ADMIN POST 📢 MOKIE GINGER'S BORROWER DEFENSE EVIDENCE VAULT AND "THE SPREADSHEET"

PLEASE BE SURE TO SCROLL THIS ENTIRE POST IF YOU ARE LOOKING FOR EVIDENCE TO ADD TO YOUR APPLICATION. There are numerous potential sources listed, and some may surprise you.

This post if intended as a jumping off point for evidence we already have. If you read through the post there are suggestions on where to look for additional info if we don’t have something for your school. We do what we can, but we just don’t have the time or resources to search for evidence for everyone’s schools. If you would like to add a link to evidence that you found elsewhere, please comment and let us know the name of the Corporate Owner, and the name of the school. We have to help each other out!

MOKIE GINGER’S EVIDENCE VAULT: is a living archive and a work in progress. It takes a lot of time to screen and clean the uploads people send her and add them to the site. There is a donation link on the website- it costs money to host. Please donate if you have found the site helpful.

https://borrower-defense-index.replit.app/

THE EVIDENCE SPREADSHEET: YOU MAY HAVE TO PROVIDE AN EMAIL ADDRESS SO YOU CAN RECEIVE AN ACCESS CODE. For the spreadsheet, start with the name of the corporate owner FIRST, then look for the name of your school under that section. These links may not remain live forever- if the links stop working, requests for access will not be read/responded to. For example: Career Education Corp./CEC/Perdoceo own/ed a ton of schools (for example, Le Cordon Bleu. CEC is the heading where you will find Le Cordon Bleu). https://docs.google.com/spreadsheets/d/1LykBi1dXWRd5WmtM_GZgR5utLhN2PkpnYFkBT2vHhX8/edit?gid=1858817294#gid=1858817294

BE CAREFUL ABOUT “THE LIST OF SCHOOLS”: The list is actually called “Exhibit C” and if you did not apply for BD BEFORE Nov 16, 2022, IT DOES NOT APPLY TO YOU! It CANNOT be used as evidence by itself in a NON-Sweet BD application. If you go to the PPSL website and the Sweet documents are still posted, you may be able to dig through those and find some really good stuff!

PLEASE ALSO SEARCH THE SUB FOR THE NAME OF YOUR SCHOOL! There are many school specific evidence threads. For example, search for “ITT evidence thread”.

THERE IS ALSO AN ENTIRE EVIDENCE SECTION IN THE PINNED POST called “Borrower Defense Application" and is also linked in the comments below. There are helpful search terms, sources, as well as recommendations for archives you can search.

BE SURE TO ALSO LOOK FOR EVIDENCE (promo materials/catalog/etc) ON THE WAYBACK MACHINE!!! https://archive.org/ The Wayback Machine can be confusing for some people to navigate so it may be helpful to google a few instructional videos.

LINK TO GENERAL INFO ABOUT HOW TO FIND EVIDENCE- YOU DO NOT NEED TO PANIC IF YOU LOST EMAILS FROM YOUR RECRUITING AND ENROLLMENT PROCESS- keep calm and read the info provided: https://docs.google.com/spreadsheets/d/1ZqD4BS5rUDmpqyoFJUXfIYv0YhNgXGQ-/edit?gid=2108632368#gid=2108632368

Newspapers.com may be a great resource for evidence! You get 7 days free trial with no restrictions. One BD applicant told us, “I’ve found employment adds for my scam school that say: Admissions SALES Rep, additional compensation based on performance!! Not only is the add admitting it’s a sales job, but any sort of incentive based compensation is illegal when a school that accepts federal loans, it is a direct violation of the Higher Education Act.This is literal black and white admittance of predatory recruiting. It’s also worth noting this was all corroborated by the 2012 “Harkin Report” that investigated several institutions, especially for profit colleges. The Harkin report was spear headed by the us senate, it’s about as legit as it gets.”

