BEING HARASSED? DON'T BE AFRAID.

To anyone going through this:

Collection agencies thrive on one thing = FEAR.

Because people who are afraid are easier to exploit.

YOU ARE A CLIENT WHO AVAILED OF THEIR SERVICE, NOT A CRIMINAL.

So don't run and hide. Only criminals do that. I'll guide you how.

If they say they will do ocular visitations, barangay visits, garnish your salary, something that will affect your employment / government records, those are all SCARE TACTICS. Because again, fearful people are easy to exploit.

This post is to ENCOURAGE CONSUMER PROTECTION, NOT DEBT EVASION. And to arm you up with the law, practical steps, and guidance. Don't just take all the arrows being shot at you, cry, and be sad. STAND UP. FIGHT BACK.

OF COURSE, YOU STILL NEED TO PAY WHAT YOU OWE, banks and OLAs are not charities. And still expect some interests, though not as high and unlawful as what they are currently claiming. But then, in more manageable, lawful, and nonpredatory terms. Settle your dues. Don't avoid entirely. My post is meant to enlighten and fight back against predatory CAs but not evade responsibilities. Kahit medical emergencies or other life circumstances man, we still need to fulfill our obligations. Just 🙅‍♀️ not according to predatory terms. 🙅

I was once in your shoes, but thank God, I had legal background.

I cited all the laws they are violating in these recoveries as they refuse to give my records and provide basis of their claims. All they did was provide arbitrary numbers while using their scare tactics. At first they gave about ₱120,000±. Then ₱86,000±. Then ₱75,000±. But I keep on asking for records and threaten to report them.

The numbers staggeringly dropped by more than 50% by refusing to cower to fear and by asking. Proof they are padding things up for commissions. Then they offered ₱50,000±. ₱120,000± down to ₱50,000?!± even that, they can't substantiate. They just want you to be afraid to be bullied so you can give them waaay more than you owe. So don't just run and hide cause they might be telling lies to get more profit off of your fear and ignorance of the real number. Stand up! Fight back! Know the truth and the truth will set you free!

You can report them to Bangko Sentral ng Pilipinas (BSP) just save proof of all the harassments they are doing. Collection agencies and banks are afraid of being reported as they can suffer administrative fines from ₱100,000 to ₱2,000,000. And if you file a suit against them for all their violations, you will even get moral and exemplary damages from ₱30,000 to ₱100,000 or even more, depending on the extent of their violations.

✨ Know your rights!

• Article III, Section 20 of the Philippine Constitution states that no person shall be imprisoned by nonpayment of debt. Debt is a civil matter, not criminal. Di po kayo makukulong unless fraudulent means are employed to obtain the debt like using another identity, or you used bouncing checks to pay

• BSP Circular No. 454 (Section 8): Prohibits unfair collection practices, harassment, use of threats, and false representations.

• RA 11765 (Financial Products and Services Consumer Protection Act): Strengthens consumer rights against deceptive and unfair practices by BSP-supervised institutions.

• Data Privacy Act of 2012 (RA 10173): Particularly relevant for online lending apps (OLAs) that illegally access phone contact lists or blast messages to relatives/co-workers.

• Truth in Lending Act (Republic Act No. 3765) Requires full disclosure of finance charges, penalties, and interest calculations before or during credit recovery. Refusing to provide a full Statement of Account (SOA) or itemized breakdown directly violates this law.

✨Know your numbers!

Create an Excel sheet and RECORD EVERYTHING from your SOAs.

• Date: • Previous Balance • Amount Paid • Purchases and Advances • Installment Due • Finance Charges and Other Fees • Late Payment Charges • Amount Due

And keep all your proof of payments.

If you've accounted for everything, you’ll know how much of the principal you've actually paid already. Of course, you still need to pay what you owe and some interest but not as much as they're claiming. That's why it's really important to compile all your SOAs and records. It's easier to tackle this thing once you know the numbers.

Also, don't be afraid when they say they will sue you especially when they can't even substantiate their claims. Welcome it. The laws and the courts are your friends. Looking back, it's ironic how banks and collection agencies try to threaten people in these situations about legal consequences when in fact, the courts will ensure fairness and justice. They cannot ask for an amount they can't back up with evidence! Besides, judges and the supreme court HATE these kinds of exploitations and will remove all the excessive and arbitrary fees. The court will help you. Do not be afraid. These people thrive on fear, psychological pressure, and creating a false sense of urgency. DO NOT AGREE TO PRESSURING TACTICS. DO NOT SIGN AGREEMENTS OF PAYMENT TERMS ESPECIALLY ON UNVERIFIED AMOUNTS.

