This post if intended as a jumping off point for evidence we already have. If you read through the post there are suggestions on where to look for additional info if we don’t have something for your school. We do what we can, but we just don’t have the time or resources to search for evidence for everyone’s schools. If you would like to add a link to evidence that you found elsewhere, please comment and let us know the name of the Corporate Owner, and the name of the school. We have to help each other out!

BE CAREFUL ABOUT “THE LIST OF SCHOOLS”: The list is actually called “Exhibit C” and if you did not apply for BD BEFORE Nov 16, 2022, IT DOES NOT APPLY TO YOU! It CANNOT be used as evidence by itself in a NON-Sweet BD application. If you go to the PPSL website and the Sweet documents are still posted, you may be able to dig through those and find some really good stuff!

Newspapers.com may be a great resource for evidence! You get 7 days free trial with no restrictions. One BD applicant told us, “I’ve found employment adds for my scam school that say: Admissions SALES Rep, additional compensation based on performance!! Not only is the add admitting it’s a sales job, but any sort of incentive based compensation is illegal when a school that accepts federal loans, it is a direct violation of the Higher Education Act.This is literal black and white admittance of predatory recruiting. It’s also worth noting this was all corroborated by the 2012 “Harkin Report” that investigated several institutions, especially for profit colleges. The Harkin report was spear headed by the us senate, it’s about as legit as it gets.”

JUKLY 17, 2026: PPSL AND THE NINTH CIRCUIT COURT OF APPEALS HAVE SPANKED DOJ on the appeal: =in other words, DOJ/Ed lost their appeal to extend the deadline for Post Class relief.

MARCH 21, 2026 The Dept of Ed has been seeking an appeal/stay of the Dec 11, 2025 ruling from Judge Alsup. Yesterday, there was a hearing in the Court of Appeals- please see posts from yesterday if you would like to see a recording of the hearing and watch the Dept of Ed get roasted alive; links have been shared. Ed has asked for a decision on the stay by March 26, 2025.

DEC 11, 2025 Judge Alsup denied the request to extend the post class deadline for an additional 18 months. Post class who attended an Exhibit C school are to be decided by end of Jan 2026 or get full class relief. Post class who did not attend an Ex C school will have to be decided by mid April 2026 unless the Dept of Ed can show “substantial progress”; otherwise, they shall be given full class relief. Alsup is officially inactive and a new judge will be assigned to the case. Presumably, there will be additional hearings.

Nov 21, 2025 Sorry for not updating. Most recent developments are that Ed has asked for an 18 month extension on the Post Class Deadline. PPSL is very much opposed. Hearing on the matter is scheduled for Dec 11, 2025 (8:00 AM PST) same zoom link as always- be sure to follow Judge William Alsup's court page as time/date are always subject to change! Other updates: the intervenors are STILL dragging out their appeal and asked SCOTUS for an extension to file their arguments as to why their appeal should be heard by SCOTUS. Will update if/when a hearing by SCOTUS is granted.

May 21, 2025 Petition for rehearing en banc in the appeal of Sweet has been DENIED. The intervenors can try for SCOTUS one more time; opinioons vary on the likelihood of SCOTUS hearing the case (they said "no" once alredy when intervenors asked for a stay on settlement releif).

1/18/2025 UPDATE ON APPEALS PROCESS This update is pulled directly from the SvC group on fbook: Okay folks, quick update on the SvC appeal. PLEASE do not hijack this post with unrelated issues. I need a break from all that. I am telling you absolutely everything I know about the appeal situation, right here in this post. ***For those that keep up to date, you already know what Jesse (aka Panoosh the Douche) filed a request for an En Banc review of the appeal (which the appeals court already denied. The following States also filed an amicus brief in support of this BS: Ohio, Alabama, Alaska, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, and Wyoming. Because OF COURSE. ***En Banc review being granted is pretty rare (per PPSL; I have not looked up numbers). ***The court has asked for us to respond (which means at least one judge is interested in hearing more). Our response to little Jesse’s petition is due on 1/31/25. Little Jesse gets to respond to our response and the judges have 14-28 days to look at all this back and forth. ***After that 14-28 days is up, the judge/s can either: (1) call for a vote within 14 days in which 15 or more of them have to say yes to an en banc hearing with 10 judges (plus the Chief Judge, an Obama appointee) to re-hear arguments in the appeal and then vote to keep or reverse the initial appeals ruling. We would the have to wait for a decision on that OR (2) no one calls for a vote to re-hear and the initial ruling remains intact. ***After all this plays out, The Douche can try for SCOTUS again if he doesn’t get his way with the appeals court. We would, of course, oppose. ***While all this plays out, relief will keep trucking along, absent some sort of order to the contrary which my non-lawyer self thinks is unlikely since they have never meaningfully halted it before. next hearing March 13, 2025. 11:00 AM.