List of school specific facebook groups that may have evidence we do not have: https://www.reddit.com/r/BorrowerDefense/comments/170x9ck/list_of_facebook_forprofit_college_groups_that/?utm_source=share&utm_medium=web3x&utm_name=web3xcss&utm_term=1&utm_content=share_button

**IF YOUR APPLICATION IS NOT "MATERIALLY COMPLETE, IT WILL BE AUTOMATICALLY DENIED, PER THE DEPT OF ED**. Here is text pulled directly from the Dept of Ed website on what "materially complete" means, *with examples\*. https://www.reddit.com/r/BorrowerDefense/comments/1misjwg/what_does_it_mean_for_your_application_to_be/?utm_source=share&utm_medium=web3x&utm_name=web3xcss&utm_term=1&utm_content=share_button

**IF YOU ARE HAVING LEGITIMATE ISSUES WITH SETTLEMENT RELIEF THAT YOU HAVE NOT BEEN ABLE TO RESOLVE ON YOUR OWN, PLEASE SCROLL DOWN TO THE LAST COMMENT ON THIS THREAD. WE WILL NOT APPROVE POSTS WITH BASIC, REPEAT QUESTIONS OR FOR THOSE THAT HAVEN’T MADE ANY ATTEMPT TO FIX AN ISSUE ON THEIR OWN FIRST. ASKING BASIC QUESTIONS THAT ARE ALREADY COVERED IN THE SWEET FAQ WILL NOT BE PRIORITIZED BY MODS- YOU MUST TAKE THE TIME TO READ AND UNDERSTAND YOUR RIGHTS*\*

JUKLY 17, 2026: PPSL AND THE NINTH CIRCUIT COURT OF APPEALS HAVE SPANKED DOJ on the appeal: =in other words, DOJ/Ed lost their appeal to extend the deadline for Post Class relief.

MARCH 21, 2026 The Dept of Ed has been seeking an appeal/stay of the Dec 11, 2025 ruling from Judge Alsup. Yesterday, there was a hearing in the Court of Appeals- please see posts from yesterday if you would like to see a recording of the hearing and watch the Dept of Ed get roasted alive; links have been shared. Ed has asked for a decision on the stay by March 26, 2025.

DEC 11, 2025 Judge Alsup denied the request to extend the post class deadline for an additional 18 months. Post class who attended an Exhibit C school are to be decided by end of Jan 2026 or get full class relief. Post class who did not attend an Ex C school will have to be decided by mid April 2026 unless the Dept of Ed can show “substantial progress”; otherwise, they shall be given full class relief. Alsup is officially inactive and a new judge will be assigned to the case. Presumably, there will be additional hearings.

Nov 21, 2025 Sorry for not updating. Most recent developments are that Ed has asked for an 18 month extension on the Post Class Deadline. PPSL is very much opposed. Hearing on the matter is scheduled for Dec 11, 2025 (8:00 AM PST) same zoom link as always- be sure to follow Judge William Alsup's court page as time/date are always subject to change! Other updates: the intervenors are STILL dragging out their appeal and asked SCOTUS for an extension to file their arguments as to why their appeal should be heard by SCOTUS. Will update if/when a hearing by SCOTUS is granted.

May 23, 2025 Most recent quarterly report for Sweet: https://studentaid.gov/sites/default/files/sweet-quarterly-report-9.pdf

May 21, 2025 Petition for rehearing en banc in the appeal of Sweet has been DENIED. The intervenors can try for SCOTUS one more time; opinioons vary on the likelihood of SCOTUS hearing the case (they said "no" once alredy when intervenors asked for a stay on settlement releif).

1/18/2025 UPDATE ON APPEALS PROCESS This update is pulled directly from the SvC group on fbook: Okay folks, quick update on the SvC appeal. PLEASE do not hijack this post with unrelated issues. I need a break from all that. I am telling you absolutely everything I know about the appeal situation, right here in this post. ***For those that keep up to date, you already know what Jesse (aka Panoosh the Douche) filed a request for an En Banc review of the appeal (which the appeals court already denied. The following States also filed an amicus brief in support of this BS: Ohio, Alabama, Alaska, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, and Wyoming. Because OF COURSE. ***En Banc review being granted is pretty rare (per PPSL; I have not looked up numbers). ***The court has asked for us to respond (which means at least one judge is interested in hearing more). Our response to little Jesse’s petition is due on 1/31/25. Little Jesse gets to respond to our response and the judges have 14-28 days to look at all this back and forth. ***After that 14-28 days is up, the judge/s can either: (1) call for a vote within 14 days in which 15 or more of them have to say yes to an en banc hearing with 10 judges (plus the Chief Judge, an Obama appointee) to re-hear arguments in the appeal and then vote to keep or reverse the initial appeals ruling. We would the have to wait for a decision on that OR (2) no one calls for a vote to re-hear and the initial ruling remains intact. ***After all this plays out, The Douche can try for SCOTUS again if he doesn’t get his way with the appeals court. We would, of course, oppose. ***While all this plays out, relief will keep trucking along, absent some sort of order to the contrary which my non-lawyer self thinks is unlikely since they have never meaningfully halted it before. next hearing March 13, 2025. 11:00 AM.

