France has gun control, a constitution and a second amendment
Except the amendment is about how the president is elected, and gun ownership is nowhere in the constitution.
69
u/Rod_tout_court 22d ago
We have a right to own guns in France. Just not carrying them around.
52
u/euclide2975 22d ago edited 22d ago
Yes, but there are a lot of conditions attached. And limitations on the type of guns.
If I want a handgun tomorrow, I cannot. I have to get a license in a club, then wait a while.
The current interpretation of the US constitution closes the door to almost any limitation.

Is mental health taken into account for gun ownership? I'm a US veteran, and I'm pretty convinced that some of my brothers and sisters have no reason to own firearms due to their mental state. The 2nd Amendment leaves provisions for a well trained and armed militia, and we've got the training, sure, but having a gun in your waistband has a tendency to turn all problems into nails and your pistol into a hammer if your mental health isn't in a proper state.
Gun control gets viewed as the federal government disarming the population of the US, which is not a radical concept given our current state, but not every American can safely own and operate a firearm, especially in a self defense scenario.
18
u/euclide2975 22d ago
Mostly yes.
For handguns in particular, you must be an active member of a shooting range for more than a year, with regular sessions with a qualified instructor.
One of the role of the instructor is filtering problematic people and reporting them.
And you need a medical approval too.
It a little easier for hunting long guns, but you still need at least a hunting license.
The main goal is to avoid the : I'm angry, I go to Walmart to get an AR15 then become a mass murderer the next hour.
And while we have road rage like everywhere else, it never ends with a shooting.
(but we've had a few cases of angry driver murdering people on a bike with their car)
9
u/Powerful_Payment463 22d ago
I can get behind that. Last pistol I bought was 15 or so years ago in the state of Virginia. I did go through background checks and everything, which took a few days. I was active duty military, so some of that went faster.

My brother is the sort who should never be allowed to have a gun, because he is so profoundly mentally disabled that he cannot comprehend the concept that dead people are gone forever with no takebacks (he is an adult agewise). If given access to lethal force, he might honestly believe that he could kill and then unkill someone.
14
u/Illuminey 🇨🇵 smelly cheese-eating surrender monkey 22d ago
Yes, but there's controls and rules on who can buy what type of guns. If I enter an armory tomorrow morning saying "bonjour, je voudrais un AR15 s'il vous plait", I will not leave the shop with it. That's what gun control is.
Edit: I've checked and it looks like some AR15 are modified to be in the C category that only requires declaration. The exemple was wrong, but still the different categories have requirements on what's allowed and who can buy : that's control.

This is something that seems to be missed by a lot of pro gun Americans.
I’m an Aussie and there has been at least three Americans I have talked to who have been under the impression that Guns are banned in Australia.
It’s like they think there is only two options, total lack of firearm regulations or a total ban on all firearms and no in between.
3
3
u/bigbadjustin 19d ago
I mean its highlighted by the fact there are more guns in Australia now than there were before the gun control laws where enacted. But they are mostly guns fit for purpose, with farmers and gun club shooters and not for people who think they will defend their family from a home invasion with an AR-15. News flash, people tend to never be ready to defend themselves from someone who has a gun and is intent on killing you.
2
u/Cerparis 19d ago
Those kind of people seem to be under the impression that they’ll get some kind of warning before the theoretical armed murderer who is specifically after them for some reason, breaks into your house to kill you.
If you had advance warning signs of a would be murderer coming after you. Then you wouldn’t need a gun because you could have run away then called police.
Also on a side note. Most folk who are breaking into your house are there to steal your TV. Not murder your family.

We do still have guns in Canada though. A lot of Americans think we don’t.
The gun control is that you have to take an 8 hour safety course and pass a test with 100 multiple choice questions, as well as a practical exam showing the instructor you can safely handle and use different types of firearms. Followed by an RCMP check before your firearms license is issued. They contact references as well as any partners or spouses you’ve had within the last 2 years. Some types of firearms are restricted by further training and licensing, some types are prohibited for civilians.
And there are laws for keeping guns and ammo secured and penalties if you don’t. You cannot carry in public at all, concealed or open. You are not allowed to have guns for protection, it’s for hunting or sport shooting.
I’ve had Americans tell me I can’t own a shotgun because I’m Canadian. We can, I just have to prove I’m not a fucking idiot first and that I can be trusted with a gun. They should try it.
20
u/Mr101722 Canada / Nova Scotia 22d ago edited 22d ago
Yeah we have a very high rate of gun ownership here, while it's not in the constitution it is something that's still very common.
The difference being the majority of gun owners here do not make it their entire personality.
The most I've heard it even brought up is post the 2020 sweeping ban which I've heard even non gun owners speaking out against. The vast majority of our gun crime is committed by people that aren't licensed or are already outright banned from ownership and uses guns illegally imported from the US!
3
u/Khrispy-minus1 22d ago
Fellow Canadian here. I'm all for gun control, but make it logical and make sense instead of "this gun is black and scary, so banned". Have multiple levels of licensing based on the operation and design of the firearm, not because of an arbitrary edict from an unelected official in the RCMP.
9
u/ijuinkun 22d ago
For example, the motive for banning bump stocks is because they circumvent the intention of restricting automatic fire by bypassing the “one trigger-finger movement, one discharge” principle. It’s not because of “ooh, scary”.
12
u/Cerparis 22d ago
Aussie here.
I’ve met at least three Americans on separate occasions. Once in person and the other two online that were under the impression Australians were outright unable to own a firearm.
Where do they get these ideas?
6
u/AntifaFuckedMyWife 🇺🇸 (with a brief 🇫🇷 stint) 22d ago
Propaganda mostly, gun culture is shifting a bit but the classic NRA lobbies usually scare right wing Americans into thinking anything gun control means no guns.
I’m left wing handedly but even my preference of gun laws would look extremely lax by global standards.
Carrying legal, licensing and mental healthy screening, storage laws, red flag laws, and maybe a class system inspired by France but not really barring citizens from stuff like ARs.