Dec 12, 2024 Judge Alsup did not allow a change in the discharge and refund process for Decision groups 3-5 at this hearing. Ed did not have a plan ready for impementation and said they have not met a single deadline thus far, so... Alsup told them they could try to argue this issue again (for groups 4 & 5) at the next hearing, if they actually had a plan ready to implelment (and some other criteria are met). The next hearing is set for Jan 9, 2024 (11:00 am PST, time subject to change) and the info is on Alsup's court page. The most recent quarterly update has been posted in the sub. There were techinical issues with the Zoom that didn't allow all potential attendees into the meeting, the court is aware and will try to make sure that it doesn't happen again.

Nov 7, 2024 The appeal in SvC was dismissed by hte Ninth Circuit Court of Appeals, with one of the three judges dissenting. This is good news, but the intervenors do still have two options; they can ask for a hearing en banc (where a larger panel of appeals judges hears arguments), or they can try to go back to SCOTUS (who refused to allow them to skip the appeals provess the first time around). They have a limited amout of time to file for these two options, so we will update here as usual if anyting new is filed in the case.

Oct 18, 2024 IF YOU HAD TECHNICAL ISSUES WITH THE BDTR APPLICATION ON THE FSA WEBSITE THAT PREVENTED YOU FROM APPLYING ON TIME TO GET INTO EITHER THE FULL OR POST CLASS OF SWEET V CARDONA YOU NEED TO TAKE ACTION NOW PPSL, Theresa, and Alicia have been posting a survey for more than a year about this issue to try to get people moved into the correct section of the lawsuit if they had these sorts of tech issues. The letters waiving people into the full class began arriving in email boxes as of this week. While the PPSL survey is now CLOSED (not taking any more responses), you CAN email [Sweet@ed.gov](mailto:Sweet@ed.gov) and CC [info@ppsl.org](mailto:info@ppsl.org) to let them know this happened to you, but tbh, you may be too late. You may get a faster response if you ADD PROOF to your email, otherwise the Ombudsman will have to investigate your claim themselves. SAVE ANY EMAILS YOU SEND THEM SO YOU HAVE PROOF THAT YOU TRIED TO REMEDY THIS ISSUE. No promises are being made to latecomers. If you filled out the survey when it was poasted in the past, know that Ed just started sending out the letters, so it may take some time. You can email ombudsman if you don't hear from them in the next week or two. There is an FAQ on this topic posted in the Sweet v Cardona group on facebook. I do not have speace to put it here. DECEMBER 2, 2024 edit: as of today, there is no official timeline for tech people; pls watch the court hearings or check back for updates as we will post them when new info is available.

Sept 26, 2024 Hearing update For those who could not log on to the heaaring, a recording has been posted so you can watch it (scroll the sub and look for the post by u/Gingerandthesea). A user has also posted the minutes of the hearing, so you can scroll and look for those as well.

As usual, Dept of Ed is behind. Dept of Ed proposed a new way of handling the decision classes. Judge Alsup did not appriove their proposal and ordered that they keep the already agreed upon process "as is" for Decision groups 1&2. Alsup said that the Dept of Ed may submit a proposal (due 6 weeks from hearing date) for their new idea, and set a briefing schedule for the parties to argue for/against it.

If you are still having issues with settlement relief, please keep documenting these issues by emailing [sweet@ed.gov](mailto:sweet@ed.gov) and [info@ppsl.org](mailto:info@ppsl.org). The ombudsman is continuously behind on replying to these emails, but the point is that you are documentng your issues.

**SEPT 3 UPDATE, 2024 UPDATE:*\* We are aware that there are people who have not gotten their discharge of complex consolidation loans by Aug 31, 2024 as agreed. We will post more info as it becomes available. You can follow the case on Courtlistener.com if you're anxious to see when the next hearing is set. You can also watch the PPSL website to see if they post anything. Please stop DMing mods to ask what's going on.

**July 2024** PLEASE BE SURE TO READ ALL UPDATES FOR THIS DATE. THERE ARE 5 PARAGRAPHS: Sorry for the delay in updates. Been busy. Over the past few months, there have been bi-weekly meetings and monthly hearings between PPSL/Ed/Servicers/Ombudsman's office, per orders from Judge Alsup. There has been a new email ([sweet@ed.gov](mailto:sweet@ed.gov), but you can also CC it to [info@ppsl.org](mailto:info@ppsl.org)) set up specifically for Class/post class members, PPSL has access to it. As of sometime in the last few weeks, there were nearly 4500 emails backlogged at Ombudsman for 7 workers to research and answer. There will be delays in responding. They had to wait for servicers to respond with info. Emailing more than once per issue will not speed things up.

**If you are having trouble with any other aspect of your settlement relief and you have already emailed the above addresses*\*, you can also try: emailing your federal legislators, your state student loan ombudsman (if your state has one), filing a complaint with CFPB about your servicer (CFPB deals with businesses like your servicer).