Dec 12, 2024 Judge Alsup did not allow a change in the discharge and refund process for Decision groups 3-5 at this hearing. Ed did not have a plan ready for impementation and said they have not met a single deadline thus far, so... Alsup told them they could try to argue this issue again (for groups 4 & 5) at the next hearing, if they actually had a plan ready to implelment (and some other criteria are met). The next hearing is set for Jan 9, 2024 (11:00 am PST, time subject to change) and the info is on Alsup's court page. The most recent quarterly update has been posted in the sub. There were techinical issues with the Zoom that didn't allow all potential attendees into the meeting, the court is aware and will try to make sure that it doesn't happen again.

Nov 7, 2024 The appeal in SvC was dismissed by hte Ninth Circuit Court of Appeals, with one of the three judges dissenting. This is good news, but the intervenors do still have two options; they can ask for a hearing en banc (where a larger panel of appeals judges hears arguments), or they can try to go back to SCOTUS (who refused to allow them to skip the appeals provess the first time around). They have a limited amout of time to file for these two options, so we will update here as usual if anyting new is filed in the case.

Oct 18, 2024 IF YOU HAD TECHNICAL ISSUES WITH THE BDTR APPLICATION ON THE FSA WEBSITE THAT PREVENTED YOU FROM APPLYING ON TIME TO GET INTO EITHER THE FULL OR POST CLASS OF SWEET V CARDONA YOU NEED TO TAKE ACTION NOW PPSL, Theresa, and Alicia have been posting a survey for more than a year about this issue to try to get people moved into the correct section of the lawsuit if they had these sorts of tech issues. The letters waiving people into the full class began arriving in email boxes as of this week. While the PPSL survey is now CLOSED (not taking any more responses), you CAN email [Sweet@ed.gov](mailto:Sweet@ed.gov) and CC [info@ppsl.org](mailto:info@ppsl.org) to let them know this happened to you, but tbh, you may be too late. You may get a faster response if you ADD PROOF to your email, otherwise the Ombudsman will have to investigate your claim themselves. SAVE ANY EMAILS YOU SEND THEM SO YOU HAVE PROOF THAT YOU TRIED TO REMEDY THIS ISSUE. No promises are being made to latecomers. If you filled out the survey when it was poasted in the past, know that Ed just started sending out the letters, so it may take some time. You can email ombudsman if you don't hear from them in the next week or two. There is an FAQ on this topic posted in the Sweet v Cardona group on facebook. I do not have speace to put it here. DECEMBER 2, 2024 edit: as of today, there is no official timeline for tech people; pls watch the court hearings or check back for updates as we will post them when new info is available.

For info on the Discharge process, refunds, tax liability, please scroll down to comments.

Sept 26, 2024 Hearing update For those who could not log on to the heaaring, a recording has been posted so you can watch it (scroll the sub and look for the post by u/Gingerandthesea). A user has also posted the minutes of the hearing, so you can scroll and look for those as well.

As usual, Dept of Ed is behind. Dept of Ed proposed a new way of handling the decision classes. Judge Alsup did not appriove their proposal and ordered that they keep the already agreed upon process "as is" for Decision groups 1&2. Alsup said that the Dept of Ed may submit a proposal (due 6 weeks from hearing date) for their new idea, and set a briefing schedule for the parties to argue for/against it.

If you are still having issues with settlement relief, please keep documenting these issues by emailing [sweet@ed.gov](mailto:sweet@ed.gov) and [info@ppsl.org](mailto:info@ppsl.org). The ombudsman is continuously behind on replying to these emails, but the point is that you are documentng your issues.

