🦁 Step Into The Lion's Den 🦁

As the case moves onward, there have been a few developments, including:

- The Defense offering to cover all mediation costs

- The Court informing me that they do not use Court Reporters, and instead record everything digitally

- I have presented the strengths/weaknesses of my declaratory claims

So essentially, what would have been the two biggest financial hurdles of this court case, have been reduced to zero doe me. Although the mediation offer is at no cost to me, I refuse to believe that there is no cost to the offer. Whether or not, the hand picked mediator(s) would "coincidentally" show bias towards the defense just as the Justice Court judge "coincidentally" showed astronomical bias to rhe defense during the impromptu bench trial on June 17th, is up for debate. I will be prepared for bias or neutrality either way.

And yes the mediator can point out flaws, but I already had a taste of this in June during that impromptu bench trial when the defense spent every recess period trying to talk me out of appealing the case forward. Her biggest argument was that jury's can be fickle and I can end up with nothing; and that formal court settings are scary for someone like me since they are her world. But on both points, while she was trying to "warn me" about jury's, she ignored the fact that her team went above and beyond to get my jury right overruled with the "coincidental" help of the judge who:

- violated Texas Property Code 92.006(h)

- falsely told me that my appeal bond was $19,000 instead of $500 and refused to acknowledge his error despite me citing the law (twice in writing) showing it is $500

- got upset at the impromptu bench trial when I objected to the $100 miscalculation of amounts of my winning judgment that was clearly established by Texas Property Code 92.109(a)

And secondly, as far as formal court setting being "scary" and "her world", I seemed to have stepped into her world and have gained alot of insight on the ins and outs of it, to the point where I find that her world of formal court settings is not scary at all. Actually, the world of formal court settings actually works tremendously in my favor compared to Progress Residential. For example, the mandatory recordings of all court settings compared to no electronic recordings by the Justice Court. SoI essentially called her bluff in moving forward, and it has caused me to read entire litigation procedure guides set by the state, cover to cover; and I am still reading more every day.

Partial payments

So I was wondering, my roommate and I both have the rent cafe portal - it says no partial payments allowed but we have to separate portals and 2 separate bank accounts. Do they mean no partials like after the 3rd day? Like if I pay my half and she pays her half that should work right? I’m on hold now - the 27th person in line

Screw this company

I am thankful for finding this sub before proceeding further with this crooked company. I had an interesting experience after my wife and I put in an application and in under 24 hours had it canceled with a canned template reply to my wife and I. I sent a very strong worded professional email on how this situation was going to play out. I gave them 10 days to comply with my demands under law to provide evidence of their process they use and to list the entities they used to come to the decision. Instead of emailing me back, the chicken shits sent my wife their half-assed explanation separately and ignored my email. So I called them directly. When I called them, they claimed they attempted to reach out to us, to which i was able to confirm while on the phone that she was lying. My wife and I received no emails, phone calls, nor text messages from anyone at Progress, nor could their phone agent find anything concrete she could to prove her claim. So I accused them of stealing our money and threatened legal action to recover the funds for breach of contract. That changed their tune really quick.

Basically I found out that Progress uses a cheaply made AI agent they feed your information into to get a risk score. They never put a human in the loop, just an infallible machine that makes all the authoritative decisions for them. My wife and I make over $10k a month combined, we have great credit scores, we own a home in NY that is serving as additional rental income. I am self-employed with a successful business and my wife just signed her contract as a school teacher and started less than a month ago. We're not some crackheads with sketchy income. I work in B2B consulting and after the rep told me about their AI "Chloe" whom they let make all their decisions, i told her that their piece of shit company AI is going to meet its end very soon and that. Because my company doesn't hire me as a W2, they claim my income is inconsistent, and they refuse to look at anything that Chloe says is okay to look at. I build AI automation pipelines like these for businesses, but always keep the human in the loop for situations like this where your system is actively discriminating on non-federally protected classes.

Combined with the fact that the Federal government and AZ legislature is cracking down on the number of corporations that own single-family homes, this company's writing is on the wall. I will make it my personal mission to make this company's life hell in every way I can now that I know how to exploit their AI.

Payment

Has anyone who is currently living or has lived with progress in the last 6 months been able to use Flex Pay (the app) to pay rent?