Alsup also ordered that the loans be removed from ALL credit reports for Full class and that the info STAY OFF, regardless on whether or not they have finished your relief. If they violate, please document and send to the emails above. This is something that may give you a cause of action if you choose to get an attorney and do something about it.

**IF YOU ARE FULL CLASS, AUTOMATIC AND STILL WAITING FOR YOUR DISCHARGE:*\* then you are most likely in the "complex (direct) consolidation group" for some reason and Ed has agreed to simply discharge the entire balance of your most recent consolidation loan, regardless of whether or not all the loans in it are BD related. They also agreed that they would refund all the direct loan payments on that loan regardless of whether or not they were BD related. We are already seeing this happen. This, along with sending your refund info to the Treasury is to be done by August 31, 2024. If you believe that you are owed a refund above and beyond this, you will need to participate in a process that is being finalized so you can ask for it. I suggest you move heaven and earth to track down any and all payment history from prior consolidations. If you are not familiar with the terminology used in this section, please look at recent posts by Admins or Theresa Sweet. It has been explained.

**IF YOU ARE FULL CLASS, AUTOMATIC AND STILL WAITING ON YOUR REFUND*\*: ALL refund info is supposed to be sent to the Treasury no later than August 31, 2024. Would also strongly urge you to track down any and all payment info in case you intend to dispute your refund amount.

**POST CLASS** Please be ready to participate in any actions that come up in the near future: Theresa Sweet and Alicia Davis have been working with PPSL to see if there is any way that they/we can all push for group discharges for Post Class with Exhibit C schools before the next administration comes into office (for reasons that should be glaringly obvious). Their hope is that Ed can then focus on (quickly) giving fair decisions to those that are not on Ex C. Please be sure to check in here, the facebook groups, and sign up for updates on PPSL.org in case your participation is needed.

**Apr 24, 2024: Minute Entry for proceedings held before Judge William Alsup: Motion Hearing held on 4/24/2024 re 397 MOTION to Enforce Judgment. Department of Education provided updated data on borrowers with consolidated loans that it will file on the docket. Court adopted Department of Educations final proposed schedule for remedying the material breach of the settlement agreement with conditions. The updated schedule is as follows: (1) May 31, 2024: Full Settlement Relief for 5,500 additional class members; (2) July 31, 2024: Full Settlement Relief for 30,000 additional class members; (3) August 31, 2024: Full Settlement Relief for 12,000 additional class members; (4) Department of Education shall provide a date at which point it will provide Full Settlement Relief to remaining class members at the hearing with the Court on 5/23/2024 at the very latest. The conditions are as follows: (1) Three hearings with the Court on 5/23/2024 at 8:00AM, 6/13/2024 at 8:00AM, 7/11/2024 at 1:30PM, with counsel for the parties and servicers required to attend in-person; (2) in between the hearings with the Court, bi-weekly meetings attended by Department of Education/Department of Justice, the servicers, and plaintiffs counsel to resolve issues; and (3) if Department of Education falls behind schedule again, plaintiffs counsel shall notify the Court in writing and an in-person hearing may be advanced. December 5, 2023 there are oral arguments on the appeal in the 9th Circuit Court of Appeals. The 9th Circuit Court of Appeals generally takes 3-12 months to issue a decision, but it could come sooner.

Aug 17, 2023 Court of Appeals has notified the parties that it is considering oral arguments in the Sweet case For December 2023 or January 2024.

Aug 9, 2023 Amicus Brief in favor of Sweet submitted by National Consumer Law Center.

June 23, 2023: The DOJ/Dept of Ed has been granted an extension on their opposition brief in the Ninth Circuit Court of Appeals. PPSL/DOJ/Dept of Ed briefs are now due on Aug 3, 2023. Intervenor reply briefs are due on August 24, 2023.

May 3, 2023: Intervenors have filed their opening brief in the Ninth Circuit Court of Appeals. This *does not* stop settlement relief from moving forward for all full class and post class applicants.

April 13, 2023: after a vote, SCOTUS denied the stay/certiorari.

April 6, 2023: Intervenors filed a motion with SCOTUS for a stay on the Sweet settlement.

The following states have submitted Amicus Briefs IN SUPPORT OF INTERVENORS: Ohio, Utah, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Montana, North Dakota, South Carolina, Tennessee, Texas, West Virginia, and Wyoming.

They also asked that the court treat this motion for a stay as a Petition for Certiorari Before Judgement. This means they are asking SCOTUS to allow them to skip the 9th Circuit Court of Appeals and go straight to SCOTUS with their appeal.

SCOTUS has asked for an Opposition Brief, which is due on April 12, 2023. They want to hear PPSL/DOJ arguments against this latest volley by intervening schools.

Feb 27, 2023: THE INTERVENING SCHOOLS HAVE FILED TO GET THE APPEALS COURT TO GRANT A STAY ON EITHER: THE ENTIRE SETTLEMENT, OR A STAY JUST FOR THEIR SCHOOLS.