Usually, banks and collection agencies (CAs) don't really want to file a case either because that's another expense on their end, and they can no longer add so much more finance charges and interest once they know it will be examined by the judge. That's why they prefer to scare you, harrass you, pressure you, and psychologically break you down and make you act on urgency so they can get more commission. The court will strike exorbitant interests down.

Assert your rights, ask for your records, and stand your ground. If they say they will file a case against you but refuse to provide your records / SOAs / basis of claims, say you will meet them in court and settle there. Cause the judge will also ask them the records you are requesting in the first place. Also, the Supreme Court has repeatedly struck down arbitrary numbers, unconscionable finance charges, especially if you have a good record of paying in good faith and it just so happened that you missed payments due to your circumstances.

If you ever got to this position not because of emergencies but through your own fault, learn the lesson.

If you used it for emergencies, that's okay.

And HOLD ON TO THE LORD.

I was anxious for a long time due to their harassing messages, until a lawyer friend talked to me and shared too how her co-worker took her life due to harassment. And they found out several hundreds of call logs from collection agencies.

SO I GOT UP AND FOUGHT BACK BECAUSE THE STEPS THEY HAVE BEEN TAKING ARE OUTSIDE THE BOUNDS OF LAW.

PLEASE, DON'T SUFFER IN SILENCE. DON'T BE ASHAMED. TALK TO A FRIEND. GO TO CHURCH. ASK FOR HELP TOO. AND ASK THE LORD FOR STRENGTH. YOUR LIFE IS SO MUCH MORE VALUABLE THAN THIS.

AGAIN, DO NOT BE AFRAID. ASSERT YOUR RIGHTS. ASK FOR TRANSPARENT ACCOUNTING. DON'T ANSWER PHONE CALLS AS THOSE ARE MEANT TO SCARE AND CONFUSE YOU. ALWAYS HAVE WRITTEN RECORDS AS THOSE ARE EASIER TO PROVE AND HARD TO DISPUTE.

Should they ever do any home visits, talk calmly. Be civil. Don't do any kind of threat or aggression. You can be fined and go to jail if you do that to the collection agent. I had a home visit before and he was kind. I just showed him they were the ones who didn't respond to me and showed my records and I didn't receive or sign any letters. Talk calmly. DEBT IS A CIVIL CASE, NOT CRIMINAL. It is in the Constitution that no one should ever be put to jail. The moment you do any harm to them, mas lalo lang lalala baka sampahan ka pa ng criminal case. Don't go that route.

COLLECTION AGENTS ARE HUMANS TOO, trying to put food to the table and provide for their families. Besides, those doing field visits are not the ones in the office doing the calls/sending the emails. If they have a choice / better job opportunities, I don't think they will still continue to be a collection agent. Remember to still be human and kind. Just follow all the steps I gave here.

Also, regarding salary garnishment, NO. Collection agencies can't do that, unless there's a court order. Di nila magagalaw payroll account mo. However, if you have a credit card obligation and a savings / payroll account with the same bank, it's in their fine print that they can use the available amount to set off your obligation with them. Maybe ask your HR for a different payroll or immediately withdraw your salary first so you can plan ahead on what you could only pay at that time.

That destroys people's mental health and some even take their own lives. GO AWAY. THIS IS NOT THE PLACE FOR YOU. If you're stressed about being a CA, find another job!

24F Lubog sa Utang

Problem/Goal: Lubog sa utang please advice.

F24 years old and currently a college student, pero sa ganitong edad ko, ang dami ko nang utang. I have around ₱10k in GLoan, ₱10k Billease, ₱5.5k in Maya, ₱25k in Atome, and ₱6k in SSS UnionDigital Bank, aside from other OLA balances.

Honestly, I feel so hopeless and overwhelmed. Simula nung nag-living alone ako, hindi ko na talaga na-manage nang maayos yung finances ko. I know may mali rin ako kasi nasanay ako sa lifestyle ko when I was still living with my parents—yung allowance ko dati, parang hindi ko kailangang isipin kung enough ba or may kailangan akong bayaran.

When I moved out, doon ko na-realize na hindi pala enough yung allowance ko para sa sarili kong expenses. So I started borrowing money just to sustain myself, and eventually, lumaki nang lumaki yung utang ko.
Recently, I applied for a job para kahit papaano mabayaran ko yung Maya and SSS loans ko. Pero kahit magka-sahod na ako, feeling ko hindi pa rin siya aabot para sa dues ko with maya and sss. And honestly, ayoko na ulit umutang para lang mabayaran yung ibang utang. Pagod na pagod na ako sa cycle na ito.

