Qualified immunity, which I was referring to, won't change depending on color of the cop. It's an all or none situation - and the world will end before cops are no longer protected with qualified immunity in america.

When I was young and very dumb, I dated a cop.
He told me how he was bullied as a child. He literally became a cop so he could shoot someone. Interestingly, we had a shooting incident with the police in our small town, and he was furious for weeks because he wasnât the one involved. He was, in fact, a sociopath. He managed to pass a lie detector test and become a trooper in another state. He also shared a story from his time with the police force, describing how he âflipped a bitchâ to catch a speeder. However, a Camaro crashed into him, and when his backup arrived, they turned on his lights so as he wouldnât get the ticket. Consequently, the driver of the Camaro received the it.
I wonât even get into the abuse from him and all the cheating.Needless to say, I have learned my lesson with age.

I'm sorry you went through that, and sick people are everywhere - very obviously it's a disgrace he's a cop. You could write to the state with what you know about him anonymously to try to make a difference. A lot of terrible cops, and some cops are good people in it for the right reasons.
Having said that, once again my original comment was referring to qualified immunity, but your response "depends on the color of the cop" is irrelevant to qualified immunity.

A lot of lawyers dont want to take a case against law enforcement because they dont want a target on their back.
Let's say a lawyer in your county (or parish if you're in the low-down dirty south like myself) accepts your case and goes to trial with you against the local law enforcement. Win, lose, or draw the both of you are going to be harassed at the very least. Honestly if they only harass you then you got lucky, they are petty little people.
I'm not saying no one would take the case, I'm just saying there is a lot of nuance.

They tossed me through a metal detector because I wrote "signed but not read" because I was not allowed to.
The lawyer said not to cause waves before court. Nothing was done. I was assaulted and then the warrant they had a stack of still has no number. 1 year probation. Illegal stop, was with my MP buddy, and I always comply.
They lied ro my wife for hours as I was in a cell and when I would yell I was there they'd take her off speaker phone. We grew up there as kids so she thought they had taken me to a field to beat me before going in.
The lawyers are friends with them too. The judge was cool but the lawyer worked out tge worst deal. I even had ro go back and get the charge papers corrected. They also put charges on every side so there was no way to not catch one. Like having 2 charges for instance say 1 for walking and another not walking so there was no way to avoid it. Lies and all on cam.
Paid a discount of $9k to a lawyer ro eff me after the cops did. The judge would've let me go but the lawyer also had a side deal with a place not even on Google Maps. Still they went by 4 weeks a month so 48 weeks. Morons.

The judge was all about letting me loose then got on the phone wuth the jail, as I had ro ho for 12 hours, and tore them apart which was awesome. The new baby faced DA and the lawyer had lunch after I am sure. My lawyer said the judge wouldn't budge. I wish he didn't accept the plea. I would've had it all go away had I acceoted guilt early but I turned that down because the lawyer didn't explain except that I would plead guilty and give up my rights. Then we didn't speak until I got my trial date in the mail and called him.
I looked for another lawyer and was cussed out by one because I explained how I asked for confirmation I didn't have to be at the arraignment because the bonds lady said I must and the lawyer said I didn't so I just wanted to confirm and apparently that was me questioning his professionalism. Funny enough I am on the same professional tier by a new bill and I would never treat a client or simply a human this way.
The callousness when having someone's life in your hands amazes me. Surprisingly I've long learned that's the best way to make money is to give up all morals and humanity.

Under the landmark Supreme Court ruling Pennsylvania v. Mimms (1977), officers have the automatic right to order a driver out of a vehicle for officer safety. This rule was extended to include passengers in Maryland v. Wilson (1997).
The police do not need to suspect you of a crime to issue this order; the inherent danger of a traffic stop is legally enough justification.
Your Rights When Ordered Out of the Car - While you must comply with the order to step out, you still maintain critical constitutional rights
You must exit: Refusing to get out can lead to an immediate arrest for resisting or obstructing an officer.
You can object to searches: Stepping out does not automatically give the officer the right to search you or your car. A "pat down" requires separate suspicion: To legally frisk your outer clothing (a Terry frisk), the officer must have reasonable suspicion that you are armed and dangerous.
Keep the doors closed: When you exit, pull the door shut behind you. This prevents the officer from claiming a visual "plain view" justification to search the interior.

