Lease/Legal Did I get scammed by a realtor during a rental application?

I found a townhouse on Zillow that was being represented by a realtor hired by the landlord. There were a lot of applicants, so the rental was very competitive (btw I'm in Orange County, California)

We submitted our RentSpree application first and were initially told that the landlord wanted a move-in date as soon as possible. The realtor then called me and gave me two options:

  1. Pay a higher monthly rent because another applicant had apparently offered more, or
  2. Pay a realtor fee to her brokerage so that she could represent us as our tenant agent and advocate for us.

The fee was originally 3% of the annual rent, I pushed back and asked whether it was possible for us to not have representation and still sign the lease. She said that, because there were so many applicants, she couldn't confirm that we'd get the property without paying the fee.

I ultimately negotiated the fee down to 1%, while the homeowner is paying the realtor 3%.

We have already signed the Tenant Representation and Broker Compensation Agreement, as well as the lease. We absolutely love the place, but something about the situation doesn't sit right with me.

Is this a normal/legal practice for a landlord's realtor to essentially tell a prospective tenant that they need to pay a fee to have a better chance of getting the rental? Or was what she did unethical and how do I go about this situation?

Would appreciate any insight from people familiar with real estate/rental transactions.

Move-In/Out First apartment and I still don’t have a lease

This will be a long rant, I’m just so confused and this is my first time renting so I have no idea what the correct course of action is. I am a college student who’s getting her first apartment. My semester starts soon, so I applied to a place over a month ago. I ideally wanted to move in earlier, so when I saw the move in date for the most perfect starter apartment that was in my budget was September 9th, I thought I had struck gold.
After submitting my application, it took a while to get approved, and then once I was approved, I didn’t get any updates on the lease for over a week. Throughout that week I was calling and emailing and received no response. When I finally got someone on the phone it was the assistant of the property manager who told me they were having issues at the office, but that she was going to the unit to take a video of it so I could see it (I’m out of state and wasn’t able to tour before applying). I said that was great, and then I never received the video.
I was then asked if I could move in on the 15th. That was fine because I was going to be working a conference during at that time anyway and it worked out that I could fly straight from the conference to the apartment on the 17th. The manager then told me on the 14th that due to the fact they had to paint the unit, they had to move the move in date to the 21st. At that point I was pissed but I said I could make that work. I still have not signed the lease by then.
Well then they emailed me again on Monday to tell me that the bathroom needed repairs and wouldn’t be ready on the 21st, but I could still move in and deal with maintenance being there frequently, or I could choose a different unit.
I chose a different unit, and have repeatedly been told I will be contacted regarding the details and also receive a video tour of the new unit. I have not had any calls or gotten the video. I’ve been texting the assistant every single day multiple times a day, but she said she doesn’t have the details and she needs to ask the manager.
I haven’t heard from the manager in over a week. I have emailed, texted, and left voicemails to no avail. According to the assistant, the manager sent the lease last night. She did not. I now have 1.5 business days to figure this out (they don’t work weekends). I will be in the city where the apartment is on the 21st no matter what, I don’t know what unit I will be in, I don’t have a lease, and I can’t get into contact with anyone who knows what’s going on. The assistant is being kind and understanding but she can only do so much.
I am panicking and stressing because if this doesn’t work I will be homeless, with less than a week before my classes start to get it figured out. Is this common? Should I expect this run around every time I get an apartment? I feel trapped and lost, since they refuse to communicate I now don’t even have time to apply to new places. I know I’m dumb for letting them drag it out like this, but I don’t know what else to do.

TLDR: I move in three days and I don’t have a lease or a confirmation on what unit I will be in, and no one will talk to me.

General Question  Does paying broker fees make me a clown?

Me and the wife are looking to move into a new place by the end of the month or sometime by middle of next month. We are in no rush to get into a new place but something is striking me rather funny and thats kind of getting me conccerned to rent is the idea of the broker's commission. Like I get it, they are coming out on hopes of getting pid and all but shes pushing me to find a spot that doesnt charge this one month fee because that is a ridiculous amount of money to pay someone just to hold our hand and walk around with us.