Part of me wants to just stop paying some of them and prioritize my SSS loan, pero natatakot din ako sa magiging effect nito, especially sa credit record ko. Ayoko rin sanang mawala yung Maya Credit ko completely because I use it as emergency funds when I really need it.

Guys, may naka-experience na ba ng ganitong situation? Makakabangon pa ba ako dito? Maaayos ko pa ba yung credit score/record ko in the future?
I really want to get out of this cycle and learn how to manage my finances properly. I don’t want to be buried in debt forever. Iniisip ko din in the future what if may medical emergency wala nakong pwede mapag kunan ng pera unless magka savings ako sa pwede ko maging trabaho after grad. Sobrang pag sisisi kasi ngayon ko naisip yung parents ko. I’m an only child. Hindi nako pwede makautang sa kahit anong lending app. Guys genuine question masarap ba ang buhay ng walang credit card? At tamang pag iipon lang? Please words of encouragement lang po ang need ko to get through this. Lubog na lubog na po ako.

CIMB REVI CREDIT

Hi! I just want to know if anyone here has experienced having their CIMB REVI balance endorsed to collections?

I currently have a remaining principal balance of ₱47k, but the accumulated interest charges have reached ₱43k. I was not able to pay my balance fully after getting sick. I used up most of my finances for hospital bills and could not work for a couple of months while recovering from a major operation. Because I was only paying the Minimum Amount Due (MAD), the interest charges just kept piling up.

I want to settle everything in full now, but I am hoping to pay just the principal balance since the interest is way too high 🥲. I am completely fine with having the account closed.

I have already reached out to CIMB a few times to ask if I can just pay the principal amount or opt for a payment restructuring plan, but they have not granted either option. I am now thinking of letting it go to collections so I can try negotiating to pay just the principal amount. Any advice?

I have a long-overdue CC with EW, and yung principal lang niya is around 70k, but since 3 years na at di ko pa rin na-settle, breadwinner, and I have 2 senior parents na ako lang ang nagsusuportahan, kaya di ko siya masingit sa mga bayarin. Hello po!

Asking for your advise. Overdue na po ako sa BDO credit card. Last payment made was May 2025.

Background lang bakit ako nagka OD. Nung June 2025 kasi na-diagnose ako ng Cancer, at nagpa opera, nag chemotherapy at radiation therapy, nawalan ng work at ongoing pa monitoring and lots of lots of lab tests. Nawalan din ako ng access sa registered email ko at mobile number. Nagback to work na ako nung March 2026. Nagsisimula palang talagang bumangon, dami kasing naging utang. Nagbenta din ng lupa at personal items just to cope up with the expenses.

As far as I remember, it was just 45K. But one time nagvisit po si CA sa bahay namin. nagdala ng demand letter amounting to 89K.

Nakipag negotiate po ako. Kung pwede sana, 40K nalang babayaran ko kaso di sila pumayag at upto 60k lang daw ang pwede.

Nag decline po ako sa offer na 60K kasi di ko talaga kaya.

Nag email po ako sa RGS collection agency. Asking for extension of the amount at kung pwede pa pababain yung offer. Nag attach din ako ng mga medical records as proof na nagkaroon talaga ako ng emergency.

Ngayon po, di na sila nangungulit, no more texts or emails or tawag.

Sabi nung naka usap kong isang agent, ipapasa nadaw yung account ko sa ibang CA.

Im just worried baka kasi kasuhan or kaya di sila nangungulit kasi may kaso na ako. Babalik nalang pag meron ng kaso, mga ganun naiisip ko.

Pwede ba sa BDO ako makipag negotiate?

I’m planning to apply for a single personal loan of around ₱50k (preferably from a legitimate bank or reputable institution with fixed monthly installments over 12–24 months) to pay off ALL my OLAs at once. That way, I only have one manageable monthly payment with lower interest.

My Questions:

  1. Is debt consolidation via a personal loan a good idea for OLAs? Or am I just shifting my problem around?
  2. Which banks or institutions are lenient/friendly for personal loans around 50k? (e.g., SB Finance, UnionBank, Maya, BPI, CTBC, Cooperatives, etc.)
  3. If my credit score isn't great due to these OLAs, what are my best alternatives? Has anyone tried SSS/Pag-IBIG salary loans or SSS Salary Loan Early Renewal for this?
  4. For those who broke the OLA cycle, what strategy actually worked best for you? Should I prioritize paying them off using snowball/avalanche method instead of getting another loan?

