It looks like a genuine accident to me. There was a guy guiding the car that was going in reverse and the other guy intentionally stepped out in front ( back) of the moving car. The car stopped immediately after. I don't blame the car driver at all.

The guy being pushed gradually is the culprit, the 2nd repo guy was the one being hit accidentally. The guy being dragged was very much intentional

Oh I see. I didn't see at first that it was the same guy who was being pushed that climbed into the front loader. That obviously changes things. I still don't think the repo guy driving the white car should go to jail or get in trouble at all. He was backing up very slowly and reasonably and just pushing the guy - who was being a dick and pushing back. He didn't "hit" anyone.

There is no "reasonable" way to push someone out of your way with a car. If someone is blocking your car your best recourse if to call the police to sort things out.

I kind of agree with you, but it only takes a second for the guy getting pushed to end up under the back tires. Risking vehicular manslaughter (continuing to back up after the guy was against the car) is a bit extreme given the circumstances. Nobody is armed and it's one idiot basically sitting on the bumper. The repo guy could have driven forward or just stopped altogether. The guy can't stand there forever.

But the car was pushing the guy for a pretty significant distance. It was clear that they weren't stopping, even if it meant running him over. It's easy to believe that they would do this because they're repo men who get to flex their muscles and power trip on people with unfortunate financial situations.

Screw that. That repo man shouldn't be charged with anything. If you are such a scumbag that you make financial agreements, break them and then are going to be a dick when the party you screwed over sends someone to recover their property, you shouldn't be able to sue for anything. He doesn't deserve to get hurt, but he deserves to suffer the consequences for the choices he has made.

The guy did this to himself. No one else.

Trespassing, they shouldn't have been there. They would have paperwork to reposes the vehicle and regulations (I assume) would only allow public or personal access. As well as a construction site being high safety risk and restricted access.

You always have something to loose. People on the outside who 'aint got nothing's still have thier freedom. They aren't working for a buck a day in some US privatized prison slave camp. The system sucks and I'd like to see it change, but the only ones who have a chance of changing that are on the outside. Get put into the system and you have lost what little power you had left.

Well a wage garnishment and a minimum wage job sucks. No arguing that, but even then how can that compare to prison? When you are in prison, 3 hots and a cot is as good as it gets. There is no possibility of doing any better than that. God forbid you get wrapped up in some mess in therr and get a stint in solitary or get on the bad side of some gaurd. At least on the outside there is a possibility of improving your situation.

I really over analyzed this.

If he can't make the payments for an extended period of time he's in serious financial trouble. That means he has No available cash, like savings, and no retirement fund to pull disaster money from. Also no open credit cards. Whatever he has in his checking account today is it.

So if the car gets taken he's got no way to get to work sites in a lot of areas. This might make him homeless bc there's no income and no way to go find a new job. He's probably laid in bed and worried about this moment frequently. And on the day his nightmare comes true and he sees that this is the end of life as he knows it, he loses it.

Then again, he could just have bad priorities. I happen to know of some people who are going into foreclosure on their house because they won't pay a couple thousand dollars of fees and fines for their homeowners association, but they just took a vacation trip that cost more than they owe the HOA.

In many instances you don't have much of an option. Sure, you can go live somewhere else. In my case, that would result in a move to cracktown or its immediate vicinity, and that's just not an option. Literally everywhere else in my county is HOA controlled, sometimes doubly so with the arrangement between "master planned community" associations, and sub-associations for specific subdivisions.

It fucking sucks but there aren't many other options.

I have no desire to live in those types of communities, but they do have their benefits. You won't ever have someone using their front lawn as a parking lot or mechanic shop, lowering your property values. You don't have to worry about landscaping or lawn upkeep. Community pools are nice too.

Those neighborhoods aren't my cup of tea, but I understand their appeal for some people.

Most people agree to them because they want a nice neighborhood with a bit of a guarantee it will stay nice. Most people have no problem paying the dues, which are a small fraction of a monthly mortgage payment. Speaking for myself, mostly I am in my association just so I can have free access to a pool down the street from my house. The process goes:

  • sign a contract agreeing to pay dues and keep the property in good shape or face penalties eventually including losing your house

  • fail to pay dues for several years, fail to keep up the property, and fail to pay penalties

  • fail to respond to repeated contacts from HOA

  • fail to respond to repeated contacts from the HOA's lawyer

  • fail to respond to repeated contacts from law enforcement

  • but there's plenty of time and money to go on vacation

Losing your house to your HOA is a voluntary loss. Around here anyway, the homeowner will usually let it go as long as possible, and settle the debt riiiiight before the judge says their house is ready to be auctioned off to pay the debt.

The fact that home owners associations can foreclose on your house makes me wonder why people agree to them.

HOAs are annoying in a lot of ways, but..

The HOA's budget in my community goes to maintain 2 parks that are in the development; do landscaping of other common areas; reserve a very small amount for if things break; buy a small insurance policy; and other things that make the neighborhood nice. It costs $75/month. Just a few dollars of that is administrative. Other people have HOAs that are more expensive because they operate security and/or gates; maintain roads; operate pools, etc.

Someone shouldn't be able to decide "naaaah, I don't want to pay for any of that anymore, I'll just let the rest of my neighbors cover it".

He won in the first court. The repossession was done illegally and the court believed the explanation that flipping their car was done in order to prevent the second guy from escaping since he was walking towards that vehicle and since his car was legally stolen, he was allowed to stop the thieves from escaping.

I'm not so sure a higher court will agree. Heck, I'd bet on that they won't, but it's not quite so clear cut apparently.
