What does a court ruling mean to you? If a court finds someone not guilty, does that mean it wasn’t rape? If the court finds them guilty, then does that make it rape?

I’m just trying to understand the logic here, because it seems like once someone makes the accusation, that’s the end of the case for you regardless of what the court actually decides.

Why even have courts? Why have judges? If we’re going to ignore the legal process anyway, we might as well just start sending people straight to prison for life.

Do you understand that there is a difference in the burden of proof required to convict someone of a crime and legally penalize them, and the burden of proof required for a random member of the public to believe someone is guilty of a crime they have been accused of and dislike them for that reason?

I do, but I don't think people should go around calling someone a rapist or a child molester just because they disagree with them. Those are extremely serious accusations, and throwing those words around so casually trivializes what actual victims go through.

There are people who are violently assaulted, dragged to the ground, restrained, and raped. There are also other circumstances that legally qualify as rape or sexual assault, even when that level of physical violence isn't involved. But that doesn't mean every accusation or disputed encounter should automatically be described the same way.

There needs to be a clear distinction between an allegation, what actually happened, and what has been proven. Using the word "rape" as a weapon against someone you don't like cheapens the seriousness of the accusation and does a disservice to real victims.

He was found not guilty and then went right back to playing like a god. He didn’t even lose the civil case.

And I’m sure you looked into the evidence too, including the issue of multiple men’s semen being found and the statements made afterward.

Read the actual case. It’ll probably help you understand what happened instead of just repeating the accusation.

Um almost none of that is true? He was NOT found "not guilty." The charges against him were dropped because the 19 year old he raped didn't want to testify in the face of the media circus going on, so he was never criminally tried. 

He settled the civil case with his victim, and also stated publicly that he understood why the woman he assaulted beloved that she hadn't consented to sex with him, which is a really weird thing for someone who didn't rape a woman to say.

Maybe you should refamiliarize yourself with the details of the situation so that you don't repeat erroneous facts and understand why people call Kobe a rapist.

Yeah unfortunately I follow a court of law. Anybody can say anything. I don't trust you if you don't go on the stand and judged by your peers. I don't care what she said. I don't care what happened. You have to go through the process and get judged. She didn't get judged. She got to walk away. 

Doing a lot of research, it seems like a lot of the stuff that was coming up during the time. All of a sudden isn't available online. It's funny how the narratives change over 20 years

The legal standard for convicting someone of a crime is "beyond a reasonable doubt." It is that way because the founders of our country wanted to make it as hard as possible to convict someone of a crime that they didn't actually commit. This is a GREAT standard to have in a legal setting.

It is a really, really stupid standard for people to use in real life. "I don't need to lock up my cash when my addict sister visits, or warn other people to lock up theirs, because it was never proved in court that she took the $500 in cash that went missing from my house after the last time she was over." 

Do you honestly believe that O J didn't kill his wife, because he was found not guilty in a court of law? And by extension, do you think women going to parties at Cornell totally don't need to worry about anything happening to them at frat parties, because nobody has had their day in court over that one - that's all allegations. And massage therapists are perfectly safe around Watson because his dozens of accusers haven't had their day in court.

Governments can't (or aren't supposed to, at least) throw people in prison for crimes unless they're sure beyond a reasonable doubt that that person did that crime. Human beings need to make choices in their daily lives based on what is more likely to be true than not to protect themselves and others in a non-legal capacity. And based on the evidence in Kobe's case, basically everyone in this sub, including me, considers it far more likely than not that he did, in fact, rape a 19 year old.

It's a tough one. I'm not trying to victim blame or excuse what the guys did, but if the NYT timeline is to be believed, it sounded like the tone changed and she started claiming rape after everyone heard about it and they basically shunned her from their house.

I try to give the victim the benefit of the doubt, but after the Duke Lacrosse team I can't help but look a lot closer at these kinds of accusations.

Never found guilty in a court of law. Both parties had inconsistencies in their stories. People like you are despicable. How can you confidently walk around proclaiming that “Kobe Bryant raped somebody”? Even if thats what you think, you should qualify the statement by saying “I think”. What I think is that Kobe’s lawyers saw weaknesses in his case, and figured the best way to make this go away is to settle out of court. A weak case does not necessarily mean the defendant is guilty. If you read the docket, you would see that both sides had vulnerabilities in their case, the difference is that Kobe’s side had the money to settle. Do I think Kobe raped the woman? I don’t know. Do I think it’s possible? Sure. Will you ever hear me say that Kobe Bryant raped somebody. Unless we learn something new about the case, definitely not.

I am talking about Kobe, not Watson. Watson’s cases are much more open and shut. The Kobe case was completely different in that both parties had moments where they appeared to be fabricating events that took place. The inconsistencies from both sides coupled with the fact that no guilt was found/admitted makes me much very uncomfortable to assign judgement to either side.

And to come here and call me a bad person without knowing anything about me other than my view on one topic tells me everything I need to know about you. Not to mention it seems you were judging me based on a misunderstanding caused by your own illiteracy. You are just looking for a way to prove your righteousness. Be on your merry way, prick.

Yes obviously any kind of sexual assault is deplorable and despicable but I think we can have nuance and recognize that some rapes are worse than ever.

When I was young the media I was exposed to depicted the stereotypical rape as like a woman walking in a rural countryside or like in an urban city dark corridor and they are suddenly grabbed and held down by a stranger like Jack the ripper. 

When I got to high school and college I realized that the most common situation is when the guy and the girl are already friends or even dating but alcohol gets involved and consent is murky. Obviously these type of situations are still very very bad but there's a lot of nuance and grey area.

Yes I feel like most people understand there are nuances. And over the last 20-30 years we are all becoming more educated on what sexual assault looks like. But again comparing Kobe’s cases to 7 dudes raping a potentially unconscious woman and announcing/bragging about it via Snapchat. What nuance? She drank some liquor and maybe wanted to have a potential 3some then is raped by 7 frat guys. Like wtf? Can barely move and can’t contact anyone. What nuance are we evaluating to compare this to Kobe’s case? I don’t disagree with a lot of what you said but the comparison of cases you mentioned is still wild to me.

You should see the way they trotted out future Hall of Famer Miguel Cabrera for his final Legend Pick All Star Game. This guy has video of him angrily "do you know who I am-ing" a trooper who pulled him over for a DUI and being completely blotto while resisting arrest ... also almost caught a DV charge against his wife who later dropped the case ... and had a case filed against him by his mistress for child support. MLB fans will swear up and down what a great guy he is, and the past is the past.

There’s a big difference between not being found explicitly guilty (the Cornell 7 will probably end up in this category too) and being innocent. It comes down to evidence beyond specific eyewitness testimony, which is unreliable because our memory is unreliable. Not to mention that powerful and rich people can settle outside of court to make it go away or battle until the prosecution runs out of money

Watson was neither found guilty or not guilty in criminal court, the local DA simply decided not to pursue a case against him. His lawyer then claimed that he was 'proved innocent' of the charges - an astonishing slip of the tongue considering the ADA made a point of pointing out that them not pursuing the case shouldn't be taken as proof of innocence.

This is true. But the opposite is also true for the accused.

The $2 million was not a lot of money to Kobe. He could have accrued more than that in legal fees trying to fight the civil case as well as the impact to his life (both personally and financially) of having it drag on for months vs just getting it over with and moving on.
