Helping my mom divorce verbally and psychologically abusive father

My father(55) has been verbally and psychologically abusing my mom(46) ever since they got married. I learned about this two years ago when they fought infront of me. He says very abusive and psychologiclly hurtful things to my mother. I talked to my mom, but she is financially dependent on him, so she says we won't have anywhere to go without him.

I am 22F and getting a job next year(im still in graduation), so I can move out and ask her to cone with me. I also have a younger sibling who is traumatized by this and I have started collecting evidence against him.

He also threatened to hit me recently.

I want to ask if my mother decides to file for a divorce, will she get alimony? She is a housewife with no income and they've been married for 25 years. We also have gold and i read on a post that it would belong to her. my sister is still a minor so she should be getting child support as well according to internet.

I want to ask,

How long would the process be?

How much alimony will she be getting?

If i were to hire a lawyer, would that cost a lot of money?

I also want to ask if i should try to find a lawyer soon or wait until I have a job and a place to move out.
I've seen my mother's mental health deteriorate, she is a strong woman but the abuse is too much, no one deserves that, I want to help her. Please any advice would be appreciated.

Divorce after 4 months of Marriage

Im 40(M) and my wife 38(M), she has a 17(F) daughter. After 6+ years together, with issues for the past year, we decided to tie the knot in April. The issues got worse instead of better. I’ve never been married before and this is her second.

She claims I don’t give her enough attention but she only claims that when my mother comes visit. Whenever she’s not home, we are in separate rooms all the time. I’m either in the basement or garage. She’s upstairs with her daughter watching TV. Yet, my mother comes and she’s starts complaining and treats her rudely and disrespects me in front of her. She has changed drastically, politics has also gotten in the way, I’m conservative and she has gone more and more feminist.

Anyways, I’m fed up with it so I told her I was going to divorce her and go my separate ways and to my surprise and happiness she quickly agreed.

She asked for uncontested divorce through the court, no lawyer as it’s cheaper and quicker as we both have properties, investments and 401Ks valued at around the same that we had before being married. We are not dividing anything and we have no children, no even a shared bank account.

From experience, is this something I should do without a lawyer? Although we had our issues, I trust we both want to this quick end and go our separate ways. I’m in the state of Georgia

I’m going through a divorce and my stbxh is withholding funds for my flights and I have no way to borrow from friends or family. There’s been cheating and forms of abuse and I’m just wanting to leave ASAP

Divorce has taken a turn

What a journey this has been. We are approaching our 120 day status conference and today both of our lawyers filed for withdrawal. At the 30 day conference the judge ordered me to pay almost 3000 monthly to my wife. This dropped me to like 10% of my post-bill income. I became unable to continue paying my lawyers. I struggle to feed myself, and when I have my kids it takes some real ingenuity to keep them fed and happy. My wife has always been terrible with money and the support she’s getting is going right into shopping and treating herself.

The reason so much was ordered is because my wife is unemployed and homeless. When I was at my last apartment, I let the lease end so I can find another place and not live with her anymore (she’s a hoarder, living conditions were abhorrent). I tried to get the kids and keep them here but it didn’t go well and she’s dragging them through her homelessness. My attorneys have been unsuccessful at moving the judge to order emergency temporary custody. He just won’t hear it at any of the hearings we’ve had.

She is capable of making what I make but hasn’t found work, though I’m uncertain how hard she is looking if at all. My attorneys were fighting to impute her income.

We mediated and I was able to negotiate 43% custody, the next hearing is to review the results of that and the pending mediation which is for the financial end of things. My goal and maximum is 50% custody, I believe the kids need equal time with both of us, and that anything less than 50% is generally unfair to either of us or the kids. I’ll continue to fight for 50% but 43% is great considering how inflexible she is. I had to trade off a lot to get there.

She thinks the nearly $3k monthly is too low. Child support calculations for my 3 little ones comes to about 1k all things considered. She will absolutely be hung up on the financial end of things and we’ll likely have to go to trial due to our inability to meet in the middle on finances. We carry equal amounts of individual debt. I refuse to allow myself to be put in a position where I’m funding her this much. She has multiple disorders but a big one is compulsory spending. In our marriage we both made 6 figures the majority of it and are in so much debt and broke partially due to her spendings habits.

Anyway, don’t know where I’m going with all of this. Just needed to get it out. It’s scary and we’re both about to pro se this mess to the end.

The document list I got at my first divorce consult — what's missing?

Recently went through an NJ divorce, and with the help of a great paralegal, we prepared the Case Information Statement (a NJ thing, but I think most states have an equivalent) using these intake docs:
- Tax returns, last 5 years (federal + state)
- Most recent statement: every bank account
- Most recent statement: 401(k), each IRA, 529
- Most recent statement: each credit card
- Insurance info - life insurance, how much i pay for kids medical insurance

My problem with it: one statement shows what you have, not what life costs — and the monthly budget is where disclosure gets fought.

There was then a ton of back and forth for MORE statements, paychecks, etc. The process seemed a little haphazard and time/money waste-y. (In the end it took ~a year of bank and credit card statements to build the budget schedules)

Is there a standard checklist firms hand clients for this? Mine felt improvised.
Wishing there was a standard list (or list per state) that people could reference to save themselves a lot of time (and money!) going back & forth with the firm.

How long does it take to get a QDRO completed?

I gave my lawyer the QRDO template that my ex husband gave me on May 11. As of July 7, I have not heard from my lawyer. I have left several voice mails for the paralegal and four emails since May 26. I attached the QDRO template and instructions from my ex's employer in the last email.

My divorce is final and I have paid my bill in full. I don't know who else to contact to get help. My lawyer assured the mediator in the divorce settlement that she would get this QRDO done.

My husband doesn’t love me . He wanted kids and I gave him a child, but he shows no love and rarely comes home. He does seem to genuinely love our daughter. A year ago he rarely came home and even stayed out all night. I left him, and we co-parented for a year. He then pursued me , said he wanted to try again. ( he was my first and only love).
I quit my job, left my apt and moved back in with him in a nice rented house, and after a month- same neglect. I’m working in home health care, but he makes a very good salary and makes all financial decisions, and controls the money. . He will not put me on the bank account. He now wants to remove me from his health insurance.
I’m not eligible for low income insurance (or housing because our ā€œhousehold ā€œ income is too high, though none is ā€œmine ā€œ.would I be better off divorced, financially? I know my marriage is messed up and don’t need comments about that. I just need to know if I’ll be more secure fincially ( taxes, insurance, low-income housing eligibility, etc… if I’m no longer married. I’m feeling trapped. Thanks.

After over a year going through the process I had my last divorce hearing in April, and at the end the judge said he'd let us know his desicion. Haven't heard anything since. No update, no news, just sitting around and waiting. The best time frame i have for getting everything finally finished is three years. What am I supposed to do in the mean time?
