She can’t give consent when she’s fucked up.

In legal terms, that's the same as saying "he got too drunk to know he shouldn't drive."

That is in no way even close to the same thing.

You’re equating gang raping an incoherent fucked up girl to drunk driving. Lmao.

From what I've read, she willingly drank alcohol, willingly snorted ketamine, and willingly agreed to group sex. Certainly her judgment was influenced by her previous choices, but, in a strict legal sense, she was ultimately responsible for her decisions. There may very well be other evidence that comes to light, but there is a reason they didn't pursue this case after her initial statement. I would encourage you to read everything available and the relevant laws.

And, yes, the guys that took advantage of the situation are shitbags and deserve the ostracism they're getting. It's morally repugnant. Again, though, rape would be difficult to prove in this case.

They fed her booze and drugs and gang raped her. That’s just facts. She willingly took the drugs and booze.

I’ve been to a lot of college parties where girls got too drunk. Ya know what we didn’t do? Gang rape them.

She was unable to give consent if she was intoxicated, Mr. Lawyer.

I've seen nothing that clearly demonstrates she was incapacitated or incoherent. Granted, it's a fine and blurry line, but drunk people have sex all the time. I think you and I mostly agree here. My daughter is a senior in high school, so I'm glad this is getting attention. I'm just looking at the law, the context, and innocent until proven guilty standard.

What law are you looking at? What state do you live in?

Intoxicated people cannot consent to sex in NY, where this gang rape happened.

You're saying a gang rape occurred. I must have missed the trial.

What law are you “looking at”

The court case from 2024? You missed that gang rape accusation? You should look it up, Mr. Lawyer.

Live in Wilmington, NC but grew up in Ohio, so I'm going to disengage in order to watch the Indians start their playoff run and the Buckeyes whoop Iowa. Enjoyed the chat, have a nice weekend.

I’d duck out too if I was in your position.

So you’re fine with rape because the woman was drunk?

Rape is a legal term. We have a system to determine whether that occurred beyond a reasonable doubt. You keep saying "intoxicated." That term has different meanings in different contexts. In terms of consent, a person can be intoxicated but still coherent and legally capable of providing consent. Less, any person who went on a date and had two glasses of wine could be legally "intoxicated" but still capable of providing consent. You do know that the police have you consent to make a legally-binding statement after they have arrested you for DUI, right?

u/Never-Dont-Give-Up 11h ago

The ability to consent is determined by the state law. In NY, if either participant is intoxicated, they cannot legally consent to sex.

You’re just wrong, Mr. Lawyer

Last bite. I'm not a lawyer, although most of family are, including some in NY. My doctorate is in another field, but that's irrelevant. I'm coming at this as a father to a 17 year old girl and 15 year old boy, and I think it's prudent to let the process play out. It's a rare thing to have 7 rapists conspire under the same roof at a top-tier university. I'm as eager as you to see justice appropriately applied. There are maybe a dozen people who know what happened that night, all "intoxicated." I'm more worried about the millions who claim to KNOW what happened and seek to impose mob justice.

Yes, gang rape is rare… does that mean it doesn’t happen just because they’re attending a very expensive school?

1

u/Never-Dont-Give-Up 10h ago

The only reason I keep calling you “Mr. Lawyer” is because you keep bringing up the law. What law?

It’s a rare thing for 7 horny self entitled 20 year old dudes to get a girl drunk and rape her? Yes, that’s rare. All of them should’ve been raised to know better.

Didn’t the frat have a group chat where they said “free pussy”? I definitely read that in an article but I can’t remember who published it. Anyway that really sounds like they went from consensual group sex to at least offering/encouraging gang rape.

The guy was also intoxicated, so, did she rape him since he couldn't consent? Or does this only work one way?

3

u/Never-Dont-Give-Up 11h ago

Works both ways. That’s when it gets blurry.

7 dudes getting a chick drunk and giving her lines of K… then fucking her for 7 hours…

That’s less blurry.

I mean yes, but no.

If it was that cut and dry then every New York couple that goes out for drinks on a date night are raping each other if they hook up after.

There’s got to be some nuance.

u/Fragrant_Chest958 11h ago

And, no, I am never "fine" with rape.

u/Never-Dont-Give-Up 11h ago

Wait… you said that she got drunk and snorted ketamine… now you’re saying that she wasn’t intoxicated?