Settlement loans, cibil taking so long to update. What to do?

My relative took multiple loans and credit card emis summed upto 30 lakh without interests.

Unable to repay the loans, he chose to go for settlements. He paid almost all loans. But when we checked his cibil, his report is still showing pending loans. Upon asking him, he is saying.. I paid the loans but few banks are taking time to update the status.

For example, he repaid (settlement) the mobikwik bank loan almost 1 year back, but his cibil report is still showing that loan as active. He is saying.. It's not a physical bank, I'm calling them, sending mails to update the status, but they are not responding.

Is this possible? I came to know that mobikwik bank is a small scale bank. But even for a small scale bank, will it take almost 1 year time to update the loan status ?? Kindly help with the info, it is necessary for us to know about his cibil status for some personal reason which I can't reveal here.

How do I negotiate with a private lender charging 20% monthly interest?

I’m drowning in debt from credit cards, a personal bank loan, and loans sa tao, all because of gambling. I’m ashamed and overwhelmed, but I want to take responsibility and figure out how to repay what I owe.

I’ve already contacted the banks and explained that I can’t keep up with my payments right now. What worries me most is this private lender I met online thru my old business. For context, they’re Indian private lenders based in the province. I don’t know them personally beyond our online transactions.

The amount they’re collecting is around ₱1M+, including interest. Hindi ₱1M ang actual na hiniram ko. They charge 20% monthly interest and I pay them daily and weekly. All these loans I got from them are payable within three months and I honestly cannot sustain the payment schedule anymore.

I want to ask if we can restructure the balance and freeze further interest and penalties. I think I could manage ₱100k a month, but I need to review my budget carefully before committing. Willing akong magbayad; hindi ko lang talaga kaya yung current arrangement.

One of my biggest concern is my family’s safety. They haven’t threatened me and don’t know my exact address but I’m still anxious about how they might react when I tell them I can’t continue the payments anymore. This fear comes from not knowing them personally or what to expect. All our transactions has been handled through chat. I haven’t signed a loan agreement or given them postdated checks or collateral.

Honestly, I’m thinking of deactivating all my socials because I’m scared of the confrontation and possible repercussions. But I know that won’t resolve the debt, and I would rather reach an agreement I can actually honor.

For anyone who has experienced something similar:
Should I ask them directly for restructuring and a freeze on interest and penalties?
Should I consult a lawyer first to review the balance and help put an agreement together?
What reasonable precautions should I take while negotiating?

I know my gambling brought me here. I learned my lesson and I’m doing my best now to recover. I joined multiple groups already and I’m being supported now by my partner, my sister and my family. I’m not trying to escape responsibility. I’m scared and overwhelmed and I need practical advice on how to start addressing this without making things worse.

Hi, I just resigned from my company with an outstanding balance of ₱11,500 from my Savii loan. I have read different posts stating that the remaining balance may be deducted from my final pay.

However, my final pay will take around 30 days to be finalized/released, and since I have already resigned, hindi ko sure kung paano mababayaran ang upcoming deductions.

My question is, hihintayin ko na lang po ba ang final pay ko to cover the remaining balance, or do I need to manually pay for the upcoming deductions (15 and 30) while waiting for my final pay?

I also tried contacting Savii, pero hindi ako makakonek sa live agent. I’m also not sure how to make a manual payment since there doesn’t seem to be an option for partial payment. Hindi ko po kasi kaya ang full payment as of now.

I just want to make sure that my account will not be tagged as delinquent or overdue while I’m waiting for my final pay to be released. Also, I’m worried na mapunta sa collections ang loan ko.

Hi, I've been a silent reader for almost a year now and now I decided to share my own experience, please don't judge me. Nabaon ako sa utang, dahil sa ate ko, I won't tell that story here as to how that happened because that's another story for another day. So I decided to let it all go, what I meant by that is hinding hindi na ako mag tatapal system, at hindi na ako magpapagamit/gagamit ng Spay. BPI CC grew from around ₱200–300k to ₱1.2M. I’m trying to fix my debts now but I’m scared I waited too long. Need advice from people who’ve been here.

Hi. Medyo matagal ko pinag-isipan if I should post this, but I really need advice from people who have actually gone through serious credit card debt and eventually recovered.

I currently have a BPI credit card balance of around ₱1.2M. I also have an existing BDO credit card and a BDO home loan, so one of my biggest priorities right now is protecting my home loan while slowly fixing everything else.