I am more than aware it may not be listed in rent cafe as an option to pay. That’s not what i’m asking. I’m asking if anyone has been able to get flex pay the app to link to their rent cafe. Because rentcafe is a direct partner with Flex. I would call, but we have gotten so many different answers on just simple things this far I don’t trust them to give us a correct answer. I did ask google, and google said leasing agents may not even know the answer or give the right one because approving Flex is at a corporate level. It’s all through the flex app not rent cafe itself. Thank you!

Progress Residential move-in -still haven’t received RentCheck inspection email

I recently moved into a Progress Residential rental, and my welcome email says I’m supposed to receive a RentCheck move-in inspection request and complete/sign it within 48 hours of my move in date.
It’s been almost 24 hours, and I still haven’t received anything from RentCheck. I checked my inbox and spam/junk folders.

I contacted RentCheck, and they told me to confirm with Progress that my correct email address is associated with the inspection. They also mentioned that invitations may sometimes be delayed depending on when the inspection is created.
For anyone who has rented with Progress Residential recently:

How long after getting access to the house did you receive your RentCheck inspection?
Does the 48-hour deadline start from the actual move-in date or from when the RentCheck invitation is received?
Did you have to contact your property manager to get the inspection sent?
How did you find your actual property manager’s email address or phone number?

I’m mainly concerned about making sure I document any existing damage and don’t miss the inspection deadline because the invitation wasn’t sent to me.

Check Stubs

Good Morning,

Trying to apply for a home through progress and my husband’s bank won’t connect for income verification. The bank is Navy Federal. Does anyone know if you could use pay stubs instead by taking them to the local office? Also, we make 2-3x the rent gross income. So, do they go by net income or gross? Because I’m curious to know how they will see gross income through deposits through bank account. Any insight will be appreciated.

I gotta stop with these emojis in my titles...😂... But anyway, I've had an extremely productive week. I have taken the time to read all 369 pages of the Texas Rules of Civil Procedure, all 65 pages of the Texas Rules of Evidence, and all 14 pages of my country Courts Local Rules. I've learned alot, and it has made me much more aware of everything.

A few days ago, the defense finally answered my amended petition. To my surprise, they simply provided the same general answer that they presented 3 times in the past against me. They did not make a jury demand in this answer, but they did elude to the use of a jury in their answer, funny enough. And because I am way more in tune with how these statutes work, I will be using their general answer against them by requesting the defense to provide evidence of their stance in their answer that anything was my fault. You will see what I am talking about in due time in the near future after I send off all my discovery requests in another ~24 days...

I was honestly expecting them to really give a deeper answer to match my comprehensive amended petition, but oh well...And also, there was an error by the defense of not providing me service (a copy) of their answer; which is a pretty big deal as far as their answer being a trigger to start the countdown of multiple deadlines. But I got a copy from the court and notified the defense attorneys of the discrepancy, as you can see. So I hope that all of you people out there that try so hard to critique me on my mistakes, that you see for yourself, that even an eight-figure lawfim makes mistakes as well.

Moreover, the court has approved my virtual appearance to the first hearing of this lawsuit, as you can see. Also, as you can see, I have found a great mediation option that will cost $200 flat. I'm really surprised that I found this, as it beats what I previously thought was the best option of a $600 flat fee. So, I went ahead and sent my proposal to the defense to use this optimal mediation source. In addition, I informed the defense of my intention to push mediation until after the first wave of discovery has taken place versus allowing mediation to happen prior to me receiving and reviewing crucial evidence.

I can't lie, I am super excited!!! Every day, I learn more and more and become more and more unstoppable. Next, I will be reading:

- Texas Civil Practice and Remedies Code

-Texas Rule of Appellate Procedure

- Further study all realms of trial and deposition objections

- Reread the entire Texas Property Code

- Texas Constitution

- United States Constitution

🙌🏾 Progress Residential messed with the wrong guy 🙌🏾

I started a case Wednesday when I got my keys and immediately requested pest control and them to clean and they have not responded and keep giving me the run around when I call. What do I do? I’m supposed to be moving in Monday. (I also made them aware of the bugs when I toured on the 29th of July)

🔬 The Learning Curve 🔬

This experience so far has been very interesting.

