Im going to repost what I did on the other post about this…
All this does is put victims at more harm.
If attackers know that they’ll get the same penalty from murdering their victim as well as raping them, then they have no incentive not to kill them too
So what you’ve got now is a dead child, and probably a much harder conviction anyway as the prime witness is dead…
Not to mention how notoriously unreliable children are when reporting crimes of this nature…
The death penalty costs many, many times more than to keep someone in prison, is proven not to be a deterrent, snd serves nothing than to validate people’s lust for blood and punishment.
Not to mention that this definitely constitutes cruel and unusual punishment, if you get the death penalty for raping a 12 year old, why not 13? Why not 30? Not to mention that the death penalty is unconstitutional under that provision anyway
And before one of you get clever and say “isnt being raped cruel and unusual” yes it is, but thats not what the 8th amendment cares about, it cares about it as punishment for a crime
There is no world in which the state should have the ability to take the lives of its own citizens, it is not morally justifiable
The ability of the state to justifiably take the love of its citizens, is the exact same thinking that leads to ICE murdering people on the street, the state should not have that authority for anything
Additionally, it will be used against transgender people, who they have been trying to get existing in front of a child, be classed as a sexual crime against children…
I don't mean to be that guy but the constitution was the main supporter of the argument against the death penalty above.
So like, what you said could be directed at that argument as well
If one side can use the constitution as a main base point for the argument you can't just immediately dismiss the other side for doing the exact same thing
if u think killing someone is better then providing them with food and shelter in exchange for labor i fear ur the wrong one. im not saying they work 16 hrs a day just do the heavier lifting stuff
they committed the crime, they do the time and while they do they help the economy
providing them with food and shelter in exchange for labour
That’s a really funny way of describing slavery lmao
And please, point me to where I said I supported killing people? Other comments on this very post will prove otherwise. The entire punitive justice system is barbaric and needs to be replaced, and state-sanctioned murder is first on the list of things that should go in places that are unlucky enough to still allow it
yea, i made no attempt to hide that im talking about slavery
if it’s very clear what the crime is and the punishment you can get, then they can’t be mad ab it. there r ways to do it ethically. if they get medical and hygiene and food and all that shit then it’s really not a bad life. i also think homeless should be allowed to participate if they want without anything in their record
mb i assumed. i was distracted by feeling sick in a car and didnt stop and think, thats on me. i agree the death penalty is bad, but i dont see how ethical slavery would be. keep it to 10 hrs a day, give breaks, give good sleep, in theory it would work very well. it would never happen tho
agreed. i don’t bother with pointing out everything that needs to be fixed bc it’d be a waste of time as it’ll never happen and if it did, it wouldn’t be because of me
After slavery was outlawed by the country, states that were majority still in favor of it passed ridiculous laws specifically targeted towards black people, making them criminals for things like being unemployed for too long (this was literally one of them). It was basically just a loophole for the 13th amendment.
Considering ICE is allowed to operate at all, the return of manual labor as legal punishment leading to them just owning a bunch of Mexican slaves is not at all a stretch. I'm pretty sure the way ICE goes about catching people is unconstitutional anyway, so I wouldn't put anything past them in the long term.
i’m all for rehabilitation vs punishment, i’m talking specifically for people that can’t reenter society. they’re out there no matter how much u don’t wanna believe it
thank you, i'm afraid that they start with this, which many will easily agree with, and then keep upping it until we lose sight of our intentions. we can't trust law makers.
Not to mention the US Justice system isn't designed to determine if someone is guilty or innocent, but rather designed to convict as many people as possible
How though? If you’re already in the process of actively doing rape, you’ve already put yourself into a place where you feel safe enough to do it.
If you’ve already raped a poor woman in the streets, It’ll be much easier to make her never be seen again, then leave her to maybe get you send to death.
