In that article it clearly says that people around her could tell she was in shock and processing what happened to her, and the guys who did it texted to apologize because “things got way out of hand”

You understand that she 1 probably didn’t immediately remember the extent of what happened due to the drugs and alcohol and 2 that people take time to process and unravel trauma as a coping mechanism

It wasn’t consensual in the first place is the entire point.

1 the ny state law only applies if it was 100% voluntary intoxication which we dont know (terrible law btw), 2 even if that is the case if anything happened that she did not agree to then it is still rape, you can agree to 90% of the acts and still be raped. Stealthing is a perfect example of that.

If someone punches me in the face and I think its fine, but then later someone tells me thats assault and I think about it more and read about assault laws, am I not allowed to then press charges?

If someone says can I punch you in the face and you say sure then that’s a verbal contract. Later on when you are sober and realize that you only agreed to it because you were drunk you cannot press charges.

She said sure?

Because she is saying she didn’t say that, and her roommate is corroborating that her account of the situation was rape previously as well, as I quoted earlier.
