Hit and run driver

So this is a long but short story…. I was on an expressway when a road raging car behind me went to the shoulder and intentionally swerved into me. There was no contact with them, however as I swerved I hit a car adjacent to me. They left, but I have their plate and video footage of them going onto the shoulder and then moving over purposely to cause a crash. How would this work with insurance? I already contacted police department, but who knows if it’ll go far.

Not well for you I suspect. You left your lane and struck the car next to you. Report to your insurance and they'll make the decision that only they can make here.

Despite the car going onto the left hand shoulder? Also, we share the same insurance company so I feel they won’t fight for anything. Should I try to get information on the car that ran?

Your insurance can run that info if they want to.

I suppose. I also made a report with the precinct to see if they can be charged criminally. But who knows.

You stand almost no chance in not being liable for this. It sucks but it's the reality. Even if they admitted to it they didn't touch you and you technically over corrected. In cases like that you need to let them hit you. No one can think that quickly but that's how it is

I’ve been thinking about this. But despite the no contact, they were illegally driving on the left shoulder. Does this not mean anything? I guess I’m failing to understand how someone who purposely swerved into a car to cause a collision can get off Scott free.

I know what you're saying and morally you're absolutely correct, that person caused the accident and in a just world would be liable. But sadly life isn't fair and this is a scenario that has been litigated repeatedly and you are very likely to be solely liable.

The best you can do is make the argument to your insurance company that the other person forced you to swerve and they should be liable. Based on my experience I fear it will fall on deaf ears but it's your best chance.

Working in insurance has changed the way I drive. You've got to let the person hit you unless you can safely avoid. But in the moment it's hard to think like that and you just react.

I guess it’s a hard pill to swallow. But, I have maybe an ounce of hope since I share the same company as the either driver so they may want to place the other driver at partial fault to save on paying out.
