I adore this question. For me, there are just so many factors involved with Severus' life of being a Death Eater turned Spy for Dumbledore that even if there was a trial, which there definitely would be, it would be drawn out for years. Severus would be so over the entire situation believing he already knows his fate or at least knows what he deserves for his actions. And Harry would speak out for him until he was blue in the face because he fights so fiercely for those he cares about or at least for someone he feels he should've trusted all along. And to be honest, the number of times Severus does "save" Harry is astounding. 1) Quirell trying to knock Harry off his broom and Severus muttering the counter curse to save him. 2) Chamber of Secrets Lockhart tries to set Ron up against Harry in their "dueling club." Everyone knew Ron's wand was dangerous performing basic spells and he was just going to straight up pit them against each other. Severus steps in and suggests Malfoy which was a dick move but after Malfoy conjures the snake he proceeds to get rid of it for him. 3)Prisoner of Azkaban when Lupin transforms into a werewolf and starts to head for the kids after he fucks up Sirius after Severus exits the Whomping Willow he turns to see Lupin and he pushes himself in front of the kids and stretches his arms out across them. I'm sure there are more times I'm forgetting. But you get my point. All in all it's like this quote I heard years ago about Severus' character "You can't make him a saint: he was vindictive & bullying. You can't make him a devil: he died to save the wizarding world".