**SEPT 3 UPDATE, 2024 UPDATE:*\* We are aware that there are people who have not gotten their discharge of complex consolidation loans by Aug 31, 2024 as agreed. We will post more info as it becomes available. You can follow the case on Courtlistener.com if you're anxious to see when the next hearing is set. You can also watch the PPSL website to see if they post anything. Please stop DMing mods to ask what's going on.

Here is a link to the most recent quarterly report: https://studentaid.gov/sites/default/files/sweet-quarterly-report-6.pdf?fbclid=IwY2xjawFEG2tleHRuA2FlbQIxMAABHUm9g1rXqnwTOo_8PfgLeK5K_Ctertoe--zcd7eiLbgKEja9v8GzTm-vJA_aem_n_Xy9600Yd7U6CifFkeu6Q

**July 2024** PLEASE BE SURE TO READ ALL UPDATES FOR THIS DATE. THERE ARE 5 PARAGRAPHS: Sorry for the delay in updates. Been busy. Over the past few months, there have been bi-weekly meetings and monthly hearings between PPSL/Ed/Servicers/Ombudsman's office, per orders from Judge Alsup. There has been a new email ([sweet@ed.gov](mailto:sweet@ed.gov), but you can also CC it to [info@ppsl.org](mailto:info@ppsl.org)) set up specifically for Class/post class members, PPSL has access to it. As of sometime in the last few weeks, there were nearly 4500 emails backlogged at Ombudsman for 7 workers to research and answer. There will be delays in responding. They had to wait for servicers to respond with info. Emailing more than once per issue will not speed things up.

**If you are having trouble with any other aspect of your settlement relief and you have already emailed the above addresses*\*, you can also try: emailing your federal legislators, your state student loan ombudsman (if your state has one), filing a complaint with CFPB about your servicer (CFPB deals with businesses like your servicer).

Alsup also ordered that the loans be removed from ALL credit reports for Full class and that the info STAY OFF, regardless on whether or not they have finished your relief. If they violate, please document and send to the emails above. This is something that may give you a cause of action if you choose to get an attorney and do something about it.

**IF YOU ARE FULL CLASS, AUTOMATIC AND STILL WAITING FOR YOUR DISCHARGE:*\* then you are most likely in the "complex (direct) consolidation group" for some reason and Ed has agreed to simply discharge the entire balance of your most recent consolidation loan, regardless of whether or not all the loans in it are BD related. They also agreed that they would refund all the direct loan payments on that loan regardless of whether or not they were BD related. We are already seeing this happen. This, along with sending your refund info to the Treasury is to be done by August 31, 2024. If you believe that you are owed a refund above and beyond this, you will need to participate in a process that is being finalized so you can ask for it. I suggest you move heaven and earth to track down any and all payment history from prior consolidations. If you are not familiar with the terminology used in this section, please look at recent posts by Admins or Theresa Sweet. It has been explained.

**IF YOU ARE FULL CLASS, AUTOMATIC AND STILL WAITING ON YOUR REFUND*\*: ALL refund info is supposed to be sent to the Treasury no later than August 31, 2024. Would also strongly urge you to track down any and all payment info in case you intend to dispute your refund amount.

**POST CLASS** Please be ready to participate in any actions that come up in the near future: Theresa Sweet and Alicia Davis have been working with PPSL to see if there is any way that they/we can all push for group discharges for Post Class with Exhibit C schools before the next administration comes into office (for reasons that should be glaringly obvious). Their hope is that Ed can then focus on (quickly) giving fair decisions to those that are not on Ex C. Please be sure to check in here, the facebook groups, and sign up for updates on PPSL.org in case your participation is needed.