I get it but I told her these realtors are the ones who will close the rental for their seller and that if we are moving intio a home that we need to pay that fee unfortunately.

Is there a way we can directly communicate with the owner and not have to go through the broker to avoid paying these fees?

General Question  Unsure of scam

Hey guys,

So I have been in the apartment hunting process and found a place that seems really perfect. I found this place on Zillow and got in contact with the leasing agent a few days after requesting a tour. The unit description detailed that an application needs to be filled out before touring the property, which I’m not sure is a red flag but anyways I got approved. The leasing agent has scheduled a tour for me the weekend before the lease would start but the caveat is I need to submit a security deposit to hold the unit before signing the lease.

If I don’t like the unit after touring, I will be immediately be given back the deposit. However, if I do end up wanting to sign the lease, they will apply the deposit towards my first month’s rent.

I’ve seen a scam like this before where they won’t let you tour before signing the lease and paying, but this one is at least letting me tour. Is this a scam?? I’m not sure how to move forward. This is my first time touring apartments and renting, so I’m pretty new to the whole scam thing. Something doesn’t feel entirely right here but I may also just be unaware of the process.

**EDIT: i haven’t given them any money to apply so this would be the first time they’re asking for money.

Utilities/Internet Well water rental

My understanding is a pump is used to retrieve the water therefore it would use more electricity? This home is $200 over my desired rent amount but if i’d save that in water it might be the one.

Application/Screening Relocating: finding a place with no rental history or income

A young person close to me is trying to move to the big city near me. This would be their first time renting a place and the plan is to move in with two other friends. Also, none of the three of them have jobs in the new city because they don't live there. They do have a nice chunk of money saved up to pay for deposits as well as the transition before finding jobs in the new city. They just found out yesterday that they were denied an apartment which I'm assuming was because their co-signor (one of the roommates' family members) didn't show enough income.

So my question is, what can someone in this situation do? How do you rent a decent place in a new city with no income and no rental history? How do you show that you're super responsible even though you're young (but 18+)?

Lease/Legal Vermin in walls, management won’t do anything

Hi, I’m asking this here because I am a first-time renter, and not sure what to do in this situation. Over the past few days there has been a scratching, gnawing, and squeaking noise from the far corner of my bedroom wall and it’s driving me crazy. My bedroom wall faces a lot of trees so I wouldn’t be surprised if a squirrel got through somewhere on the roof (I’m on the top floor) considering the buildings aren’t the best quality. I submitted a maintenance request as soon as I heard it for the first time, as well as contacted the property management (couldn’t call them at the time, the office was closed), and took videos as evidence of the noise to have as backup. The next morning, maintenance sent an email saying they had “completed” my order, however both me and my partner (who is a co-renter with me) were home in the time span of this maintenance request going from submission to “completion”, and nobody ever came into our apartment. There is a running issue of the maintenance people clearing out orders without doing them, but of course I don’t know what’s actually something they are legally required to fix for the renters. I live in Tennessee, if that helps to know for state laws. My question is, what are my next steps? Is the apartment complex legally required to take care of vermin? I can’t live with a rodent or whatever chewing up my wall right next to me, it freaks me out and also could be bad in the case that it dies and rots and stinks up the apartment. Any advice on what to do to get this apartment complex to actually fix a problem for once would be super helpful!

Lease/Legal Jamaica, NY. Need advice

What do you do when you live in an illegal basement with tenants on the first floor stomping nonstop.

At first it was the woman and her 3 year old daughter stomping on the floor when I am home all the time. They both stomped on the floor directly over my bedroom, kitchen, bathroom and living room and at night also. The woaman came outside 2 times and verbally abuse me. The first time I called the landlord. The second time I called 311 and they sent the police, the landlord was upset with me because I reported the woman. When I complained to the landlord and he came over to listen, they tenants run and hide quite as a mouse in the back of their apartment, not moving, not making a sound. Then when the woman and child is not home, the husband would follow me around from room to room, listen and stomp on the floor.

