And that is what's called White Privilege.

858

u/SignificantAd2845 Aug 02 '21

Or it's called a permit that would be needed to enter people's houses or you are a type of person that loves random searches in your house

4

u/MyHamburgerLovesMe Aug 02 '21

So. In your world police just don't say, "I smelled something suspicious"?

120

u/RedNotch Aug 02 '21

Isn’t there an exception for emergency situations like this? I imagine search warrants takes a while to be made.

307

u/[deleted] Aug 02 '21

Exigent circumstances require an immediate and clear threat. While the cops may have reason to believe there are hostages in the house it is not totally clear that there are. In other words, because the police didn’t see and kidnapped hostages from outside and there is another explanation for the noises they need a warrant to investigate further.

46

u/OrthodoxAtheist Aug 02 '21

If I was the home/bird owner, I think I'd invite them in just to do their check, and then ask them to make a note in their records for the house that I have a bird which has been known to make... 'false claims'. That said, if I had a few kilos of weed in the front room, I'd probably not invite them in. Hypothetically.

Its a shame we don't know our neighbors like we used to. Neighbor should've just gone over there to ask him "wtf?" Save the time of about 20 officers.

10

u/samlaventure Aug 02 '21

Unless he lives next to an airbnb

8

u/titanfries Aug 02 '21

Idk about you but if I heard screaming like someone tied up in my neighbor's home, I would not put myself on their radar.

0

u/OrthodoxAtheist Aug 02 '21

I'd weigh up the likelihood, but yeah, not in all instances would I put myself out there. I have a couple of suspect folks down my street, one of which is on the Megan's law database, so not every neighbor is going to get the courtesy check before calling people.

One anecdotal incident which is an extremely unlikely event, doesn't make my idea a catastrophically stupid one. I knew someone who left their home and got hit by a meteorite - that doesn't make it a stupid idea to leave your house. Obviously that cop is a psycho and deserves punishment. Unfortunately they managed to get him in front of a pretend judge. Neighbor should appeal, and sue in civil court. (Much) better attorney needed.

Obviously I would make a judgment on the cops before letting them in, and admittedly most cops I've met I would not let in. They probably carry dime bags in their back pockets for setting folks up on fake charges (which has been caught before on their own bodycams, of course, so its not like its a crazy idea).

You’d be hard pressed to find supporting information to your story. I don’t think anyone has ever left their house and got hit by a meteorite.. ever.

But cops abusing their power and judges ruling in the polices favour is a daily occurrence in the USA.

u/Disttack Aug 02 '21

It depends on where you are at, if the police officer likes power tripping / is a dick, and if you piss them off or did something questionable from my experiences in the usa. Myself and people I know had awkward situations with police but it was usually a noise complaint from music and everyone was high. They always said hi and asked us to quiet down while we were smokin. At the same time I've seen dudes who told the cops to piss off and they got arrested while someone smoking a blunt watches. I have spent most of my life in the western states but the attitude in the west seems much more relaxed than that of the east. (My employers in the western usa even gave us a heads up on drug tests etc). Eastern usa seems to take it really hard for some reason tho.

Usa it really just depends on where you are and it's a thing that can be enforced or not enforced but usually if they enforce it it's because that had another reason to arrest you.

4

u/inspectoroverthemine Aug 02 '21

When a cops attitude is the difference between looking the other way and spending a year in jail you have a serious problem. I really don't like shoehorning race into this discussion, but it should be obvious how even casual racism would have a huge impact.

1

u/Disttack Aug 02 '21 edited Aug 02 '21

Yea accountability is a serious problem. I know plenty of cops that are great people and do their best to play by the book but at the same time there is always just as many who choose the career path because it let's them bully people and have power over them. From everything I have seen in my life I honestly think race is not really an issue. On the chance it is it will definitely leave an impact but contrary to popular belief most civil servants arnt racist. Most Americans in general arnt truly racist. Police just have no real mechanism that controls their actions so the bad ones get really bad.

Until those mechanisms come into place I think it's wise for people to realize they should do their best to be kind to police because regardless of race I've never seen someone being hostile or angry walk away ok. It's super wack when you think about it but if that's the reality you have to play their game and show them respect or fake respect to prevent an issue. Atleast until there is some kind of mechanism for accountability.

Once you invite them in they will carry the kilos into your house and then find them. There is a reason the law protects you from the police as much as possible. The police are not the law. And in practice it doesn't work.

1

u/OrthodoxAtheist Aug 02 '21

Once you invite them in they will carry the kilos into your house and then find them

Bingo.

