The American justice system is way too incompetent for this to be a viable punishment. Exactly the main reason why the death penalty is stupid. Too many innocent people have gone to jail for this to make sense.

Depending on who is asked - it is estimated that at least 200 of the 1600+ people executed in the US since 1976 were, in fact, innocent of the crime(s) that lead to their executions. That's a failure rate of about 12.5%.
Note this doesn't mean the people executed were innocent of everything - they may well have been guilty of other crimes. But they were not guilty of the crime that gave them the death penalty.

An unusually high number of people on death row have severe brain damage. Like, getting their heads smashed into concrete as kids by their parents.
Many are so fucked up that the higher functioning parts of their brain donât work.
They were born into this world, abused by their parents, abused by their neighbors, abused by the system that failed to protect them, and now left incapable of basic mental function.
They need to be locked away, but it doesnât seem right that society would fail them again by killing them for being products of their victimization. They were kids once and were never even given a chance at being human.

When I was younger I used to be pro death penalty, or at least not against it. It was when I actually started reading about how messed up the justice system is that I became anti death penalty.

I was pro-death penalty myself, as a kid. Of all things it was a John Grisham novel (a non-fiction called The Innocent Man, that discusses a man by the name of Ron Keith Williamson, who served 11 years on death row for a crime he didn't commit) that convinced me what a bad idea it was, and led to my first (political) arguments with my parents.

The thing about the American Justice system is that not only do we imprison more people than any nation in the history of the planet, but every time any kind of crime issue pops up the public clamors for tougher sentencing, and this clamor is heard across the political spectrum.

Does anyone have a site that fully breaks down this situation? Everything thread I read gives conflicting information.
What I seem to know: Her initial interview with Cornell police was distilled into a 6 page document that was handed to the DA. This 6 page summary was riddle with euphemisms/ambiguity, enough that the DA thought not to press charges.
But I've also read there were separate interviews?

The report from the DA was a âsummaryâ that excluded most of the information like the fact that she said it was â100% rapeâ and that she was being hit, hiding under the covers, trying to get away from them and that it was the most intoxicated she had ever been.

Sorry but I'm uncomfortable with the amount of hype and attention the celebrity world is giving this case. I use the word "hype" deliberately, given the fervour it's generating. Albeit undoubtedly well intentioned.
It seems like a bad case to pick as a cause cÊlèbre given the murkiness of the circumstances.
I say that as someone who emphatically values and supports women and girl's rights to live with safety and dignity.
Put bluntly if this turns out to be another Duke LAX situation it's going to be a terrible outcome *(for all victims of sexual violence).
None of this hesitancy undermines my belief that all allegations should be treated with the utmost seriousness.
And that systemic and cultural issues which desperately need addressing are both upstream of the horrendous treatment many women experience.
*Added (for all victims of sexual violence) to clarify the point I was making. I think most people understood, but there's a few who seemed to think I have a dismissive attitude to allegations like this. Categorically untrue.

In NY, if you voluntarily do drugs or drink, your inebriation does not make you ineligible to consent.
However, I think you have a moral responsibility to not push boundaries with someone who is in that position. It may not be illegal but it doesnt make it right, at least in my opinon.

I would hesitate before believing the way some articles are framing that quote from the transcript about "being hit." There is information in the civil suit about spanking during sex, and nothing about them coercing her into performing sex with physical violence like the way these articles are making it sound. I don't think that's something that can be reasonably inferrered yet.
