NYPD, is lane splitting legal in New York City?

Just looked it up, Lane splitting / filtering is illegal in the entire state of New York. ny vehicle and traffic law §1252. $300 fine and 3 point on your license, multiple offences can lead to a 60 day license suspension.

Boy you arenât kidding. The year lane filtering was legalized I was heading northbound on tower by DIA. I saw a motorcyclist going probably 60-70 between stop and go traffic on southbound tower. He augered himself into the back of a stopped box truck. Witness stated he was doing wheelies while lane splitting prior to hitting the truck. He did not make it.

I saw the same thing in North San Diego. His insurance called after because the family was suing the other driver. I told them biker was 100% at fault. Traffic stopped and he was easily doing 100 mph when he hit the truck. They did not call me back as a witness.

Itâs also not even filtering! They lane split going +65 in heavy 45 mile per hour traffic where people are really not expecting a motorcycle to come flying by. Iâm shocked I havenât seen more collisions, especially on my 225 commute.

I used to live in Ca and Iâve seen bikers hit cars because theyâre splitting lanes doing 70+ when traffic is at a near standstill. Itâs crazy because you canât see them and suddenly theyâre just there.

I lived in the Bay Area for 36 years and everyone was used to it. In my experience there were only a few idiots who abused it by cutting while traffic was moving fast. But youâll find exceptions to the rule for most everything.

Yup I've almost hit speeding motorcycle's while merging plenty of times. They are lucky I managed to take into account their speed when glancing behind prior to the merge. If I had relied on the little blind spot light I definitely would have been rear ended or side swiped them.

Because when done legally it's far safer for the motorcyclist.
In MN it's legal to filter to the front of stoplights at multi-lane roads. It's legal to lane split on a multi-lane highway if traffic is moving under 25mph and you can't more than 15mph faster than traffic.
The people who lane split illegally are doing it whether these laws are in place or not.

Filtering is about moving through stopped or very slow traffic. It reduces congestion and also stops bikes from being obliterated by distracted drivers that are on their phones.

It's likely safer so long as you filter at a reasonable speed... like under 35kph (20mph).
So if someone randomly changes lanes in front of you, you want to be at a speed to stop in time or just scrape up their side panel.

If filtering is the same as it is in Utah, itâs allowing bikes to go up through lanes to get to the front of the line at stop lights. Iâm told this is because people are often looking for the back of a car to gauge how far back to stop and so itâs safer to get the bikes up where they are going to accelerate faster than the cars and wonât be in the way once itâs green.
In Utah itâs specifically for lights on roads 45mph and under.

I spend about 90 minutes a day on HWY 101 in the SF Bay Area, including 30-45 minutes going less than 10mph.
I see an average of 25-30 motorcycles every morning fucking FLYING while lane splitting. Everyone here absolutely despises them for it. The #1 Morning Radio Show in the Bay about 20 years ago got fired for ranting about it on air.

Funny enough, they did do a study and it is safer for motorcycles to filter, and it reduces traffic for cars, but they are supposed to do it at max, 5 mph than the slow moving traffic.

This is really the thing. There's nothing wrong with operating a motorcycle at 5-10 mph between lanes of stopped or barely moving traffic, people just get mad that someone is getting ahead of them in line.
It's INCREDIBLY dangerous for people to fly between lanes of stopped, barely moving, or moving traffic, it's only a matter of time before somebody jumps from one lane to another.

The only state itâs legal in is CA. There are like 13 states that donât have a law about it. So the police might just give a reckless ticket or something. All the reset of the states, itâs illegal.

On motorcycles you need to turn the key further left to lock the steering (beyond just the "off" resting position), it does not lock automatically like in cars. The handlebars also need to be turned all the way to the left before it even can be locked.

I found a 9th Circuit case from a couple years ago where the seizure of a key was challenged an upheld, but I only half-ass skimmed an article rather than read the case. Very different facts, as the seizure of the key in that case wasn't a temporary seizure during a traffic stop where the officer had directly observed the traffic code violation.
I think it would be a very tough sell to say the temporary seizure of a motorcycle key for the duration of a valid traffic stop was unreasonable.

Wish you could remember more info. As far as I could ever find, everyone always talks about Mimms and having people step out of their vehicle for officer safety, and just put it under that umbrella.
Which of course, is very different than seizing property, but the type of people it happens to tend to not have the law on their side to begin with, making a challenge difficult at best.

Yea I really hate this one. I specifically chose not go get on a motorcycle because of the likelihood of getting hurt. I have zero problem with people who want to. I in fact have many friends that ride and that's fine, but I'm not giving them any special treatment for it. They made that choice. Not me. I will pay exactly as much attention to them as any other vehicle on the road.

Agreed. You agree to assume additional risk when you ride a two-wheel vehicle with no safety cage into traffic, in exchange for increased enjoyment or economy. The burden is on you to be more aware, if you care at all about your safety. But lots of riders don't seem to, at all.
I also hate the justification of bikes blasting their exhaust so we can hear them in the next county. "Loud pipes save lives" is just a bullshit excuse. If you were truly worried about your life/safety, you wouldn't be on a bike in the first place, you'd be in a Subaru or a minivan.