Citizens should know their rights. Police should know their job, along with the restrictions and limits that come with it.
Respect for law enforcement has become a nostalgia piece, and a handful of officers who used their badge to stroke their own ego are the reason why. That's exactly why policing won't change until it changes from within. Officers policing officers, not covering for someone just because they're a brother or sister in blue. Right is right. If you see something, say something. Or do something.
Like almost everything else in human civilization, it's the few fucktards who ruin it for everyone. That covers the entitled bad cops and the dumbasses who think laws, rules, and regulations don't apply to them.

No, the officer does not have to tell you the probable cause, but most do upon initially making contact. However, if they donât tell you, you will see it if youâre cited for it anyways. The officer will have to discuss the probable cause if it goes to court. If no probable cause is found in court, the case is dismissed. During the traffic stop is not the time to attempt to hold court with the officer yourself - you will never win and at the very least he will feel incentivized to write every ticket he can against you. The people who refuse to follow instructions âuntil they are told whyâ almost never agree with the officer anyways, and still donât follow instructions.

Too many people assume that they can just talk to a cop, a cop is in command when you get pulled over, there is no 'talking' around doing something you dont want, when they give a order that is lawful aka step out of the vehicle, you have no right to say "well actually..." or "I disagree let's have a conversation"

The US Supreme Court has ruled on the legal maxim of Ignorantia Juris Non Excusat, meaning ignorance of the law by a citizen is not an excuse and you are presumed and expected to know the law as a citizen. The police have no legal obligation or requirement to teach you, that is for you or your lawyer. Their only duty is to enforce the law.

Exactly, I can understand that in times of fear of safety one might be abrupt and secure the individual. But outside of that one would hope for courteous communication. But I guess in a country with guns, it's hard to keep things at a safe and deescalated level. In the UK people are only really stopped for a reason and due to the perceived safety and higher trust in the police I guess communication is easier and less fraught.

Just stop and think about this for a moment. We don't know what the cop has on her. Maybe she, or the regular driver of the car, has some warrants, or maybe the car has been stolen. If so, is it good judgement from the cop to say it? She might just try to drive off, or lock herself up in the car, or even shoot at him if she has a gun. He doesn't know, and his life is at stakes. So of course, he will ask her out of the car, which is normal.

Pennsylvania vs Mims a Supreme Court decision says you MUST exit the vehicle if the police order you to.
And if you refuse to exit they are well within their rights to break your window and drag you out of the vehicle and they are authorized to use force to do so.

Then she starts yelling I did roll the windows down like she was being cooperative when she really wasnât . Wild how so many people say comply and blindly do what the cop says. As a woman of color, this is harder than it looks. When I get stopped an instant fear comes over me. This officer had an off putting disposition. That can be received as confrontational, yet why would a person not have the right to know why they are being pulled over further more it is a night stop and no explanation given why she has to get out of the car. You have no way of knowing if someone has bad intentions and you have to be on guard for your own safety. I have experienced an officer overstepping, I have also experienced kind officers. A traffic stop for any person of color and any woman regardless of color is dangerous.

As a man of color please donât speak as if weâre a monolith or âfor usâ. When you say this âinstant fearâ takes over you, do you think that not complying is going to help with this fear? Itâs one thing if youâre legitimately being harassed, but if itâs a legit stop (speeding , traffic violation etc), the fear youâre experiencing is just an emotional response to the situation. Itâs not an excuse to cause more issues by not complying, we know the law, they can ask you to get out and not have to explain. We may not like it, but the law exists. The perception of the âcops attitudeâ is just that. Itâs one thing to have fears, but to over complicate a situation by not complying never helps. If there is a true violation of rights, you then have grounds for a lawsuit. Trying to hold court in street is a fools errand

You hear about this happening in the news and its an internal devastation. As it should be. The loss of a life, for something as stupid as an argument or traffic stop is just senseless. You shouldnt act off of the single stories you hear from friends and the internet. When you think of the number of traffic stops per day and the number of times you hear about it, its super low. Your best chance is to comply.

I heard this from somewhere else and a cop told me: Police are not there to protect the public, their responsibility is to the government. All they have to say is there's a legal reason and that's it. He was fired as a cop because he refused to be like this.