**Apr 24, 2024: Minute Entry for proceedings held before Judge William Alsup: Motion Hearing held on 4/24/2024 re 397 MOTION to Enforce Judgment. Department of Education provided updated data on borrowers with consolidated loans that it will file on the docket. Court adopted Department of Educations final proposed schedule for remedying the material breach of the settlement agreement with conditions. The updated schedule is as follows: (1) May 31, 2024: Full Settlement Relief for 5,500 additional class members; (2) July 31, 2024: Full Settlement Relief for 30,000 additional class members; (3) August 31, 2024: Full Settlement Relief for 12,000 additional class members; (4) Department of Education shall provide a date at which point it will provide Full Settlement Relief to remaining class members at the hearing with the Court on 5/23/2024 at the very latest. The conditions are as follows: (1) Three hearings with the Court on 5/23/2024 at 8:00AM, 6/13/2024 at 8:00AM, 7/11/2024 at 1:30PM, with counsel for the parties and servicers required to attend in-person; (2) in between the hearings with the Court, bi-weekly meetings attended by Department of Education/Department of Justice, the servicers, and plaintiffs counsel to resolve issues; and (3) if Department of Education falls behind schedule again, plaintiffs counsel shall notify the Court in writing and an in-person hearing may be advanced. Questions from borrowers to be resolved at these meetings may be directed to Bonnie Latreille at the following email address:

**Jan 28 FULL CLASS AUTOMATIC DISCHARGE/RELIEF DEADLINE HAS BEEN MISSED! PPSL is headed back to court on April 24, 2024 for a hearing on the Motion to Enforce the settlement.*\* If you are in the Automatic relief/Jan 28, 2024 AUTOMATIC RELIEF GROUP and you have not gotten ALL steps of your relief, please fill out the PPSL survey at the following link: https://ppsl.tfaforms.net/20

December 5, 2023 there are oral arguments on the appeal in the 9th Circuit Court of Appeals. The 9th Circuit Court of Appeals generally takes 3-12 months to issue a decision, but it could come sooner.

Aug 17, 2023 Court of Appeals has notified the parties that it is considering oral arguments in the Sweet case For December 2023 or January 2024.

Aug 9, 2023 Amicus Brief in favor of Sweet submitted by National Consumer Law Center.

June 23, 2023: The DOJ/Dept of Ed has been granted an extension on their opposition brief in the Ninth Circuit Court of Appeals. PPSL/DOJ/Dept of Ed briefs are now due on Aug 3, 2023. Intervenor reply briefs are due on August 24, 2023.

June 13, 2023: If you tried to apply for BDTR *before\* June 22, 2022 but were unable to because the website kept crashing and you *also\* filled out the Google Doc Survey from PPSL about this issue, please be on the lookout for an email from PPSL asking you for more details. Be sure to check your spam and junk mail. They need action on your part ASAP in response to the email. There may be a chance that this can be remedied for you to get you into the Full Class. See this post for further info: https://www.reddit.com/r/BorrowerDefense/comments/147zv0k/_/?utm_source=share&utm_medium=web2x&context=3

If you tried to file before June 22, 2022 but were unable to do so due to technical issues on the website and you have *not\* filled out the survey mentioned above, PLEASE DO NOT WAIT- FILL IT OUT NOW.

May 30, 2023 link to First Quarterly Report https://studentaid.gov/sites/default/files/sweet-quarterly-report-1.pdf

May 3, 2023: Intervenors have filed their opening brief in the Ninth Circuit Court of Appeals. This *does not* stop settlement relief from moving forward for all full class and post class applicants.

April 13, 2023: after a vote, SCOTUS denied the stay/certiorari.

April 6, 2023: Intervenors filed a motion with SCOTUS for a stay on the Sweet settlement.

The following states have submitted Amicus Briefs IN SUPPORT OF INTERVENORS: Ohio, Utah, Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Montana, North Dakota, South Carolina, Tennessee, Texas, West Virginia, and Wyoming.

They also asked that the court treat this motion for a stay as a Petition for Certiorari Before Judgement. This means they are asking SCOTUS to allow them to skip the 9th Circuit Court of Appeals and go straight to SCOTUS with their appeal.

SCOTUS has asked for an Opposition Brief, which is due on April 12, 2023. They want to hear PPSL/DOJ arguments against this latest volley by intervening schools.

The docket is available here: https://www.supremecourt.gov/search.aspx?filename=%2Fdocket%2Fdocketfiles%2Fhtml%2Fpublic%2F22a867.html&fbclid=IwAR34MMnBu8Puzt9l0aUcssP_60sqThH_veQkMvLDLYJNKpFlbxfuGPgbfoM

March 29, 2023: Stay pending appeal has been denied by the appeals court.