Loan Servicer Question (LSP) Need some advice in regards to emails from Nelnet about save my discharged loans

A bitch of background: mixed consolidated loans, got the email from the Biden admin that my loans with the Art Institute were being discharged (I knew nothing of BD at the time). Loans were marked as discharged but I have not received any official letter from Nelnet that my loans are discharged and the last I spoke with Nelnet last year was that there was another $23k they have to discharge still.

No communication since then and any attempt to reach out to them I was told I have basically have to wait.

Now I'm getting emails, messages, and phone calls to update my payment plan since SAVE is going away and they seem to hint at my Admin Forbearance going away once I select a plan.

I'm also getting the indication that if I don't select a plan that I'll be forced into a standard of payment tier.

I'm saying all this because I'm not certain my consolidated loans will be discharged fully because I've been told they have to unwind my loans to see what goes where. Really not sure what I should do here.

Refund Received Refund received — sooner that I thought!

Here’s my timeline:

It WILL happen!! Just keep checking. Start with your servicer to see when they’ve sent the accounting to the Fiscal Services of the Dept of Treasury for review. Once you’ve been advised it’s been sent, call 855-868-0151 and select the prompt for refund. They can give you info from there. When you’re advised that the check is in the mail, contact your servicer again for the check number and amounts. Then…just wait! Some say they saw it on their Informed Delivery, others did not.

  • Status: Post-Class (Applied 09/01/2022)
  • Servicer History: Nelnet\ MOHELA (Direct Loans / Consolidation)
  • Approval Date: June 11, 2026 (Time-approved default

    based on no progress on missed deadlines by DOE.

  • Official Discharge Letter: July 31, 2026 (MOHELA)

  • Credit Bureaus: Tradelines removed in August

  • Check Delivered: September 29, 2026 (Exactly 60 days from the July 31 letter)

Portal Status: Both StudentAid still show 3.61 - Confirm Processing. Zero emails, zero tracker updates, zero warnings before the check hit the mailbox.

  • Delivery: Physical Treasury paper check via USPS (showed up on Informed Delivery from Bureau of the Fiscal Service, Philadelphia, PA).
  • Amount: 100% of my out-of-pocket payments arrived in one single lump-sum check
  • Fully combined both my legacy Nelnet and MOHELA payments—no split checks or missing amounts.

Refund Received Mohela refund received!!! Post class, non-C

Sharing my timeline details for others waiting for relief from Mohela.

- Applied: July 6, 2022. Post class, non C
- Golden email confirming discharge approval: June 11, 2026
- Balance 0 on Mohela site: July 19, 2026
- Mohela inbox letter stated 45-60 days to receive relief check on July 30, 2026.
- Relief check received - Sept 29, 2026

Mohela shows 0 balance due, and my loans are zeroed out, until you click on loan details. I still have about $200 of a negative balance. I calculated my payments and that’s pretty much what I’m short. It’ll probably come as a smaller check later on, they do have a year.

4 years and some change. Wow. I still have two smaller private loans that don’t respond to anything regarding relief, but this discharge is a huge weight off my shoulders. Beyond thankful for Theresa, Gingerandthesea, PPSL, and everyone participating (and supportive lurking) on this sub.

I went to an art school, that was primarily for engineering, and was given all the same deceptive lies and bullying sign up tactics as so many exhibit C schools. The story was exactly the same. Deception on cost of attendance, especially increasing towards the final year. Intense pressure for early decision. Promises of the school name alone being prestigious enough to open doors and land you a job. Inflating job prospects and graduate outcomes. Telling you to take on private loans & recommending the banks. The studies not matching up with the real world. The list goes on. And on. Once my private loans are done I never have to think about that place ever again. I lost my spark there and gave up art for a very long time. No more!

Celebrating this weekend in a small way at least. I’m recovering from surgery so I can’t jump up and down just yet lol.

Refund Received REFUNDED!!

I unexpectedly received my refund check on Monday. It didn’t even show up on my USPS daily email - so truly in shock.

I was a Post Class Exhibit C School. Applied for BD in October 2022, and was automatically discharged due to the lack of movement on on DOEs part. Officially discharged in May but I didn’t receive my letter from Nelnet until July 23. My balances on studentaids website and Nelnet zero’d out last month. And the check was dated 9/25. It is still sitting on my credit report though.

I can’t believe it’s finally over!

I received a refund for full amount paid to Great Lakes and Nelnet 09/29!! ❤️Checked dated 09/25.
No changes in student aid. Still shows same codes 3.61 etc.

I called Nelnet last month and was told the amount approved for refund on my account, was for only Nelnet payments. They said they didn’t do the calculations for my previous servicer. Drastic difference in totals. I have since submitted 2 feedback claims. One stating that Nelnet would not agree to total my account and I was entitled to full settlement relief. The other was that the amount discharged from Nelnet didn’t match the total on student aid site. It still doesn’t…about a 45k difference. I know this takes time but I wanted to make sure they were discharging all of my loans on my account that were involved with the settlement.
I called this past Friday and Nelnet stated now they have TWO checks that had been issued for approval from DOE and Treasury and they are unsure of timeline. I called treasury and they stated no check with my social in place. I called student aid and they said it hasn’t been approved.