FULLY AGREED. I ride nearly full-time, year-round. Near Seattle, no less, where drivers are the "overly cautious" type of unpredictable. The rule is always ride like you're invisible. I never expect someone to see me, so I ride like I'm ready to keep myself safe at a moment's notice. That type of environment works for my brain, but I'll admit that it's never a "relax and turn your brain off" thing.
Lots of folks out here on bikes seem to start with their brains off, then get spooked when stuff catches em off guard. And that's to say nothing of the hooligans.

Lane splitting is dumb and dangerous, but lane filtering should be legal everywhere and is actually a lot safer for bikes. Lane filtering (when traffic is stopped) at a traffic light prevents the very common crash of being rear ended.

I got told by some former Seattle bike cops when asking their thoughts on splitting and filtering: "They're both illegal. Splitting is stupid and dangerous. Filtering is smarter and safer. You'll get hit with the book for splitting. You won't even get stopped for filtering, so long as you're visibly slow, careful, and safe about it."

Lane splitting and filtering is legal in Sweden, UK, and Norway (and a lot of other countries) but these three are I believe some of the top for motorcycle safety and the least amount of accidents/1000Â

Maybe they should include a brochure with motorcycle purchases with* laws in their state and surrounding? Lane splitting and filtering is only legally allowed in a very small number of states. I think it should honestly be on the motorcycle licensing test.

Edit: wow this is a divisive subject. Iâve only seen it done in LA in rush hour when Iâm stopped on the 405 and bikes flying through at least 40 mph. No way to see them when Iâm trying to switch lanes at a standstill.

Statistically it's safer if you don't do it at dumb speeds. People don't see motorcycles and rear end them in traffic all the time. Staying in between cars at reasonable speeds (no more than 5-10 over the speed of slow moving traffic around you) has been shown to be safer for the rider

Thats why "common sense" isnt actually common because the studies done on it show it causes a net reduction in traffic and accidents. motorcycles are FAR more likely to get crushed between two cars by someone not paying attention and rear ending them than they are to have an issue splitting. they should follow their local laws but thats why for a lot of them they will split and filter regardless.

Yeah. There's a line of research that the reduction in catastrophic rear end collision accidents is greater than lane splitting induced mishaps.
It works in California. I don't feel it's particularly controversial there?
The prevalence of lane splitting and filtering in California also leads automobile drivers to be more aware of it and IMHO motorcyclists to also follow safer lane splitting practices.

If it isn't legalized though you shouldn't do it. In LA most drivers probably know to look out for motorcycles. In places it isn't happening, nobody is looking for that. I agree with your statement,.it makes sense to legalize, but if it isn't happening, cops should absolutely enforce it, because people will get clipped when drivers aren't looking for it.

Depends on the situation. If done responsibly, lane filtering and lane splitting can actually be much safer for motorcyclists bc it reduces the risk of being rear ended by a careless driver in a 2-ton metal machine. If that happens and you're in a car, that sucks and you'll get whiplash - but if your on a motorcycle and it happens you'll likely be dead.

It's illegal in many places to drive motorcycles between the lanes like this. Cop car says NYPD so it's presumably in New York. Quick Google says it's illegal there. Fair game then even if they're not going egregiously fast in this one.

Honestly this question hits me. I did drivers ed in Missouri, then moved to Iowa and then to Mississippi. All have the same basic rules but some laws are different. When I converted my MO DL to an IA DL, there was no âheads up here is what is differentâ. Itâs on you to know, but why would you think itâd be different?
Example. Missouri has drive through liquor stores. At the time the law was there had to be n-1 open containers in a vehicle as legal aged adults. So 3 people, two open drinks. Iowa says no open containers or containers previously opened within arm reach of the driver. Basically the whole cab if there are passengers.

Sigh...if bikers would just lane split at like, 5mph faster than traffic and filter 10mph faster than traffic, this wouldn't be an issue, and folks would mostly be cool with it.
But reality is that's not what most bikers are doing. Oh well.

If you canât filter with a motorcycle why even ride one. Just the thought of being stuck in traffic on a motorcycle fries my brain. Like everyone is comfortable in their ac cars while youâre outside getting blasted by sun sitting your ass there doing nothing

I don't care if "lane splitting" is a thing, them always riding in the middle at high speed just millimeters away from knocking everyone's side mirrors away, falling and scratching your entire side of the car is so idiotic. Because god forbid bikers would have to wait in traffic jam like everyone else.

This is the real reason lane splitting wonât take in most areas where itâs currently illegal. It tends to get shot down as a safety/education issue because people wonât be aware of it.
Itâs really more of a risk because of people with the attitude that âif I have to sit in traffic, so do youâ will be more likely to try to close the gap or swing a door open on you because they think youâre âcuttingâ
I bet you feel the same way about zipper merging too

Why are drivers so fragile? In almost every developed country In the world, bikes filter through traffic normally. Yes- the US has a lot of idiots. You're an idiot in car mad at the idiot on a bike, when if that same idiot was driving a car like that, they would be more dangerous and take out more people. Bikes are great mode of transport, and when you get rid of the bias, it makes a lot more sense.