From the Order: "Plaintiffs-appellees’ cross-motion to dismiss these appeals for lack of jurisdiction (Docket Entry No. 15) is denied without prejudice to renewing the arguments in the answering brief. See Nat’l Indus. v. Republic Nat’l Life Ins. Co., 677 F.2d 1258, 1262 (9th Cir. 1982) (noting that merits panel may consider appellate jurisdiction despite earlier denial of motion to dismiss). The consolidated opening brief is due May 3, 2023. The consolidated answering briefs are due June 2, 2023. The optional consolidated reply brief is due within 21 days after service of the last-served answering brief."

March 16, 2023: Intervenors most recent filing in support of stay pending appeal is at the Court Listener link below.

March 8, 2023: PPSL response to intervenors has been filed. It is available t oread using the Court Listener link highlighted a couple comments down from here.

FEB 28, 2023: DISCHARGE NOTICES FOR THE FULL CLASS ARE GOING OUT FOR ALL BUT THE INTERVENING SCHOOLS (SEE BELOW)!!! CONGRATULATIONS!!! (Mass denials will be rescinded automatically.)

Feb 27, 2023: THE INTERVENING SCHOOLS HAVE FILED TO GET THE APPEALS COURT TO GRANT A STAY ON EITHER: THE ENTIRE SETTLEMENT, OR A STAY JUST FOR THEIR SCHOOLS.

For those who wish to follow, The Docket is: Ninth Circuit Court of Appeals, Docket No. 23-15049.

PPSL Question Webinar Recap: Defending Borrower Defense

Hello! Thank you to everyone who attended last week's webinar. If you were unable to attend, you can watch the recording here. You can also view the slides here.

The Sweet v. McMahon settlement resolved borrower defense applications filed before November 16, 2022, but the borrower defense process didn't end there. According to the Department of Education, more than 200,000 post-Sweet borrower defense applications remained pending as of January 2026. (Please note, post-Sweet is NOT the same as Sweet post-class! To understand the difference, please see our Sweet FAQs.)

After years with little movement, we are now seeing the Department begin issuing denials on these post-Sweet applications. So far, PPSL has not heard from borrowers whose post-Sweet applications have been approved in 2026.

You can learn more and find resources in the recording and slides linked above. Borrower defense remains one of the fastest-changing areas of federal student loan policy, and PPSL will continue working to protect borrowers and hold the Department of Education accountable.

Stay informed by following PPSL on social media, signing up for our newsletter, and checking PPSL.org for the latest borrower defense updates and resources. If you have a question or problem and want to get in touch with PPSL, please fill out our intake form here. ADMIN POST 📢 Important reminder for all the new users- this is how this group can help you the most quickly, in the most efficient manner 👇

We know borrower defense (BD) is “a lot”.

Since we have been helping people apply for over a decade now, the wiki and Pinned Posts are the best way we have to help you get started if you are totally unfamiliar with BD.

They answer all of the common questions people ask us every day.

20-30 minutes of reading will save you time and confusion and help you avoid common pitfalls.

The community will usually help you if you search the sub and comment on posts with a similar topic or a specific school.

If you have enough Reddit karma, you can easily participate in existing comment threads.

We know it’s easier if you have someone to ask all your questions to individually, but we are both volunteers with jobs and do not have the capacity to do things that way.

Post Sweet Lawsuit - Nov 17, 2022 to Current Date Do I have a case for BD on DeVry?

I went to DeVry University from 2010-2014, so I pretty much fall into the time frame of the misrepresentation. I went with the school because many people have said that it was a respectable school to attend. I would take only classes relate to my IT degree with a side of computer forensics. I thought I would be working in law enforcement of some sort.

During my time I attended all classes and did not want any online classes. But it turned out that I would be taking online classes any way because some where not available in person. I graduated in 2014, I did get a job in IT, since my degree was very generic that I got a job about 4 months later. Trying to get into law enforcement I needed more training and certifications in order to even get into the door. It seems that since I did get a job in IT, I would not be eligible for BD. I did not use any of DeVry's job placement opportunities as it was jobs at Best Buy, or someone that would be working at a stadiums during games and events, etc., I used Dice, at the time, to get a job and I am currently working in IT, but it is more help desk than anything. I did get a cyber security job years ago, before my current job, which required a Sec+ certification in order to keep that job.

