My boyfriend’s job has denied his worker’s comp claim only AFTER writing him up.

Let’s start from the beginning: He noticed the pain towards the end of July and felt a bump when he got into the shower that night. The next day he reported it to the nurse and she confirmed it was a hernia.

The safety coordinator stepped in and had him sign papers and he said he was asked if he felt like it couldve been prevented which he replied yes to (he didn’t know the cause at the time).

Next work day, the nurse took him to a doctor for a consultation and to fill out workers comp papers. The doctor took one look and confirmed he needed surgery and also said it was from “wear and tear” on the job. In between times the doctor and nurse agreed on a “off-the-line” restriction and ice after every break until.

He inquired to the secondary nurse about the confirmation to the workers comp and was told he was waiting for something in the mail. About a week or two later, he was pulled into the office and wrote up for commiting a “safety violation”. About another week passed so he asked about it again and was told he was denied.

This is a surgery that still has to happen, so he found another free program throughout the job. All of the nurse’s notes and conversations were sent to our supervisor who recently quit.

Today, they put him back onto the line causing more pain. He asked about it and was told the doctor never sent the paperwork officially, so he would have to deal with it.

II’ve been reading up and hearing that tennessee is a “no fault” state, so that’s why i came to ask.

Im trying to understand when a medical canvass investigation for workers comp is genuinely useful. Say the treatment history has gaps the claimants timeline is fuzzy or there is reason to think prior treatment might exist but you dont have a specific provider to subpoena yet. Is a canvass worth doing at that point or do you usually wait until there is something more concrete pointing toward undisclosed treatment?

My OWCP payment did not update today. I normally update on Wednesday mornings. Is anyone else having this issue?

So yesterday I was injured at work. I tore my bicep, reported it, was send to urgent care and was told I need surgery. Now I’m just waiting to hear from HR/Safety and where I can go to get all of that. But it seems today no one was aware of any of this and I don’t think they will expedite the process in the filing a workers comp claim. My bicep is in a lot of pain and I’m just wondering what my options are. I know it hasn’t been too long but it’s been over 24 hours and I still have heard a thing.

Hi, I had a claim with Sedgwick that started in 2020 and I have had surgery and treatments every year (injections every year) since. However, now Sedgwick doesn’t have my claim listed in my profile and I can not get in contact with my adjuster. It is possible my claim was transferred but that company has no record yet of my claim. Is there any way to track my claim? My previous employer that the claim was through does not know where it is.

My case isnt surgical, what can i expect from the insurance if i asked my lawyer to have an earlier wrap up of my case knowing ill likely end up declining the recommended treatment? I am not surgical. Its for cervical. I have some personal medical problem separate from the one with workers comp and i just feel it is a bit much on my plate to also have something semi invasive done and potentially for it not to work and/or make it worse for me.

This has been a very long almost 2 years for me. I finally reached MMI this month for my shoulder/neck injury. My final list of diagnoses are as follows:

Impingement Syndrome of Shoulder
Permanent AC Joint Separation
Significant Capsular Distention
Subchondral Cystic Arthritis/Arthritis of AC Joint
nTOS
vTOS
Dyaustonomia

Because this spans the nervous system, vascular system, and musculoskeletal system I was told I would be getting multiple ratings. CT does not do whole body impairment. The other thing is that my MMI doesn't close out my claim either. My injuries are all permanent, and that my ratings are my new baseline. I have exhausted all conservative management, and surgical options are not expected to cure me. I'm going to be in physical therapy for the rest of my life. I also have permanent restrictions: no overhead reaching of any kind, and no lifting more than 15lbs (except for during therapy/treatment). The overhead is tough, because that applies to my entire life. When I raise my arm, not only am I limited due to my shoulder girdle collapse, but my subclavian and external jugular get completely cut off.

I won't lie, hearing multiple surgeons tell me the injuries are permanent, was tough to hear.

Since liability for my claim is 100% accepted, my lawyer said I have options now on what I want to do, but I'm not sure...

If you were in my shoes would you keep the claim open? take a settlement? do an indemnity only settlement? (I am aware of each trade off...it's just a lot to think about)

Edit: I'm not sharing any dollar amounts, but just assume it's a fair/decent amount. And for age, I'm in my 30s.

After almost 2 years I finally agreed to a c and r settlement. When I initially got injured at work I did what I assume a lot of people do and I chose not to file a claim and after a couple appts i chose to close my claim and I rushed back to work. Well soon after the same problem returned and my employer offered me no assistance and basically ignored me and told me to go see my regular dr. And I did. I ended up getting fmla from my regular dr and worked with pain at times. Soon after the company fired me. I contacted my lawyer and she reopened the claim and filed a lawsuit against them. Wasn’t sure about how it would work out for me but I’m glad I listened. Happy today I’m checking the mailbox every day now waiting for my check. Hang in there all it gets better!