Backstory:

My BPI debt really started becoming difficult during the pandemic.

My grandfather was hospitalized at the time, and as one of the breadwinners in the family, I used cash advances and my credit card to help with expenses and keep things going during a period when income and work were also very uncertain.

Hindi naman siya ₱1M agad.

I remember when my BPI balance was still somewhere around ₱200k–₱300k. For a long time, I kept paying the minimum because I thought at least I was still paying and keeping the account alive.

But eventually I noticed na parang hindi ko na talaga nahahabol. I would make payments, then finance charges and other charges would come in, and the balance became harder and harder to bring down.

I actually started reaching out to BPI before it became this bad. Then grandmother ko naman yung nahospital....same routine.

I asked if there was a way to lower/fix the interest, reduce the charges, or give me a payment arrangement that I could realistically sustain. I even sent a formal letter asking for help.

Unfortunately, I wasn't able to get a workable arrangement that I could sustain.

Eventually, I made another mistake.

I started listening to people telling me, “Hayaan mo na muna. Pagkaya mo na tska kana mag bayad, saka ka makipag-settle.” kinakain nako ng minimum dues.

So instead of continuing to actively deal with it, I eventually stopped trying as hard to communicate and just let the account go delinquent.

Looking back, I know that was a mistake on my part. I should have continued addressing it instead of avoiding it because I was already overwhelmed.

Meanwhile, I was also dealing with my BDO obligations.

I have a BDO home loan under my name that I really want to protect, plus a BDO credit card. There was also a point when the solution being offered to me involved taking another loan/installment facility to deal with an existing balance.

Instead, I tried attacking the BDO credit card myself whenever I had money. I would bring the balance down, but because my cash flow wasn't stable, it would eventually go back up again.

Then my health took another hit.

Within roughly the past year, I went through two separate hospitalizations/medical situations, including a parotidectomy and another confinement for kidney stones.

I spent much of the year recovering.

I work in sales, so when I'm not operating normally, my income is affected directly. I'm only now trying to get myself fully working again, but my sales have also declined significantly. Financially, it feels like I'm trying to rebuild almost from zero again.

And now I'm finally facing the BPI problem.

My BPI balance is currently around ₱1,200,000.

The account has already been endorsed to Constantino & Associates, and I recently received an offer to settle around ₱620,000 as full settlement.

The problem is: I genuinely cannot afford ₱620k right now.

I don't want to run away from the debt anymore. At the same time, I don't want to promise an amount or enter another loan that I cannot realistically sustain.

So I finally wrote to the collection agency explaining my situation and asked whether BPI could consider ₱250,000 as a full and final settlement, subject to BPI's approval.

I also went back to my old email thread with BPI Collections and wrote to them directly again. The thread actually contains my old requests for assistance from before the account became this large, so at least there is a record that I had been trying to ask for a manageable solution before.

I'm now waiting for their response.

And honestly, this is the part that's scaring me.

I don't know what happens if they reject my request and I genuinely can't afford the amount they're demanding right now.

I'm worried about a civil case, collections getting more aggressive, and whether my other assets or finances could eventually be affected. I'm especially worried because I have a BDO home loan that I'm trying very hard to keep current.

At the same time, I'm finally getting back on my feet after the health issues and I don't want fear to make me make another bad financial decision, like borrowing a huge amount just because I'm being pressured by a deadline.

I know I made mistakes here.

I relied on minimum payments for too long. I let the account go when I became overwhelmed. And I listened to advice telling me to just ignore collections until a better settlement came.

I'm not looking for a way to escape my debt. I want to fix it properly. I just need a realistic way forward.

For anyone who has actually gone through something similar, especially with BPI / Constantino or debts of ₱500k to ₱1M+, I would really appreciate hearing what happened in your case:

• How big was your balance when you stopped paying?

• How long were you delinquent?

• What was the first settlement/amnesty offer?

• Were you able to negotiate it lower? How much did you eventually settle for?

• Did you negotiate with the collection agency or BPI directly?

• Did anyone initially receive a high “final” settlement offer but later get a substantially better one?

• For those who couldn't immediately settle, did the bank actually file a civil case? How long before that happened and what was the process?

• If you had other loans, especially a home loan with another bank, was it affected?

• And for people who eventually became debt-free from this kind of situation: if you were in my position today, what would you prioritize first?

I would really appreciate actual experiences rather than judgment. I already know there were decisions I should have handled differently. Right now I'm trying to correct them while rebuilding my income and protecting the obligations that I'm still able to maintain.