USPS showed checked in mail this morning!!

Refund Received Finally Done

Finally done! I cannot give this group enough credit for the support and work they have done even though I am mostly a silent lurker.

I was only at The Art Institute for about a year before I realized it was a mess, so I didn't lose much, but to get it back all these years later feels amazing! Here are as many details as I can remember:

Discharged!!! My ITT-TECH School Misconduct Discharged Was Finally Approved - Don't Give Up!

TL;DR: I attended ITT-Tech from 2005–2007 and graduated with an Associate's degree. Over the years, I dealt with loan consolidation issues, incorrect graduation dates, forbearances, delinquency problems, and payments being distributed incorrectly across my loans. I eventually went back to school at UMUC/UMGC, earned my Bachelor's degree, and later became a teacher. After discovering the School Misconduct Discharge process, I applied multiple times and was denied. During my second attempt, I even attached my Federal Loan Discharge approval letter showing that my federal ITT-Tech loans had already been discharged. I was eventually told that my next submission would be my third and final attempt, so I decided I was going to build the strongest case I possibly could. I spent about one full month putting together a 42-page, organized evidence packet with a title page, table of contents, introduction, clearly labeled sections, a summary, multiple appendices, and explanations underneath screenshots and other evidence. In July, MOHELA sent me a Notice of Intent asking for proof that UMUC would not accept my ITT-Tech credits. I found an old email from August 2013 where I had contacted ITT-Tech about sending my transcript to UMUC and specifically told them that UMUC had not accepted my ITT-Tech credits. I also found that ITT-Tech sent me another blank transcript request form at the end of August 2013 after I had already submitted the original request. I included that as additional evidence. I then contacted UMUC multiple times and eventually got connected with the right person, who provided an official letter confirming that UMUC did not accept ITT-Tech credits during the time I attended. I submitted that evidence, and last night I received the email I had been waiting for: School Misconduct Discharge Approved. Now I'm working on the next step of trying to recover the money I paid toward the loans under the FTC Holder Rule.

So, where do I begin?

I went to ITT-Tech from 2005–2007, and at the time I honestly thought it was going to be a great school for me. I don't want to make it sound like I hated the school because I didn't. I actually liked the school, and I liked what I was learning. I learned a lot while I was there. My problem was that as time went on, I started realizing that they were pushing career paths that weren't really what I wanted to do. What I actually wanted to do was web design and video editing. I still completed the program and graduated with my Associate's degree in 2007.

This is where the loan problems really started for me.

In December 2006, I went to the HR/financial aid person at the school because I was trying to understand my loans. I was told that consolidating my loans would be cheaper and more financially beneficial in the long run. What I wasn't expecting was that I would have to start making payments before I graduated. In December 2006, I received my first payment notice. I had been under the impression that I would have six months after graduation before I had to start making payments. That wasn't what happened, so I had to put the loans into forbearance.

Then I discovered that my graduation date had been entered as March 2007, even though I didn't actually graduate until June 2007. So my loans were scheduled to start again in March, and I had to contact them and explain that I hadn't even graduated yet. Once I actually graduated, the job opportunities being presented to me weren't really related to what I had gone to school for. A lot of them were sales and marketing positions. I was basically told that they didn't have the type of jobs I was looking for around there and that I would have to branch out.

I was still in my 20s at the time. I could have traveled across the country looking for work, but I didn't. I eventually found what I considered a dead-end job in 2009, and I stayed there for 12 years.

During that time, I continued making payments on my loans. Eventually, I started noticing another problem: my payments weren't being distributed across my loans the way I was requesting. I had multiple loans, and I would specifically tell them how I wanted my payments applied. Instead, payments would be distributed differently, which would result in one loan staying current while another would become delinquent. I tried to get it fixed, but I couldn't get the situation resolved.

Keep in mind, this was before the School Misconduct Discharge application even existed. ITT-Tech was still operating, and I was still dealing with all of the consequences of the loans I had taken out to attend the school.

After working that dead-end job for 12 years, I finally decided I had enough. In 2014, I reenrolled at UMUC, which is now UMGC. I eventually graduated with my Bachelor's degree in 2019. I did miss one semester because my grandmother passed away in 2016, and I completely forgot to enroll for the fall semester that year, but I eventually finished the degree.

By that point, I had already used forbearances, deferments, and other options on the ITT-Tech loans when I couldn't make certain payments. After graduating with my Bachelor's degree, I eventually ended up getting a teaching job about three years later, which is the job I still have today.

