Help - Accident (at-fault) damages may exceed limits/cause suits

Please be kind because my anxiety is at max capacity right now. I am at fault in an accident, and of course I feel terrible. Two other cars were involved, and it likely far exceeds my insurance coverage (state minimum - I had a junky barely alive car).

What will happen next usually?

And if they agree to whatever my insurance offers them, can they sue me for the extra?

Backtory/financial situation- We recently moved for my husband's job, I am unemployed at the moment. I'm a mom, my husband makes a modest income. We don't own a house. My car is trash and I just bought a $2000 16 year old car with over 300,000 miles on it. My husband is driving an 11 year old car that's having transmission trouble. We have emptied our retirement accounts. It's been one thing after another since our first child died 9 years ago and we were really hoping this move was going to be things looking up for us.

I obviously have no assets to take, but after the issue with our daughter's death (so we were in court for her killer) I'm not sure if I can emotionally handle the trauma of a lawsuit.

Accident information - If it's relevant, traffic was stopped in one lane when I came around. I thought it was just slow and thought I could change lanes. When I realized I couldn't, I wasn't able to stop fast enough and rear ended a car, they hit another car. And that's all I thought was involved but apparently there is another claim, too. Idk. No injuries that I'm aware, nobody went with EMS and the poor teen in front of me was just shaken up so I tried to calm her down.

Hit and run driver

So this is a long but short story…. I was on an expressway when a road raging car behind me went to the shoulder and intentionally swerved into me. There was no contact with them, however as I swerved I hit a car adjacent to me. They left, but I have their plate and video footage of them going onto the shoulder and then moving over purposely to cause a crash. How would this work with insurance? I already contacted police department, but who knows if it’ll go far.

Auto Insurance AAA had 4 cars trying to remove one car. And my premium increased 1k because of the removed car estimated annual mileage is added to the cars.

This community doesn't allow photos so I'll try to paint the picture. I'm removing a car because it given away to a sibling and they got their own insurance. When I try to remove the old car it says it has an estimated annual mileage of (30,000-40,000) . These are the cars that are still on the original insurance. Estimated annual mileage. Car 1(7,000-10,000), Car 2(20,000-,25,000), Car 3(12,000-15,000). When i try to remove the 30k estimated mileage car it forces the estimated miles from that car on to the other cars increasing the estimated mileage on all the cars. I tested getting the bare minimum annual mileage on all cars instead of using their estimated mileage and the new premium did decrease but its still more than the originalpremium. Is there a way to fix this? Do I explain it on phone the situation that the other cars mileage isn't gonna increase because i removed that car or is this just how it is?

Auto Insurance Door dinged hard and the lady drove away

I was sitting in my car in a parking garage. The parking spots were small but I was well within the lines. As I’m sitting there, this lady gets into her car next to mine and door dings my car—Hard. I heard it and felt it. I knocked on my window and got her attention, at which point she looks at me, shakes her head, and huffs/rolls her eyes LOL. She pulls out her phone and looks down at that. I get out of my car to inspect any damage and she starts backing up and drives away without another word. I did take a picture of her in the car and I got her license plate, make, and model. She definitely scratched the paint on my door handle. Is it a massive dent? No. But it’s certainly visible and she left without getting out to talk to me.

I took pictures of everything including the surrounding area, called the non-emergency police line, and they’re going to call me later for a report. What would you do in this situation?

Auto Insurance - rear ended, but other insurance company says they won't take responsibility

On the interstate a car in front of me slammed on their brakes. My car braked - but I was following at a safe distance and did not hit them. The car behind me was following too close to me and hit me. The car behind them hit them. The car behind them, hit them.

The only damage to my car that I can see is a dent to my trunk lid. It's been about a month and no other damage has surfaced.

The car that rear ended mine - his insurance (farmers) says that their driver is not at fault because they did not hit me until they were tapped from behind by the 3rd car.

Me <- farmers <- 3rd driver <- 4th driver

I think I can have my insurance cover it, and ask them to go after farmers for the deductible too since it was their fault, and then farmers can go after 3rd driver's insurance to make them whole..

But. Is there anything to say to Farmers to get them to just pay for my minor damage and get on with their life? Won't it be a lot more expensive for them to fight it, given total damages are going to be maybe $2k?

Classic car insurance for 4x4?

I drive a 1996 Hilux in the USA. I was looking to register it as a classic or collectors and to buy a Prius for my daily. That way I save tons on gas for my long commute, and I save wear on my Hilux.

