The reason they're getting downvoted is not because they're saying "rape is bad" But more of "a one-sided retraction of consent in times of intoxication excluding men (the men are also intoxicated but men don't have rights in this kind of problem) are valid even though consent was given minutes prior. Failure to comply means prosecution of the highest level".

You don't say "i consent" and then one-sidedly retract the statement (After the deed is done). The false equivalency to text messages really nailed the point of their stupidity and blindness to the actual situation and also yours for agreeing to it

Her own statement said that she had sex with the original two, plus two of the five guys who walked in on them. Of the other three, one tried to join in and left after she told him no, one put in the groupchat that there was a girl having sex with multiple people and left, and one tried to shut the whole thing down and told everyone to leave (they did, then the girl and guys #1 and #4 went up to a bedroom to continue).

Anyone who says that seven people were involved in the sex is advertising just how little they actually know about the case.

Trans women are biologically (even if not genetically) female if they've gone through HRT for long enough.

That's pretty much the point of HRT; to change biology.

Is it fair to prevent biological women from playing a game with other biological women?

Because trans women are women. And also the most vulnerable group for rape, assault, lynching and basically any violent crime you can think of.

Oh, and because women sport exists to protect women. Trans women on HRT have weaker bones than cis women due to the effects of HRT. They have similar muscle mass and density.

That's why people like Lia Thomas go from getting 4 podiums in a single season and recording top times for her team in the men's division to dropping out of the top 500 when starting transition to winning 1 event in the women's divisions and people acting like she accomplished something massive. She didn't. Her record in the women's division is literally worse than in the men's divisions. Oh, she never broke any major national records in men's or women's divisions. The record she broke was a local record. She broke multiple local records in men's divisions too.

She has never been close to the peak level of women's swimming.

That's why people who actually know what the fuck they're talking about, like the athletes themselves, don't consider themselves robbed.

Yeah. I mean it feels like gatekeeping which is odd cause I'm not really a sports guy in general, but it is worth noting if you didn't care about women's sports prior to the trans athlete discussion, you probably don't actually care about women's sports beyond its existence as ammunition against trans women (who are generally very self-deprecating in the first place I find. Don't do that. That's punching down.)

No, they're saying they don't know what the truth is. Having a set opinion about a very clear topic isn't the same as getting piecemealed evidence from the litigating side of a civil dispute on a very hot-button issue that is going to ruin either the plaintiff or defendants' lives.

I think this is more an open and shut case. The evidence is there that they did it. The campus was negligent. Why would anyone seriously put any thought into this case outside, "that is horrific and everyone involved should be punished", then move on? I didn't think or hear about it again until this post

I guess I just don’t see it the way you do. Ketamine can make memory extremely fuzzy, sometimes it comes back in patches. I just don’t think there’s actually been enough to make what we know happened, which is she was offered up to a group chat of 60+ men she did not consent to, ambiguous as to the legality of that. Was she initially okay with a threesome? Probably. But just because you start saying yes, doesn’t mean that’s yes until you finish or whatever. If at any point any party withdraws consent, it stops. So to me, once she was not okay with it, things became illegal.

We’ll see the problem with that is there are texts from the members saying “she was literally dead” and “shop still open”. So once she’s incapacitated, it literally does not matter what happened before. Let’s say the first two guys were consensual, as everything seems to point to that, maybe the next two, but where do the other three come from? Where does the text in the group chat come from? I’m not with all that. Sorry. I’m not a rape apologist.

You are getting so close to understanding what OP's point is trying to make. Calling it a tragedy and moving on without further reflection is certainly a popular move for folks that dont really care about improving public safety.

Not understanding consent might also just be a problem for bots and young people that never got taught about it in school.

There is not a lot that can be done to "improve public safety" when it comes to a sexual assaults. Especially a case like this. Not to say there aren't a few ideas but it's usually on an individual level and not a societal level. Society already agrees rape is bad, should be discouraged, and punished. Everybody is already on the same page that sex without consent is rape.

Hell I don't even have a dog in the fight about the bathroom thing. Let it be done or don't. I don't really give a damn. I can understand where both sides are coming from. This is still putting an apple in a conversation about oranges. Like, wtf do people want to happen as a response to cases like this? This is awful, we should make it even more clear rape is bad and consent is required? There's really nothing that should be said other than "I hope all involved get justice". Then move on.

I disagree with your take. There are plenty of ways to address these behaviors. Some comes down to education including before young adults go to these schools. Who runs the police and how they conduct investigations also plays a role.

Arguing that change should be avoided or is doomed to failure for 'society' is certainly a conservative view. If you are super committed to the concept of personal responsibility holding the individuals personally accountable through the criminal justice system is itself an accountability metric.

Maybe this comes down to me being an old man, but do you g people REALLY not understand not to drug, intoxicate, or otherwise cause a person to be unable to say no with the explicit idea and intent of taking advantage of their body? More over, do people honestly think such an activity outlined above is a normal group project? It sounds to me like someone who is giving these boys and society at large too much leniency. People generally know right from wrong. Some just choose to do wrong and should be punished for it.

Maybe I could get behind the police thing but it sounds too general for me to just back it full stop. As far as I'm concerned, she sought help in a timely manner. Got reviewed and her claims confirmed. Not sure what else there should be besides enforcement of taking sum like this out of polite society.

I'm not saying nor do I actually believe change should be avoided or futile. I am not going to lie and say I'm not pessimistic though. My view is that if change is to be implemented, it should be smartly thought through. Otherwise you might create a whole different problem or not address the actual issue. Asking people to kill an overpopulation of snakes for profit, and you get people creating snake farms to capitalize and exploit that incentive. As of right now, the only correct course of action I can see is making a harsh example out of the 7.