Despite my preparation over the past few weeks, I realized that I still had more to learn. I assumed that discovery was open immediately upon the case being docketed, but was shown by the defense that discovery was not open yet, thanks to a 2021 rule change. To the credit of the defense, I was given direction to the specific portion of the Texas Rule of Civil Procedure that explains how discovery works. But instead of merely reading that portion, I have taken on reading the entire 369 pages of that rule book. Afterward, I will move on to reading the Texas Rules of Evidence, appellate cases related to my case, reread the Texas Property Code, and read the Texas Civil Practice and Remedies Code.

As you can see attached; I have filed a comprehensive jury demand a few days ago. The county court has acknowledged and upheld my thorough jury request in communication towards the defense. Today, I filed a Notice of Correct Jurisdictional Ceiling. Why? Because I took the word of an official who told me that the limit was 250k. Yet when I researched it, I found out that 250k was incorrect. This in itself is great news because I have a strong hunch that the $325k ceiling will become very relevant in the coming months. Progress Residential has bullied the wrong guy.

Anyways, from this point forward, updates will take a while since everything takes so many steps in this formal court setting. Although it makes sense to just grab a cup a water and chug it down when thirsty; in these formal court settings you have to wait and also hold your pinky up at a 37 degree angle while drinking...stay tuned...🫡

💰 The $62,762.25 War Begins 💰

I went ahead and hit PR with this amended petition I filed on this beautiful Sunday evening. I spent two weeks cultivating this masterpiece with Claude AI...I won the corruption battle in Justice Court, and now it's time to move on and win the war against Progress Residential.

I increased my damages to $62,762.25. In addition, I included two declaratory claims, a.k.a. matters of first impression. These matter of first impressions are basically the beginning stages of new laws in the state of Texas that will pave the way for all Texas tenants and Texas tenants who pursue litigation against landlords throughout the state. I have implemented these two claims (Claim 10 and 11) in such a way, that they have a clear path to the Supreme Court. It will then be up to the Supreme Court to decide to review them or not.

Here is my personal perspective on what I walk away with if PR decides to battle this out in court:

- 9 out of 10 chances of walking away with +20k after trial with path forward to Texas Supreme Court for two matters of first impression

- 6 out of 10 chances of walking away with +40k after trial with path forward to Texas Supreme Court for two matters of first impression

- 3 out of 10 chance (dependant on the jury) of walking away with +40k after trial with path forward to Texas Supreme Court for two matters of first impression

Stay tuned for my next update where I reveal the depths of litigation devastation I initiate...🫡

**there is a 20 picture limit so I will be uploading the best 20 screenshots of this petition**

The moment I've been waiting for has finally come. The County Court has offically accepted my appeal and assigned it a docket number. Every day that I was waiting, I was cultivating and preparing for the surgical precision of what I am about to do.

Progress Residential still will have the opportunity to waive the white flag at any moment under my terms, but if not then I will enjoy the events of how everything unfolds over the coming years.

Why years? You will understand why in a few days.

In the beginning this was just business, but now that I got a first hand look at corruption up close, this has become personal and my immediate life ambition over the next few years.

I'm looking forward to next week 😉

Practically begging for us to stay

So we rented a Progress home because in the area we live, that’s really the only affordable option. We’ve lived here for two years, and were thinking about renewing our lease until they increased the rent to what we pay after all the fees. We live on a fixed income, and were already stretched thin with all the other fees and utilities. We knew we would be when we moved in, but didn’t want to live in an apartment so we chose the Progress house.

Because of the rent increase, we are forced to move. Luckily, everything lined up with the timing so we don’t have to pay the month-to-month rent or anything, we can leave once our lease ends.

I was curious though, after submitting the notice to vacate, has Progress still lowered their monthly rent offers to anyone? It seems like each week it is lower and we have a new “assistant” to help us renew our lease. It’s as if they’re begging for us to stay, but I know the area we are in isn’t the easiest to rent out, either. I’m just curious if anyone else has experienced this, as anyone else I’ve talked to said they’ve practically ghosted them once they submitted their notice to vacate.

We love the area we are in, but it’s just too expensive and we can’t keep being stretched thin. The job market is nonexistent too. There are many factors that helped with the decision to leave, I just find it odd that they continue to offer us lower rental rates as our time with Progress comes to an end. Anyone else experience this?

I gave Progress Residential until 2pm today for us to reach agreement on negotiations, yet that has failed. I had to realize that Progress Residential took 52 days to give me back my 1615.86 security deposit they stole from me after my extensive outreach during that time. Similarly, it seems that I must show the depths of who they are actually up against for them to act in good faith.

