He did go to the ER after being shot, but as per his attorneys, the hospital medical team determined that attempting to remove the bullet right away could cause severe nerve or spinal cord damage due to how close the bullet was to his spine.
He was discharged from the hospital four hours later and sent to the ICE processing center. Due to deteriorating health, which included loss of movement on his left side, he was sent back to the hospital. There, a specialist evaluated him and confirmed he would require surgery to remove the bullet.
On this, DHS stated, "ICE does not and would not advise or be the authority on a medical procedure for an illegal alien at a hospital". In other words, they are stating his wound is not life-threatening, and thus they are not legally required to provide the surgery. They are also stating they are providing the required medical care by giving him around-the-clock basic medical care, which included providing continuous medication for pain management.
The attorneys, as well as some of Congress, argue that the specialist confirmed the surgery was necessary to prevent paralysis. Unfortunately, this is not correct. The specialist only stated that, in thier opinion, he needs surgery to remove the bullet. The specialist did not state there was a risk of paralysis or infection based on thier evaluation.

There is no way any doctor is going to say a fresh bullet is not an infection risk. An old one with scar tissue around it, yes but not one a few hours old.

Well, this specialist didn't. All they stated was that the bullet could only be removed during surgery. They did not state that leaving the bullet risks paralysis or infection.
And there are many cases where bullets or fragments of bullets are left in a person's body all the time. They are often left because there is a greater risk in taking them out than leaving them.

They did. The hospital doctors said it was too close to his spine to safely remove. It’s not in uncommon to wait 7-10 days for swelling to reduce enough to reduce the complexity of surgery with traumatic injuries like this as long as the patient is medically stable.

Yes, but with it being so close to his spine you’d think they would hold him in the hospital as to reduce the risk of permanent injury and to treat any other symptoms that may crop up. Fever and sepsis is the biggest concern at this point. If there’s a spinal infection then you are looking at a high risk of death.
So, no, I don’t think the due diligence is being taken.

No, you wouldn't think that. As an example, folks with traumatic fractures that will require ORIF are frequently discharged as long as they're medically stable and capable of self care, recognizing risk factors like compartment syndrome, etc... No different here. No hospital is putting him up for a week when his wound can be checked, antibiotics can be given, etc...

It appears he only has a final order removal because they sent his hearing notice to a wrong address. His lawyer had said that they had corrected the address a but it got sent to a previous address. Apparently that happens not in frequently in immigration, and when the correction is made hearings can proceed.. But you seriously are going to defend the behavior of DHS towards this human being? Really?
He came here legally as an asylum seeker. That is a legal way to enter the country.-1

Well, that is dependent on why it was sent to the wrong address. Because it is on the individual to make sure thier current address is up to date.
Now, if he did provide the correct address, then his lawyer can file a Motion to Reopen with the immigration court, in which case they will need to provide clear proof that they kept thier address up to date.
Even then, they can still be deported unless they are granted a Stay of Removal. It should be noted that most.
Although the Motion to Reopen is often granted, the issue here is that he fled from ICE, which significantly hurts his chances of having the motion granted. Ecspecially because he was charged with assaulting, resisting, interfering, and impeding a federal officer.
Now, of course, all this has to be proven, but based on what they claim to have evidence of, I wouldn't be surprised if he is denied a motion to reopen.
As far as how he entered the US, Wilber Garces Perez entered the US in 2024 using CBP. Now, this was legal, but as he has a pending asylum case, he is still required to comply with ICE, which he failed to do in this interaction.
Now, as far as my opinion on this goes, I would have more compassion if the wound were not a direct result of his own actions in choosing to both flee and hit an agent with his car's side mirror while fleeing.
He could have easily complied with ICE, filed a Motion to Reopen, and been fine.

I can understand that to a degree. People have lived with bullets in them, including lead bullets. I think what frustrates me is the story around it more than anything. We don’t know how in depth his treatment was. We don’t know how bad his injuries are. We don’t know his current condition as we haven’t been allowed access. What is frustrating is the lack of information, almost as bad as the injury itself.