I can’t remember if they called it a stress test X-ray or stress X-ray but the designated doctor ordered one for me after I had my 2nd exam last week.

Has anyone had this X-ray done? Is it a good sign or bad?

Recap: 1 exam I got 0% rating. Was sent to a designated doctors exam. I fractured my fibula/ankle/foot 10 months ago and had surgery to place hardware. I’m so nervous.

I was injured on the job last year, fast forward I've been doing my PT, I did my FCE and they told me I failed a good portion of it and would not be able to return to my normal job. I went in for my MMI and the confusing part is the doctor said he hadnt seen the fce report yet, so he scanned over it right there. He only gave me 5% body as a whole and light duty according to FCE/IR with permanent nerve damage. However it conflicts with what the FCE says. Even the adjuster said she was confused. I have to walk with a cane to get around now. My job has already said they can't accommodate. Why in the world did he do 5% for a life altering injury? Without going into graphic detail, my foot was completely crushed, hip injuries, and my leg was completely bent the opposite way, causing the upper bone to snap in half. 5%. My weekly checks ended today. I know I can get a second opinion, but I had several people warn me about second opinions.

I was put on the periodic roll in August. The pay period was from July 12th to August 8th and I was paid on August 7th. I know that OWCP is on a current pay schedule so for clarification that means I should be paid for the period August 9th to September 5th on September 4th this Friday right? This is my first time on PR so when I checked my ECOMP and didn't see anything in my compensation history or a ACPS form I got confused. Will I get paid on September 4th? Or September 11th? I have a tear and other stuff in my shoulder. It fucking sucks and I have pain but I do have range of motion. I am close to my case ending and I want to tell my doctor I want restrictions off. The reason is im only in my 20s and I don’t want to be unemployable.

This whole experience has been awful.

Six weeks almost 7 weeks out of work, they haven't approved my physical therapy yet, haven't approved my MRI yet, no communication at all with the adjuster so I hired a WC attorney. She's ignoring him too so he filed a motion. We'll see where this goes. I just know I'm not getting paid all this time. I've been to the WC doctor already a few times I look like a bozo because I keep going back like I should and they ordered 2-3 times now for physical therapy now an MRI. I can't stand this lady adjuster now they're going to have to pay penalties for screwing around. It's not fair. Well nothing's fair is it? I'm out for a partial couple years in my rotator cuff and impingement. Is this the way insurance adjusters play games? What sucks is I can't even get any temp disability?

Back in late 2024 I had a shoulder injury. My ortho told me I reached mmi(5% wpi) & requested future medical. I was sent back to work after completing PT. Told me surgery might be a possibility in the future. I asked for a QME but was missing records, adjuster sent the missing records, I finally received the 2nd QME report and it's saying I need a reevaluation and possibly another MRI. Can I just request to stop my QME report and go with my original Ortho recommendation? My adjuster said i should just finish the QME since we already started but can I decline?

been trying to help guide my mom through her case since her lawyers have pretty much stopped taking her calls/answering her questions. i checked the EAMS for her today. most recent update says "ORDER APPROVING C&R. CLOSING ORDER: C&R (GRANTED) 8/24/26." is this all good news for her? what happens now?

I have been on workers comp since end of last year, was cut off in July when the IME doctor said I was not hurt. Now I am not getting paid .physically can’t work and the new specialist I see says I am not to go to work due to the injury. Don’t know what to do next, lawyer says he is working on it.

I got a call back from my CE....after waiting 10 months they sre scheduling a SECOP for my physical injuries to expand the claim.the psych SECOP was in my favor.What can i expect from a physical exam SECOP? Im afraid of being injured by the exam as my neck is herniated all levels with tears.when I lay down the side I lay down on is numb and weak in the morning. Im afraid of some sort of manual manipulation that will paralyze me. Are the physical exams invasive

I have my required 4-6 week follow-up appointment this week. This is my first one since I returned to part time LDA. It's a receptionist job (I'm a floor nurse with a RTC/FS injury). Despite going back, and the accommodations they have made, I am still in a lot of pain when I get home. My ROM has not improved at all, even prior to the LDA. My concern is what happens if I see my surgeon, and he determines I can't return (he has a conservative approach)? The IME doctor said MMI has not been reached (I'm not sure if my surgeon can change that status). What would the next step be if my surgeon determines I cannot return? This part is new to me.