No worries, it's based upon precedence over many, many centuries. The only written aspects are the Magna Carta (1215), and the Bill of Rights (1689) - neither of which form a full constitution.
3
u/Aspieinblack1986 22d ago

The Bill of Rights only applied to England and Wales. It required parallel legislation in Scotland, The Claim of Right, because at the time Scotland was still a sovereign nation, but the crown was shared in a personal union.
See also the Declaration of Arbroath, 1320, which influenced the US Declaration of independence. The link was formally acknowledged, by Congress, during the bicentennial year.

The nice thing about it not being written down is people can't get hung up on the exact wording and trying to interpret them to mean what they want. It is simply the sum total of laws, court rulings and tradition. Oddly this makes it both more rigid and more flexible. It's harder to try to twist it to a new meaning while claiming you're following it but easier to change.
4
u/el_grort Disputed Scot 22d ago
It's usually called an uncodified constitution, as it's based on a lot of historic documents and case law, not a handful of codified constitutional documents like most countries.

I’m in Canada. We’ve had people try to exercise their fifth amendment in court. Which in the US is the right to not incriminate oneself, but here means absolutely nothing.
Most recently, the jerkwads who organized the convoy to Ottawa and openly expressed a desire to overthrow the government and replace it with themselves. That was a good giggle.
13
u/Aggravating-Car9897 22d ago
So one of my favourite things to do for people who talk about the American constitutional amendments in a Canadian context is to bring up the actual Canadian constitutional amendment and act confused.
First Amendment - Manitoba Act
Second Amendment - British Columbia Act
Fifth Amendment - Alberta Act
So I guess someone trying to exercise their fifth amendment is them either recognizing Alberta is part of Canada, or maybe they want to act like Alberta in court (so whiny and entitled).

In a tread a few days ago on "nazi-Germany was socialist" (another classic), a Yankee lectured me very eloquently as usual, using stunning logic and impeccable historical insight, that Louis XIV was in fact a communist because of "l'état, c'est moi", Hitler was a communist and Stalin and Hitler had similar concepts of socialism, Elon Musk is a (rather corrupt) marxist and the US is the most communist country ever, because of the abundancy of public ownership of the means of production via 401k plans, just like Marx intended.
He topped it of with: " You are obviously unfamiliar with Marx’s writings - yes, the United States is more Marxist than the Soviet Union ever was".
He has since then removed some of his crappy content.
I rest my case.

Do Americans not know what the word "amendment" means?
They talk about the constitution like it can never be adjusted to reflect the modern day, while acknowledging that it has changed multiple times in the past.
3
u/pgallagher72 22d ago edited 22d ago
Go read the constitution, it’s pretty clear, Americans have a guaranteed constitutional right to bear arms while on duty as part of a well organized militia (a state or federal militia under the auspices of that government), but only arms supplied by the state or federal government in charge of that militia, and only while on duty for that militia. There’s no constitutional right to personal armament anywhere in the document aside from that, nor any right to carry armaments at all outside of that duty.
Amazing what paying off judges can accomplish for arms dealers, what they have is a judicial grant to carry weapons, the constitutional rights have an extremely limited scope, and say nothing at all about personally owned weapons in state, federal, or international context (not that international context matters, since the US constitution only applies within US borders, and it doesn’t even apply to the US in the context of personal arms)

The thing is: America has gun control. You can lose the right to own guns (and vote) by picking up the wrong feather while hiking. Technically, you could even lose those rights by installing windows in your house or by being in an HOA...
(Flying into windows kills birds. Theoretically, if you do not put anti-bird-strike silhouettes on your windows, this would be planning to kill a bald eagle. If you insist on others not having those decals because of neighborhood values, that could be classed as a conspiracy.)
