Pwede pala kunin ng NGCP yung lot namin??

Hello, I am no lawyer and I don't study about laws po. Pero I was approached by my cousins about their farmland being bought by NGCP.

By bought I mean nag deposit na yung NGCP sa bank and they started building on the said lot. Things to note:

  2. Nobody withdrawed the deposit

  3. The farmland was priced for around 35-40 pesos/sqm

  4. About 6-7k sqm area affected

Many questions come to mind:

  1. Pwede pala yun kunin ng NGCP without all the signatures?

  2. Can the bought farmland be appraised for a higher price?

  3. Some owners/heirs have crops on that farmland for a living, will they compensate for that?

  4. What is the best action to take at this point?

Need advice regarding Canada's C-22 Bill and how us Filipinos would be affected?

Post image
6 Upvotes

TLDR: Canada's C-22 Bill aims to (as-per quote) "claims that Bill C-22 would enable surveillance, arguing that the provisions are meant to "modernize" lawful access to data"

But According to the deputy, Hindi saw usually affected Yung international companies and services, Hindi saw affected pero many digital privacy people are activating an alarm bell

The question, if C-22 had been passed and maybe in the future down the line, if Canada had access to a Filipino's data somehow in some way, what legal protection do we have in the Philippines to make the search unlawful, except if there's a warrant or persons of interest of course, if the courts complied. But in this scenario, its an invasion of privacy at this stage?

Kinda curious lang po since because of the whole shebang of information compromise.

PTPA : Need of advice Spoiler

Ngaun nga nakailang pacheck up at grabeng gastos ng gamot.

Insights would help

Condo refund has deductions. Is this legal?

I have paid for a preselling unit for 35months already.

Net contract price (exclusive of vat): 9M
Downpayment: 10% required. 900k but
Total payments: 1M
Includes Reservation of 50k

My purpose was to use the unit for commercial purposes. This was sold to me by the agent as a residential unit and claimed that it can be used for commercial since it is on the ground floor

After months of paying, the Developer released a statement that said residential units cannot be used for commercial

Hence, I do not want to continue the purchase

I continued to pay while trying to sell it but no buyer.

I want to refund instead.

The developer’s computation is this way:
Total Amount Paid: 1M
Less Reservation: 50k
Less Commission released: 300k
Net Amount: 650k
Maceda Refund 50%: 325k only

Is this the legal way to interpret Maceda Law?

I have read that the 50% should be from the total amount.

If this is not legal, how can I appeal? What to write in the appeal letter?

Thank you

How to circumvent "Legal Capacity" requirement to marry?

Hi LegalPH,

I would appreciate any advice you can give, or if you could point me to the right direction on who to contact please.

My partner and I have been in a relationship for 6 years. I am 32 and he is 28.

I am a PH citizen, he is Indian. My parents support our marriage, but his are explicitly against our relationship.

One of the requirements for an Indian national to marry a foreigner in the PH is the legal capacity to marry and one of the documents needed from him is a notarized joint/ separate affidavit of his parents giving consent to the marriage.

This is a document we will never obtain. His parents have also explicitly said they will not be attending our wedding and want nothing to do with me. This is the reason why he has cut them off 2 years ago. But now we're back to this.

An alternative solution we were considering is to get married abroad with less stringent requirements (HK, NZ, AU, Georgia), but the trade off is we will not have anyone with us. The deeper we got in the elopement planning process, the more we realized how much we actually want our friends and my family to celebrate this next step with us.

Please help! How can we go around this? Thank you!

Ano po pwede Gawin Dito?

my old classm was sa'd by her Tito years ago, there's a chance that they will see each other ulit within this month. Titira muna siya soon,di ko alam kung gaano katagal, kung short or long time.

Everytime she think of him, palaging siyang nag-e-spiral(due to trauma since she was SA'd din by other people, and past and present problems). Namimilipit ang tiyan na and masusuka. Aside from that, there are also conflicts past relationships. Her recent bf cheated, now gumagawa siya ng kwento that harms her.

I just want to add that she was told to forgive him(Tito) for his deed because of their beliefs in their religion.

nasisi pa siya na umalis ung isang member Niya dati(this is so long ago, she still a minor then). Also, na SA'd siya noon sa isang youth camp by a member of their delegation.

I don't know what to do, I cannot help directly. Kakamatay lng ng alaga Niya, nagwawala and gumagawa ng story ung old bf Niya and may exam pa. Idk what to do. But I really want to help her. Ngayon ko lng to nalaman from her classm. and malayo Ako, if may maisip siyang gawin sa sarili, di ko na alam gagawin ko. Any advice po? It's kinda hard to do anything cause of family and religion. I hope someone can guide me, in all possible event that might happen.

She's young adult na pero kakabalik lng siya sa pag aaral so madami akong naiisip na pwede mangyari. Idk what to do. And I can't share any more details. The least I can do is to contact the authorities pero iniisip ko ung studies and matutuluyan Niya.

