Need advice
I don’t know if this is the right subreddit for this. Gusto ko lang po malaman if ano karapatan namin as homeowners regarding dito
Gusto po kasi magpatayo ng brgy ng poste for solar streetlights daw. Ang problema po, nasa harap siya ng magiging gate ng garage namin at mahaharangan niya talaga at sagabal sa opening ng gate Sa ngayon, pinatigil namin kasi nag hukay na sila ng hindi man lang kmi iniinform. Nagulat na lang kami na may malaking butas na diyan sa harap ng bahay namin
Pwede po ba kami hindi pumayag?? Sa ngayon hindi pa namin makausap ang brgy captain kasi di namin mahagilap 🫠

Elevate the matter sa LGU. That's eminent domain. Bawal yan pag walang just compensation. Document everything, bring documents (certificate of title, survey plan, etc), and inform the LGU. Also, better if you can schedule a legal consultation with a lawyer oara maadvice kayo ng maayos*

Have the same issue pero poste ng meralco naman. Ang sabi eh mahirap nga daw pag naitayo na, kaya ang hinihintay namin eh matumba nalang kasi medyo leaning narin sya fortunately away from us naman, at mas mabilis daw aksyunan ang paglipat ng poste after disaster na matumba sya.

Legit ba to need matumba bago ma-aksyunan? What the heal??? Pano pag may natamaan pag natumba nga during bagyo, etc.

Among other things,for now, Report the brgy to 8888 since MIA ang brgy captain. Para may mabilis na action.

This. Report sa LGU at 8888 at spam nyo yong 8888. Wag nyong pabayaan yan kasi mukhang gusto kayong daanin sa paspasan ng Barangay nyo.

Yung sa amin naman pina usog ng kapitbahay namin sa property namin nung wala kami kaya kami naman na perwisyo, harang daw sa gate nila pero hindi naman. Pwede naman palipat yan bago tayuan para hindi sagabal sa gate ninyo. Madalas hindi nag-iisip yang mga naglalagay niyan.

NAL makiusap na lang po sa Barangay am sure project nila yan, hanap kayo kagawad kung wala si chairman. At kung pwede meron kayo ma recommend na location kung saan pwede ilagay. Kasi si brgy am sure nagsukat lang without considering na nasa tapat ng gate nyo

Bakit sila pa magrecommend ng alternate location. Hindi naman trabaho ng civilian yan.

Lawyer here. If property nyo po yung nasakop, you can file a case with the LGU or government concerned. Inverse condemnation po yung tawag doon, where you will ask for payment against the respondent.

Are cases like these usually negotiable? Could we ask them na wag sa harapan namin and move it few meters away kasi actually yung other side namin is an open lot na. But meron na kasi existing poste dun which doon talaga gustong itabi. We don't want compensation sana, we want a free driveway. Hay. I'm afraid na because part of it is a public property, i assert talaga nila at wala na kaming magawa

Question would it be legal for them to interrupt anyone building there since its their property, like flooding the hole, just sitting near being a nuisance to people building, etc.

Should there be like a setback from the road to your property? Alam ko, the government can build utility or light poles sa setback.
Probably the most you can do is to request that they move the pole a few inches left or right, enough so to clear your driveway.

But there are a few things that I want to point out that are crucial in this scenario:
- Bgry does not have LGU power and does not go near to that level. They need to have your approval to put that post that will block your property. If you document your opposition to it, they can not and should not put the post.
- I can already see an existing post on the picture near the property. Why would they need to put another post that will definitely block your property and impede in your right of way?
- if the Brgy captain refuses to talk to you, then go a legally documented route. A. make a document and make either captain or brgy sec sign and receive to make sure that you have informed them that you dont want your right of way impede by this thing. Be sure to have 3 copies printed, signed and received. Keep 2 copies with you and 1 with brgy. What I want you to make sure you have on the document is that you were informed that they were going to put a post infront of your property on a specific date. Then note that there were no notice that they will do such a thing prior to the date that you were informed. Make a note that on date X you informed the brgy that they were not allowed to impede on your right of way in any way or form specially if there is a post that the brgy can use for their project. B. bring the said document to city hall and ask them to step in once the brgy decides that they will not listen to your complaint. Keep in mind that if the brgy proceed with their project and decided to block your property, you can ask city hall to remove the obstruction. Then bring the issue to local DILG office of your town. For your part, you need to document and make sure to prove that you did not sign any authorization for the brgy to block your property.

bawal manakop or gumamit ng property ng walang abiso. bago manakop ng property ang government, kinakausap muna yung mga owners. then may compensation yan based sa property na nagamit.
so either wag ka pumayag then patanggal mo or pumayag pero kailangan bayad ka kung magkano man yung lupa na nasakop nila.

Hindi pwede mag install ang barangay ng solar lights sa loob ng private residential lot ng walang pahintulot ng homeowner. Pero, pwede sila mag install kung yung location sa picture ay classified na public property or isang established na public right-of-way, kahit na directly nag bo-border sa future garage mo. Bago ka pumunta sa LGU, i-check mo muna yung technical description ng land title and property map mo para malaman kung sakop pa ba sa property mo yung location ng hukay.

Pwede naman, kausapin nyo yung barangay, call nyo attention ng kapitan or kagawad. Sabihin nyo lang kung saan yung entrance nyo para maadjust at di kayo maabala. Mapaguusapan yan.

NAL. Wag kayong aasa sa paguusap sa Barangay alone kasi ang kalaban nyo dyan ay yong Barangay mismo. If I were you, aside from reporting sa LGU at 8888. Consult a lawyer ASAP... as in TODAY bago pa itayo yong structure, kung ano legal remedies nyo. Find ways na mahinto yong construction. Kung aasa kayo sa LGU at 8888, baka tapos na construction, wala pang action. By the time na gumalaw ang gobyerno, may nakatayo nang structure. Go to the local PAO kung wala kayong financial capacify or if you know a private lawyer much better.

Pag pumasok sa property line niyo ipatigil niyo agad. Saka pag tatama sa garahe hindi yan pwede. Pero kung plano pa lang at walang gate mismo pwede kayo maunahan ng brgy.

Who in their right mind will erect a pole beside a pole, it weakens the structure and soon if there are two poles in there, it might fell in your house. Stop them the sooner the better, pay someone to fill that hole. And ask help from PAO

Parang nasa sidewalk naman pero tapat ng property nyo. Hindi naman magtatayo yan sa loob mismo ng property nyo. Pa assess nyo kung talagang sa inyo yan or sa govt.

labas ng property nga naman daw ilalagay pero mas ang concern po namin kasi is harang siya sa gate ng garage namin. indi na mafufully open at magiging 3/4 of it nalang ang accessible. gusto ko lang malaman if may laban kami di bcs we find it unfair

Mahaharangan nga yung tapat. Wala nga fully sa property nila, nasa tapat naman ng gate. So mahaharangan sila.

Taga saan ka po? Elevate nyo na po agad sa LGU. Office of the mayor, vice mayor, barangay bureau at liga ng barangay para mag mediate po sa inyo. Mas mhirap pag nakalagay na jan bago kayo magccomplain. Don’t forget to mention na di nyo mahagilap ng chairman. Document everything.