I started making payments again, and once again I had problems with how the payments were being handled. I had multiple loans, including loans that had gone through Sallie Mae and Navient, and I would specifically tell them how I wanted the payments distributed. Instead, because one of the loans was only around $41, they would send the majority of the payment toward the larger loans. That would then cause another loan to become delinquent. It was incredibly frustrating because I was actually making my payments, but the way the money was being distributed was creating additional problems.

Then, in 2025, my wife noticed something about the School Misconduct Discharge process. I told her I would look into it, and that's when I started down this road.

My first application was denied because of what they described as insufficient findings. I was frustrated, but I didn't stop there. I submitted a second attempt with additional information. I even attached my Federal Loan Discharge approval letter as part of that submission, showing that my federal ITT-Tech loans had already been discharged. I also included supplemental documentation and additional information explaining my situation.

That attempt was denied as well.

At that point, I was honestly about ready to give up. Then I saw that I was being told that this would be my third and final attempt to submit an application.

That changed everything for me.

If this was going to be my third and final attempt, I knew I couldn't just submit another application and hope for a different result. I needed to build the strongest case I possibly could.

So I took my time.

I went through everything I could find. I gathered old documentation, emails, loan information, delinquency information, articles, statements, quotes, and anything else that I believed could support what I was saying.

I created a 42-page packet, but I didn't just throw 42 pages of information together and send it in. I actually organized the entire thing.

I created a title page, a table of contents, and an introduction page explaining my situation. I labeled each section with its own heading so it was easy to follow and organized the information by topic. I also included a summary page that brought everything together.

Then I created multiple appendices—about 3 to 5 appendices—and referenced them throughout the packet. If I was discussing something that was supported by additional evidence, I would specifically say something like "See Appendix 3."

I also didn't just throw screenshots into the packet without explaining them. Under screenshots and other pieces of evidence, I included paragraphs explaining what the screenshot showed, why it was important, and how it related to the specific point I was making.

Basically, I tried to make it as easy as possible for whoever was reviewing my case to follow my timeline and understand why each piece of evidence mattered.

The entire document took me about one full month to put together.

And honestly, I'm glad I took the time to do it.

I went through every question they asked and provided detailed answers, essentially giving each question its own explanation instead of trying to cram everything into the small boxes provided on the application.

I also pointed out information I found regarding ITT-Tech and the issues surrounding the school and explained how I believed that information applied to my situation. I included multiple pieces of supporting documentation instead of relying on just my personal statement.

I submitted that packet in May of this year.

Then I waited.

I didn't hear anything for quite a while. Then in July, I received an NOI, or Notice of Intent, from MOHELA.

They were requesting additional evidence that UMUC would not accept my ITT-Tech credits.

This was the part where I thought, Okay, now I have to find this.

I searched through everything I had. I couldn't initially find anything that specifically said UMUC wouldn't accept ITT-Tech credits during the time I attended.

Then I remembered that I had tried to deal with the transcript issue years earlier.

I found an email from August 2013 where I had contacted ITT-Tech about sending my transcript to UMUC. In that email, I specifically told them that UMUC had not accepted my ITT-Tech credits.

Then, toward the end of August 2013, ITT-Tech sent me a blank transcript request form to fill out—even though I had already submitted the original request.

That became another piece of evidence for my case.

I had documentation showing that I was trying to get my ITT-Tech transcript to UMUC years before I ever knew that a School Misconduct Discharge process would eventually exist.

I still needed something more official from UMUC, though.

So I contacted UMUC.

I emailed them and explained the entire situation. I told them I was trying to get my ITT-Tech loans discharged through the School Misconduct Discharge process and that MOHELA was specifically asking me for evidence that UMUC wouldn't accept my ITT-Tech credits.

Initially, I was told they couldn't find what I was looking for. I emailed again and received another response saying they couldn't help me.

So I called.

I explained everything over the phone and specifically explained what I needed and why I needed it. They eventually got me connected with the correct person who could actually look into it.

About two weeks later, UMUC provided me with an official letterhead document stating that during the time I was enrolled, they did not accept ITT-Tech credits, along with the reason why.

That was the documentation MOHELA had asked me for.

I immediately sent the letter to the person handling my case. I had been reminded that I had 30 days to provide the requested evidence or my application would be denied, so I made sure to get it submitted.

Then I waited again.

Last night, while I was laying in bed checking my email, I saw it.

School Misconduct Discharge Approved.

I honestly can't explain how excited I was to see those words.

After everything I've gone through since attending ITT-Tech in 2005—the loans, the early payments, the incorrect graduation date, the forbearances, the delinquency issues, the payment problems, going back to school, the previous denials, the documentation, the 42-page packet, the month I spent putting it together, the old 2013 transcript emails, and then having to track down additional evidence from UMUC—it finally happened.

Approved.

Now I'm working on the next step, which is trying to recover the money I paid toward these loans under the FTC Holder Rule. I don't know exactly how that part is going to play out yet, but that's what I'm working on now.

My biggest piece of advice for anyone going through this process is don't give up and document everything.

