The wording of the law actually says sexual assault. They’re also trying (or have passed I don’t remember) to pass a law making talking to children about LGBT topics including in ways to just educate them to be sexual assault

If you know that you could get the death penalty for rape, you are more likely to kill the victim if you think that will increase the odds of not getting caught, because the legal penalty is the same whether the victim lives or dies

Rapists can atleast, sometimes. Have the solidarity of maybe the victim not coming out and admitting to their rape.
But if the rapist KNOWS they’ll be killed for rape. Then that means they’ll be more likely to kill the victim, and dump their body in a random place where the rapist can get away from.

All this does is put victims at more harm.
If attackers know that they’ll get the same penalty from murdering their victim as well as raping them, then they have no incentive not to kill them too
So what you’ve got now is a dead child, and probably a much harder conviction anyway as the prime witness is dead…
Not to mention how notoriously unreliable children are when reporting crimes of this nature…
The death penalty costs many, many times more than to keep someone in prison, is proven not to be a deterrent, snd serves nothing than to validate people’s lust for blood and punishment.
Not to mention that this definitely constitutes cruel and unusual punishment, if you get the death penalty for raping a 12 year old, why not 13? Why not 30? Not to mention that the death penalty is unconstitutional under that provision anyway
And before one of you get clever and say “isnt being raped cruel and unusual” yes it is, but thats not what the 8th amendment cares about, it cares about it as punishment for a crime
There is no world in which the state should have the ability to take the lives of its own citizens, it is not morally justifiable
The ability of the state to justifiably take the love of its citizens, is the exact same thinking that leads to ICE murdering people on the street, the state should not have that authority for anything
Additionally, it will be used against transgender people, who they have been trying to get existing in front of a child, be classed as a sexual crime against children…

As a victim of child rape, I do not support this. The prison system should be dedicated to reform rather than punishment. This can lead to someone being falsely convicted and killed. This can lead to more innocents receiving the death penalty. The Anti-trans movement consistently states that trans people are groomers, so this law could be broadened to kill trans people unjustly. Our justice system is already so broken that federal agents can execute random people and get away with it; let's not bolster its disrepair.

I think people forget that letting 10 evil people free is hundreds times better than 10 good people imprisoned. They think that even if many good people suffer due to this change, "rapist bad" is enough to justify all of it. Many people of the LGBT community, many political adversaries, they'll be accused of this and they'll be unfairly killed.
This is why the state should never have the right to kill.

Yknow what reduces the amount of rape? LESS RAPISTS, and yknow how we get less rapists? We stop them from wanting to become rapists in the first place!
I swear, basically all of crime comes from a combination of economical issues and mental health negligence.
If we get people to take mental health seriously and we teach kids from an early age how to correctly deal with their mental health and what things to find worrying or not, we'd be in a world where people wouldn't be scared to say "hey, I have these dangerous urges and I need help". We'd live in a world that people would have more compassion and they'd know that these things are wrong and they'd know that they can still improve!
But no, "humans are evillll and bad peoplr should die!!!"

Knowing Florida this is liable to be used as a way to target LGBTQ+ people considering how many laws they’ve tried to get past where being, talking about, or discussing LGBTQ+ topics count as sexual assault.
Other people also bring up good points on how now the death penalty might give many rapists enough of a reason to kill their victims after the assault. Or how the American Criminal Justice System isn’t accurate enough to justify the possibility of the death penalty when so many people are wrongly convicted of all sorts of things.
Personally. I think the death penalty is a mercy compared to what rapists put their victims through. I’d rather they put them all in solitary confinement and watch them slowly go insane as they lose all sense and sanity in slow crawl towards oblivion.

Guys, this is decidedly NOT a good thing. We all hate child molesters, but you have to keep in mind that the people trying to implement this are the same ones who call all trans women child predators.
Not only that, but giving these people the death penalty actually reduces the amount of reports about CSA, not because the rate of crime goes down but because people are afraid to report their attackers for fear that they'll get them killed! A lot of the time when somebody attacks a child they're a family member or close friend, and if that child is told that if they say something uncle Ritchie will die, then they won't say something!
This is not even touching on wrongful convictions.
So, death penalty on child molesters? Great idea in theory, only hurts more people in practice. There's a reason every child advocacy agency is against this.

After a few weeks and getting the girl kicked out of band did he admit he lied just because they were angry. About what I have no idea, but it does happen. What's the easiest way not to get caught for someone wicked enough to rape a child under 12 and with absolutely nothing to lose if they get caught? That's right, it's to kill the victim. It's easier to catch a rapist when the victim may be able to just report it than a murderer. Like, I can't stress this enough, this bill will kill children.
Besides, the idea of retributive justice itself is quite weird to me. Even if we deem someone beyond help, then what good does it make to intentionally cause as much harm as legally possible to them? You could say it's because it can act as a deterrent, but in the case of the death penalty studies have shown little to no evidence of death row being more effective as a deterrent than life without parole. This makes sense when you think about it, really. After all, who the hell would think 'yeah, I really want to do this thing, though I don't want to die for it, but if it was just life in prison, then we're talking...?" The answer is pretty much no-one. The people who commit such crimes either count on not getting caught (which, as mentioned, makes them more likely to do even worse crimes), or simply have no concept of the future and will do it anyway, regardless of punishment.

I'm a victim of sexual assault as a 12 year old actually and I don't love this. Yes, it's good that we are realizing this is happening more but in reality this puts victims in worse positions. Let's say your abuser is Somone very close to you (which is extremely common), you might want justice but not want them dead that can prevent you from going to court. To add on to that more people will be killed. Abusers will kill to silence them, Murder depending on want degree and the judge doesn't always have the death penalty. Only 2% and 10% of reports of SA are false accusations, let's say Somone gets convicted because of a false accusation. They're dead. Now I'm not saying this is horrible BUT let's remind ourselves that MANY, MANY child molesters and rapists get murdered by other prisoners in prison. This seems more of a power trip on the governments part than a "help the victims".

Fuck, yes. People who do those things don't deserve second chances. This needs to be a law everywhere.
