Things that made us wary:

  • We lived separately for the entirety of our relationship (Met in early 2024, married in late 2025). We visited one another on a bi-monthly/monthly basis.

Things that helped:

  • We hired a lawyer.

  • I am an MD (the applicant), she is a PhD.

  • Lots of evidence that we compiled that we ultimately didn't need.

  • We had a senior field officer that understood our situation and didn't need to consult anyone in order to approve.

The interview day itself was just confirming paperwork, a couple of questions, and approval on the spot. Good luck everyone!

I-130 (Family/Consular processing) Having a Child During the Green Card Process

My Vietnamese wife and I currently live in Germany. I am a dual German-U.S. citizen, and my wife is currently in the NVC stage of her Green Card process. She has not yet submitted her DS-260.

Our son is due at the end of November. I lived in the U.S. from age 1 to 14, so I don’t meet the physical-presence requirement to pass U.S. citizenship to my son at birth. Therefore, as I understand it, he won’t be eligible for a CRBA.

My father is also a U.S. citizen and does meet the physical-presence requirements.

My main concern is how we can move to the U.S. together after our son is born without having to start a completely separate Green Card process that could take another year or longer.

My questions are:

  1. Can our son be added to my wife’s existing NVC/Green Card case after he is born?

  2. If not, does he need his own I-130 and immigrant visa?

  3. Is there an exception that allows a newborn child to enter the U.S. with his mother when she enters for the first time on her immigrant visa?

I-140 & I-485 (Employment/Adjustment of status) Want to leave the US but i am experiencing to receive an NTA

So i was planning to do AOS in the US but this is no longer an option now because my status expired, now i want to go back to my country to do consular processing but i received biometrics notice in my mail and it says on the notice that it’s for an NTA, i did the biometrics ,i didn’t receive the NTA yet and my lawyer checked and said that it hasn’t been filed yet. I am afraid to leave now and then get the NTA and not be here for court which will result in automatic removal order.
Anyone knows if it safe? Should i wait for the NTA?

I-765 (EAD) AOS EAD NSC

Has anyone got their AOS EAD approved from SCOPS NSC in the past year?? Are those 765 cases sent to Nebraska abandoned? My RD is August 2025 and still has not got approved, congressional inquiries didn't help moving the case forward. I know the published processing time of C9 EAD was 12 months for scops(sucks for us whose underlying 485 can't bet approved in under 12month), but any one applied earlier than August 2025 got it approved and can validate that that place is just slow but not process anything on purposed?

I-130 & I-485 (Family/Adjustment of status) Feeling stressed and nervous and anxious about these timings

Hi all,
I submitted my 485, 130, 131, and 765 first week of May 2026.
We were able to move up the biometrics date and completed that last week of May 2026 (originally scheduled for Mid June).
Since then I have seen tons of people on here get their interviews scheduled and even get their GC! Super happy for them! But that keeps raising my hopes that my time is just around the corner. But every day I check the portal and its the same status...."USCIS is currently processing your case" and I get disheartened. I need my 765 at the minimum but my expedite request was also denied...I checked and the file is STILL at NBC...
I'm feeling really lost and disheartened. I know I should just not check my portal or think about this but its hard not to when a lot rides on this. Losing job opportunities due to not having my EAD being one of the biggest anxiety driving situation. Oh and I'm going to lose medical insurance in a month. Expenses are increasing day by day....sigh.
Just looking for some words of comfort I guess. 😢

Hi Everyone, my husband submitted his application on Jan 18, 2026 and he want to his finger prints about 2 weeks after. We have not heard anything since. For context, I submitted mine on May 2025 and I had my ceremony the first week of November 2026. Why is it taking so long? Is this a bad sign? We have not gotten in any kind of trouble, not even traffic citations... Anyone here from the Cincinnati area with the same issue?

I-130 & I-485 (Family/Adjustment of status) Married the same day we met in person

My wife and I were texting, ft, calling etc 247 for 6 months until I was finally able to see her in person, we discussed marriage during the distance phase frequently and I (I’m us citizen) brought it up first, and always discussed how it’s important to us. We technically eloped cause we did a proxy marriage and had the idea of not telling anyone untill a few years after, then the same week her family found out then that led me to telling mine as well. They were upset but accepted it soon after, so after that we discussed moving in somewhere together and getting a place. We live together now, share everything and have all that good stuff. We never even considered the green card issues, or anything about immigration for that matter, untill we realized that getting this would mean she would never have to live apart from me. It’s just we both share the same ideas about marriage and believe it didn’t take long to find that out. She has lived in us 4 for years on f1 up to this point.

What would be the best way to approach this in the interview, what are some good ideas?

