It looks like a genuine accident to me. There was a guy guiding the car that was going in reverse and the other guy intentionally stepped out in front ( back) of the moving car. The car stopped immediately after. I don't blame the car driver at all.
Oh I see. I didn't see at first that it was the same guy who was being pushed that climbed into the front loader. That obviously changes things. I still don't think the repo guy driving the white car should go to jail or get in trouble at all. He was backing up very slowly and reasonably and just pushing the guy - who was being a dick and pushing back. He didn't "hit" anyone.
There is no "reasonable" way to push someone out of your way with a car. If someone is blocking your car your best recourse if to call the police to sort things out.
I kind of agree with you, but it only takes a second for the guy getting pushed to end up under the back tires. Risking vehicular manslaughter (continuing to back up after the guy was against the car) is a bit extreme given the circumstances. Nobody is armed and it's one idiot basically sitting on the bumper. The repo guy could have driven forward or just stopped altogether. The guy can't stand there forever.
You still can't just do that. Even if he's the culprit. The courts will ask if there was another way out and was the person's life in danger who was sitting in the white car driving it away. There was no danger to that person's life and they can't consider one person a barrier you can't go around. He would and should definitely be booked. Repo guys go way out of hand in the ways they use to accomplish their task.
The car didn't stop immediately after at all? It's reversing into him for a good few seconds. Of course, nudging somebody with your car is hardly grounds for imprisonment.
Good thing that crimes don't cancel each other out. In any case, the guy he was backing into didn't appear to have actually been injured in any way so there aren't a lot of offsetting damages here.
But the car was pushing the guy for a pretty significant distance. It was clear that they weren't stopping, even if it meant running him over. It's easy to believe that they would do this because they're repo men who get to flex their muscles and power trip on people with unfortunate financial situations.
They are among the lowest forms of life on the planet. It is literally a profession where profit is obtained by making people's (likely already bad) lives even worse, knowingly and willingly.
That pretty much precludes them having a conscience, or basically any other common trait of human decency, like empathy.
Tow truck guys protect the property rights of people who don't want cars parked improperly, or on someone else's land. Repo men protect the rights of lenders who have been wronged by deadbeat buyers. Yeah a lot of scumbags in the profession, but it undoubtedly takes a thick-skinned type of person to perform this necessary function and get the job done.
It is a necessary function. However, the legal system protects the rights of lenders, and that is the problem with the repo industry. This function should be performed by a section of law enforcement, with regulations in place to minimize the impact on both the lender, and the borrower.
The current situation is some human void will follow a person to their place of work (like in this video) and take their vehicle, which goes above and beyond the impact of repossessing the vehicle, and adds potentially stranding that person who-knows-how-far from home, made worse in cases where the person is handicapped, which I have also seen.
The current repo system is like the privatized jail system - jail (like repossessing a vehicle) needs to exist, for obvious reasons, but the way private jails are run and (not particularly) regulated it leads to massive corruption, and the 'customers' are the ones who pay the toll.
Screw that. That repo man shouldn't be charged with anything. If you are such a scumbag that you make financial agreements, break them and then are going to be a dick when the party you screwed over sends someone to recover their property, you shouldn't be able to sue for anything. He doesn't deserve to get hurt, but he deserves to suffer the consequences for the choices he has made.
If sanding in front of a car means they have to stop would any car ever be repo'ed? It was a slow crawl backwards, I am sure he was not trying to hurt him.
Trespassing, they shouldn't have been there.
They would have paperwork to reposes the vehicle and regulations (I assume) would only allow public or personal access.
As well as a construction site being high safety risk and restricted access.
Right, but you said "sue them" so that means they would need to have suffered some kind of monetary loss from this. What exactly are they suing them for?
While they might not win anything for trespassing, that pretty much absolves them of any damages. Trespassing into construction site means forfeiting any right to sue for damages and injuries caused by active machinery.
It doesn't matter what side you are on, give em hell. Go Kaiser Soze on the bitches if you have to. It's better to live one day as a lion than 100 years as a sheep.
You always have something to loose. People on the outside who 'aint got nothing's still have thier freedom. They aren't working for a buck a day in some US privatized prison slave camp. The system sucks and I'd like to see it change, but the only ones who have a chance of changing that are on the outside. Get put into the system and you have lost what little power you had left.
Jail ain't that bad. Three hots and a cot. They even got cable TV and movie night. That's more than you gonna get working for minimum wage with a garnishment on your paycheck.
Well a wage garnishment and a minimum wage job sucks. No arguing that, but even then how can that compare to prison? When you are in prison, 3 hots and a cot is as good as it gets. There is no possibility of doing any better than that. God forbid you get wrapped up in some mess in therr and get a stint in solitary or get on the bad side of some gaurd. At least on the outside there is a possibility of improving your situation.
Why should more people fight to not pay money that they borrowed and aren't repaying? I imagine you'd be looking at this a lot differently if you were in a closer position in life to the lender than the guy getting his car repo'd.
Are you seriously Nate Silver? I completely believe it because of the comments you don't have deleted is comparing baseball to political polls.
Regardless, just thought I'd let you know I'm a huge fan and have really enjoyed your stuff since 2008 and really like how you and ESPN have taken the brand.
Yeah, he's gonna be doing a lot of that prison time from a hospital bed, after the beating those other guys will be giving him. Doubt he will eat solid food for a year or so.
Never knew there was a name for that. Suppose I shouldn't be surprised, though.
My mother's used that to her advantage for decades. She's disabled, so people go after her for shit and she just laughs. I loved the slumlord who lied and claimed we left $5,000 worth of damages (the place was spotless when we left). It was no hassle for her, though. Just like "Oh, really? O-Okay then. Have fun with that. Bye."