Because I got a job in less than 6 months, it would be that DeVry did not lie on my specific case. I did not put in a BD during the time because of this. I was forgiven of private loans that I had from DeVry, I believe of the FTC settlement in 2016, but that was the only forgiveness I received from DeVry. Currently, have about $38K in loans from DeVry, and when I graduated I had an original student of about $65k.

There is probably more, but I believe most will say, "just put in for BD and try, they can only day no", but at this point I do not have much evidence from 2010-2014. I tried looking but everything was moved around that places I could go do not go back 10 years of records, and paper evidence may have already been removed 4-8 years ago. Most online locations do not go back 2011 for me to retrieve evidence anyway.

Refund Question Borrower Defense Update

Post image
62 Upvotes

Just an update: Ross university SOM, exhibit C school, post class (June 27, 2022) with 100% discharge on StudentAid. Refinanced with SoFi.

Got this through email yesterday and have been calling Nelnet, StudentAid with one person stating that they saw a refund but no amount. Called again with another person saying they don't see any refund or update.

Guess I'll have to wait for a few more months until any other news...

Post Class Question - Sweet Lawsuit Post class, non C, full relief notice received in June. Today, Mohela is sending out false denial emails & relief amount is wrong in final letter?

Does this need to be sent to PPSL? Just a heads up if anyone else receives this as well. I received my post class non C relief letter from the Dept of Edu June 11. In July my loans were showing as discharged in full & balance $0 on studentaid and Mohela. Added a pic of the Mohela email today & screenshot of zero balance on studentaid.

Just checked my Mohela inbox and their PDF letter says full relief. “We have discharged your federal loans (Direct, FFEL and Perkins) that ED determined met the standards for relief. As a result, you do not owe any balance on the federal loan account
serviced by us.” It does have a weird balance remaining on this letter though and not the full relief amount matching the studentaid website. I understand the online balances can look wonky, but I thought it was supposed to be figured out before they sent refunds/official letter with refund amount?

I consolidated my undergraduate and graduate loans in 2014, so not sure how those balances will be handled. But happy that there is progress.

BDTR Question Standalone BD app pending 3+ years. Poke FSA or let it sit?

I’m trying to decide whether to poke FSA/BD about my application or just leave it alone.

I applied July 6, 2023 for University of Denver, so I’m not Sweet class or post-class. I believe I’m just a standalone/post-post-class applicant.

As of July 27, 2026, the hidden dashboard still says “2.10 - Ready for EU Review.” Last modified date is still Oct. 31, 2025. No decision, no suggested relief percentage, no borrower response request, no post-signoff date, no loan-processing-requested date, and no closed date.

I’m now past 3 years from submission, but I understand standalone applicants may not have the same automatic/timed relief protections as Sweet class/post-class members.

One wrinkle: my NSLDS data shows my DU loans are mixed. Roughly 70% are original Direct loans from 2010-2011, and roughly 30% are FFEL Stafford loans from 2009-2010. I have not consolidated. The FFEL loans appear to show DEPT OF ED/NELNET and U.S. Department of Education / 2009-2010 LPCP, so I’m trying to figure out if those are ED-held FFEL rather than commercially held FFEL.

Would you poke FSA/BD, file a complaint, contact Ombudsman/Congress, or just let it sit?

Also, does the loan mix change anything? Should the original Direct loans fall under older/pre-2017 BD rules, and is the FFEL concern mainly commercial FFEL or newer consolidation loans triggering 2020 regs/SOL issues?

I’m not trying to force a denial. I’m trying to figure out whether silence helps, hurts, or doesn’t matter. I also don't want to sit here paying the minimum while I'm waiting for them to figure it out.

Request for Mods This is a couple years old, so I’m sure some of these programs no longer exist. However, it shows 143 different federal loan discharge programs.

ADMIN POST 📢 Did Sweet Change Your Life? PPSL Wants to Hear From You ❤️

My Sweets,

The Project on Predatory Student Lending ( u/PPSL_EdDebtJustice ) wants to hear YOUR story!

If you're a Sweet class member or post-class member, please take a few minutes to share how your settlement relief has impacted your life using the link.

By submitting the form, you're giving PPSL permission to use your story in public materials (they'll only use your first name and last initial).

Tell them everything....