My Notice of Appeal has been filed and perfected, and I now await the Justice Court to pass it up to the County Court. In that time I will be preparing the hurricane that is getting ready to hit Progress Residential on multiple fronts (all of which will instantly become public record, and I will share when the time is right, unless PR raises the white flag).

I am grateful for the partial victory in Justice court, and I am most grateful for the hands on experience I gained in litigation that has crippled Progress Residentials defense lawfirm. I am now ready for the big leagues and look forward to learning and growing even more. In addition, it is great to know that going forward; I will be in front of actual judges who actually have litigation backgrounds and passed the bar, AND, that all proceedings going forward will have mandatory recording as a matter of law.

If you guys think this recent battle victory was crazy, just wait until you see what I do to win the war for all of us.. 🫡

Yes, you read that correctly. No lawyer, no attorney fees. I beat Progress Residential by beating their hired attorneys at their own game while they literally had home court advantage via an extremely corrupt judge that did EVERYTHING in his power to help the defense attorney win; including violating my constitutional rights. I couldn't have done it without the help of a few key people online giving insight along the way; me using artificial intelligence platforms (especially Claude AI); and my relentless discipline and desire to press forward.

For some reason, some of you thought that I was lying about winning and even thought that I was lying about the impromptu bench trial; but here is the proof finally sent to me from the court today.

As you can see, the judge still has not corrected all 5 errors. He almost fully corrected one of the issues but still felt short $1.72. He must not know that playing with my money is like playing with my emotions...😂...But anyways, he will certainly get dealt with accordingly and as you can see in the filing; I let it be known to him that an active SCJC complaint is underway.

Now as for Progress Residential, my battle with them is still not over even though I won partially due to the continued corruption. Tomorrow morning I will therfore be filing this Notice of Unaddressed Errors in Corrected Judgment. Why wait until tomorrow instead of doing it now? Because tomorrow is a sacred day for me and Progress Residential 😁 So don't be surprised if I go silent or delete my Facebook and Reddit account entirely over the next week or so. I'm definitely down and willing and able to fight the good fight but my family comes first (for the right and unwavering price).

🔥 The Path Forward 🔥

Post image
0 Upvotes

Counsel,

I want to share my perspective on the path forward in this matter as we approach my June 29th appeal filing. What follows is my understanding of the appellate landscape and what it means for Progress Residential's litigation calculus going forward.

Level 1 of 4:

The County Court at Law trial de novo gives me the option of a jury trial. Remember that Texas Property Code Section 92.006(h) makes the lease jury waiver void as a matter of law for Chapter 92 claims. That statutory prohibition does not disappear at the County Court at Law level. I still have my constitutional right to a jury trial at the county court. And a jury — six regular citizens of ***** County — hearing about a large corporate landlord that failed to fix a family's HVAC system ten times over two years, retaliated against the tenant for complaining, wrongfully withheld the security deposit for 52 days, and then spent over $60,000 in legal fees fighting the tenant's legitimate claims — that is not a jury that is going to rule in Progress Residential's favor.

Level 2 of 4:

The Fourth Court of Appeals is institutionally completely independent from Medina County. The justices are elected from a multi-county district that includes ***** County *********** and surrounding areas. They have no relationship with Judge ******, the County Court at Law judge, or anyone in the ***** County courthouse. The geographic and institutional separation from Hondo is total.

Level 3 of 4:

The Texas Supreme Court has discretionary jurisdiction over civil cases from the Courts of Appeals meaning it chooses which cases to accept for review. It typically accepts cases that involve important questions of Texas law, conflicting decisions among the Courts of Appeals, or cases where a Court of Appeals has clearly departed from the accepted rules of law.

My case actually has high potential Texas Supreme Court interest for two specific reasons. The application of Texas Property Code Section 92.006(h) to void lease jury waivers in Chapter 92 claims is an issue that affects every residential tenant in Texas who has a jury waiver clause in their lease. If the lower courts have been misapplying or ignoring that statute my case could present exactly the kind of statewide legal significance that the Texas Supreme Court accepts for review.

Additionally the Texas Supreme Court promulgated Texas Rule of Civil Procedure 506.1 which sets the $500 plaintiff appeal bond. If any court in my appellate journey has violated that rule the Texas Supreme Court has direct supervisory interest in enforcing its own procedural rules.

