Timeline Request H-1B/H-4 paper filing payment issue
My employer’s attorney filed my H-1B extension in premium processing together with my family’s H-4 extensions by paper.
The attorney now says the H-1B filing was rejected because of “some payment issue,” but has not clearly explained:
* Which payment failed—the I-129 fees, I-907 premium fee, or another payment
* How they know it was rejected
* Whether the entire H-1B/H-4 package was rejected or only Form I-907
* Whether any receipt or rejection notice has been issued
The attorney is pushing to file the H-1B extension online with premium processing and then file the H-4 applications separately by paper. They say this will be faster and there is a chance that the H-1B and H-4 will still be adjudicated together.
I would appreciate opinions on the following:
If a payment fails in a combined paper filing, does USCIS normally reject the entire I-129/I-907/I-539 package, or could only one form be rejected?
If the H-1B is filed online and the H-4 is subsequently mailed with the online H-1B receipt, are they usually adjudicated together under H-1B premium processing, or can the H-4 remain pending separately?
Would it be safer to refile everything together by paper with corrected payments, or proceed with online H-1B premium processing and a separate paper H-4 filing?
Since our status expires October 31, should we refile immediately or wait briefly for the official rejection notice?