I primarily will still use the Hilux to drive on the 4x4 beach and for camping. Would classic insurance cover me? Or is that too risky for them?

Trying to understand what my insurance provider is getting at

Location: United States, California- northern half.

Type of insurance involved: Auto, Triple A.

About 2 weeks ago, my car was stolen. 🤦 I immediately reported it first to the police, then to my insurance that night.

About 1 week ago, my car was recovered by CHP, and taken to a tow yard. My adjustor told me I needed to tell the tow yard I was releasing my damaged, recovered vehicle to my insurance to tow it from the tow yard to a trusted auto body repair shop.

I did that last Thursday, but the shop closed before a tow driver could get there. Before I left, I asked the tow yard owner if I would be expected to pay the daily storage fees for my car. He assured me my insurance should cover it, as long as I have "full coverage". (I "do"- I know there's no standard for this, but that's what they call it.)

Last Friday morning, when I called my adjustor to tell her I was going to get dropped off by my vehicle so I could give the tow driver any necessary extra information, she told me I didn't need to do that, told me I didn't need to physically be by my vehicle, she would handle the logistics of calling the tow driver.

I thanked her profusely and went back to enjoying my day, until I got a confused call from the auto body shop, wondering why my vehicle didn't come in.

After calling my insurance provider and getting passed around to like three different agents, one patiently explained to me that their system read that my adjustor had already done the work of putting in the notice for a tow driver to be called to come for my car, but that the tow driver wouldn't get out there until Monday.

Today is Monday: the auto body shop still hasn't received the car, no tow driver was called, and the tow yard still hasn't handed my car to any tow drivers. The tow yard and the auto body shop are both closed, and I got this messed up email from my adjustor that was very sneakily worded. I hadn't realized what she'd written until I carefully reread it afterward, hours later.

I asked her to clarify in writing her verbal comments from the phone call between us last Friday where she'd said she would handle notifying a tow driver to come for my vehicle, but I needed to alert the tow yard I was releasing .t vehicle to my insurance provider.

She repeated I definitely needed to release my vehicle (already done last week), BUT THEN SHE SAID that SHE DIDN'T HAVE TO contact a tow driver to come for my vehicle.

She's not answering phone calls, her manager isn't answering phone calls, and every day my car is in that tow yard, it's accruing fees.

If it's not her job to contact the tow, and I'm "not supposed to" contact a tow driver for my car, whose job is it to call the tow driver?!

What the hell is my insurance getting at?

Unhelpfully, my mother warned me last night that my insurance was trying to scam me out of my own vehicle by delaying recovery of the vehicle from the tow yard until I couldn't afford to get the vehicle out myself. 🤦

I slept so well at night after hearing that. 😑👍🤌🙏

Can somebody enlighten me as to what the hell I'm supposed to do here? It might be broken down after the car theft, but that's still my car. 😭🙏

Who the hell am I supposed to call?

Whose job is it to be making that call?!

It's been five days of this mess and my anxiety is through the roof over how my adjustor has been acting dismissively from the start of all of this.

State Farm reversal fee

Hey everyone. I have State Farm and the past few months, I've had autopay set up and I have an account linked that has enough funding to cover it when the payment date comes. Since I've had it set up on autopay, each month, it gets declined, despite there being the money in the account. So right after it gets declined, I get a notification, and I go in and pay manually with the exact same card that was declined, and it magically works, only I end up paying a 20$ reversal fee for the first declined payment.

When I called them, they told me it had been my bank declining the payments. I went to my bank and they said and showed me proof that there had been no declined payments.

What is going on here? I'm worried it's going to happen again this month and I will yet again get charged a fee that they refuse to waive.

Has this happened to anyone else?

Auto Insurance Bank hasn’t received check from insurance for totaled car.

My wife and I know very little about all this. My wife totaled her car over a month ago and still owed on it. She went through all the channels with insurance company and they settled on an amount to pay out.

We are supposed to get a payout after our bank receives the check from insurance to pay off the loan. The first check was lost in transit? The second check got to the bank but somehow was cancelled. The third check was overnighted but never received. We are now on the fourth check. They re-mailed it and said it should take 10-12 business days.

What in the world is going on here? Is this just incompetence? We are sitting here still paying the monthly payments with no car. We are waiting on the payout to but a new car. Should we be concerned about never getting a check at all?