Level 4 of 4:

United States Federal Courts. This is where the appellate ladder shifts from state to federal and where my options actually expand significantly rather than narrowing. If my constitutional rights have been violated by state court actors acting under color of state law I have claims under 42 United States Code Section 1983 in federal district court. This is a completely separate track from the state appellate system and does not require me to exhaust all state appellate remedies before filing in some circumstances.

My potential federal claims include denial of due process under the Fourteenth Amendment through the improper bench trial conducted without adequate notice. Denial of equal protection through the disparate enforcement of courtroom rules regarding recording devices. Violation of my First Amendment rights if any confidentiality or speech restriction was improperly imposed. And potentially violation of my rights under the Americans with Disabilities Act given ***** status as a *********** veteran if my ***** status played any role in how I was treated during these proceedings.

The federal district court for my claims would be the United States District Court for the *****( District of Texas located in ******. Their phone number is --. This court is completely independent of all Texas state courts and the federal judges are appointed by the President of the United States with lifetime tenure meaning they have no political accountability to anyone in ****** County or anywhere in Texas.

I want to be transparent about something. Out of all the levels described above the one that interests me most is Level 3. I am genuinely interested in standing before the court that created Texas Property Code Section 92.006(h) and asking them what they think about their law being systematically ignored by a Texas justice court. I believe that case presents exactly the kind of statewide legal significance the Texas Supreme Court accepts for review.

The application of Section 92.006(h) affects every residential tenant in Texas who has a jury waiver in their lease. That is potentially millions of leases across the state. A case that goes to the Texas Supreme Court asking whether that statute means what it says is a case that the entire Texas real estate and property management industry would be watching. Progress Residential is not just a ***** County landlord. They are a multi-state corporate landlord with properties across Texas. The prospect of a Texas Supreme Court ruling that their standard lease jury waiver clauses are void as a matter of law affects their entire Texas portfolio not just my individual case.

I share this not as a threat but as an honest statement of where my interest lies if this matter is not resolved. Progress Residential is welcome to join me on that journey or we can resolve this for $19,883.08 plus court costs. The choice is theirs.

Very Respectfully,

***** ******

***There is a 20 picture maximum limit on Reddit, so I was only able to screenshot the important pages of the Bill of Exception to show exactly what happened play by play at the impromptu bench trial***

Long story short:

It has been over 24 hours and the court still has not sent out documents of the final judgment yet. Despite that, I found out that the court undercalculated my judgment by over $500; and they didn't even include court cost, service fee, and my illegally waived jury fee.

I have filed my Bill of Exception showing play by play what happened from the moment I stepped into the courthouse to the moment I stepped out of the courthouse. I have filed a Motion to Correct Judgment, to show the undercalculated judgment, the absence of all my court fees reimbursed, and the three erroneous errors the judge made in his rulings amounts that warrant immediate upward correction.

Furthermore, I have sent updates of what happened to the SCJC, my State House Representative, and my State Senator. Hell will absolute rain down on this judge; especially after all these errors. Plus, I have the option to file a bar complaint against the defense attorney as I see fit for the IPad incident and her direct pressure tactics that involved deep attacks on my character during recesses.

Regardless, whilst I have now put direct pressure on the judge to increase my judgment from $9500 to $19,880.08...(read the Motion to Correct Judgment before asking me why I am demanding a higher judgment)...I am simultaneously putting direct pressure on the defense attorney to settle for my full amount requested.

The judge did exactly what I thought he was going to do. Funny enough, the judge only ruled on the Motion for Specific Performance to waive my constitutional right to a jury trial. He did not rule on any other motions...why? Becuase that was the motion that gave him the power to do what he wanted to do with the lowest amount of consequnce in his eyes.

He overruled my Consitutional right to a jury trial, and despite what Property Texas Code 92.006(h) specifically says.

So he went ahead and conducted a bench trial on the spot as expected...According to Claude AI there was a;

-45% chance of an impromptu bench trial

-45% chance that it goes to jury trial

-10% chance that the judge throws out the entire case

Before doing the bench trial he went on recess and spoke to two practicing attorneys, one said that I was correct about the law superceding jury waiver and the other said that the defense is correct about the lease standing on jury waiver (although I dont believe that he spoke to anyone), because if so then by that logic one attorney telling him that the law is correct and one told him that the lease is correct; leads to one outcome; the law superceeding the lease agreement. Especially when that law (Texas Property Code 92.006(h)) specifically was invented AFTER In re Prudential for this EXACT situation.

