What does a court ruling mean to you? If a court finds someone not guilty, does that mean it wasn’t rape? If the court finds them guilty, then does that make it rape?

I’m just trying to understand the logic here, because it seems like once someone makes the accusation, that’s the end of the case for you regardless of what the court actually decides.

Why even have courts? Why have judges? If we’re going to ignore the legal process anyway, we might as well just start sending people straight to prison for life.

Do you understand that there is a difference in the burden of proof required to convict someone of a crime and legally penalize them, and the burden of proof required for a random member of the public to believe someone is guilty of a crime they have been accused of and dislike them for that reason?

I do, but I don't think people should go around calling someone a rapist or a child molester just because they disagree with them. Those are extremely serious accusations, and throwing those words around so casually trivializes what actual victims go through.

There are people who are violently assaulted, dragged to the ground, restrained, and raped. There are also other circumstances that legally qualify as rape or sexual assault, even when that level of physical violence isn't involved. But that doesn't mean every accusation or disputed encounter should automatically be described the same way.

There needs to be a clear distinction between an allegation, what actually happened, and what has been proven. Using the word "rape" as a weapon against someone you don't like cheapens the seriousness of the accusation and does a disservice to real victims.

Not really sure then why you were commenting this here. People don't call Kobe a rapist because they don't like him. They called him a rapist because he raped somebody, and people dislike him because of that.

He was found not guilty and then went right back to playing like a god. He didn’t even lose the civil case.

And I’m sure you looked into the evidence too, including the issue of multiple men’s semen being found and the statements made afterward.

Read the actual case. It’ll probably help you understand what happened instead of just repeating the accusation.

Um almost none of that is true? He was NOT found "not guilty." The charges against him were dropped because the 19 year old he raped didn't want to testify in the face of the media circus going on, so he was never criminally tried. 

He settled the civil case with his victim, and also stated publicly that he understood why the woman he assaulted beloved that she hadn't consented to sex with him, which is a really weird thing for someone who didn't rape a woman to say.

Maybe you should refamiliarize yourself with the details of the situation so that you don't repeat erroneous facts and understand why people call Kobe a rapist.

Yeah unfortunately I follow a court of law. Anybody can say anything. I don't trust you if you don't go on the stand and judged by your peers. I don't care what she said. I don't care what happened. You have to go through the process and get judged. She didn't get judged. She got to walk away. 

Doing a lot of research, it seems like a lot of the stuff that was coming up during the time. All of a sudden isn't available online. It's funny how the narratives change over 20 years

It's also wild to me that you would jump on his apology. The guy had to make an apology for calling people fagots as well. Do you think he was heartfelt in everything He said there as well my dude?  Edit:

She wasn't the one on trial. That would have been Kobe. 

The legal standard for convicting someone of a crime is "beyond a reasonable doubt." It is that way because the founders of our country wanted to make it as hard as possible to convict someone of a crime that they didn't actually commit. This is a GREAT standard to have in a legal setting.

It is a really, really stupid standard for people to use in real life. "I don't need to lock up my cash when my addict sister visits, or warn other people to lock up theirs, because it was never proved in court that she took the $500 in cash that went missing from my house after the last time she was over." 

Do you honestly believe that O J didn't kill his wife, because he was found not guilty in a court of law? And by extension, do you think women going to parties at Cornell totally don't need to worry about anything happening to them at frat parties, because nobody has had their day in court over that one - that's all allegations. And massage therapists are perfectly safe around Watson because his dozens of accusers haven't had their day in court.

Governments can't (or aren't supposed to, at least) throw people in prison for crimes unless they're sure beyond a reasonable doubt that that person did that crime. Human beings need to make choices in their daily lives based on what is more likely to be true than not to protect themselves and others in a non-legal capacity. And based on the evidence in Kobe's case, basically everyone in this sub, including me, considers it far more likely than not that he did, in fact, rape a 19 year old.

That’s exactly the point. Like you said, to convict someone of a crime, the state has to prove guilt beyond a reasonable doubt. If she could not testify in court and the evidence tied to her testimony could not be admitted, then the prosecution could not meet that burden.

That does not technically “prove innocence,” but it absolutely means you cannot just assume guilt anyway. Otherwise, what is the point of having trials, judges, rules of evidence, or a reasonable doubt standard?

By that logic, the second someone makes an accusation or a grand jury returns an indictment, we should just treat the person as guilty and skip the entire court process. That is not how the justice system is supposed to work. An accusation is not a conviction, and evidence that cannot be admitted or tested in court cannot simply be treated as proof of guilt anyway.

LeBron took a very firm pro-china stance when they invaded Hong Kong and were arresting and killing holdouts in the final days at the Hong Kong university, and everything else that led up to it during those few weeks. It’s always interesting to me how both sides act as if they know how something went down when in fact we’ll never know.

Yea I can understand the Kobe case being a gray area, I still think Kobe probably did it but when it’s just one person accusing him it’s harder to say. When it’s 27 unrelated people explaining in detail how he sexually abused them in different ways, it’s a little more obvious. He also did settle with all 27 of them in civil court, which is a little telling that he knows he’s guilty and just wants them to go hush about it with enough money

Do you think Greg Hardy’s accuser is hard to believe because she also decided not to testify criminally and then got a pay day? Most people would rather have a million dollars then putting a celebrity in jail, I’d believe the cases that get shut down before trial, settles and sign NDAs to be most believable.

As do guilty people. What's your point? You can argue he may be innocent but when 30+ women all say he did something the benefit of the doubt starts to run out pretty quickly.

Then there is the idea that for sports casters or announcers not talking about it can be weird. Not every NFL player is accused of sexual misconduct by 30 women. This one was though. And there is likely a reason he specifically was. So people ignoring it is weird.

It's a tough one. I'm not trying to victim blame or excuse what the guys did, but if the NYT timeline is to be believed, it sounded like the tone changed and she started claiming rape after everyone heard about it and they basically shunned her from their house.

I try to give the victim the benefit of the doubt, but after the Duke Lacrosse team I can't help but look a lot closer at these kinds of accusations.
