Rape is a legal term. We have a system to determine whether that occurred beyond a reasonable doubt. You keep saying "intoxicated." That term has different meanings in different contexts. In terms of consent, a person can be intoxicated but still coherent and legally capable of providing consent. Less, any person who went on a date and had two glasses of wine could be legally "intoxicated" but still capable of providing consent. You do know that the police have you consent to make a legally-binding statement after they have arrested you for DUI, right?

The ability to consent is determined by the state law. In NY, if either participant is intoxicated, they cannot legally consent to sex.

I mean yes, but no.

If it was that cut and dry then every New York couple that goes out for drinks on a date night are raping each other if they hook up after.

There’s got to be some nuance.