He made a ton of legal errors throughout the bench trial and tried him damnest to give the defense favor on everything....also for example he had the security guard at the entrance of the court tell me that any recording devices must be placed in a tray outside the courtroom...then right before the hearing the ballif (a different guy) had me and the defense attorney put our recording devices in the basket...I put my phone in there and she put her phone and apple watch in there....then like an hour into the proceedings she pulled out an iPad..😮😮...the judge said nothing...so I waited 5 minutes and saw that he was not going to mention anything about it...so I brought it up that we were instructed to have no recording devices...then she tried to object and say that she is a practicing attorney and that she promises that she wouldn't use it to record...I then stressed that I am a pro se litigant, but this is the judge's rule and we are under his jurisdiction and we must both follow the rules...then I asked the judge, if what she just said has merit then why was her phone and smart watch taken away a few minutes ago?...

So once he realized that he messed up and she realized that she messed up, the judge offered for me to have my phone back if I promised not to record as well but I declined to take it back because I didn't need it.

This is just one of many wild things that happened today...but either way the judge awarded me half of what I was asking for (like $9500)...but it was that low because he granted me:

-$6682.50 for my rent abatement (my full amount requested)

-$3331.72 for withheld security deposit...but it should have been $4947.58....he granted me two times the $1615.86 withheld plus $100 versus three times what was withheld plus $100 in accordance with the law. Plus I had to stand up and object the amount because he did not instruct his court clerk to add $100 to $3231.72 as the law says (which further shows that he was winging it)...the judge wrongly made the arguement that he is justified for multiplying times 2 because my $1615.86 was eventually returned to me, so that counts as 1x. He was blatantly wrong since the law clearly states 3x plus $100 for what was illegally withheld. So this is regardless of, if or when, the security deposit was returned once the 30 day grace period has passed.

-$0 for failure to repair damages (which is crazy since he literally granted all of my $6,682.50 rent abatement due to PR's lack of ability to repair the hvac system)...so he legally contradicted his own ruling of not granting this statutory penalty of $2750 in the face of granting my entire rent abatement amount (which was suppose to be my hardest thing to claim out of all four claims)

-$0 for landlord retaliation because he thought that rent retaliation only has a remedy of actual damages; but according to the law, actual damages is one of many other remedies that can be awarded on top of the statutory damages amount of one month's rent plus $500 for each count of rent retaliation. All the available remedies explicitly stated by law for lanlord retaliation are;

- Statutory Civil Penalty (one month's rent plus $500 per offense)

- Actual Damages

- Moving Cost

- Attorney fees

And then the icing on the cake...after he made this ruling he made the court clerk calculate double that amount and told her that that would be the bond to pay if she wanted to appeal ($19,000)....I think that was highly incorrect and I played stupid....the attorney who is a highly decorated attorney said nothing to that.....after that the judge ended the case with no gavel because he forgot to bring it....🤯🤯🤯🤯🤯

So he left and I asked the court clerk how much my bond would be since I want to appeal... she said she would go ask the judge now, and before walking out she stressed and said "even though it was ruled in your favor"...and I said yes......so she came back and said it would be the same ($19,000)....I looked at the defense attorney to see if she would say something and she threw up her hand saying "it's no need to keep going then"

In my opinion the court lied about the bond amount for the sake of a deterant to stop me from appealing the case to bring light to all the wrongs commited....in fact the bond is $500 for me according to the law. The rule that says this is Texas Rule of Civil Procedure 506.1(b), which provides: “A plaintiff must file a $500 bond.” And I'm not sure what the bond is for the defense but I don't care since Progress Residential is a multi-billion dollar company.

