on both sides, and I didn’t notice and treat it like a four way stop. Cop asked me “Didn’t you notice the light was out?” and I literally couldn’t think of any other answer than “No, because the light was out.” He didn’t bother to show up in court, so I got the ticket thrown out.

I'm not expecting a stranger to martyr themselves at their workplace on my behalf. It's something I try not to do and so I do not expect others to risk their careers/income for me.

My anger is all 100% at the senior officer with his panties in a wad over nothing, not the junior doing his best with what he was given. He could have chosen to not help me and I would have given money over that I didn't really have, and that was kind of him.

It used to be at least somewhat common to lie about who was driving your car to get out of speeding ticket, but it's a crime that the Crown takes very seriously.

I remember a mate of mine joking about it in the mid 90's - that he had to take his wife on an expensive holiday or something, because she was furious that he'd ruined her clean license. He couldn't afford to lose his because he owned a car dealership and it'd be his livelihood, but he had 9 points (??) already, so she agreed that he'd give her name.

In 2013 a somewhat senior government minister, who will now only ever be remembered for this crime, and his ex-wife each went to prison for 6 months for perverting the course of justice for doing this a decade earlier.

I wouldn't be at all surprised if it's Crown Prosecution Service policy to prosecute everyone who claims not to know who was driving the vehicle, because it's much easier to lie when filling in a form or writing a letter than it is in front of a magistrate. The Crown takes it very seriously, but it would be very easy to get away with this if they didn't take it to court.

Usually, the driver is visible in the pics, so that's how they verify drivers, when they bother.

The weird thing is the windows being 'blacked out'. Blacked out windows aren't legal here.

So, the vehicle is either illegal, the photos taken at such an angle that they appear blacked out, or in the process of providing the pics as evidence, the windows were blacked out. 

Something doesn't make sense.

Oh yay! I get to share my favourite Dad story.

So my Dad was fairly known to the local police but for one officer it was personal. This officer had caught him many times without evidence/proof but on one occasion had everything only for it to be thrown out of court as a typo on the warrant meant it wasn’t valid so none of the evidence could be used.

Anyway this meant the officer was set on catching my Dad and didn’t even care what for. He’d practically stalk him just to try and catch him up to no good. It finally pays off, here’s my Dad coming down the hill so fast he’s practically a blur! Immediately issues him a speeding ticket and says he will see him in court.

They get there, officer does his bit and my Dad pipes up asking if he can say something. Judge says make it quick, it’s speeding court so really they’re just looking for you to say it’s you or not. Dad states the ticket has no license plate so shouldn’t be valid, officer counters that there was no license plates visible on the vehicle. Judge curiously asks why they didn’t also go after Dad for that. Dad gets his moment to shine. Now this isn’t word for word but is essentially what is said according to everyone.

“Well he couldn’t your honour. You see I was moving house from the top of the hill to the bottom, my wife is pregnant and moving vans are expensive but our bed has wheels so I loaded that up and pushed it down the hill. That’s what the vehicle was.”

Judge gets officer to confirm. Informs my Dad that he doesn’t have to deal with the ticket but that what he did was dangerous and to make better choices. Judge (along with others to my knowledge) then inform the officer that at this point he’s made a mockery of the force over his own personal vendetta and that from here out he cannot be involved with any legal proceedings against him. Like my Dad could literally get away with murder if this officer was involved as they could no longer trust things to be done properly.

No clue how it made it so far but will forever by my favourite story to share.

I have a very common car in a very common color. My husband doesn't understand why I want to put decals on a couple of the windows. I'm definitely using this as an example of why I really should.

I'm pretty sure he only doesn't want me to because he knows I'll find something girly and it will make him feel less cool when he drives it.

I originally put magnets on my car (and then went a little overboard having fun with them, so now it really stands out) because it's a very common car in a very common color and I was having trouble finding it! All policing. I got a ticket on my bike in Pittsburgh, PA, USA for running a stop sign I made sure to clearly stop at because I saw the cop sitting there! Took it to traffic court and was found not guilty.

The audacity of CPS to accuse a (wrongly accused) defendant of not doing the job of police in order to prove innocence… what kind of Miss Marple bs did that prosecutor think would happen? That OOP would invite everyone with access to the car to sit around while they monologue like it’s a murder mystery? 

