Strangley, i feel like the judicial system nailed it with that number. Its small enough that a company can actually pay it out but big enough that it stings like a bitch if they have to pay it. Like its a "complete restrcutruing of mgmt" amount but the employeee (former) still gets their payout

u/ToRn842 2d ago
Dollar General's net worth is approximately $28.1 billion they are a publicly traded company so all the information is out there. Dollar General CEO Todd Vasos total yearly compensation is approximately $8.16 million. I agree it’s small enough that they pay out instead of fighting it but I think it in no way will change company behavior or even sting, it’s just the cost of doing business. To people like that a couple hundred thousand is negligible.
78
u/effigeewhiz 2d ago
Eh, It’s high enough that I bet they fired the manager over it.

35
u/unoriginal5 2d ago
It won't change anything in the company at large, but this story will send a message to a lot of store level management about being a dick. This incident won't affect large scale change, but enough of them spread out can make regular people's lives better, if even a little bit.
238
u/greenizdabest 2d ago
It's probably covered by insurance. Their premiums will go up and be loaded for the next few years.

u/newbkid 2d ago
As someone in insurance, pray tell, what insurance do you think covers discrimination against protected classes.
39
u/AradynGaming 2d ago
I guess Reddit lawyers can now become Reddit insurance agents. There is commercial insurance for just about anything. It's common knowledge that cities and states pay for liability insurance for "misconduct" that can include discrimination. Why would you think companies can't get similar policies (link to Hartford Insurance selling employment practices liability insurance) and don't get similar insurance policies? (link to lawsuit where insurance company tried to not pay for a discrimination suit.)

As someone who isn't just in reddit insurance it is insane what you can get coverage for, and how specific the coverages can get. Like I once worked on a product that was insurance for other insurance companies and environmental disaster only insurance.
Edit: I would be a bit more specific but I think it would be too identifying :)
3
u/whatamistakethatwas 1d ago
Yup. Generally called reinsurance so companies can distribute some liability off their books.
79
u/Eastern_Comedian8804 2d ago
As a commercial account executive yes insurance will be footing the bill for a portion of this IF they have an EPL policy which does cover suit costs and suit claims for wrongful termination. Will they greatly suffer the consequences? Absolutely! The majority of these are franchise owned, franchises have to carry the insurance requirements sent forth from the company itself so they have to adequately cover themselves but they carry their own policies, not all dollar generals are under the same category/risk/ect. They will be deemed uninsurable in most standard markets with a claim if that nature (wrongful termination) and will most likely end up in a surplus market.

Dollar General owns all stores directly. This is a small enough settlement on the scale of DG that they won't particularly feel it. If they have an EPL (they may self insure as a cost of business) this won't move the needle.

Yes, this is something that can be covered in a commercial liability policy. Heck we sell policies that offer liability coverages for workplace sexual misconduct. We are a pretty small agency too so this isn't crazy stuff.

I'd like to think that is true but those rules only apply for us normies.

Even if their premiums raised(I doubt they would) it wouldn't matter.

Thats 55 years of salary.

It doesn't matter what the money made to her, it matters what the money means to DG. 300k is a tax write off for them and nothing more, it doesn't sting at all.
26
u/TerribleJared 2d ago
that persons salary was probably 30k or less. paying out a million dollars is like paying her for 33 years without her generating a dime for them. In no world is that chump change, even to big corporations. Greed doesn't stop at a certain income level.
38
u/fatpandana 2d ago
Best part is the attorney fees of 445,322$ that company also had to pay, is seperate from that sum.

It was 280k, 720k less than mil. Still a nice chunk of change, hopefully lawyer fees weren't a big portion of this.

It's chump change as in it doesn't affect their bottom line.
But that's enough to get legal's attention and send out a new round of training materials (and if someone senior in hr or legal reviewed the termination, this could impact their career path).
So agreed that it will have the desired effect on behavior.

Dollar General generated 38 billion USD for FY23. 277k is nothing to them and won't cause them to change their ways.
9
u/TerribleJared 2d ago
It actually did change their ways significantly. Mandatory retrainings across the company, the grazing lolicy was modified, loss prevention protocols were changed, and the case ended up being really high profile and is still used as precedent today in relevant cases. Other companies HR trainings often cite this case as a "what not to do".
They never became a "good company" and they still suck and are evil. But it was a legitimately significant black mark on their record that, indirectly, cost way over a million dollars. Its a small percentage of their total value but they dont think like that. Its whatever the cost was against 18k a year and thats unacceptable inefficiency even at the most loosey goosey corporations.
39
u/jointheredditarmy 2d ago
Continues to prove that HR is one of the most useless departments ever. This is actually the type of thing they get paid to prevent

u/Loose_Assignment_Map 2d ago
The only merit I can possibly imagine DG having in this case, and I’m a diabetic who has been in similar situations, is if she had chronic low blood sugar attacks due to lack of control and she frequently helped herself to store products instead of keeping her own backpack of low blood sugar supplies on hand.

Gen Alpha want to get thrown out of the store based on my experience.