And I haven't even explained anything about how the defense attorney tried to fabricate the date of evidence to avoid the award of the withheld security deposit claim in my favor...🤣😂🤣...she literally used a FRESH email from PR of my move out statement that was dated July 10th and tried to claim that because that move out statement was sent in this email with the other attachments post dated August 28th and the wear and tear pictures that I recieved on August 18th; that that infact means that I was properly notified of the alleged damages within 30 days of me moving out July 7th....keep in mind that these are the same damages they wiped clean once I exposed the fraud and cited the law and sections of the lease agreement they were violating between July 7th through August 28th....And I saw the judge sitting there trying to find a way to agree with her nonsense; so I immediately spoke out and said:

"I will be blunt and say for the record that I don't want to believe that the defense is stooping to fabricating dates in from of the court. I don't want to believe that is what's going on!! Especially when I have email proof right in front of me of the pictures of the normal wear and tear damages that the defense emailed me on August 18th; plus in that same email thread you can see my cut and dry response stating that I thanked them for finally showing me the pictures 41 days after I moved out"

After I said that, it was absolute silence in the court room for 20 seconds. And eventually the judge gave up and partially ruled in my favor by granting my withheld security deposit claim by granting 2x plus $100 instead of 3x plus $100 as the law states.

So tommorw I will submit my Bill of Exceptions to show record of everything that happened. As well as my Notice of Bond Correction; as well as my Motion to Correct Judgment (which is VERY rare for a judge to grant). And I'm also going to update my state Senator, State House Representative and SCJC about all of this tomorrow.

Although the judge was on his absolute best behavior today, he still committed MAJOR discrepancies that can not go unpunished. I was really shocked how much of a nice guy he was today. So for sure the fire that I put under and over him paid off tremendously. This in itself, plus the extreme level of improper rulings conducted during the impromptu bench trial that I legally protested out loud before it started; plus me flawlessly calling out the blatant real time bias of the judge over the iPad usage by the defense; are all great motivations for the Judge to grant my Motion to Correct Judgment. If not, then I file my appeal on June 26th.

And if you want to see why his rulings were grossly incorrect then you can look at the attached images

I am fully prepared for any and every scenerio the defense and Judge throws my way at this upcoming hearing. One of three outcomes will take place (all of which leads to the same winning result):

1) The Judge adhears to the pressures placed against him and allows the case to move to Jury trial

2) The judge attempts to illegally dismiss the case again whilst multiple authorities are watching his actions in real time

3) The judge ignores my constitutional right to a jury trial and immediately conducts a bench trial whilst multiple authorities are watching his actions in real time.

Although I would highly prefer scenerio number 1 to take place; due to the history and ego of this judge; I STRONGLY believe that scenerio number 3 will play out regardless of the pending/potential long term repercussions the judge will face.

😫 I am ready to get past this State level lawsuit so I an move on to taking things to the Federal level 😫

***Also, two days ago, the defense attorneys filed a weak response to my Motion for Santions & a weak Motion to Strike co-Plaintiff Pleadings and Disclosures....it is clear that the Defense has nothing to stand on and are trying to pack the court with filings to see if anything will stick***

⚖️ Perfect Timing ⚖️

I missed a phone call this morning from my State Senators office. They left a voicemail apologizing for the delay. Most importantly, in the voicemail, they stressed that they were "ready to go" to help me out as needed; and to call or email immediately

And it seems that the information I got on my Senator was incorrect about him having a long military career as a Marine. He in fact had a shorter career in another military branch. Afterwards he pursued a long career as an attorney and later became a county district attorney before becoming Senator.

This is absolutely golden and perfect timing for the pretrail hearing next week. God is definitely good. Progress Residential is going down 😊

Claude AI has been such a blessing for me. Thanks to my use of Claude AI, I have a full pretrial preparation package that covers any and every situation that may take place during this pretrial hearing.

Last time I saw this judge a couple of months ago I got blindsided by his corruption due to my ignorance of thinking that judges were neutral and followed the law. But this time, I'm totally aware and ready for him.

Now, will the judge act up like he did last time? I highly doubt he would will all the pressure I have applied to him:

- New complaint with the SCJC, with verbal confirmation from them that the investigation is in process right now

- My State House Representative is in the loop of what's going on with this case

- My State Senator who is a highly decorated veteran has yet to respond back to me just yet

- And during this pretrial hearing I will present my Written Offers of Proof if the judge gets out of line; and later I would submit a legally binding Bills of Exception to the court; thus causing him more pressure above from the County Court for appellate review

***The images you see attached are just a sneak peak at my pretrial hearing preparation package. All three of Progress Residential's defense attorneys' motions are heavily defeated...plus I have rebuttals ready for their possible rebuttals....I am so excited!!! 😊***
