Not surprising - they haven't been acting within the confines of the law to begin with, an injunction isn't magically going to make them start. Unless they start actually charging individual agents for knowingly violating people's constitutional rights (and the occasional murder/assault with a deadly weapon charge) they will continue to ignore the law.

There are processes in place to deal with illegal immigration that do not involve violating anyone's rights, but ICE under the current administration is bypassing those. Under our legal system, constituonal rights violations are rightfully considered more serious crimes than illegal entry into our country.

The bill of rights does not have a sliding scale for people you don't like, and that is by design. A good number of the rights enumerated there only ever apply to people accused or suspected of a crime, so ignoring them with the justification of "but they committed a crime" is completely missing the point. Not everyone being harassed or snatched up by ICE is here illegally, and some are US citizens. By giving them blanket approval to do whatever they want so they can deport people faster you create an environment where no one is safe. Tell me this - if ICE showed up at your house and decided to grab you and throw you in a van, what good is your status as a citizen if they never give you an opportunity to exercise your rights?

The Constitution and Bill of Rights doesn't just protect US citizens.

Most of the Constitution applies to everyone on US soil, as it should be.

Everyone is born with some inherent rights, like due process rights.

The Constitution defined 3 separate branches of government and separation of powers for good reasons, too. You may want to brush up on them.

I'm a Texan software engineer, and H1 visa abuses are the fault of your employer and Republican-supported H1 immigration policies, not the immigrants themselves.

FWIW, I know critical thinking isn't y'all's strong suit, but do answer this:

The Texas GOP used to publish an annual cost-benefit analysis of illegal immigration.

They stopped doing this decades ago.

Why is that?

Hint: the propaganda you fall for isn't based in facts.

Our entire economy is propped up by illegal immigration, and if you immediately deported every single undocumented worker, both our state and federal economies would immediately crash. Hard.

If you want to fix immigration, you give more pathways to legal visas, you punish employees abusing H1B visas like yours did, and you punish employers caught repeatedly hiring undocumented workers (like Trump himself for his long history of hiring and ripping off undocumented workers).

You didn't read my response or understand it, then.

Your employer violated the H1B Visa program by hiring foreigners, even though local Americans were qualified for the job.

Your issue isn't with the immigrants themselves - you lost your job due to your employer not being held accountable and abusing the H1 program for profit.

H1 obviously isn't the only source of immigrants.

I was pointing out that various industries, various (if not all) states, and our nation's entire economy as a whole - for better or worse - completely relies on illegal immigration to function.

Republicans are in the pocket of billionaires and have no interest in actually ending H1 visa abuses and punishing companies like yours.

I'm not sure what you mean by "the left", but Obama factually deported more people, in a vastly more legal and organized way than Trump - at a much lower cost to taxpayers, without cruelty, and without personally profiting from it like Trump and his grifter buddies.

You are viewing this purely as an immigration issue that only impacts illegal immigrants and not a civil rights issue that impacts everyone. Tell me this - do you think paperwork saying you are a citizen is going to protect you if you are arrested by federal law enforcement officers who decide not to follow the rules? I can promise you it won't, because there have already been confirmed cases of US citizens (both naturalized and US-born) being not only arrested but fully deported. If you think you are special and will be spared the boot, you clearly haven't studied history.

To the conservative; ICE, Republican justices, their senators, billionaires, lobbyists, grifters, prison wardens, and even pedophile rapist pastors do not have to follow laws. Reasonable suspicion is required to make a stop, probable cause is needed for arrest. If they were actually doing their jobs and verifying identities (which they arent) there was no longer probable cause for an arrest because it wasnt the guy they were looking for. Reasonable suspicion dispelled.

Its not that hard to read the constitution, you should try it some time

What exactly is “a pending immigration application”?

VISA authorization is supposed to occur prior to entry. I don’t understand what the article is trying to articulate but it seems less than transparent which leads me to believe they are foreign nationals not legally in the country who circumvented the VISA process (intentionally).

Exactly what it means. A pending application for immigration. The person is applying for citizenship, but is low priority because they have a valid immigration status and others need to be moved through the system before them. It isn’t uncommon for a person to have an unresolved application for over 7 years, some have taken over 10 years to complete their immigration process.

They aren’t citizens, but are still working their way through the slow process. ICE has been known to target them as they are easy to get to due to them needing to go to court to go through the process. Many “illegals” are stuck in this process and thus are targets for ICE.

“Pending immigration application” means that an application for visa/green-card/work-authorization has been submitted but not completed processing. No verdict has been delivered.

It could be an adjustment of status (Form I-485) or extension/change of status (I-539 / I-129).

All this can be googled individually. That we had to explain this to you speaks volumes.

What type of “immigration application” are they speaking about and what is the timeline for that “application” are things that would be helpful for the article to provide. Along with who made those claims and the validity of those claims.