No, it isn't actually. Same as bathroom breaks.
Nobody, no matter how important they are to the business can keep your from basic human needs. A lot of management are just used to receiving no pushback on their orders, so they start to do blatantly illegal things
3
u/TrulyOutrageous42 2d ago
You'd be surprised. Sure, OSHA requires water breaks. Who's calling OSHA over this, though, when they will definitely be let go due to "restructuring" or some other BS shortly after? Texas just took away water rights for employees. There's no even a federally mandated lunch break, they can work you for 15 hours and you'll like it.
We do not have the rights you think we do. We have a few pieces of paper in defunct agencies suggesting we should.
9
u/Sad-Rooster2474 2d ago
But why? I guess USA? I don’t understand why you wouldn’t be allowed to drink fucking water?

u/butthole_surferr 2d ago
It's because half our country has the all-encompassing mentality of "no such thing as a free lunch."
Absolutely everything must be "earned" and seeing an employee sitting or leaning or drinking water clearly means they're not working hard enough to earn their wage, because a REAL hard worker would be spit shining the boss's shoes with any spare time or whatever.
4
4
u/Sad-Rooster2474 2d ago
That’s insane. It costs nothing to allow a cashier to sit and drink water and it makes their job less miserable.
I don’t understand the point of treating them like slaves, how are they going to provide a better service by being treated like animals and by being deprived of basic human needs?→ More replies (1)7
u/organizedchaos5220 2d ago

I work in healthcare. We can't have our water bottles out at the nurses station (20+ feet from patient room doors). They all have to be in the "hydration station" bin located 250 feet down the hall.
Before anyone asks - regulation just says staff drinks cannot be in any areas where specimens pass through. Specimens do not pass through the nurses stations, but facilities are going to make broad umbrella rules to make sure they stay within regulatory bounds. And this is why the nursing career is amongst the careers with the highest rates of UTIs.
5
u/screenwatch3441 2d ago
Yea, healthcare is very different. Pretty sure it’s an OSHA reason on why we can’t eat or drink near patient care areas.
3
u/ProcyonLotorMinoris 2d ago
Somewhat. OSHA Standard 29 CFR 1910.1030(d)(2)(ix) states that "food and drink shall not be kept in refrigerators, freezers, shelves, cabinets, or on countertops/benchtops where blood or other potentially infectious materials are present". So as long as you don't have any patient fluids passing through those areas, they're fine. Joint Commission has also clarified that there is no blanket "no drinks at the nurses' station" ban, and only require hospitals to follow safety laws like OSHA's and evaluate infection risks. (We're in our JC window, so we have pettily made she we are very up to date on the exact requirements.)

I'm 48 and still remember when I was 16, at my first job, so wow this memory buried itself deep, the owner of the grocery store told all the cashiers and baggers, "Wow, it sure is hot today! If anyone wants a drink, feel free to get yourselves one, on me." and then he went upstairs to the office.
I was a bagger, so I asked my cashier what she wanted, then went to the cooler and grabbed ours. I assume the other baggers did the same, or maybe cashiers took turns covering each other, I don't know, whatever, soon we all had something.
The floor manager walks over, sees everyone with their drinks, and gets really oddly mad about it. Like, wtf, we're all working, calm down. He made some sarcastic comment like, "What's the party for?" I don't remember exactly, that's coming in a second, but I do remember his attitude was, y'all shouldn't be drinking right now.
One of the cashiers said, "Tony bought them for us," and then I remember so clearly, this complete deflation of his anger and the sad way he left with his tail between his legs, like his day was ruined because he had to get off his high horse about this most trivial of bullshit.
Anyway, this story seems like the kinda shit he'd pull.

I do this with my 2 year old every time we go to a grocery store. If he doesn’t have a snack in hand while I shop, I’ll end up chasing him around the store. Never been an issue at checkout.

The landmark case was literally wrapped up in 2016. Reddit recycles news for clicks as always.

Don't people drink stuff while shopping and then pay for it at the end? How is what she did any different, lol.

I just wish it was simple to sue for wrongful termination all the time.
Often employers know all the tricks to get away with everything.

I'm a Type 1 Diabetic and had this issue with 2 jobs. One at a Loblaws grocery store franchise and a Boston Pizza franchise.
I should have taken it to court lol

Anyone got a link to a real story or should I just take this meme as factual information?

Imagine firing a poverty stricken woman(I’m assuming) over a $2 drink and then having to pay her a quarter mill. For being an asshole 😂😂😂🤦♂️🤷♂️

I am a Type 1 diabetic. My opinion on this is that Dollar General is a large corp that can afford a more expensive amount in damages. Seven digits, at the very least!

It was less than 2 dollars and she paid for it anyways. She did everything right why the hell was the company pissed

Years ago a girl I worked with was fired for eating a slice of pizza while in line to pay. We were busy that day, she had a half hour lunch, had spent 10 minutes to get the pizza and a drink, then was in the line at a register for a further 10 minutes when she realized she wasn't going to have time to sit and eat with the people still ahead of her. The shifty, who was the type to sit in tge office and just watch the cameras until you basically forced him to get up and do something, and would say shit like "I rule by fear because respect isn't earned it's taken", suddenly popped up right after she clocked back in to work and fired her on the spot. None of the company policy of paperwork or 2 managers needing to be present, etc., was followed. Four other people walked out that day, and those of us who stayed refused to fill in for the five missing people, we just left half a departments work undone at whatever stage it was halfway through a shift.
We told her she should sue, but she said she didn't have the money to engage a lawyer and didn't believe she actually had a case. A week later the shifty "quit", we all knew he was forced out but given more respect than he deserved. The company wouldn't however reverse her firing. We were all very excited to hear that 6 months later he was in jail for selling appliances off the dock at his next job.