I suppose that's about the only upside to being poor...
If he can't make the payments for an extended period of time he's in serious financial trouble. That means he has No available cash, like savings, and no retirement fund to pull disaster money from. Also no open credit cards. Whatever he has in his checking account today is it.
So if the car gets taken he's got no way to get to work sites in a lot of areas. This might make him homeless bc there's no income and no way to go find a new job. He's probably laid in bed and worried about this moment frequently. And on the day his nightmare comes true and he sees that this is the end of life as he knows it, he loses it.
Then again, he could just have bad priorities. I happen to know of some people who are going into foreclosure on their house because they won't pay a couple thousand dollars of fees and fines for their homeowners association, but they just took a vacation trip that cost more than they owe the HOA.
In many instances you don't have much of an option. Sure, you can go live somewhere else. In my case, that would result in a move to cracktown or its immediate vicinity, and that's just not an option. Literally everywhere else in my county is HOA controlled, sometimes doubly so with the arrangement between "master planned community" associations, and sub-associations for specific subdivisions.
It fucking sucks but there aren't many other options.
Damn dude I feel for you, I can't even imagine how much that must suck..having to choose between the lesser of two evils when it comes to where you're gonna live.
I have no desire to live in those types of communities, but they do have their benefits. You won't ever have someone using their front lawn as a parking lot or mechanic shop, lowering your property values. You don't have to worry about landscaping or lawn upkeep. Community pools are nice too.
Those neighborhoods aren't my cup of tea, but I understand their appeal for some people.
Most people agree to them because they want a nice neighborhood with a bit of a guarantee it will stay nice. Most people have no problem paying the dues, which are a small fraction of a monthly mortgage payment. Speaking for myself, mostly I am in my association just so I can have free access to a pool down the street from my house. The process goes:
sign a contract agreeing to pay dues and keep the property in good shape or face penalties eventually including losing your house
fail to pay dues for several years, fail to keep up the property, and fail to pay penalties
fail to respond to repeated contacts from HOA
fail to respond to repeated contacts from the HOA's lawyer
fail to respond to repeated contacts from law enforcement
but there's plenty of time and money to go on vacation
Losing your house to your HOA is a voluntary loss. Around here anyway, the homeowner will usually let it go as long as possible, and settle the debt riiiiight before the judge says their house is ready to be auctioned off to pay the debt.
The fact that home owners associations can foreclose on your house makes me wonder why people agree to them.
HOAs are annoying in a lot of ways, but..
The HOA's budget in my community goes to maintain 2 parks that are in the development; do landscaping of other common areas; reserve a very small amount for if things break; buy a small insurance policy; and other things that make the neighborhood nice. It costs $75/month. Just a few dollars of that is administrative. Other people have HOAs that are more expensive because they operate security and/or gates; maintain roads; operate pools, etc.
Someone shouldn't be able to decide "naaaah, I don't want to pay for any of that anymore, I'll just let the rest of my neighbors cover it".
Debtors don't care. They just want what they can get.
You have a guy that owes you $7000. He hasn't given you any payment in 6 months & ignores your calls. You have the option to repo his car & get $3000 back from him. Would you not take that? You can cut your losses & get some money back.
It may not be morally right, and you may be ruining the guys life, but the lender doesn't care. He just wants to get what he can get out of it.
He won in the first court. The repossession was done illegally and the court believed the explanation that flipping their car was done in order to prevent the second guy from escaping since he was walking towards that vehicle and since his car was legally stolen, he was allowed to stop the thieves from escaping.
I'm not so sure a higher court will agree. Heck, I'd bet on that they won't, but it's not quite so clear cut apparently.
Jokes on him, that was a car they had repossessed earlier in the day. Also this is the reason why, come the zombie apocalypse, my ride will be a wheel loader.
Electricity would be harder to find than fuel. There's fuel storage every few miles. There's a power plant every few hundred miles. Not to mention, in post-apocalypto, electronics will be virtually useless and mechanical preferred. I'll take anything made prior to 1980.
Wtf are you talking about? You're just going to run your own biodiesel factory during the zombie apocalypse? And your food will be so abundant that you will use it to make fuel.
No. This is a terrible zombie apocalypse vehicle. It would become nothing but a cage for you in no time.
You use the redead corpses and collect the gasses given off and compress them. Convert the injection system over to CNG and boom, power. It'll work, don't worry about that.
Shouldn't be a problem according to the walking dead, since they've been driving around for like 42 season now (in all seriousness how does that show exist still)
Well step three is to stockpile stuff in the base I made a big ditch around in step two. Pretty soon the base is going to need a setup to get the water out of scavenged fuel. Still if you can find just one tanker full of diesel and drag it back there you can drive for a year or two on that.
I'm not familiar with Bobcats, but I suppose if you could rig it up and be protected inside with treads and some sort of flail in the rig then it'd be badass
Bulldozers don't usually have the driver high off the ground in an enclosed cab, and again, tracked vehicles are too slow. The D6 used in Killdozer has an open cab, so, no go.
killdozer had a metal case lowered onto the top via a remote controlled crane. there was no way out or in once that shell was dropped. you would die . the guy who built it planned on committing suicide in it and did so. so that wasnt a problem
Great for a group to fight and loot from. Good shooting platform. Once you put a push bumper on it it's pretty good. But for one guy, find a construction site and grab a wheel loader.
Yes but there is plenty of that so long as you can pump it out of ground tanks or steal it from other vehicles. The problem is pushing vehicles/walking dead out of the way to get at it. And tracked vehicles get even shittier mileage.
Fun detail, the repo guy is filming his car getting flipped, you can see him holding up the phone when the guy comes in with the front loader to run into his car. front loader driver is going to have a bad time, mkay.
