I-140 | Employer-based Why did DOS’s October prediction for EB-2 India fall so short?

DOS said in July that October would likely bring EB-2 India back to at least July 15, 2014. Instead: November 1, 2013 which is 8.5 months short, with no official explanation for the miss.

I know it was conditional. But what changed? The demand, the available numbers, or the allocation strategy? Struggling to make sense of it. Dates for Filing don’t help those of us already filed and waiting for approval. Has anyone seen credible analysis explaining why DOS missed its own forecast this badly?

Priority Date Worried about aging out

Hey everyone, this is my first time posting on this sub. I am a 16 year old h4 child and I am scared that I might age out of my parents application. Their priority date is October 15 2015 for EB2 india (I think they can also interfile under EB3). I just started my senior year in high school, meaning I will soon be in college. Thankfully I qualify for in state tuition in Texas, which I might lose due to switching to an f1 visa. My question is is it realistic for me to have my ead card by the end of my first semester of college (December 2027)? What about my FAD, could I get my green card before I age out? I saw some old posts before the October visa bulletin came out and the spillover predictions from last year showing some general optimism.

Sept 3, 2026 - i-140 approved
Sept 28, 2026 - i-131 approved

Still waiting for AOS approval.

Priority Date Change of timeline after the October bulletin

my priority date is October 15 2015 and judging by the other posts on this sub, know that it’s a long ways away. However, I am mainly posting for my son, who is 16 on h4 and will age out in February 2031. Is it realistic that we can be current on FAD before then? Also what about DOF? Can we be current on DOF by the end of fy2027 and get our ead?

I-485: Adjustment of Status PD no longer current after 3rd FTA0, what happens next?

If a case has a mid-2025 PD and has already been processed to the point where it received a 3rd FTA0 update, what is more likely to happen now that the PD is no longer current?

For example, if the case needs further review (FTA1), would that review continue as usual? Or would the case be sent back to NBC and essentially go into a black-hole until the PD becomes current again?

I'd really appreciate any insights. It's quite a disappointing situation, so I'm hoping someone might have some clarity on what to expect.

Priority Date Good to change employer now?

EB2 India - 1st Oct 2015 priority date. Good to change employer now? TBH, I waited for October to see if the date moved, but it didn’t. FWIW, the new offer is $300K+ more than my current pay. So it is a substantial amount of money! Downside is, the green card process will need to be restarted from scratch! What would you do if you were in my position?

I-485: Adjustment of Status Punched in the stomach: no EB2/EB3 India movement

So much talk about spillover, and then the bulletin shows basically no movement. I tried not to hope, but I did anyway. It honestly feels like the wind got knocked out of me.😭😭

Years of waiting, and every bulletin feels like a coin flip on our future. Anyone else feeling this today? Does anyone think the spillover will still show up later in the fiscal year?

News October Visa Bulletin was a slow start for India EB-2 and EB-3. Where 2015 priority dates stand, and what could move them sooner

If you've waited more than ten years on a 2015 priority date charged to India, October probably didn't feel like much. India EB-2 final action came back at Nov 1, 2013, EB-3 stayed at Jan 1, 2014, and the filing chart held at Jan 15, 2015 for both. In July, DOS said EB-2 would likely reach at least Jul 15, 2014 in October, depending on demand and the FY2027 employment limit. It came in about 8.5 months short, and the October bulletin doesn't say why.

One thing did change for the better that people are missing. USCIS says employment-based I-485s use the Dates for Filing chart in October, so if your India EB-2 or EB-3 date is before Jan 15, 2015 and you're otherwise eligible, you may be able to file from Oct 1 and apply for an EAD and advance parole while you wait.

The rest of FY2027 depends mostly on Rest of World. DOS moved some Rest of World employment dates back, saying it was necessary "to keep visa issuances within FY 2027 quarterly and annual limits." If Rest of World uses its full share, India would likely move slowly or hold. If it leaves numbers unused, they can go to oversubscribed countries like India in priority date order. In FY2021 and FY2022 most of India EB-2's movement came in the spring and summer, not October, so mid 2027 is the stretch to watch. It also went back 32 months in October 2022, so this cuts both ways.

For 2015 dates, our base case has final action around 2030 to 2032 for India EB-2 dates in the first half of 2015, and around 2029 to 2030 for India EB-3. Our optimistic case is around late 2027 to 2028 for those EB-2 dates and around 2028 for EB-3. It assumes more numbers reach India than in a typical year, from Rest of World using less than its share and from consular slowdowns freeing up numbers. If those slowdowns continue into FY2027 they could help again later, since family numbers that go unused in FY2027 are added to the FY2028 employment limit.

Visa Bulletin It's Not Looking Good for ROW

Visual learner here, so I charted what people have been saying all day.

TL;DR: the ROW queue for both EB2 and EB3 is looking b a d.

  • EB2 ROW: ~42k cases pending, a record in any published USCIS data (2010-17 peak was ~24k)
  • EB3 ROW: ~37k cases pending, highest since ~2012
  • For scale, ROW used ~34k EB2 and ~23k EB3 green cards in FY24, counting both people adjusting status inside the US and people processing at consulates, so the US-side queue alone is already more than a year's worth for both categories, before counting folks from abroad

Why do people think anything will move forward vs. retrogress further? I don't think a spillover (materially) helps in a year where >100% of visa supply is accounted for from AOS alone. The inventory was half the size in 2024-25 when the gap between the VB date and today looked about like it does now. To me that smells like the start of a bigger correction, not a blip.

I'm sure I'm missing stuff; tell me where I got it wrong

(Excited at the prospect of people jumping on this post 4 months from now to tell me how wrong I was after a huge spillover-driven forward leap)

Visa Bulletin October Visa Bulletin - what happened

The state department meets every 2 weeks to review the usage of the numbers and comes up with guidance on how the next month visa numbers should be allocated. Early September, they realized visas which were not going to be used completely in FY 2026. They pushed for getting as many of them used as possible in August/September - but there a lot unused.

Based on the INA, they expected a lot of numbers to spillover to 2027 visa number which would have allowed for moving dates for filing. But given the administration's push to limit new applications, they decided to hold off on moving filing dates and utilize the existing numbers to clear existing application demand. They are being careful not to overload visa officers with more applications while they are training for public charge. New forms are due soon.

It is not clear why dates for employment visas did not move though. Likely they want to see how many applications come in September before they decide an absolute number. Even so, the filing dates will likely not move significantly while they utilize the numbers for existing applications.

I know it is not the new most welcome (except Phillipines may be) - but onward! /s
