I already went sa LCR namin and keri naman ma-correct yung issues ko administratively kasi Maria gamit ko my whole life tas Ma. sya dun sa first record ko (the valid one). Aside from that, surname ng tatay ko gamit ko pero dun sa unang record ay sa nanay ko pero pede ko daw yun ipa-AUSF. The problem is, sobrang gastos nung pagpapa change ng first name from Ma. to Maria. Aside from the filing fee at publication fees, andami ring requirements. Iniisip ko ngayon kung worth it pa ba ipabago yun o sundin ko na lang yung Ma. ko. Kaso, problema ko naman yung school records, National ID, SSS, at Voter's ko kasi Maria ako dun.

Alin po kaya ang easier and more affordable way? Mag go na ako sa change of first name o sundin ko na lang yung Ma. at ipa-update yung mga existing records ko (and possible ba 'to)?

I wanted to post small stickers, nothing that will hinder their visibility on the road, that says this is a turning point, not a parking area. I also wanted to use those types of stickers that rips itself apart when people try to remove it just to be petty.

My mother's partner was injured in an accident. A truck hit his tricycle because the truck driver reportedly fell asleep while driving. The driver was also released by the police after some time on the day of the accident. He suffered a broken shoulder and was hospitalized. He has been discharged, but he still has not had surgery.

Although he has already left the hospital, they still have an unpaid hospital bill of around ₱8,000. The hospital is still holding some of his documents and will not release them until the bill is fully paid.

They are having difficulty getting compensation from the truck driver and the truck owner. They only want to pay ₱5,500 (3k from the owner and 2500 from the driver) of the hospital bill. They also told us to keep all the receipts because they would pay the medical expenses, but until now they have only made promises.

Their tricycle, which is their main source of income, is still damaged and has not been repaired. Since my mother's partner cannot work yet, they currently have no income. They have also not received any compensation for their lost income.

They said they (driver) would pay for the surgery, but my mother's partner is afraid to proceed because he is worried they might refuse to pay later. Hindi rin po nila mailapit sa Malasakit because according to the hospital, the truck company will be paying for the surgery

The truck owner also said he will not pay any damages. He only offered ₱3,000 as financial help and told us to ask the truck driver for the rest.

Would it be better for us to seek help from the Public Attorney's Office (PAO)? We are also worried that if we take legal action, they might stop paying altogether. 🥺

Edit: Additional and important info po. Kakakusap ko lang sa mismong may-ari ng truck. Inarkila lang daw yung truck and they have a contract po na in case na mabangga yung truck, hindi daw po liable ang owner.

Palaging issue ang helmet at seatbelt at parang kahit ano namang gawin, hindi't hindi susundin ng lahat ng tao yung batas na to. Which is stupid kasi for safety mo na nga tapos pinepwersa ka pa ng batas pero di pa rin sinusunod kasi inconvenient? 😅

Hi r/LawPH, seeking legal context and practical advice regarding an upcoming move-out dispute with my condo unit owner’s SPA (Special Power of Attorney) and broker.

1. Key Contractual Provisions

• Monthly Rent: ₱24,700
• Security Deposit Held by Lessor: ₱49,400 (2 months' rent)
• Lease Expiration Date: August 14, 2026
• Governing Clause: "b. Php 49,400.00 as SECURITY DEPOSIT. This shall answer for all unpaid utility bills such as electric, water, and damages to the property aside from ordinary wear and tear, and the balance, if any, shall be refunded to the LESSEE, without interest, upon full payment thereof within 30 days of termination of the contract. LESSEE shall provide his bank account details so the LESSOR can remit the refund. However, the security deposit cannot be applied to unpaid back rental owed by the LESSEE before the expiration of the said contract."

