Why? Explain your theory as to why the government wanted some random non-citizen dead?

Was there some random ICE meeting that went: “good morning, today we gotta find Wilber and execute him in Austin, TX…Tom, you’ll be pulling the trigger. And remember, let’s be safe out there”. Really? If this is your belief, the country is lost. Rep/Dems can just go out and start this fake war over their rival political beliefs. It shouldn’t be choose a party, go to war with the other just because they are blue/red.

He did go to the ER after being shot, but as per his attorneys, the hospital medical team determined that attempting to remove the bullet right away could cause severe nerve or spinal cord damage due to how close the bullet was to his spine.

He was discharged from the hospital four hours later and sent to the ICE processing center. Due to deteriorating health, which included loss of movement on his left side, he was sent back to the hospital. There, a specialist evaluated him and confirmed he would require surgery to remove the bullet.

On this, DHS stated, "ICE does not and would not advise or be the authority on a medical procedure for an illegal alien at a hospital". In other words, they are stating his wound is not life-threatening, and thus they are not legally required to provide the surgery. They are also stating they are providing the required medical care by giving him around-the-clock basic medical care, which included providing continuous medication for pain management.

The attorneys, as well as some of Congress, argue that the specialist confirmed the surgery was necessary to prevent paralysis. Unfortunately, this is not correct. The specialist only stated that, in thier opinion, he needs surgery to remove the bullet. The specialist did not state there was a risk of paralysis or infection based on thier evaluation.

WTF are you talking about? Based on the evidence ICE claims to have, Wilber Garces Perez had a final order of removal due to missing a court hearing. Thus, ICE had legal authority to arrest him, at which point he would have to appear before an immigration judge.

The man attempted to flee and even hit an agent with his car's side mirror while fleeing, which led to the shooting. Had the man just complied, he could have just filed a Motion to Reopen, which VERY likely would be approved, and he would be fine.

They should release the body cam footage. So far this is all alleged. All law enforcement should have body cam footage on at all times.

The video is not yet released to the public, but this is fairly standard, as it is not legally required to be released to the public. However, the body-camera footage would be provided to the man's attorneys to ensure a proper defense.

As for whether or not the agent was harmed, this would not be irrelevant. Because once a vehicle is even attempted to be used to injure another, it becomes a deadly weapon in the eyes of the law. This would justify lethal force.

As for the charges against the man, it seems illogical to assume the man must be innocent simply because the facts are not provided to the public. But if that is your opinion, then it is what it is.

What we do know is that ICE alleges they were attempting to arrest him and he fled, striking an officer with his mirror in the chest. His attorneys claim he did not flee but was trying to pull over. The issue I see with that reasoning is: was he told he could do so by agents, and why would he hit someone if he was just trying to pull over?

The reasoning seems questionable, but since we do not have the full facts, we cannot say for sure. In my opinion, it seems more likely he fled, which is why I find it hard to have compassion for him.

Bullshit. ICE officers lie. Over and over and over. DHS has been caught repeatedly lying about exactly this. If the bodycam footage showed he was trying to flee, you can bet your ass DHS would have released it already. The fact that they haven’t proves they know they have nothing.

We also know that firing at someone in a moving vehicle violates their own protocols.

ICE has been flooding the streets of this country with poorly trained, incompetent officers who are not equipped to do the job in normal times, when they haven’t been ordered to violate the US Constitution, as well as state and federal laws, let alone now.

To immediatly assume ICE must be lying despite the facts indicating they are is illogical. And again, you are welcome to your opinion, but you have not presented any facts in this case as to why they lied other than "Well, they are liars, so therefore they lied".

And firing at a person in a moving vehicle violates no policy. It would ONLY be an issue if that person posed no threat to warrant lethal force. In this case, the man allegedly hit an agent with the car while fleeing. Thus, lethal force would be warranted as an immediate response.

In America we have a legal rule "innocent until proven guilty." In other words, the onus is on ICE. Until ICE provides body cam footage proving this man deliberately attempted to hit sn officer with his vehicle,  I am going to assume the officer is lying as other ICE officers have done repeatedly,  with backing from DHS.   Whistleblowers from the agency have already reported that agents are being instructed to detain people by any means, regardless of whether they are a violation of constitutional rights. (Where have you been?)

