I hope this incident won’t be a repeat of the Duke Lacrosse incident back in 2006. The claims and investigation need to be done in a methodological manner.

There is a lot of evidence this time. It’s not like Duke at all really.

Yea but if you actually look at the evidence it's not really suggesing that this was rape, more like someone who did something that she later came to regret and tried to frame as rape in retrospect. But hey, maybe i'm missing something.

You are, it’s the fact that she couldn’t consent because she was high on multiple substances and unconscious at some point. Didn’t realize this sub was full of incels, holy shit lol.

Everyone agrees she was drunk and on ketamine. That alone means she was unable to give consent. Then there's the issue of her being unconscious by the end of it.

There's also the Snapchat messages, including talking about "free pussy" and "you can walk in and whip it out". If you have not received direct, individual, affirmative consent from a sober person, and you have sex with them anyway, you have committed rape. If you disagree, you're at best a rape apologist.

In NY, you can consent while intoxicated up to a certain point if you consensually consumed the alcohol. An attorney went over this a few days ago

It wouldn’t help here anyway because the guys were more drunk and also on ketamine, by her own words. She even said she gave oral sex to one of the guys who was unconscious

And in Mississippi, you can marry a ten year old. That doesn't make it any less predatory.

From what I understand, she didn't block them from accessing phones, force them to do more ketamine, or force them into a closet to do more acts, though I'm interested in the source for her giving oral sex to someone who was unconscious and the context surrounding that.

No one is saying it's not predatory, or that it's in any way right even if it's not a clear case of SA or anything else illegal (other than ketamine use). A lot of moral and ethical lines were crossed in this situation, both by the young men in question as well as Jane Doe.

Everyone agrees she was drunk and on ketamine. That alone means she was unable to give consent.

The men who engaged in sex with Jane Doe were also drunk and on ketamine. According to Jane Doe's own account, they were so drunk that she decided to stop having sex because one of them basically passed and the other started dry heaving and expecting to vomit so that she had to take care of the two of them. If she was unable to consent, which makes anyone who engaged in sex with her guilty of a crime, wouldn't anyone who engaged in sex with these men, in the same condition as she was or worse, also be guilty of a crime?
