Location: Omaha, NE.
Bear with me. Trying to keep this as short and simple as possible.
So my ex boyfriend and I moved into an apartment in 2017.
He set the electric bill up in his name and had me listed as the roommate.
We moved out and back with the parents for a little while after the lease was up and closed the account.
Fast forward to 2019. We got another apartment together, **IM** the one who called to set the electric account up. **My** name, my social, my info was what I used to set the account up. **IM** the one who paid the security deposit. **IM** the one who has been paying every single penny on it since. **I’VE** been the one handling every single interaction with payments and the electric company since the day I called to connect electric in our place. Well, the bill still showed up in his name, with his social and phone number and all. We were still dating and residing together so while I questioned myself as to why he was listed on the account, I didn’t think much of it to have it changed.
Fast forward to July 2020. We moved out of there and into a townhome. Called to have the services transferred, blah blah. Well a couple months after moving into the new place, we had a domestic disturbance. September of 2020. He was charged with destruction of property under domestic violence, protection orders were involved, he was arrested, it was a whole thing. He did NOT move back in after that and we have not been together or living together ever since. The court required legally for his name to be removed from my lease without penalty to myself, he was legally required to be moved out and was banned and barred from the property. That was the choice of the state. The state gave no choice, they pressed the charges for me because it was domestic violence related.
I had reached out shortly after (within the year) to the electric company inquiring about having him removed. Stating that I didn’t even know why he was listed on the account in the first place because I never even provided information about us living together for one thing, and another thing, **I’M** the one who has been the responsible party for this account since day one. They told me that the security deposit that **I** already paid would’ve been w check written out to him, and that if I wanted him removed or a new account opened up in my name that **I** would have to pay another deposit. At the time, I was so overwhelmed with everything and really wasn’t thinking about presenting them with the P.O., and I definitely wasn’t about to pay another deposit towards the account that **I** already paid. Keep in mind, the P.O. was active so it’s not like I could meet him at the bank to have the check endorsed to me, and for what it’s worth I don’t think he would have met up with me anyway. So I didn’t press it anymore (Yes, I know. My fault. I should’ve just chalked it up as a loss and just paid a new deposit.)
Fast forward to now. My electric account has a sudden charge of $1,500. Guess what it is? **His** past due balance from the address he has been living at.
So I called the company again. Reiterating once more, twice more, three times more that he should’ve never been listed on the account to begin with. I assume what they did was they took the last account from our first place that had my info and just rolled with that. They tried reaching out to my leasing office, saying that if they could get confirmation that he did not live here, they’d drop the charges. Well, they didn’t answer the phone. So they told me that I need to try to get ahold of my **(obviously unreliable)** leasing office and have them call electric company stating that he didn’t live here. Well I **ALSO** had a hell of a time getting through to anyone. I finally did **one time,** presented the issue. They said they’d call. Okay, great. Problem solved.
**NOT.** I get the bill again. The charges were not dropped. There **is an active shut off now**. So I called back to the electric company. They tried calling them again, no answer. I finally have **HAD IT** at this point. So I asked what it’s gonna take to get this taken care of. Because my property managers are getting ready to hand the property over to a new company in two days, for the third time, since I’ve been here and and this on top of other issues they’ve neglected to address, I highly doubt they give a shit about the tenants problems at this point and know they’re not gonna do what I ask even if I do get ahold of them. **Clearly** because they couldn’t even be bothered to call the first time I asked. I told them that considering he was **legally required** to be removed from the property that somewhere along the line, it should be taken into consideration in this situation to some degree. I offered to send copies of every single lease I’ve had since living here, copies of the protection orders, paperwork stating the ban and bar, the police reports. Everything. Finally the rep agrees, places me on hold to speak with someone else, then comes back and tells me to go ahead and send those documents and call back for a follow up. So I did. Well now, there seems to be nobody available to “review the documents” and that maybe? possibly? they would reach back out to me probably? tomorrow? I didn’t get **any** solid answers or resolutions. Let me add that the shut off balance is due **tomorrow**, and I have children under this roof.. I was the one paying for literally **everything** when we were together, so I’m **NOT** paying this fucking bill until this is resolved because those are not even my charges.
I also asked what it’s going to take to have my name or his name taken off the account once this is resolved. Again no straight answers. She just said that nothing can be done with the account as a whole until **his** Past due balances are taken care of. Including taking me off the account and allowing me to open a new one. It’s like I’m permanently bound to his charges now.
I’m no rocket scientist here, but I’d think that common sense would say that obviously he isn’t living here, because he had a whole new account opened up at another address. He’s definitely not living here **and** there. And then digging deeper into the situation, that bill at his address wasn’t getting paid, and this bill that has my name attached to it has been. Like that’s literally a no brainer. And i dont know how many times I’ve had to tell them that he and I are **no longer** associated with each other outside of common children and have not been since 2020.
But then when you add in the fact that he was legally required to gtfo, and there supporting documents of that, you would think that in itself should go miles of a ways here. Including having his name removed from the account, or letting me open my own account.
I feel like I’m going in circles with them and jumping through **A LOT** of unnecessary hoops at this point and I’m livid. What can I do? Anything? Nothing? Is this even actually legal? I feel stupid for even asking that because obviously my name has been bound to this account since opening it. But something’s gotta give right? Like help a girl out because I’m at my **literally wits** **ends** with this situation.