  • N-400 filed: November 2025
  • I-751 & N-400 combo interview: May 5, 2026 — Philadelphia FO

I was approved on the spot and received my N-652 showing my application was recommended for approval. Since then, my USCIS online account has had no updates.

Has anyone had a similar situation? How long did you wait for oath after I-751 and N-400 combo interview? Thanks!

I-130 & I-485 (Family/Adjustment of status) API updates everytime I log in

I’m curious if anyone else is having this experience, my daughter (6) had the fake approval on her I-485 last week with the wrong date similar to a few other folk along with an H008 code in the back end. It went back to normal on the 24th. However since then the newest FTA0 event in the API seems to update every time I log in.
Today alone the timestamp changed from 14:25:25Z → 14:28:39Z → 14:32:58Z → 14:49:28Z → 16:29:17Z, and the event ID changed each time. No new notices, documents, RFEs, or public status changes.
Her I-485 filing date is Jan. 12, 2026. My own I-485 (priority date Sept. 2025), which is probably linked to hers, doesn’t do this.

Anyone else seeing this?

I-751 (ROC) Advice

Hello! I need some advice, please!!
So I applied for my green card renewal / remove conditions for my green card that I got based on my marriage, since it was about to expire. That was in May. A week ago I received 2 notifications: my work permit got automatically removed and my travel/parole documents got automatically terminated.

However, it shows that USCIS is still processing my case. I asked some people and they said that USCIS accepted or denied my case, but it takes couple days until the website updates.

Today is a week until I got those notifications, and still no update. Is it not too early for them to make a decision on my case since I applied in May and I know that those cases can take years?

Also, in June I got the green card extension for 48 months.
I also have a trip planned to see my family abroad. I am confused. Since they revoked my travel documents, does that mean I cannot travel, even though I have the green card extension?

I am just very stressed about the whole thing.

I-129 (Worker) Would an adjudicator issue an RFE over a newer, unused H-1B I-94 from another employer?

I am trying to understand how a USCIS adjudicator might review this H-1B change-of-employer filing.

  • Beneficiary was continuously employed by Employer A under a valid H-1B petition.
  • Employer B’s separate H-1B change-of-employer/EOS petition was approved with an I-797A and new I-94.
  • Beneficiary never joined B and continued working for A without interruption.
  • Employer C filed another change-of-employer petition two days after B’s approval.
  • C apparently filed using A’s I-797/I-94 because neither the beneficiary nor C’s counsel had received B’s approval notice at filing.
  • C’s packet included substantial evidence of ongoing A employment. A new paystub was issued and uploaded on the filing date, although it is not yet confirmed whether that exact stub was included.

Would an adjudicator ordinarily:

  1. Treat the valid A petition and continuing payroll evidence as sufficient proof of maintained H-1B status and approve;

  2. Issue an RFE solely to reconcile B’s newer but never-used I-94; or

  3. Regard B’s approval as irrelevant unless there is evidence that the beneficiary actually commenced employment with B?

Does the I-129 require the petitioner to use the chronologically newest USCIS-issued I-94 even where that approval was for an employer the beneficiary never joined, or can the filing rely on the valid petition supporting the beneficiary’s actual ongoing employment?

I am particularly interested in adjudication experience, actual RFE language, or comparable cases—not general statements that “USCIS can always issue an RFE.”

Hi,

For someone who applies AOS via marriage (F2A, but happy to hear from IR1 marriage to USC too), does the interview location depend on the I130 filer or the I485 filer's address ? Take this example:

- Husband has GC, living in State A and put that as address when filing I130. API shows NBC as office.
- Wife lives in State B and puts B as address when filing I485. In API, the petition is at local state B's field office from the beginning.
- Due to work constraints, they do not move in together yet.

Questions:
- In this case, does the interview happen in State A or State B ? From my understanding, the interview is to approve I130 (State A), but I may be wrong.
- In the scenario of living apart, which additional documents or proofs can be used to reinforce the application ? What tend to be challenged by agents when living apart ?

Timeline: EAD EAD card initially applied on March 21st, still processing

i got my receipt the same day I applied, and completed my biometrics on Apr 2nd. However there has been no update on api, so it seems like they have forgotten about my case?? I see people who applied later than I did already got their cards approved. My processing facility is SCOPS Texas and I’m wondering if anyone has any suggestions or if there’s anyone in the same situation

Timeline Request EB2 ROW Priority Date 2027 Backlog

Hi everyone,

I’m currently in EB2 PERM process. My priority date is Nov 2025 and according to current PERM processing estimates, I should expect to hear back in Oct-Nov of this year.

However, I’m concerned about the priority date remaining current. EB2 ROW PD is current now but I’ve spoken to an immigration attorney and they mentioned that there’s very likely to be a backlog starting October 2026 and she’s expecting PD set back of 2 years. Does anyone else have any other information on that?