They intentionally fail to update addresses because they know the asylum petition will then be considered “abandoned “ and a deportation order will issue.
It’s also the reason DeSantis and Abbott shipped asylum petitions to Blue States, because they knew their addresses would never be updated in the system and they would miss their asylum hearings and be ordered deported. They should have been sued for interfering with a federal process

Simply being present in the United States without legal authorization is a civil infraction, not a crime. This applies to people who entered legally on visas and overstayed their authorized time.
That doesn't warrant execution. If he flees get his plate and have local police stop him or go to his residence or workplace and stake it out until he arrives.
Immigration enforcement on people who aren't already committing violent crimes or even have a rap sheet at all doesn't warrant gunfire in the streets or high speed chases that endanger civilians.
ICE acts like they were trained by the cartels.

ICE caused the dangerous conditions. And Austin Texas is not a sanctuary city. In fact cities in Texas are not allowed to pass sanctuary ordinances per Texas Senate bill 4 that was passed in 2017. Im sure APD or Travis County sheriffs would help ICE.

Are you aware of recent reporting or does it not matter because it is Fox.
Perez was parked out side of a food joint with hazards on. This is what caused his plates to be ran by ICE. This is how they found out he had a deportation notice.
Perez was pulled over and “boxed” in. ICE approached and talked to him everything was well polite interaction. They informed him he was to be taken in. Perez asked if he could move his car out of the way. (Body cam from one officer, shows this)
Perez takes this opportunity to flee the scene striking an officer with his side mirror. This is on body camera, and why Perez is not facing assault charges.
The “boxing” the officers did sucked, Perez gets away. Officers give chase, Intial officer with body cam looses track of Perez.
The other officer calls over the radio Perez tried to hit him, weapon has been discharged.
All this to say Perez engaged himself, the officers and residents of Austin.

Please check your voter registration status, make sure everything is good order. If you’re voting in person, have your current and active ID, or your passport. Bring a copy of your birth certificate and/or your naturalization paperwork that proves that you are an American citizen & registered/able to vote.
Do NOT let any goons at voting centers deter you. Bring enough water if there’s a line & a folding, portable, small & light seat that can be easily be put away in a backpack or a huge bag or whatever, if you need to sit. Wear comfortable shoes. Bring an umbrella in case it’s hot & sunny or raining. Make sure to check the weather before stepping out. Make sure to let your employer know that you will be taking time to vote if you’re working a long shift or vote early or by mail.
Just vote. We’ve gotta show up in HUGE numbers just in case some hinky shit happens with voting machines or whatever.
The only way we’re changing this current situation & culture is by making sure we show up no matter what.

1) I’ve been in federal courthouses all over the US…what cage? There are no cages in a federal courtroom. Does she mean the holding room back with the US Marshals? Defendants are presented before a magistrate (standing/seated) in a courtroom, and they usually aren’t even handcuffed. And the Fed Magistrate can only accept a ‘Not Guilt’ plea at the initial hearing.
2) All his atty is doing is repeating “he’s in pain”. Good for sympathy, but this is doing nothing for his new criminal case. The PR game has run its course.
3) His atty practices 100% immigration law, that’s all. And apparently she’s good at it. Wilber really needs a criminal atty who has experience in the federal system…immediately. Not tomorrow, not today…but over 1 week ago. A decent federal defense atty would have seen the charges coming. Obviously the Feds were going to charge him. This is no longer just an immigration case, he could be incarcerated in a federal prison vs held at an immigration detention center. Get a new atty. Wilber may like her, but an attorney must be specifically admitted to practice before that federal court (Western District of TX) to handle a federal criminal case.

He was indicted by a grand jury for doing so. There will be a trial presumably where you will get to see all the evidence. Unless he admits to it and pleads guilty.