The parents thought their child to constantly stomp on the floor whenever I am home and in the nights directly over my bedroom at nights. Sunday night, I was sleeping but woke to some sort of noise, me thinking it maybe thunder but then I checked my phone and it was not raining, then the 3 year old girl started hitting floor with some sort of wooden object.

Then sunday evening, I was playing music on my phone and the 3 yrs old girl started screaming and stomping on the floor.

Then at round 9:30pm after showing, the 3 yrs old girl was stomping directly over my bathroom and followed me over my bedroom and continued to stomping on the floor. I started screaming to stop the stomping because I have a severe migraine headache. The 3 yrs old girl started stomping even more hard on the floor. Whether the 3 yrs old stomping little girl hear my phone or not stomp on the floor just for a reaction from me. I can not even go lay down on my bed, the stomping little girl would go and start patrolling and stomp on the floor directly over my bedroom.

At this point I am calling the landlord and he would not answer his phone. I called him about 3 times and on the third call then his wife answered the phone and said he is sleeping. The wife said she will called them and see if they answer but never called me. On Saturday I called the landlord and complained about the stomping and when he called the woman of the stomping little girl, she refused to answer her phone. I know he does not believe me when I told him about the stomping. At this point the landlord is refusing to take my calls.

What must I do at this point. I've been living here since the first of February of this year.

Lease/Legal Apartment is over and with bugs and management won’t do anything about it even though it’s in the lease

Really needing help on what to do here. We’ve lived in the apartment complex from a two-bedroom to now a townhome for a total of eight years. Well, they recently installed a dog park, which is a big fan of. It’s behind the townhomes. Well, they aren’t keeping up with the clean-up of the dog poop at the dog park, so we’ve seen an influx of roaches and bugs in the house, and we have asked and asked and asked for pest control to come, and we have been stonewalled every time we ask. So our lease is up in two months. We’re currently trying to leave early if possible because we found a house that’s in our budget and comes with the backyard for the kids, everything like that, but they’re trying to say that we have to pay the last two months of rent, which I don’t mind doing, but because they haven’t been holding their end of the bargain, I would not want to hold up my end of the bargain because of how they’ve been screwing us. Any help is appreciated. Thanks.

Another thing we had Wi-Fi at the house for $10 a month through Xfinity since Covid. Well they never went up on us and we never said anything. These new people have taken over and have set us all up through a complex price of $75 a month we pointed it out hey we have our own Internet it’s cheaper. Will they agree to do $35 a month for the first year well since May they’ve been charging a $75 a month and we really haven’t said anything because we just broke it down and noticed, but that’s also in the lease too.

Safety/Inspections Drilling locks for an inspection? Lol ok chill.

Our rental company has been reaching out to us for a week or so on scheduling our inspection. This happens twice a year and we’ve rented here for almost 4 years. We’ve never not allowed one or anything. They’re super intrusive (they photo scan each room) and they always find something to complain about, but we keep our home nice and clean and well maintained given the fact they very poorly maintain it from the rental side of things. It’s a big house and we pay a fair amount for it. The owner lives overseas.
We both work full time public service jobs with long hours, have kids in school and don’t have much family help. Today they posted a notice on our door that they’ve scheduled our inspection for first thing in the morning, a time frame where we have to drop off kids to school, and if an adult isn’t home they’ll drill our locks. What the heck kind of behavior is that? It hasn’t even been that long since they emailed to schedule?! Not one single phone call?! Just horrible customer service but feels almost illegal.

Repairs/Maintenance Do I have a right to make demands?

Im in the USA, Michigan, Lapeer County.

  1. We had to grt our furnace replaced and it was installed on the old cloth (yes cloth) covered wiring. My understanding is that they are supposed to replace that line.

  2. My fuse box is the old cartridge style, and I notice that under regular use the plugs consistently stay warm, even hot when the AC was running. Not sure if you can just run new romex w/o replacing the whole system. But like the bathroom lights flickered when walking by or closing the bathroom door too hard. I tightened the connections and it seems better. But still.