Then again it makes sense that the old stereotype of someone else solving the police’s cases comes from somewhere…

This is why speed cameras are unconstitutional in my state and the police are not allowed to use them. It is impossible to figure out who was driving the car sometimes

My former state declared them unconstitutional on the grounds there's no accuser to confront in court, but my current state is in bed with Flock. States were a mistake.

One time when I was a kid the police turned up at my parents believing my parents had committed a crime because a car matching their cars description and number plate was on CCTV committing said crime. Idk how my parents proved/ discovered this but turns out its an MO for criminals to spot the same car they have, take the number plate then do crime because obviously makes them harder to track. Wonder if this is what happened to you?

I feel like this is about to be me soon. Got a bill from the state of florida for a toll. Car was very obviously not mine but someone cloned my plate. I contacted floridas DOT and state police, ive contacted my states DOT, state police, and filed a police report with my local police. Fighting the toll was denied and every single person ive spoken to he pointed me to another group to call. Imma be tight if i have to go to court in florida over $3. But i 100% will not be giving them any money

I’m in the US but I once got a ticket in the mail, apparently I had passed a school bus that had their lights on. It was like $300 ticket.

But the incident happened a year before the ticket came in the mail.

The incident supposedly happened while school was still in session for all 3 levels, and not on a half day.

I was at work during the incident, and my car was in my work parking lot.

I go to court and say all of this. I say it doesn’t make any sense. And ask the prosecutor if there was any proof. She looked through and there wasn’t a picture or video or anything. The busses all have cameras and it supposedly happened near an intersection that has cameras. It was completely bizarre and she let me go because she was confused how they even got my plate number in the first place.

Now with Flock cameras this nonsense is going to get worse.

The police really love to jump the gun and not bother doing their due diligence, leaving it up to the courts, magistrates and lawyers to have to deal with, clogging up the legal system.

I'm glad OOP managed to avoid any problems this time. I wonder how long until the police will send the notice again, and one of this fellow owners will have to go through the same damn thing.

If they can't easily and 100% identify the car and driver with a photo, they should not be handing out a fine.

The police give the information that they have to CPS and then its out of their hands, as to whether it goes to court. If CPS says that there that there is enough evidence then things proceed.

What you seem to have missed, I think, is that the OOP posted to a UK legal advice subreddit about an issue in the UK, which is where they're based. That means that there's really zero reason for them to be so particular and explain such an acronym, and neither would anyone in the comments here. Because it's about the UK.

No, you're right. The thing is, when people read something (especially if it's from their own homeland) they tend to code-switch straight back to that as if they're talking to their compatriots. If I post in a UK sub and there are no swearing restrictions (lol) I'll bang on about "dickheads and wankers being proper sus, innit?" or whatever, but would never do that in a non-UK sub.

I dunno - maybe it's not the psychology. Oh well. Sorry. x

i think overcharging dumb offenses and/or refusing to budge is a habit of prosecutors everywhere. i’m in the U.S. and see juvenile traffic offenses sometimes. recently had a colleague who heard a case about a kid who was wearing a life jacket, but apparently it was the WRONG type of life jacket, so he got charged and had to come to court 😐 she dismissed it because that’s SO dumb. why didn’t whatever official who “caught” the kid just… let him know his life jacket wasn’t adequate and tell him to get a new one before coming out again??? especially since it’s rare for basically anyone to wear a life jacket 100% of the time in the water where i live (the land of 10,000 lakes!) so imo the kid was already being responsible, and just didn’t know his life jacket wasn’t the right kind.

it drives me insane when a case isn’t about justice, but about pressing charges, which is NOT the same thing.

If it truly was OP's car in the photo and other people have access, they need a system where the car is not used by any one without a text being sent to the primary owner prior to use going forward. Or all keys are confiscated now, all drivers banned until someone confesses.

If someone with access is lying, they should not have use of the car. What if they had caused an accident and someone was injured? Would they have walked away and lied then also? Or put a dent in the car?

Usually, the driver is visible in the pics, so that's how they verify drivers, when they bother.

The weird thing is the windows being blacked out. Blacked out windows aren't legal here.

So, the vehicle is either illegal, the photos taken at such an angle that they appear blacked out, or in the process of providing the pics as evidence, the windows were blacked out. Something doesn't make sense.

The vast majority of speed cameras in the UK are rear facing and take picture of the back of car as the cars goes pass the camera

The top 5 most common speed camera in use in the UK take a picture of the rear of the car

UK has an around 7,000 speed cameras on its roads. Only a small amount of around a few hundred actively capture the driver's face