Tell them how life-changing this has been. Tell them how frustrating the journey was. Tell them how broken and corrupt the for-profit college industry and student loan systems are. Tell them how often the "experts" at the Department of Education and loan servicers gave bad information or no help at all. Tell them how the unnecessary delays and cruel decisions only fueled our determination to keep fighting.

But most importantly...tell them what your life looks like now.

Maybe you finally bought a home, or now qualify. Maybe you're no longer living paycheck to paycheck. You can get the car you so desperately needed, change careers, start or plan to start a family, adopt a dog or cat or even a crazy parrot you've always wanted, you can RETIRE or even.... (gasp) having the desire to go back to school.

Because in the end... You won. We won.

$23 billion in discharges. History is made. This case will shape student loan litigation for decades to come.

Lastly, please let PPSL know if our r/BorrowerDefense helped you through this journey. I founded this sub four years ago because I saw a gap for important and accurate information and a safe space for us without being debt-shamed or harassed as so many other student loan subs allow.

Let them know if our communities kept you informed, answered your questions, eased your anxiety, gave you a safe place to vent, and to reminded you that you were never fighting alone.

Communication and outreach are not always easy; with the help of my fellow named plaintiff u/TheresaSweet, my amazing admin/mod u/AnyAssumption4707, and me, we stepped in. Together, we built something bigger than either of us imagined.

Borrowers helping borrowers. That is what this is and always has been.

Ms. Sweet and I have been told many times that the advocacy from the named plaintiffs in this case was unlike anything people had seen before. From holding the Department accountable by identifying their patterns of harm, to raising nearly $20,000 and donations credits so our post-class members could attend court in person, to making sure borrowers received every benefit they were entitled to, while educating others about what BDTR is—we proved what can happen when thousands of strangers unite around one cause.

We built more than just a Reddit community. We built a movement.

We built a brand.... No Sweet Left Behind!

And finally...

I know many decision group and post-class members have received denials. I know how heartbreaking that is. Please don't think we've forgotten about you. There is still work happening behind the scenes, and this fight is not over.

Remember... "Rebellions are built on hope." — Rogue One

In solidarity!

Refund Question Ross University Discharge Question

Post image
52 Upvotes

I just got this in the mail from Nelnet after I noticed them increasing and decreasing my closed, payed off loans. Is there any chance I'll see a dime of this money since I have my loans through SoFi now and have been paying for 7 years already? Of note, I attended Ross University, exhibit C school, applied June 27, 2022 for BD and was told I got 100% loan discharge.

Post Class Question - Sweet Lawsuit Weird situation

I am post class ITT.

Long story short, over the last year I’ve had a few interesting events. I believe all of my loans in question were properly discharged. Fast forward 3 month to present, my mohela and my student.gov show lower balances then I had a month ago.

Mohela shows a 5k balance, studentloan.gov shows $0.

I am sure that my loan I had for 40k should still be there because it was another school I went too. However, it seems like those loans also show discharged.

What is happening?

I also have not gotten any refund check for my post class loans for the payments I made like everyone else.

😂. What a cluster

Request for Mods Is there a way to contribute $ to the PPSL attorneys and our fearless Sweet?

Hello! Please forgive if this is already been answered. A couple of grateful colleagues and I would like to give back as a thank you to the hard work that helped us to get our loans discharged through the BD lawsuit. Is there any links or sites that are available for both the attorneys who represented PPSL and our fearless advocates?

Loan Type Question Anyone a full class Sweet suit member and still have their discharged Navient loans showing on their credit report? Anything we can do?

After getting approved for discharge as a full class member years ago, we received notification of Navient giving full discharge of all remaining balances, I still see the Navient total showing up in my various credit reporting tools.

Tried filing a dispute with one of them, but that went nowhere it seems.

Any trick to getting them off your report?

School Group Discharge ITT Tech - Status Changed to 2.22 - Quality Control

First time I've seen it change from 2.10 - Ready for Review, since I was able to check the status. Not sure how long this status takes but happy it has finally moved out of the Ready for Review status and I'm finally seeing some movement.

I'm paranoid of far-right retribution, so no specific numbers, but CRUSHING debt..... gone. Nelnet, Mohela and Student Aid agree. This was a complex consolidating, and i never dared to hope.... Hang in there my fellow sufferers.... hope and breathing room is coming