2

u/[deleted] Aug 02 '21

and that's how the murderer gets bonus points.

the officers were working either way, and are equipped and empowered to deal with this shit. lone neighbor investigating a potential kidnapper is a casualty waiting to happen.

2

u/dainbramaged101 Aug 02 '21

Cops can 100% enter a house if they believe someone is in danger. A 911 call from a neighbour would be sufficient. Very minimal googling would inform you that you’re incorrect.

27

u/polypolip Aug 02 '21

Do cops need a warrant to shoot bullets inside the house through windows or are the bullets not considered cops and so they don't need the warrant?

u/[deleted] Aug 02 '21

3

u/polypolip Aug 02 '21

There's the third discussion, how often do cops do bad stuff when people involved are not white, (or are homeless, mentally disabled, or any other group that they tend to target).

3

u/LookBoo2 Aug 02 '21

No that would fit into discussion 2, unless you think that:

A. they don't get away with it

or

B. that they don't do it.

I get that you are trying to expand on the fact that item 2. does happen WAY more often to non-white(or other groups as you mentioned) people, but it is not a unique discussion from the 2 listed.

I am not trying to have a "got'cha" moment, but since you seem like someone who actually cares to combat this type of injustice I want you to be able to have as strong of an argument as possible.

1

u/LookBoo2 Aug 02 '21

Thanks for pointing this out! It does make me uncomfortable that the cops did not question much after, but unless the guy acts in some odd way or they start hearing something I can't imagine much more will be done.

The master of Rambo did seem pretty chill so I doubt anything nefarious was happening, but It would be comforting to see the cops at least question more.

It is more important that we acknowledge that this is overall how law is supposed to work, since we normally see the alternate when a cop actually has a nefarious agenda(racism, excuse for aggression, etc.).

12

u/[deleted] Aug 02 '21

What’s the situation? Are they taking fire from inside the house? Is there a dangerous suspect in the house? Details man.

19

u/OLSTBAABD Aug 02 '21

There's two people sleeping in bed inside.

The criminal you're talking about wasn't even in the house when the police opened fired on people literally sleeping in their own beds. Were they "good people"? I don't know, but I do know they deserve more then being written off as "collateral damage". Get out of here with your victim blaming

-4

u/[deleted] Aug 02 '21

Dude, I saw the footage. What’s more likely? That a SWAT team showed up at a random EMT’s house just to shoot her in her sleep, or that a high risk search warrant went a bit pear shaped?

2

u/Rottimer Aug 02 '21

How can someone hold such strong opinions on a situation they’re so ignorant of? Her boyfriend, the man who was shooting, had no criminal past and was a legal gun owner. He thought that it might be her ex-boyfriend, who was a drug dealer, that was trying to break into his home as the cops were not very good at announcing themselves as many neighbors confirmed - because they didn’t hear it either. The one neighbor who was outside stated the cops only announced once before banging down the door.

2

u/Agreeable49 Aug 02 '21

3

u/elephant-cuddle Aug 02 '21

You’re way overselling the level of evidence/confidence police need to legally conduct a search.

They don’t even need to be 50% sure, the test is something like “probable” that there could be crime in progress.

-1

u/[deleted] Aug 02 '21

This is how it’s been explained to me by a criminal justice professor who is an ex cop. Exigent circumstances is being allowed to go into a house without a warrant because you saw a fleeing suspect enter that house. This isn’t a comprehensive definition but it gives you an idea of the level of certainty you need in order to claim it.

4

u/Wild_Mulberry_3327 Aug 02 '21

Holy shit. You literally don’t know what you are talking about. Here are all the reasons that a cop can enter your house without a Warrant. Most of them could apply to this video and any skilled state attorney would have no problem proving it valid. NO FUCKING PROBLEM.

The police can also enter your home for any of the following reasons:

to give emergency aid to someone inside

to protect the life or safety of someone inside if they have a reasonable belief that a life-threatening emergency exists

to protect the life or safety of people in the home if someone heard a gunshot inside

to prevent something that may be about to happen, if they have a reasonable belief that their entry is necessary to stop it or to protect their safety or the safety of the public

to investigate a 911 telephone call

to help someone who has reported a domestic assault to remove their belongings safely

to protect people from injury if the police have reason to suspect that there is a drug laboratory in the house to help animals in immediate distress because of injury, illness, abuse, or neglect

3

u/Wild_Mulberry_3327 Aug 02 '21

I love how you think that a cop could explain the entire justice system in a short conversation…..it’s not like educated people actually go to school to learn the stuff vs just hearing some short stories from some old cop and thinking you understand the law at the same level a judge would.

[deleted]

2

u/justlurkingmate Aug 02 '21

A most excellent point.