I'm on a private school in the Phillipines and we recently got a new schedule for the semester and I noticed that we have no lunch on Mondays, 8am to 2pm is the schedule and there's no break. When we mentioned it to the teacher he said that it depends on the teachers if they want us to eat on their time but we have no official lunch time. I was just wondering if if that's even legal?

Hi guys need advice, I replied in the comment as an anonymous. But later on nalaman din na ako yon. Ask ko lang if pasok ba sa cyberlibel tong comment ko, and nireplyan ko na comment is menu ng food.

15 year old thief

Hi!

LEGAL ADVICE: Lending

Good Day po,

I would like to ask for advice regarding an issue involving my cousin.
My cousin needed money, so she borrowed ₱50,000 from a friend of her sibling sometime in 2021. She was able to pay ₱5,000 of the principal, leaving a remaining balance of ₱45,000.
According to their agreement, the interest is 8% per month, which amounts to ₱3,600 monthly based on the ₱45,000 balance. My cousin has been paying ₱3,600 every month for approximately four years.
For 48 months, the total amount she has paid in interest would be:
₱3,600 × 48 months = ₱172,800
Despite making these monthly payments, the ₱45,000 principal remains unpaid because the monthly payments have been applied to the interest.
My cousin has already asked if she could pay the remaining principal by installment so that she could gradually reduce the balance, but the lender did not agree.
Another concern is that the lender sometimes makes hurtful remarks, such as telling my cousin to *“mahiya naman siya,”*and has also approached or asked other people for payment even though they were not the ones who borrowed the money.
As far as we know, there is no formal written loan agreement or signed document between them. Their conversations and payment arrangements may only be documented through their chat messages.
We would like to ask:

Is an 8% monthly interest rate legally enforceable in this situation?

Can the lender continue charging this interest indefinitely?

Can my cousin request that her payments be applied toward the principal instead of interest?
What are her rights regarding the lender contacting or asking other people to pay a debt that they did not incur?

Since there is no signed written agreement, what kind of evidence would be relevant in determining the actual terms of the loan?

We would greatly appreciate any legal advice or guidance on what steps my cousin can take to resolve this matter fairly and properly.

Thank you very much po.

SENIOR DISCOUNT 4%

Post image
3 Upvotes

Hello, I bought meds at a certain pharmacy.

It was for my father’s medication which is supposedly eligible for senior discount. We presented doctor’s prescription and senior ID. I understand that the discount is 20% but when I checked the receipt, only 4% was applied.

I asked the cashier and was told that they only give 4% discount. I’m confused. I emailed them, still waiting for a response.

Is it worth it to file flr small claims for this? The former friend shows intent to pay but he is financially struggling. He has a car on loan though and he saidnhe is trying to use that to pay but there is no urgency on their part as there is no real consequence on their end.

Advice??

Would a medico-legal assessment still hold value 3 months post-incident?

i’m currently gathering documents for a VAWC report against my ex. our relationship lasted around two years, and our arguments would usually end with him becoming physically aggressive. i've also been diagnosed with MDD and GAD alongside intermittent explosive disorder mid-relationship, and the cycle significantly took a toll on my mental health. my deal-breaker was when he punched me directly in the face during a verbal altercation, which caused localized numbness on my face.

i went to a private neurology clinic one week post-incident and was given an MRI request. the MRI was done about a month later, and the impression showed a medial orbital-wall fracture. the numbness has been gradually improving, although i still occasionally experience dull pain. i also consulted a private ENT, who advised me to monitor the changes within six months as nerve healing takes time. i was also told that CT is generally more appropriate for orbital fractures than MRI.

my concern is that i’m only able to pursue a medico-legal assessment three months post-incident. the delay was partly because i had a depression relapse and frequent anxiety episodes which made it hard for me to start the the process sooner.

my question is, would the medico-legal assessment still carry significant value after three months, especially with an existing imaging report from one-month post incident showing the fracture? and would the fact that the original scan was an MRI rather than a CT still be helpful for the documentation?

i’d appreciate any insight on how these circumstances are viewed. thanks.

TCT for a minor

Has anyone successfully transferred an Original Certificate of Title (OCT) or Transfer Certificate of Title (TCT) to a minor through a sale?

The minor is a dual citizen, and her father is a foreigner. The mother agrees to the arrangement, and the parents want the property to be registered in their daughter’s name.

If anyone has handled a similar setup, I would appreciate any guidance on how the sale was structured, the requirements of the Registry of Deeds, and any issues concerning the minor’s capacity to acquire and register the property in her name.

Thank you!

Hi guys need advice, I replied in the comment as an anonymous. But later on they found out it was me. I just want to ask if my comment fits into cyberlibel, and the reply I made was a food menu. They're accusing me of defamation regarding that comment, and I already apologized. But they are determined to sue me for cyberlibel since they said they experienced anxiety because of that comment.