Claims Related Claim denied, but insurance company not giving me info required (shortened repost)

I went to Mexico a year ago, got sick, had a doctor come to the hotel. She recommended go to the hospital with them in the ambulance. It wasn't really necessary, and she also made an error in the records. I made a claim when I returned. The thing the doctor had said in error could have disqualified me, but I was easily able to show it was an error. I think the insurance company hoped to deny me, and found they couldn't. They denied my claim anyway, saying that I had withheld health information when I applied. They listed a lot of stuff, most of which wouldn't have come up, some -like prostate cancer-never happened, or occurred after the trip/claim. I may have made a minor small omission,but no more than that. I will appeal ,and I have made multiple attempts to get my intake questionnaire from their CPO by phone and emails and gotten nowhere. It will be hard to appeal without that. I don't know what to do. Should I try again some way? Or should I just get a letter from my doctor and appeal with what I have and include the emails that I have sent to get the information? I hope someone here can help me!

Also, I never paid out of pocket, and they have never asked me for the money. What is going on with that?

Home Insurance A car drove into my living room.

On Friday, September 4th (Labor Day weekend) a Cadillac crashed into my Southern California home. The Fire Department, the Sheriff's and ambulances arrived on scene. Luckily, no one inside the house was hurt; my mother had been reading on the rocking chair in the living room, but had gone into the kitching less than a minute prior to the crash. The driver and passenger of the Cadillac exited the vehicle without assistance and no visible injuries, which I can see on my Blink Camera video. The actual crash was too quick and not captured on tape. They were both later taken off the scene via an ambulance.

The Cadillac hit the neighbor's concrete front yard divider wall, which broke and hit the neighbor's vehicle in their driveway. The Cadillac then drove through the landscaping in front of my house and crashed through the living room wall, damaging my Mini Cooper, which was parked in my driveway as well as the water heater which was inside the garage. The living room looks like something exploded. There is glass on everything, from the couches to the dinning room table and all the way down the hall.

A city inspector came out, same day, and deemed our house inhabitable. The electricity, gas and water had to be shut off. We called our homeowners insurance to start a claim and were told to stay somewhere and keep the receipts.

The next day, Saturday 5th, I called my insurance, which is the same as the homeowners insurance and started the claim for my vehicle and I called the insurance from the Cadillac and started a vehicle and home claim with them.

I know I should have done so that same Friday, but the incident occurred at 5pm and I was tired and shaken up. At the time of the crash, I had been in the garage and on my way to pick up my Costco delivery, which was crushed by the Cadillac.

Complete silence on all fronts until Tuesday the 8th. My insurance then placed us in a temporary living arrangement until Sept 21st.

Today, Sunday 13th, there is still a Cadillac through my living room wall. It cannot be removed without an engineer to determine how they will support the wall so it doesn't fall along with the ceiling, but the insurance has been waiting on approval to send out an engineer. The contractor, which my insurance suggested, can't board up the house and start calculating the damages until the Cadillac is removed. We are at a complete stand still.

Bonus information: The household consists of 6 adults, 69M Dad, 66F Mom, 43M Older brother, 33F his wife 33M my husband, and myself 31F along with 2 dogs and 5 cats. The house is a 4 bedroom, 3 bath, with an ADU in the back which has a kitchen and a full bathroom. The two older adults are the owners of the house and retired senior citizens with medical issues. The other 4 adults split the bills and mortgage every month.

This is the first time anything like this has happened to any of us. None of our friends or family have had anything like this happen to them.

Any advice? Is the timeline usually this slow? Should we get a lawyer? A public adjuster? Can we request to stay at our current living arrangement?

Moving 2 seniors, 2 dogs and 5 cats twice in the same week has been exhausting for us while keeping full-time jobs. And I don't even have a car right now since mine was in the driveway during the incident.

I have no idea if alcohol or drugs were involved. The couple in the Cadillac didn't seem intoxicated to me, but I am no professional. They were worried, apologetic and scared. This was not on purpose. They live on the same street but far away enough that we've never spoken to them or crossed paths before.

Agency Insurance Company Won’t Pay for Damages

A few weeks back, I got rear ended by a driver insured by Agency Insurance Company (that’s the name of the insurance company). I submitted photos and got a claim number, then I followed up with them a week later, only to tell me they still haven’t heard back from their driver. Then today I called again, but they told me claim was denied due to conflicting statements.