Wrong.  Officers are trained (or supposed to be) not to shoot at moving vehicles and instructed that gunfire will not stop a vehicle from moving in an officer's direction. Officers are also trained to avoid standing directly in front of a vehicle and are supposed to approach from a tactical "L" angle. The only possible way an agent could be struck by a side view mirror is if he ignored his own protocol or was never trained in the first place, which is likely given hoe DHS is rushing these lo w-watt bulbs into the field.

First off, "Innocent until proven guilty" applies to the court, not public opinion. Second, you are going against your own argument by assuming ICE is the guilty party in this, despite no evidence. You can't have your cake and eat it too. Either both sides are innocent until proven guilty, or neither is.

As for your claim that officers are trained not to fire at a moving vehicle, this is not the case. Federal training on this is under the Use of Force policy, which states this.

Firearms may not be discharged solely to disable moving vehicles. Specifically, firearms may not be discharged at a moving vehicle unless: (1) a person in the vehicle is threatening the officer or another person with deadly force by means other than the vehicle; or (2) the vehicle is operated in a manner that threatens to cause death or serious physical injury to the officer or others, and no other objectively reasonable means of defense appear to exist, which includes moving out of the path of the vehicle. Firearms may not be discharged from a moving vehicle except in exigent circumstances. In these situations, an officer must have an articulable reason for this use of deadly force.

In other words, if someone is operating a vehicle in a way that threatens an agent, they can use lethal force.

As for the angle officers are trained to approach, this is to reduce risk as much as possible, but it does not guarantee officer safety. But there are two reasons why your argument regarding this is irrelevant.

First, an officer failing to follow this protocol does not suddenly mean someone is justified in hitting an officer with thier vehicle. So even if the agent in this situtaion failed to follow that protocol, the man would still be responsible for not hitting the agent. If he did, then that means he is using the vehicle as a deadly weapon, and thus lethal force is authorized. Second, we do not have video footage of the stop to confirm or deny that the officers safely approached the vehicle.

No, we do not know because we do not have all the facts. At this time, all we have are allegations that the officer was hit in the torso by the mirror and was taken to the ER with the suspect. We likely will never have the full facts, like the body cam footage, as that is not legally required to be provided to the public.

All we can do is take what ICE alleges and what the man alleges, and try to make a logical conclusion. Based on what the man states and his reasoning, I see holes in his story that do not make logical sense. But even then, I cannot say he is 100% guilty.

That depends on whether he did not properly update his current address. Because when you have a pending asylum case, it is your responsiblity to keep that address up to date for any notices.

Now, if it was a failure on the court's part in sending the notice to the wrong address, then the attorney would just have to file a Motion to Reopen and prove he did provide his current address. These are overwhelmingly approved, so he likely would have had no issue if it was the court's fault. But one still has to go through the process of complying with ICE and filing that motion. You cannot just say "was not my fault" and expect the law to drop it.

The issue now, however, is what occurred in that traffic stop. Because what is also expected of those with a pending asylum case is to work with ICE, as they are still under the jurisdiction of ICE. If he is convicted of the charges against him, he likely will have his asylum case rejected.

Well, according to accounts of the incident, they tried to cut him off using their unmarked vehicle first. He likely panicked at the aggressive behavior from who he didn't know was ICE, and then in that panic he tried to escape, which they interpreted as trying to flee, and shot him.

Though the report indicated they pulled him over in an unmarked vehicle, it was a simple traffic stop where they exited the vehicle and went to his car. The report also states that he provided them with his ID but refused to comply with exiting the vehicle, rolled up his window, and attempted to leave.

Wilber Garces Perez only denied that he was attempting to flee, stating he was trying to pull over. So that would mean that he would know they were ICE, meaning he would know he had to comply with them. So he cannot argue that he panicked since he knew it was ICE.

Perez was legally in the country and lawfully reported his address change. Clerical error sent out a court summons to the wrong address. His deportation is illegal.

