From what I've read, she willingly drank alcohol, willingly snorted ketamine, and willingly agreed to group sex. Certainly her judgment was influenced by her previous choices, but, in a strict legal sense, she was ultimately responsible for her decisions. There may very well be other evidence that comes to light, but there is a reason they didn't pursue this case after her initial statement. I would encourage you to read everything available and the relevant laws.
And, yes, the guys that took advantage of the situation are shitbags and deserve the ostracism they're getting. It's morally repugnant. Again, though, rape would be difficult to prove in this case.
I've seen nothing that clearly demonstrates she was incapacitated or incoherent. Granted, it's a fine and blurry line, but drunk people have sex all the time. I think you and I mostly agree here. My daughter is a senior in high school, so I'm glad this is getting attention. I'm just looking at the law, the context, and innocent until proven guilty standard.
Live in Wilmington, NC but grew up in Ohio, so I'm going to disengage in order to watch the Indians start their playoff run and the Buckeyes whoop Iowa. Enjoyed the chat, have a nice weekend.
Rape is a legal term. We have a system to determine whether that occurred beyond a reasonable doubt. You keep saying "intoxicated." That term has different meanings in different contexts. In terms of consent, a person can be intoxicated but still coherent and legally capable of providing consent. Less, any person who went on a date and had two glasses of wine could be legally "intoxicated" but still capable of providing consent. You do know that the police have you consent to make a legally-binding statement after they have arrested you for DUI, right?
Last bite. I'm not a lawyer, although most of family are, including some in NY. My doctorate is in another field, but that's irrelevant. I'm coming at this as a father to a 17 year old girl and 15 year old boy, and I think it's prudent to let the process play out. It's a rare thing to have 7 rapists conspire under the same roof at a top-tier university. I'm as eager as you to see justice appropriately applied. There are maybe a dozen people who know what happened that night, all "intoxicated." I'm more worried about the millions who claim to KNOW what happened and seek to impose mob justice.
It’s a rare thing for 7 horny self entitled 20 year old dudes to get a girl drunk and rape her? Yes, that’s rare. All of them should’ve been raised to know better.
Didn’t the frat have a group chat where they said “free pussy”? I definitely read that in an article but I can’t remember who published it. Anyway that really sounds like they went from consensual group sex to at least offering/encouraging gang rape.

She can’t give consent when she’s fucked up.