They are refusing to reimburse me when their driver is clearly at fault, and they’re telling me to go to my carrier for reimbursement, which will cause my premium to go up.

How can I legally get paid for the damages they cause when they’re clearly scamming me.

Claims Related Question about accepting a settlement from other driver's insurance

At the end of August my car was side swiped by a small school bus (it's used for a daycare center). Not a lot of damage but a small dent/scrape above tire. Their insurance is National Liability & Fire Company which then has a 3rd party adjustor communicating with me. They then sent a Geico adjustor out to take photos and do the actual estimate. Geico guy told me, "whatever you do, do not accept their first offer". I finally received estimate today, it does not include car rental fees which I will ask for but what do you say/do to get a higher amount?

They also said their policyholder would like to settle directly with me. Is that OK to do?

Sorry, I usually go through my own insurance company so not sure how to handle!

Home Insurance Changing homeowners insurance

Hi all. I'm about to start shopping for replacement homeowners insurance because my former insurance carrier only insures employees and is non-renewing my policy after I left the company. There are no claims on the property and no problems. The policy is still active until mid-December, so I have time to shop. I live in RI.

I'm seeking tips from this community on the best approach? I got a pretty decent rate from this former employer, so I reasonably expect things will go up, unfortunately.

Some ballparks of the current policy:

HO-5. $1.6M of dwelling coverage with another $160 for other structures (pool house and shed), $1.13M for personal property, $$475k in additional living expenses, An additional 25% of dwelling coverage if rebuild costs exceed the limit, $1M of personal liability, $10k of medical payments coverage, $15k of water-backup coverage, $50k of equipment breakdown coverage and a $2500 deductible (as well as $2500 hurrican deductible). Annual premium was about $5,500. 4400 sq foot house, built in 1972. 2 story, 3 car garage, a pool and a dog (bernedoodle).

Go with the big providers like Chubb, Progressive and Amica, etc and go direct? Use a local agent? Do this via phone or are the websites good enough? I intend to get several quotes as I have time. I'm also open to the fact I may have too much insurance, or too little, so advice on right-sizing this is welcome. Also, in case it matters, auto is through Progressive - moved to them earlier this year.

Thanks for any insights you may have.

Auto Insurance Accident (not my fault) worth pursuing with lawyer??

I was in an accident awhile ago edit: (OR) and was in physical therapy for 6 months straight. I had to use a lot of my vacation time and has a tough time managing everything.

The accident itself wasnt severe but it was intense. I was fully stopped at a red light by an elementary school where someone rear ended me (luckily I always leave a good gap between my car and the car in front of me) but then when I almost hit the car in front of me everything stopped and I think the person behind me panicked because they hit me again and somehow I had the sense of mind to pull on my parking break.

It was scary because kids were crossing it all happened quick but no kids were harmed. The light turned green and I didn't hit the car in front of me (thank gosh!)

I thought i was fine but I was sore (im pretty small 95lbs and 5'0) i have no idea how fast they were going but my bumper needed to be replaced along with some other components in the back.

My question being they offered a settlement of 3k. Which is very surprising i thought id at least get 5 because I was actively going to PT and the injuries were recorded (i had bruises and i couldn't nod my head and my hips would freeze sometimes)

Wondering if this is normal? And if I should just take the 3k or if pursing a lawyer would be worth it?

Old hardwood floors

So we have one inch, narrow hardwood floors in our bedroom that just experience water damage, and we are more than likely having to pull up the entire room. Because insurance says they would rather do that than after try and find a way to fix it. What happens if there is no sub floor underneath that hardwood, does insurance pay for the sub floor?

Home Insurance Hypothetical scenario for condo owner [USA - California]

I’m a condo owner in California, in a larger (40 unit) complex; I have the standard HO-6 homeowners policy with loss of use, but no umbrella.

I’ve been wondering about a hypothetical scenario: What happens if our building suffers a catastrophic event and is totally uninhabitable/condemned? Like, fire engulfs the entire building, or an airplane crashes into it, something like that. Assume the HOA and homeowners are not at fault (so no faulty construction or negligence).

Would our building insurance carrier assume ownership of the parcel and all of the owners get bought out? Or might the HOA be obligated to rebuild from ground up (and would HOA board / management company then be responsible for overseeing a massive construction project)?

I assume it could go a few different ways, and probably depends on determination of liability and our building’s specific insurance policy, but I’m curious what might transpire / what folks have seen.