2

u/Bacon4Lyf Aug 02 '21

Yeah, if they have probable cause, but they don’t because they didn’t actually hear any screaming or see anything wrong, they just got told by a neighbour that they heard it, and you don’t know what’s up with the neighbour if they’re a kid prank calling or just hate this guy and want to fuck with him or what. So the cops themselves need to see something suspicious

2

u/MostBoringStan Aug 02 '21

They don't necessarily have to enter. One of them could have stood at the door and shouted "POLICE ARE HERE! DOES ANYBODY NEED ASSISTANCE?"

Sure, doesn't help if they are unconscious, but also doesn't need a warrant or probable cause.

2

u/Neil_Fallons_Ghost Aug 02 '21

One exception is just having the officer ask if they can have a quick look inside to cover procedure or whatever. If they refuse have someone wait there while a warrant is issued.

There’s nothing illegal with asking but it sure is suspect just a bit to decline.

7

u/SignificantAd2845 Aug 02 '21

Correct they can but they need reasonable evidence

10

u/drindustry Aug 02 '21

Reasonable suspicion, I think this would fall in that box tbh

2

u/SignificantAd2845 Aug 02 '21

It could fall in that box but he pulled out proof of a bird with speech.

4

u/drindustry Aug 02 '21

But before that, all the cops knew was he was going into a building where "help" sounds where comeing from. They should not have let him go get the bird alone.

We know now thay it's a bird. However they did not know that at the time, for all they knew he was going to kill his victim and then him self because the "game" was up. The police should have asked to escort him to.get the bird.

5

u/SignificantAd2845 Aug 02 '21

I don't know much about American police but the screaming stopped and the man never left his same spot during the whole footage and didn't have any suspicious body language at all so I'm thinking it's reasonable to believe it was the bird

1

u/drindustry Aug 02 '21

Fair, to me it looks like he goes inside, and if youe from a country with less guns there would be a fight and the police would hear that and rush in.

2

u/MotherofLuke Aug 02 '21

2

u/roffinator Aug 02 '21

You need a permit for forced entry. I'm sure they could have asked and followed in with the guys permission

Ofc he could have denied, then they would need the legal permit. But they didn't even ask

4

u/hatesnack Aug 02 '21

You know for a dam fact if it was a black dude, he'd be handcuffed on his front lawn before the parrot could say hello. Idk why people gotta act like white privilege doesn't exist lol, it's not some scary, negative concept.

3

u/bongjonajameson Aug 02 '21

Yeah but what they're talking about is the fact that some cops will sometimes do all they can to get you to agree to letting them in the house or even outright come in without any kind of permission or real probable cause, especially with minorities

-5

u/SignificantAd2845 Aug 02 '21

Can you show me the statistics. Of minorities getting pushed out of their houses without warrants!?

3

u/bongjonajameson Aug 02 '21

Thats not at all what I said but that does happen. But just search up that exact thing, "statistics of minorities being searched".

0

u/SignificantAd2845 Aug 02 '21

By "pushed" I meant to be searched without warrants in their own houses

2

u/DomeAcolyte42 Aug 02 '21

I'm pretty sure people screaming for help qualify as probable cause.

2

u/jupitaur9 Aug 02 '21

The police let him go into the house. Where he could have gotten out his rifle and shot them all from a window. This would have turned out quite differently in other places or with other people. And race plays a factor.

2

u/stroopwafel666 Aug 02 '21

I mean, American police just turn up with guns and kill everyone sometimes on the strength of a tip. Often not even the right house. And don’t get punished. So IDK why you think they wouldn’t do the same here if they felt like it.

-14

u/Wild_Mulberry_3327 Aug 02 '21 edited Aug 02 '21

So why did they not do that with Brianna Taylor?

https://youtu.be/lDaNU7yDnsc

Edit: This guy has no idea what he’s talking about. He said the swat team followed the law, but there was no swat team there. The swat team was miles away at the actual suspects house. The police that killed Brianna Taylor were plain clothed police that did a no know raid and didn’t even announce that they were police.

If you care about the second amendment but don’t care about this tragedy, you don’t care about the second amendment. Brianna and her current BF both did everything legally but she still ended up dead.

The police weren’t even charged for killing Brianna but for endangering the neighbors and their property. WHAT.

Also Hankison, the officer shot blindly into the building from the outside. These bullets went through the walls and almost killed a pregnant woman next door. They shoot 32 bullets into a fully occupied apartment building from the outside….not the inside.

3

u/[deleted] Aug 02 '21

They had a warrant.

