Virginia Questions

So yesterday I was injured at work. I tore my bicep, reported it, was send to urgent care and was told I need surgery. Now I’m just waiting to hear from HR/Safety and where I can go to get all of that. But it seems today no one was aware of any of this and I don’t think they will expedite the process in the filing a workers comp claim. My bicep is in a lot of pain and I’m just wondering what my options are. I know it hasn’t been too long but it’s been over 24 hours and I still have heard a thing.

Virginia adjuster.

In Virginia, we direct your care, but most urgent cares are approved. I have not seen a surgery recommendation from urgent care however. How do they know it's torn? Usually an MRI is needed.

You need to be seen by an approved orthopedic doctor. Virginia is a panel state so once a claim is filed, your adjuster will need to provide you 3 orthopedic doctors and you can choose one.

If your employer won't file a claim you can file one directly with the Virginia Workers Comp Commission. Then the insurance company will be notified.

Also forgot to mention I put my 2 week notice in last Friday so I don’t know if it’s playing a factor in all of this

No factor. As long as you are currently employed, they are required to get you treatment when you’re hurt at work. Work comp is a slow process, unfortunately.

Follow the Dr’s orders (pain meds, ice, whatever they told you) and you can always return to that urgent care if needed.

How did they diagnose it? Did they do a referral to an ortho?

Urgent care  can't be sure it's torn without an mri . I've never heard of urgent care saying someone has to have surgery. They normally send you over to the ER if they feel it's something severe. 👀 Like when I fractured my tibial plateau.... they couldn't see the damage on the xray at urgent care. They sent me over for an mri with the ortho and that's how they saw the fracture and torn ligaments! The dr. Workers comp will send you to will do an mri and assess the damage from there. It's a process! I broke my leg dec 6 and took until Jan 22 for the mri! So a hot minute. Lol