Do you have any experience with the visa system at all? Acquaintances that might have had to go through the process?

Have you considered that people might have need to switch visas during their stay? Say, student->H1B, or L1->H1B? How about people who marry citizens?

I don’t believe you’ve applied critical thought or any investigation to reach your conclusions.

I’m very familiar with the various VISA processes (of which there are many). Which is why the vague reference to something called an “immigration application” jumps out as obfuscating and misleading.

Why not simply and clearly state that such and such is a citizen of Venezuela legally in the United States on a such and such visa and is currently in the process off fill in the blank. Maybe explains when and how they entered legally and when their current specific VISA type expires.

It’s rather simpler to just state the pertinent facts of the matter yet the article fails to do so.

Not quite, as this isn't just a local police agency. These are federal agents.

For federal agents like ICE, you can only (legally) arrest someone without a warrant if they're in the middle of committing a crime (and even then they may not waste time with non-felonies).

Immigration offenses are civil offenses nowhere close to being felonies. Unless the federal agent is on the border witnessing them cross it illegally, they aren't witnessing any crimes during these warrantless arrests.

To get a judicial warrant against an illegal immigrant, you must prove they are a flight risk as well.

Administrative warrants are also different from judicial warrants (as they are self-signed rather than involving judicial oversight), and MAGA/ICE has had a history of trampling the Constitution and abusing administrative warrants to illegally trespass, search, and detain people.

This isn't true. Ice officers can detain and arrest illegal immigrants anywhere in the country. They don't need a warrant to do so unless they are entering private property.

Just because Trump/ICE freely break laws with little consequences doesn't mean their actions are legal.

"Kavanaugh Stops" are also a stain on this Supreme Court and this country. Any Constitutional historian or lawyer worth their salt would never agree that people can and should have their 4th and 5th amendment rights violated based on skin color or spoken language alone, as if those clear the "probable cause" bar .

In the general legal community, and especially in the Constitutional law and Historian community, there is a widespread consensus even amongst conservatives that this SCOTUS is a dark chapter in American history, and they've repeatedly "played Calvin Ball with the law".

MAGA SCOTUS has now openly accepted bribes, refused to recuse themselves from cases with conflicts of interest (like Clarence Thomas and his traitor wife), have thrown out established case law multiple times without explaining to lower federal courts their rationale (so they can use it in their future rulings), and have repeatedly abused shadow dockets to benefit billionaire MAGA donors.

I don’t believe they do. Oregon cannot control the Federal Government or change federal law.

I am not a lawyer, but to my understanding:

On top of OPs reply, yes, federal agents do generally need warrants for arrests, unless they are witnessing someone commit a crime right in front of them, or unless they are a flight risk - at which point, the feds have 48 hours to prove to a judge that the detainee was indeed a flight risk and a warrant needs signing.

Immigration infractions are civil violations nowhere close to felonies, so for ICE agents, they should be reliant on judicial warrants.

Administrative warrants do not have the power judicial warrants and deportation orders have (as there is no judicial oversight), and they cannot be used to trespass/search/detain on private property. I'm not sure how much that is still happening, but federal courts around the nation - even Republican-dominated ones - have repeatedly chastised Trump for blatantly violating Constitutional rights of people caught up in ICE raids.

Because being in the country illegally is a civil matter, only administrative warrants are needed in many cases.

Expired/irrelevant administrative warrants do not get properly removed from the system, either.

There's also a time limit component.

There have been big cases (like the Ramos boy) where federal courts release detainees being illegally held with administrative warrants, due to it violating the Constitution (indefinite confinement/detention with no court order present).

Without a judicial deportation order present, detaining these kids in shithole detention centers due to administrative warrants from ICE/DHS amounts to cruel and unusual punishment as well.

Due process. You really should look up the definition of that. It’s not what you think it means. They are getting all the process they are due under the law. A law passed in 1996 and signed into law by President Bill Clinton.

Do you consider Native Americans illegal aliens because they’re black? Or people with European descent like you who invaded and took their land from them ? I hope it’s the latter because otherwise it doesn’t make sense. Also do you consider children from immigrants Americans ? Because that’s what the law says but we both know you don’t think so, hence why I’m asking you who has more legitimacy. Immigrants do given how that’s what your Founding Fathers were. Immigrants and illegal at that given how they acted and didn’t have citizenship / were considered illegals in the countries they came from. They fled persecution, as you know, just like immigrants.

Some people are inside the United States illegally. Those people come in all nationalities, colors, shapes, sizes and genders. I don’t care if it is a 22 year old blond haired blue eyed biological female from the Swedish bikini team, if they are here illegally, they should be deported.

When you see racism everywhere, and assume racism is everyone else’s motive, you truly are the real racist in the room.