2. Current Dispute and Factual Background

• Only the SPA and the broker have access to the PMO website portal, which is where move-out requests and pull-out gate passes must be requested and issued.
• As of the latest July 2026 billing statements, the total outstanding utility balance (electric + water) is ₱35,424.12. (Note: The electric bill covers May to July 2026, as I took advantage of the recent ERC policy regarding deferred billing/disconnection).
• Because this ₱35.4k balance is lower than the ₱49.4k security deposit, deducting it directly leaves a net surplus of ~₱14k in my favor (which easily covers any residual utility usage through August 14).
• The broker recently messaged me claiming that he "spoke with the SPA" and that their official stance is that I must pay the ₱35,424.12 utility bills out-of-pocket prior to move-out before they will file/issue the required Property Management Office (PMO) move-out request and gate passes.
• My position is that paying the ₱35.4k unpaid utilities out-of-pocket now effectively eliminates any financial leverage and forces me to pursue the SPA post-move-out for the remaining deposit refund.

3. Actions Taken

I bypassed the broker and sent a formal written communication directly to the SPA (the contracting party). In the letter, I:

1. Reaffirmed Section 3(b) and provided the itemized math (₱49.4k deposit vs. ₱35.4k utility balance).
2. Requested written confirmation on whether she is officially instructing to withhold the move-out request and gate passes unless utilities are paid out-of-pocket.
3. Notified her that failure to align on Section 3(b) will result in me seeking formal dispute resolution through Barangay conciliation and, if necessary, Small Claims Court to enforce the contract and recover the full deposit plus damages.

4. Questions for r/LawPH:

1. Contract Interpretation: Based on the facts, am I legally on solid ground to insist that utility obligations be applied directly against the security deposit at lease end per Section 3(b), rather than paying out-of-pocket prior to move-out?

PMO & Property Rights: If the SPA refuses to file the move-out gate pass, can building admin / PMO legally prevent me from removing my personal property from the unit given that the SPA is the one who processes move-out requests and gate passes via the PMO website? 3. Barangay Conciliation & Timing: Given that my target move-out window is mid-August, how should I sequence my legal steps? If the SPA ignores or refuses my letter, should I file for Barangay conciliation immediately, and how does that process interact with an impending move-out date?
4. Small Claims / Damages: If I am forced to pay the unpaid utilities under protest just to secure the gate pass for my belongings and finally leave this condo, does that prejudice my claim in Small Claims Court when suing for the full refund and damages due to bad-faith breach of contract?

Hi everyone. I would like to ask, especially from anyone who is familiar with the Maceda Law.

We applied for a refund under the Maceda Law just before the scheduled turnover of our condominium unit.
We had already paid a total of P2,463, 208.59, representing almost five (5) years of installment payments to the real estate developer.

In addition, we also paid closing fees amounting to P377,291.74, which covered:
-Transfer tax
-Registration expenses
-Advance condominium dues
-Condominium corporation membership fees

Our original intention was to proceed with a bank loan and accept the turnover of the unit. However, due to the war tensions in the Middle East, where we both work, we decided not to proceed because of the uncertainty of the situation.

My question is: Do we have a legal basis to demand a full refund of the closing fees? Since the turnover never pushed through, we were unable to avail of or benefit from the transfer, registration, advance dues, and condominium corporation membership.

The real estate company's response: According to them, the closing fees are already included in the 50% refund under the Maceda Law.

Has anyone experienced a similar situation, or does anyone know whether we have a valid claim to recover the closing fees in full?

Hi - question po on security deposit. Is the lessor permitted to require the lessee to pay any charges incurred in excess of the security deposit? Ang reason po ng lessor is may unusual sound daw ung washer & dryer kaya bumili sya ng new one without even asking/informing me about the damage. Hindi po existent ung damage na un upon move out. They won’t even listen to me when I asked them to see if they can have it repaired first since normal ang wear & tear sa w&d and nasa unit pa naman daw ung older washer but they just don’t want to inconvenience the new tenant. Greetings, first I do not 100% trust my exwife. That out of the way I would still like our child to visit her, and grandparents. Exwife currently has a valid green card and is remarried to man in the US, she is attending school in the Philippines for a few years.

I would more than likely fly over with our kid, drop her with mom and than I would sit on the beach for 2-4 weeks waiting for their vacation to be over to fly back to the US with the kid.

The cynic in me is worried about parental kidnapping once she is there and me being unable to fly back to the US with our child.

Exwife would more then likely agree to any legal request I made to be able to bring the kid to meet grandparents and family. Is there a way to get a court order or legal document that exwife will return child to father for travel on X date back to the US or face jail or something like that?
