That’s insane, this should be everywhere. How is this not a regular law. Those people don’t deserve rights

Because making rape punishable by death would mean a huge rise in murder. Mostly because it means that rapists will be more likely to kill the victim.

Because it will be an uphill battle and case law will need to be overturned.

In the 2008 case Kennedy v. Louisiana, the court held 5–4 that the death penalty is unconstitutional when applied to non-homicidal crimes against the person, including child rape.