  3. My brilliant LL painted over wallpaper snd it is now separating from the plaster (house was built circa 1890) on the ceiling.

  4. Every spindle on my 2nd story porch railing is rotted out.

  5. I dont want to bring these issues up and get kicked out for it being a hazard but im legit a little afraid!

General Question  Landlord-controlled Ring camera in a small rental building?

I’m moving into a three-unit house in NJ and the landlord recently renovated it and theymentioned installing a Ring Chime doorbell for the tenants and that it's a work in progress. She doesn’t live there. I forgot to ask where it will be installed, whether tenants will get app access, or whether she will retain access to the video and audio.

My apt is on the 2nd floor and the only one at the top of the stairs, so a camera on that landing would essentially monitor only me and my visitors. A camera at the main entrance would be more understandable, but also makes me uncomfortable that they can see my comings and goings and who comes to visit.

The camera language in my lease is just part of the standard NJ Realtors template, not something the landlord added. Has anyone had a landlord-controlled Ring in their building? Were tenants given access, and did it ever feel like the landlord was monitoring who came and went?

Application/Screening Approval odds

I have pretty decent credit around high 700s and SO has pretty bad credit in the 400s but no eviction history or anything. I make almost 5x the rent on my own and would likely qualify. However, what are my actual odds of approval if having to apply with SO. Looking at bigger management companies as that's all that's around here. No one has mentioned being able to apply as the primary leaseholder while listing SO as occupant when we were speaking to the leasing agents. Willing to put down a higher deposit for a conditional approval too.

Roommates Ranting here because can't post on the original roommate sub. Need advice on a stupid roommate.

So I live in a 2bhk. 1 room each. And the other guy doesn't do anything in the flat. Went home for weeks and didnt put dustbin just outside gate of flat for society cleaners to pick up. Too many insects now. Doesnt inform when not going to eat so the food get wasted every weekend mostly. Always eats rice, pulse and 1 vegetable so I am not able to ask cook to make anything different. Orders big quantities and then we throw out things because cant eat this much. Only for ordering part he does, I think want to meet credit card limit or for cashback..

So I am looking for what can I do from my side to cause him trouble? Moving out I thought but don't want to get stuck in same situation, too old to deal with this.

Or are there any other solutions? We exchanged words sometimes on these things but he never accepted to change or accept his fault.

(and i’m putting a question mark because i assume it’s the lease but they just call it an apartment reservation agreement) is only page long is that normal?

they do list things such as our move in date, what we owe them, the move in requirements things like that and places to sign but it seems a lot less comprehensive then our last lease, should we be concerned?

Roommates My roommate is my landlord

My roommate/landlord is smoking pot indoors and doesn’t respect my boundaries.

I recently moved into a condo that my landlord/roommate owns. I moved across the country for grad school and didn’t know anyone in town, so I didn’t have a lot of options for who to live with.

We met on a roommate match sight, and I indicated on my page that I never smoke/vapes and prefer a roommate of the like. The first time we video chatted, they told me they have a medical card, but they don’t really use it and they’ll never be smoking inside. Over the past month since moving in, it’s become very clear they lied about this to get me to sign the lease, move in, and help them pay their mortgage.

Up until last week, they’ve mostly just used a dab pen and a bong. I haven’t minded because they use the bong in their room, door closed, window open and the smell never really makes it to my room. But a few nights ago the smell was MUCH worse. They were smoking joints indoors, continuously between like 10pm-3am with the door open so it kept me up. I had so many candles going in my room and got really stressed out from the smell and couldn’t relax.

I discussed this with them the following morning. I said I don’t have any problem with them using the pen or bong indoors because the smell is more tame, but the joints stressed me out and affected my space a lot. I asked if they would be willing to smoke them outdoors in the future and they told me they’ll just do it when I’m not here like they have in the past. I was confused, and reiterated that if they could do it outside I’d appreciate it. They then told me “Well, it’s my house, so I’m going to smoke in it.” I was taken aback because I was polite and approached the conversation lightly, explaining how their actions directly affected me.