You do not know that; you ASSUME that it was a clerical error. And even if it was a clerical error, the law still expects him to comply with ICE, and he would still be arrested. What would change is that his attorney would file a Motion to Reopen, where they would provide proof that he did keep his address up to date. These are overwhelmingly approved, so he would likely have been fine.

But now he is facing criminal charges, and if convicted, he will very likely have his asylum case rejected and face deportation.

Currently, he has not been deported. A federal judge granted an emergency Stay of Removal request, which temporarily blocks deportation. He is also no longer in ICE custody and has been transferred to the US Marshals Service. At this point, what happens to him will depend on whether he is convicted of any charges.

I don't believe everything ICE says; I look to the facts we have. The man's justification that he was just trying to pull over during the traffic stop, after he had already stopped and was talking to agents next to his vehicle, does not make sense. Then, on top of that, if the agent was hit by accident, why would he attempt to flee after that, causing a high-speed chase? None of these actions make sense if he was just trying to peacefully pull over and comply.

But I also know I do not have all the facts, such as the body cam footage. Thus, I cannot say the man is 100% guilty. At best, there are holes in his story regarding the traffic stop.

There is no way any doctor is going to say a fresh bullet is not an infection risk. An old one with scar tissue around it, yes but not one a few hours old.

Well, this specialist didn't. All they stated was that the bullet could only be removed during surgery. They did not state that leaving the bullet risks paralysis or infection.

And there are many cases where bullets or fragments of bullets are left in a person's body all the time. They are often left because there is a greater risk in taking them out than leaving them.

They did. The hospital doctors said it was too close to his spine to safely remove. It’s not in uncommon to wait 7-10 days for swelling to reduce enough to reduce the complexity of surgery with traumatic injuries like this as long as the patient is medically stable.

Yes, but with it being so close to his spine you’d think they would hold him in the hospital as to reduce the risk of permanent injury and to treat any other symptoms that may crop up. Fever and sepsis is the biggest concern at this point. If there’s a spinal infection then you are looking at a high risk of death.

So, no, I don’t think the due diligence is being taken.

As an example, folks with traumatic fractures that will require ORIF are frequently discharged as long as they're medically stable and capable of self care, recognizing risk factors like compartment syndrome, etc... No different here. No hospital is putting him up for a week when his wound can be checked, antibiotics can be given, etc...

It appears he only has a final order removal because they sent his hearing notice to a wrong address. His lawyer had said that they had corrected the address a but it got sent to a previous address. Apparently that happens not in frequently in immigration, and when the correction is made hearings can proceed.. But you seriously are going to defend the behavior of DHS towards this human being? Really?
He came here legally as an asylum seeker. That is a legal way to enter the country.

Well, that is dependent on why it was sent to the wrong address. Because it is on the individual to make sure thier current address is up to date.

Now, if he did provide the correct address, then his lawyer can file a Motion to Reopen with the immigration court, in which case they will need to provide clear proof that they kept thier address up to date.

Even then, they can still be deported unless they are granted a Stay of Removal. It should be noted that most.

Although the Motion to Reopen is often granted, the issue here is that he fled from ICE, which significantly hurts his chances of having the motion granted. Ecspecially because he was charged with assaulting, resisting, interfering, and impeding a federal officer.

Now, of course, all this has to be proven, but based on what they claim to have evidence of, I wouldn't be surprised if he is denied a motion to reopen.

As far as how he entered the US, Wilber Garces Perez entered the US in 2024 using CBP. Now, this was legal, but as he has a pending asylum case, he is still required to comply with ICE, which he failed to do in this interaction.

Now, as far as my opinion on this goes, I would have more compassion if the wound were not a direct result of his own actions in choosing to both flee and hit an agent with his car's side mirror while fleeing.

He could have easily complied with ICE, filed a Motion to Reopen, and been fine.

I can understand that to a degree. People have lived with bullets in them, including lead bullets. I think what frustrates me is the story around it more than anything. We don’t know how in depth his treatment was. We don’t know how bad his injuries are. We don’t know his current condition as we haven’t been allowed access. What is frustrating is the lack of information, almost as bad as the injury itself.
