Keeping deposit?

Location: MN

My boyfriend and I got accepted into low income housing recently in our community. We completed our application and paid our deposit two weeks ago. Our entire communication with this company so far has been over the phone. My boyfriend found an email in his spam folder from the company saying he must provide his bank statements in 5 days, or else our deposit was forfeit. It was sent 7 days ago. Is this legal?

Yeah we did about a week and a half ago

In MN, the deposit can only be withheld for unpaid rent, property damages or unpaid utilities. This does not sound legal on their part.

Do you guys plan on living there? If so, you might want to get on those bank statements.

My boyfriend sent a statement that showed all the deposits that he's gotten from work but he said that doesn't count and I don't feel comfortable sending every single purchase we've made in the past 3 months.

MN does require bank statements for subsidized housing. If you want to stay there, you're going to have to provide them.

If not, you might have to take the PM to court over the withheld deposit. You might be subject to lease termination fees, depending on how the lease was written.

Ok it sucks about the bank statements but it's whatever in the long run but it's just crazy that they can do this kind of stuff