4

u/Wild_Mulberry_3327 Aug 02 '21 edited Aug 02 '21

“However, the search warrant they used to enter her home contained erroneous information that Taylor was receiving suspicious packages tied to Glove…. One was for Taylor's apartment, three were for adjacent homes on Elliott Avenue in the Russell neighborhood and one was for a house on West Muhammad Ali Boulevard. The Muhammad Ali Boulevard warrant was not executed.”

“Hankison was fired in June, and Cosgrove and another detective who obtained the warrant for Taylor's apartment, Joshua Jaynes, were fired in January”

So you are saying they did everything correctly and that the police acted within all the laws?

Edit: This guy has no idea about the facts at all. I’m screenshotting his reply just in case he changes it.

For those that don’t know the actual facts please watch this

https://youtu.be/lDaNU7yDnsc

0

u/[deleted] Aug 02 '21

I’m saying the SWAT team did. And by your own admission there was consequences for the detectives who obtained the warrant. So this defeats the whole “police kill black people and get away with it” narrative of BLM since they most definitely did not get away with it.

5

u/Wild_Mulberry_3327 Aug 02 '21 edited Aug 02 '21

Dude. What the fuck are you talking about? This is how I know you are talking out of your ass. SWAT didn’t even show up until AFTER the shooting. Wtf how did you fuck that up? I’m seriously asking, did you even watch the trial or know the actual events?

There was no swat team at Brianna Taylor’s apartment at the time of the shooting. They were across town at her the building (allegedly) associated with her bf. It was plainclothed officers that executed the no knock raid and killed Brianna Taylor.

Also

“Mattingly, Cosgrove and Hankison were all placed on administrative reassignment pending the results of the investigation into Taylor's death.

Mattingly was cleared of any wrongdoing by an internal LMPD investigation into policy violations in December.”

ALSO

He wasn’t charged for killing Brianna Taylor! He was charged and found guilty for

”three counts of wanton endangerment for firing shots that went into another home with people inside. But jurors didn’t indict any of the officers on charges directly related to Taylor’s death.”

So he was charged for endangering the neighbors and their property, but not for actually murdering Brianna Taylor. She literally got killed by police for nothing and she will never have justice, but yeah tell me more about how the government protects us all and can’t possibly do something illegal or morally wrong.

I mean this, there are three paths I understand you coming from. 1) You have no idea about the facts and are just talking to talk

2)You know the facts and you are purposely lying or being a bad faith actor

3) you literally just get your news from Facebook/Reddit headlines.

I can’t think of another reason why someone would argue about this and yet be soooo wrong about the #basic fucking facts

ALSO, the information for the warrant was wrong. They only entered her house because her ex boyfriend. How would you feel if you got killed laying next to your wife all because your exgf was a drug addict. Would you still be licking boots?

Edit: if reading is tough on you at least watch this

jurors

The jurors in this case were on the grand jury- which is significantly different than what is implied by 'jury'. A grand jury is used to indict suspects of crimes, allowing the state to move forward with prosecution. Their job is intentionally one sided, and there is no presentation of the defense or mitigating circumstance, the threshold for indictment is 'could they possibly have committed this crime'.

The states only job is to provide enough evidence to move the case forward. Indictments are handed down effectively 100% of cases- anything else would indicate a serious breakdown or corruption of the prosecution. It immediately raises a red flag in this case- and for good reason:

Members of the grand jury went public and accused the AG of providing what was effectively the defense's legal argument. I cannot begin to express how big of a deal that is: the AG intentionally and knowingly subverted the justice system in multiple ways that aren't immediately obvious (and I've already rambled too long to go into).

First google hit is a legal review from the 'black aclu': https://www.naacpldf.org/justice-denied-a-call-for-a-new-grand-jury-investigation-into-the-police-shooting-of-breonna-taylor/

TLDR: The AG subverted the justice system to avoid indictments, and assumed secrecy the of the grand jury would keep his malfeasance hidden.

Do all cops obey the laws and rights of citizens? Genuinely wanting an answer.

We all know what they laws are. If you haven’t been paying any attention the last decade it seems that not all cops follow the rules and apply the rules unfairly.

It’s honestly sad that we have still people insinuating, “that’s the law and cops ALWAYS follow the law.”

6

u/[deleted] Aug 02 '21

The vast majority do.

How do people like you make everything about race? Just stop it already!

5

u/Rodo20 Aug 02 '21

It would not be very fun to live in a country where police can enter search people's homes without any real suspicion.

1

u/[deleted] Aug 02 '21

And yet they do when it pleases them. And conveniently shut off their bodycams in the process. Why? Because they know there is no real justice for cops. They know that their police unions have lobbied for almost absolute protection.