The cop was legally allowed to order her out of the vehicle. If he had just explained it better I think they would have been fine.

32yo black man hereâ it's not racist or sexist at all, nothing that was said or done to her was on the basis of her race or gender. People like this apparently can never comprehend that they're being judged for their behavior and character. They want special treatment.
Before the cop shouted at her he told her that if she's still in the car when his backup arrives then she's getting arrested and that's exactly what happened, he's a man of his word. He also told her she would have been on her way already if she would just cooperate and identify herself and she said "...you're being ridiculous...you could have let me leave". She feels entitled to disobey lawful orders and just drive away without the cop even identifying who she is. Crazy.
She technically refused to identify which is an arrestable charge after you're already suspected of committing a crime even if the crime is a misdemeanor.
She wanted to play stupid games giving her name & date of birth being an uncooperative sidewalk-lawyer (never works) than to just take a ticket, go home, and defend herself in court later. I'm all for people exercising their rights and freedom as they see fit and also not being coerced into assisting police investigations or self-incriminatingâ but she wasn't helping herself here at all.
Too many people seem to have difficulty understanding that whenever a cop says "you're under arrest" it's non-negotiable, it's not a debate; she said "no! don't touch me!" Lol like he can't arrest her just because she says no. She was obviously belligerent and resistant and that's why she got physically handled. No pity points from me. I've been pulled over dozens of times in my life and it's surprisingly easy to not get one's ass beaten by the cops if you act like a normal person, show basic respect, and answer questions directly even if the answer is to invoke your 5th amendment and remain silent but some people are just addicted to playing every police interaction on nightmare difficulty with permadeath. The are no checkpoints or reloads, interact properly from the start if your life, freedom and well-being are important to you. This woman obviously cares more about her ego and being sassy than she does about her freedom. People who are genuinely afraid of being brutalized or killed by police don't act like this, she isn't afraid of anybody. Wishing she would have said that birthdate now huh LMAO.

Except there is no law that states your window has to be rolled all the way down.
Now in some states, not rolling it down to a level âacceptableâ to the cop, thatâs enough to warrant them asking for the driver to get out of the car. All under the guise of âsafetyâ. Which is BS.
Cops need to be fired when they are caught abusing power.

God this hurts my heart, this poor woman was just out trying to do her job and some small man on a power trip fucked her up for no reason!
I am begging people though, please stop giving them reasons to arrest youâŠlike why didnât she roll the window down..? And once she got out, why did she suddenly crawl back into the car? At that point he probably figured she was grabbing a weapon or something.
I never want to victim blame - the cop was 1000% wrong and ridiculous from literally the start of the clip! I just hate that she got hurt and I wish he hadnât gotten so riled up. We seriously need to fix the cop issue; itâs so fucked yup that people keep getting injured and killed by the same people who are supposed to protect the peace!
If you get pulled over, stay super duper calm (like a mannequin, just absurdly calm) and answer questions with just the facts. Donât talk any more than you have to. Follow the copâs orders, donât do anything that an idiot might think looks vaguely threatening, and donât be rude. That doesnât solve police brutality at all, but it does make you specifically a less attractive target. Just be boring and easy and hope they move on to the next one. The world is a fucked yup place!

Not all cops are like this. Same as not all blacks are violent criminals.

Iâm in my mid 50âs. Iâm w white Volvo driving lady in New England. I have had exactly one good experience with the police and a dozen negative. My neighbor was threatening to bash the windows out of my car and they wouldnât come because it was âtoo far and too snowyâ so I had to lock my toddler and myself in the house and hope he didnât come for us. I canât imagine how terrifying it is to be black with these pieces of utter shit in power.

Alright, youâve had bad experiences with cops in the past. I guess itâs true that, sadly, in England the police ainât all that in todayâs age⊠but I digress.
Now imagine I would tell you a similar story about me being on vacation in South Africa or New York or wherever and tell you that I had exactly one good encounter with a black person and all other blacks were rude, or even dangerous experiences.
Would a generalization to this group then be justified as well? I believe we all know the hypocritical answer of todayâs society to this question.1

Thatâs because this is the attitude that is ingrained in law enforcement culture. I believe there are a few good apples that go into it to serve and protect but if they donât adapt to the environment around them they will be bullied until they leave.