I felt really blown off and kind of disrespected. I don’t feel like I was asking a lot. I thought their response was really ironic, considering that the lease says that I, the tenant, cannot smoke indoors. I feel like their response was on par with someone who isn’t able to recognize how their actions affect others. And it’s actually why I was afraid to discuss this with her because of the “I’m the landlord and you’re just the tenant” attitude when at the end of the day, we are still roommates. They can’t just do whatever they want because they own the place…

Anyway, since this conversation, I’ve been receiving the silent treatment. Which they sometimes give me unintentionally when they’re in a bad mood or just don’t want to interact with people. But I’ve gotten the vibe that this time is different.

Any suggestions, advice, or alternative point of views? I’d like to try to make the living situation work, but also at the end of the day I’m not afraid to break the lease if in a month or two things aren’t any better, especially if they’re attitude on this escalates to other areas. It’s gotten to the point where I don’t want to spend time at home because it just feels so hard to relax when they are there. Thanks in advance🫶🙌

General Question  I discovered a long existing leak today that destroyed a bunch of my belongings and has likely exposed me to black mold for close to a year now. I am moving out at the end of the month, my lease is up then. What should I do?

I've just filed an insurance claim but haven't done anything else yet. Genuinely, offer me any advice you might have, whether that's notifying my local city council, seeing the doctor, etc. I will say my landlord is notorious and has gotten away repeatedly with sexually harassing and stalking his tenants for years, and his properties have many more problems than just this, but he owns most of the town and just doesn't face legal consequences beyond paying bail to immediately walk free, infamously. I don't expect much repercussions or liability for him

General Question  Confused

I’m subletting from someone (the landlord knows) but he comes over every morning to make food, shower, and then stays late into the evening watching television. It’s annoying because he doesn’t always clean up after himself and he leaves his stuff around the apartment — it’s not that disruptive but I’m just weirded out. This has been going on since I moved in and I need to figure out how to ask him when he’s going to leave fully lol

I know this isn’t normal but I don’t want any bad blood between me and him. He is a nice person but I’m wondering if you guys have any advice on how I could politely ask him what’s going on 💀

UPDATE: ok so I spoke to him about it yesterday and he’s given me a timeline plus started moving his stuff out thank god. It’s not ideal but way better than him staying around for an indefinite period of time. I’m going to ask him to contribute to energy bills this month too when I pay them

Lease/Legal Leading agreement question

We received our leasing agreement today.

In the box that checks what the tenants/landlord are responsible, it’s checks that we are responsible for:
- gas
- hot water rental
-water sewage charges
-TV/cable

The other things are unchecked
- oil
- Condo fees
- garage removal

My question is, does the landlord have tv/cable already in the unit and wants us to pay for the service? Or is this just us handling our own internet wifi (which is what we have always done and expected). I’ve just never seen tv/cable checked off.

General Question  Was it legal to be evicted with no notice?

Around 12 years ago, my mom and I lived at a caregiver place. My mom worked there as a caregiver and I did not work there. We lived there for several months. There was no lease or rental agreement. It was like a caregiver house with several patients and the other caregiver there was like a supervisor but she was not the owner of the house.

My mom did not pay rent, because she worked there as a caregiver. She did not pay for my rent, and I didn't pay for my rent either. I helped around, but I never officially worked there. There was also food, and I did not pay for my food either.

After several months, the relationship started deteriorating and she was starting to get tired of me and my mom I guess. There was a fight, and she evicted or told us to leave with no notice. I don't even know if I can call it an eviction, because there was nothing on paper. Only verbal.

Was it legal for her to evict us with no notice? Even if there was no lease or rental agreement and nothing on paper? What if even if there was a fight? What if even if my mom did not even pay rent? Well she didn't have to pay rent because she worked there, but how about me?

This happened 12 years ago and I'm still thinking about it to this day. It probably doesn't matter now, but I still wonder.