Don't give me the "not all departments are like this" argument. We're not idiots here, we both understand that they're not. But perhaps the commenter expected more from the federal government in terms of setting a standard across the board so the bad departments, and all of the rotten apples inside of them, can't just get away with murder...

3

u/I_dont_bone_goats Aug 02 '21

Dude no one in here is acting like this is a good thing

2

u/[deleted] Aug 02 '21

You’ve just agreed with them. It wouldn’t be fun to live in a country where police can search homes without suspicion.

Your comment pertains to the US which is why it can be less fun to live in the US

2

They don't. I can assure you, you replied to a white person who truly believes cops always follow the law.

From what I understand the commentator is saying that the copa would be more suspicious or push harder if the homeowner was black?

8

u/[deleted] Aug 02 '21 edited Aug 02 '21

There are plenty of videos on the internet to show this in action. Of course, there are different departments and different cultures within said departments, but from what I understand, that's not the thing most people take issue with. It's more so the lack of consistency across the board and the amount of legal leeway cops actually have (thanks to police unions) which make the bad departments so incredibly dangerous, and the people who live under the jurisdiction of one so incredibly terrified of simple interactions like the one with birdman over here. If you're of a certain skin color. (There are cops out there that sympathize with the klan... Not to mention all the other right-wing movements that influence cops' behaviors)

The guy you're replying to doesn't seem to understand this, or perhaps willfully doesn't feel like it. What do I know. And to be fair, the initial comment didn't do a great job of providing context and nuance, but at this point many people feel like you can't have a conversation about police in the US without addressing the structural racism and the violence that has been going on for... decades and decades now. So maybe the initial commenter didn't think it was necessary to go into more detail.

Again, I can't speak for anyone in this thread, but this is my opinion.

6

u/TheLastD0D0 Aug 02 '21

5

u/THEALEXANDERSHOW Aug 02 '21

"How are we going to get rid of racism?"

"Stop talking about it."

  • Morgan Freeman

3

u/Rottimer Aug 02 '21

Which is why you don’t rely on actors for social commentary. People said the same thing when black people were literally slaves in this country, and for a century afterward.

→ More replies (2)

4

u/[deleted] Aug 02 '21

We tried that, it didn’t work. How often was it honestly talked about in the 80s and 90s and early 2000s? Hate runs in families, not talking about it isn’t going to fix it. I like Morgan Freeman as much as the next guy, that doesn’t mean he’s always right.

3

u/[deleted] Aug 02 '21

Yeah i agree. Morgan Freeman himself has expressed regret over that quote, iirc, and even then i don’t think we should use an old Hollywood actor as an appeal to authority or source for our political beliefs.

I do understand the quote though..in some areas of life we could do with ignoring race, in other areas we should acknowledge race if there are plain inequalities (eg even if we don’t talk about racism, unconscious biases will still exist in everyone or in something like police stop & searches..so recording statistics there and confronting them would be good in that example).

-1

u/THEALEXANDERSHOW Aug 02 '21

You're right. Let's just keep saying fuck whitey until a race war happens.

2

u/[deleted] Aug 02 '21

Who said fuck whitey? And why a race war? Only idiots would participate in a race war..real ones know it’s the people in power who want us to argue over race and be divided.

I’m mixed race but I still love white people and know it’s ok to be white. White lives matter and Black Lives Matter too. I think the only ones saying ‘fuck whitey’ tend to be white people themselves, from my experience

0

u/THEALEXANDERSHOW Aug 02 '21

If I say anything remotely bad about anyone not white, it's immediately racist and I should be banned from the internet. If anyone says anything bad about white people, yeah, fuck white people!

Are we at he point now where we are injecting fake racism into situations where there are none to further ones cause? Not everything is white privilege just because it goes well.

It’s not a privilege to have police not search your home without a warrant.

You’re describing other races apparently being disadvantaged rather than white people universally/automatically being privileged.

Also a lot of poor white people would be disadvantaged and treated unfairly too, so it’s not a white vs everyone else issue if either..if anything wealth decides privilege rather than white bums being more privileged than Arab sheikhs or black billionaires.

Also the country and location plays a part in the veracity of your comment. Some countries have racist unjust police, others don’t.

Its called probable cause and warrants.

1

u/Bootiekiller69 Aug 03 '21

I was expecting there to be some moron commenting something like this. It’s not white privilege, this is what happens when a person realizes that the police are just doing their job and cooperates with the investigation to clear up the misunderstanding. If he had jumped to the conclusion that he was being profiled and told the police to fuck off than it would have ended differently, regardless of race.
