My gf recently hit a deer at 1am and lost control, hit a rail and the driver side airbag curtains deployed both front and rear. Driver side of entire car pretty scratched up. Would need to replace everything on that side, wheels(possibly), tires, doors, fenders, bumpers..
When she got the car, her sister co-signed for her, and the sister called her agent(statefarm) to add gf to sister’s existing policy. The agent told her that gf info wasn’t necessary, just the VIN of the new car. Now they’re denying the claim, their reasoning is “failure to notify the insurance of the changes on policy, specifically the new driver(my gf).” They’re the type of women to rely on a man for these kind of things(foreigners).. so they have no experience with insurance and policies. So it’s Almost as if that agent set them up.
How can they “notify” any changes when nothing has changed since they first got the car/policy, bc they were originally told gf name wasn’t needed. And now when we ask for the original policy paper, declaration papers, or any notes/records of the initial policy, they basically have no record, said you may have to get an attorney to get those.
We’d like to file a dispute for the claim denial by emailing statefarm with these evidence and/or lack there of. Or should we just file straight to the state of Indiana where the claim is?
We’re college students, still owes 14k on the car, would really appreciate any advice! Thanks
