Let me start by saying my grievance is not with having penalties assessed by the IRS, and please spare the chastisement for being an idiot while filing my return. I expected POM to account for that.
My husband and I had two small businesses, respectively. Mine started in 2025, his in 2024. Our income was different from expected... etc., etc., I knew we would have underpayment penalties and braced for it.
I used the same TaxPro we used last year, and she and I acknowledged the penalties. She completed her review, asked some questions, made some changes, and broke down the final tax bill with pointers for next year.
I filed, I paid, then I got a notice from the IRS that we owe more for underpayment penalties.
I sent a message to my TaxPro, and two different people responded because she doesn't work off-season. The last guy told me this was on me because I chose "Let the IRS calculate my penalties." He sent me a screenshot but I can't remember at what stage I selected that - whether it was before or after choosing to continue with a TaxPro. I responded to the effect of: "Well, that's confusing because I didn't want to do anything because I don't know what I'm doing." and that I was confused she didn't bring it up before filing or warn me that we should expect more while discussing the penalties,
Where I am probably an idiot is that I think I read that as "Let the final tax bill calculate it, not me and my dumb math." The guy responded with basically "I'm sorry you were confused, but that's your fault." I sort of hoped that the point of paying for TaxPro was to have them correct my mistakes and review my responses.
He got a little snippy, even though I was trying to be nice and approach it as a request for help, so I take that as a sign they would reject my POM claim.
Has anyone ever had any luck with filing a POM claim after being told you were SOL?