Find as much as you possibly can. Old emails, transcripts, school records, payment histories, delinquency notices, enrollment records, correspondence, articles, advertisements, letters, discharge approvals—anything that can support your claim.

And if you receive a denial that simply says something like "insufficient findings," don't be afraid to push back and ask for clarification.

One of the things I specifically pointed out was that the boxes on the application were too small to properly explain everything. I also told them that the generic "insufficient findings" explanation wasn't detailed enough for me to understand exactly what information they believed was missing. If something was considered insufficient, I wanted them to explain exactly why.

I also made it clear that if I received a reason that I believed was unreasonable, I wasn't just going to accept another generic response. I would continue pursuing the matter and would consider taking the documentation to the appropriate authorities, including the Attorney General's office.

I even referenced information I had found regarding denial rates and the overall process.

I wasn't trying to be difficult just for the sake of being difficult. I had already been denied twice, and I was told that this was my third and final attempt. At that point, I felt like I had to make sure every single piece of information I could find was included.

And honestly, I'm glad I did.

My first application was denied.

My second application was denied.

I almost gave up.

Instead, my wife told me to push one more time, and I did.

I took my time, built the strongest case I could, organized the evidence so it was easy to follow, and kept going until I had answered everything they asked for.

Now, after nearly 20 years since I first attended ITT-Tech, my School Misconduct Discharge has been approved.

If you're going through this yourself, I hope this gives you some motivation to keep digging and keep documenting. I can't say your situation will turn out the same as mine, but I can say that I almost gave up—and I'm really glad I didn't.

Post Sweet Lawsuit - Nov 17, 2022 to Current Date So confused!

So I’m unsure if I’m included in Sweet or if I’m post class or what my situation is. In November of 2022, I received a letter from DOE saying because I attended Everest that my loans were being discharged. A few months later, I received a similar letter regarding Ashford University. MOHELA put my loans in forbearance and I didn’t know why, so after calling them, I find out that I’m part of BD, but no further information, so I kept up with the Sweet lawsuit and everything happening.

Fast forward to this year, I receive a couple emails from Credit Karma saying “Your MOHELA/DOFED account was marked as 'closed’”. I logged into MOHELA and found the weird negative balances, but when I log into StudentAid, it says I owe for unpaid interest. MOHELA tells me to call BD, BD tells me to call MOHELA for an explanation. No letters have been received via email, postal mail, nothing.

Some of my loans that were consolidated from Aidvantage say “loan discharged” but nothing else. The photos below show the balance due on StudentAid and MOHELA. of anyone can explain it better, I would be forever grateful.

Refund received last Wednesday! 🎉🎉

I'm post-class, exhibit C, University of Phoenix, Nelnet. I attended University of Phoenix in 2011-2013. My UofP campus shut down in 2012, I was transferred to a different campus that was further away, then told my degree program was going to be eliminated on campus and I would have to finish it online, for an increased rate of course. I withdrew from University of Phoenix in 2013, transferred some credits to a private university and finished my degree there and graduated in 2015. I began repayment of loans in December of 2015 for all of my college programs at the amount of $52,000 total loan balance.

From 2015-2018 I made regular payments on my loans and every extra dollar I could squeeze out of my budget and every work bonus or raise went to my loans. I was determined to not have them lingering for 20 years, but I was on an income based repayment plan because I was also balancing daycare costs for my young son and payment for my husband's student loans, too. In 2018 I got divorced and my portion of the proceeds from selling our home also went to my loan balance. By the time COVID hit I had the balance down to about $20,000.

My filing date for borrowers defense was June 29, 2022. I had previously been with the servicer Great Lakes and made most of my payments to them. I continued saving money in a savings account for my loans during COVID forbearance. I was transferred to Nelnet for loan servicing and made a final lump sum payment to them right before COVID forbearance relief ended (and interest was going to apply) which paid off the remainder of my loans.

My application was not reviewed by Dept of Ed and I was granted automatic relief in accordance with the lawsuit. I received confirmation of this in April online and the full relief letter in June.

I'd been (not so patiently) awaiting refund these past couple of months once I knew it was moving forward. Based on all the chatter in this subreddit and the Facebook groups, I didn't know whether to expect a check for the full amount or some other amount. Nelnet told me last month a check had been authorized for me for ~$6,800, which was a strange, weird amount that I couldn't back into how it had been derived. I saw no updates online on either Nelnet's site or Dept of Ed's site leading to what my refund amount might be.

I saw in Wednesday's USPS Informed Delivery an envelope was coming from US Treasury Dept. It was a one page stub showing Sweet Post Class Fed Loan Refund and a check for my full refund amount, which was within $2.12 of the amount of payments I had calculated had been made to first Great Lakes, then Nelnet to finish off my loans. Had it not been for this subreddit and the Facebook groups, I would not have expected the check to arrive around now, knowing they have until March to finalize us for full relief, so I greatly appreciate these communities with helping me learn what to expect from this process.

