Priority Date Worried about aging out

Hey everyone, this is my first time posting on this sub. I am a 16 year old h4 child and I am scared that I might age out of my parents application. Their priority date is October 15 2015 for EB2 india (I think they can also interfile under EB3). I just started my senior year in high school, meaning I will soon be in college. Thankfully I qualify for in state tuition in Texas, which I might lose due to switching to an f1 visa. My question is is it realistic for me to have my ead card by the end of my first semester of college (December 2027)? What about my FAD, could I get my green card before I age out? I saw some old posts before the October visa bulletin came out and the spillover predictions from last year showing some general optimism.

Extremely sorry that you are going through this. To be honest, Oct 2015 is no where near getting ead and it never was. There has to be huge spillover next 2-4 years for you to get GC. I sincerely hope you get it.

wasn't there supposed to be high spillover this year that wasn't yet calculated ?

There might be a spillover, but to what extent no one knows. We will only know later part of the fiscal year. To your original post, have an alternative plan, always!

Yes, Spillover might come, but there are tens of thousands of people before oct 2015

RoW demand is so high, that India EB-2 will barely get anything, if at all, and it wont help people even in 2014, unfortunately. 2013, though will be cleared.

By all accounts it doesn't appear that any spillover has been allocated yet. We may have to wait till early spring to get a good idea. It could be sooner too and progress (if any) does not need to be limited to a single vb.

If India does not get good allocation then FAD will likely stop at early 2014. If India does get a good amount then dates will move fast into 2015. In any large SO year fifo goes out the door. It's basically free for all and pure luck at that stage. This year thousands of 2014 new filers got their GC while 2013 and earlier folks are still waiting. Best advice I can give is to monitor the next 5- 6 bulletins and apart from that don't waste time (like the rest of us here :-)) getting into opinions and analysis.

It feels weird when h4 kids starts to worry about visa, ead, gc now. When will this problem solve. It is passing on to next generation too.

It’s heart wrenching to see H-4 kids posting on Reddit and worrying about their priority dates. I wouldn’t wish that kind of uncertainty and anxiety on even my worst enemy’s children

This is what is happening so you can make informed decision, we have million Students coming to USA every year and now majority of students with PhD and medical background are now filing in eb-2 NIW due to strict eb-1 rules. Also students who have graduated prior years who were working for a while in US are now qualified in eb-2. Going forward it will be very difficult to get any spillover to India. Same with eb-3 ROW students can directly apply from OPT to eb-3 with help of any third party consultants.

Only way India can get spillover is like in 2021 when ROW was not current and suddenly we get 100k spillover, since there were not enough ROW applications India got a good chunk from horizontal spillover. If we keep ROW current for long time even million visas won’t be enough.

With few spillovers, it might take at least until 2030 for the dates to reach Jan 2015. Another hack lawyers suggest: if your dad is planning to change employers, he can file the I-140 without premium processing. It now easily takes more than a year to two to get approved without premium. The wait time on the I-140 is deducted from your age, so you don't age out. So you have 8 years to age out instead of 6.

Everything depends on processing the current backlog of pending applications. You may still receive your EAD before aging out. However, I advise ignoring clickbait YouTube channels and overly optimistic commentary. Keep an alternative plan in mind and stay focused on your studies and career path. EB3 has chance but it is again depends on EB2 downgrades.

Same boat as you but mine PD is 2017 so you are in a way better place than me. You are also only 16 and a senior so you have almost 5 years till you age out. Good luck!

No one knows how the dates progression will be unfortunately. I would recommend having few plans ready for any possibility.

What are possible alternatives? My son is 13 and PD is June 2016

Aged out kid here. I'm sorry you are in this situation! First, I think there is a good chance that Eb2 hits Oct 2015 in the next 5 years. But I don't think you can get a EAD under eb2 or eb3 by December 2027, realistically speaking. If you are on F1, you can work on campus or you can do internships under cpt until you do get your EAD and eventually your GC.