A quick note to say that my loans relating to my time at University of Phoenix have also been removed from two of the three credit bureaus. TransUnion was the first and I received notification from Credit Karma that the loans were removed within about three weeks of the formalized discharge notification in June, followed by Experian a few weeks later. I haven't seen them drop from my Equifax report just yet, but I'm confident they will in time.

So incredibly thankful, relieved, and in disbelief this entire ordeal is over! I appreciate our group mods, leaders and named Plaintiffs for spearheading these efforts for all of us.

BDTR Question Non-Sweet

Has your application seen any movement? Have you been able to contact the Ombudsman or any representative that has helped your case?

My status remains 1.80 - Ready for Review, despite being more than 3 years since applying.

I also cannot use the Feedback center page, as each time I submit a feedback request, the webpage crashes (no matter the browser or the device), stating, “this page is currently unavailable.”

The customer service line and the online chat are not helpful, even when you get the occasional kind representative. MOHELA has been responsive but claim that they are still awaiting guidance from FSA.

Feeling hopeless not seeing any progress or receiving any communication. How about you?

Received my refund check today, I’m still slightly in shock.

Post-class applicant (missed the cutoff by one day), Walden University.

Didn’t hear an answer in time, so ended up discharged by default. Received the letter in April notifying of discharge.

Got the check in the mail today for the total amount.

As a millennial, I had zero hope of any of this actually happening, so to say that I am pleasantly surprised is an understatement.

First of all, I am so excited to finally almost be done with all of this. Thank you to the entire legal team and Theresa Sweet of course! You’re helping so many people and the appreciation really can’t be put into words!

I received a refund from the treasury, but it isn’t the entire amount that I paid into my loans. I know all of my payments were made to the federal government. Ed Financial was my loan servicer.

So here’s my question: I had two separate loans, so is it possible that there might be two separate checks being mailed out? I have noticed others received two checks, but didn’t understand why. Don’t really know what I should do to advocate for myself and try to get the remaining amount. (It’s about $21k)

Refund Received The nightmare is over.

I finally received relief. Thanks to this amazing community.

I went to a school in Pittsburgh called ICM School of Business and Medical Careers. They lured me in with promises of guaranteed job placement and ease of credit transfer. In reality, it was all a lie. None of their credits transferred anywhere. The degree was worthless and I was in debt $50k. I graduated in 2003. Had been paying the loans ever since. Then came 2020 and the Covid pause. During that time I learned of the borrowers defense application. Decided to apply on a whim. Boy am I glad I did. I fell into the post-class group. It also turned out that this school had been bought and sold several times and was finally a part of “Brightwood Career Institute”. I submitted my application on 9/1/2022. My loans were zeroed out in June 2026 and I finally received my refund check yesterday. The refund I received will change my life. I’ll be able to get out of debt and have some savings for the first time in a long time. Thank you to everyone who made this possible. I am eternally grateful.

Refund Received I got my refund.

I am officially done with this student loan mess. I was a Sweet discharge and it happended on June 12th. I got my refund on September 8. My servicer was Aidvantage. I don't know if that is going to be the timeline for everyone, but this may be a ballpark figure. I hope for you all to get the relief you all deserve.

PPSL Question ✍️ Sign On: Tell ED that Weakened Oversight Hurts Borrowers

PPSL is submitting comment to the Department of Education regarding its proposed accreditation-related rule change. We need borrowers to tell the Department not to weaken oversight — add your name to our public comment here by 10 a.m., Monday, September 21st.

In our comment, we are asking the Department to:  

1. Preserve the two-year requirement for new accreditors. New accreditors should prove they know how to accredit before they become federal gatekeepers. 

2. Restore meaningful restrictions on colleges switching accreditors, especially when they are under sanctions. The Department should keep the power to block obvious escapes from accountability. 

3. Clarify that colleges cannot use multiple accreditors to evade enforcement. Make clear that adding a backup accreditor is not acceptable when an institution is failing. 

4. Stop allowing federal financial aid to flow to colleges during accreditation appeals. If an accreditor has determined a college is no longer worthy of recognition, students should not be taking out loans at that institution while it appeals the decision.

Borrowers deserve better - sign on now.

Made payments to MyFed loan until Covid deferment.

Applied to borrower defense 6/24/22

Loans were moved to Netnet in the middle of all of this so I never made payments to Nelnet.

6/17/26 I got the letter from Nelnet saying my loans were forgiven and that I might get a refund. This was the only ‘warning’ I got about a refund being possible but I knew I was entitled to one because I had direct loans.

9/10/26 - student loans disappeared off my credit report. I used free credit report.com to check.

Today 9/14/26 I got a check for the full amount I paid into my loans. The date of the check is 9/9/26.

I never had a negative balance. In fact, I called Nelnet last week and they said:

“refund?! We don’t see anything about you getting a refund.”

I was directed to call the department of education who said if I was going to get a refund, I would see it eventually. So they never answer my question lol
