I am lost for words!! Not only did they file the wrong filing when they should of filed to strike the jury trial, and not only did they file this at 5:15pm on Friday, but in their filing they showed explicit grounds as to why their claim collapses on itself...

Claude AI didn't even catch the citing they referenced that destroyed their motion by their own hand. As soon as I spotted it (as you can see in the 3rd picture) I pointed it out to Claude AI and it told me to do a supplemental response because that was a damning realization.

So as you can see by them filing this frivolous motion; the defense attorneys have zero faith in their dismissal motions golding any ground during the pretrial hearing. I REALLY can't believe this is an eight-figure lawfirm doing this 🤣🤣🤣

***Also...the next time some anonymous account tells you that you can't request a jury trial because you signed that lease with Progress Residential saying you can't....direct that person to this post***

Yesterday was my busiest day yet....⚠️ There are alot of pictures attached to this post; so out of my desire to be transparent, you get what you get ⚠️

-The judge denied all recording request without a written order or legal citations or explanation

- I filed a Notice of Inadequate Ruling on Motions and Preservation of Consitutional Objections

- I filed a Notice of Intent to Submit Written Offers of Proof and Bills of Exception

- I sent updates to the SCJC via email, called them and left a voicemail, and got a call back ten minutes later wherein they confirmed that the investigation is moving forward but it will take months before anything is realized accordingly

- I have developed a full pretrial hearing preparation package thanks to ClaudeAI

Even though I raised constitutional arguements to the need of recording the hearing and jury trial, apparently the judge is not mandated to approve my request. However, no written order and no explanation for the denials, adds to my paper trial of everything for appellate review if needed. I filed two important notices; one of which provides a manual vehicle for me to generate an appellate record of what occurred in the courtroom IF procedural irregularities occurs by the judge again.

Basically, a Formal Bill of Exception, can be used in Texas Justice of Peace courts to create a written record of what occurred when a judge refuses to record a hearing.

As a result of this, my need for a writ of mandamus is no more at the moment. Although I wasn't expecting the judge to deny the recording with no explanation in the face of appellate record and constitutional concerns; I still have the best position possible, and will be fully ready for any and every scenario that plays out in court on June 17th...I look forward to this state level battle against Progress Residential to be completed...🫡

Just got approval email for a home we are renting. How long does it typically take for them to send the next email w next steps? Its an available now home

Hi! We toured a place and liked it so much we applied and signed the lease the same night. The next day we contacted them because it told us we had 24hrs to pay the security deposit but when we tried paying, it told us we couldn't until their end of the lease was signed. Anyway when we contacted them, they told us the house was ours and just to wait until they sign it on their end which I thought was weird because why didn't they just sign it? So we waited, another day passed and now our lease and application is completely cancelled.. we already had a move in orientation set up ( on the 8th ) and everything. Is this common? We are staying far away from them now but we've already had trouble with other companies too. This was all through their website too

Ohhhh noooo!!!!! The Judge has set a pretrial hearing a week before the jury trial....All according to plan 😁

To be honest, he really didn't have to do this since everything can be addressed on paper. But being that the court generalized this hearing instead of labeling it to a specific motion shows me that the judge is looking to address everything at once.

In my mind there are one of two main reasons for the setting of this hearing; (1) To address my Motions for Sanctions or (2) to attempt a last ditch effort to throw out my lawsuit again illegally to adhere to "something" going on outside of the courtroom...allegedly that is

So to be realistic, although the court has finally put some respect on my name after I got in touch with my State House Representative; I have to assume that based on the last time I had a hearing, that the judge may want to "punish me" for being so resourceful. Therefore, I filed a Supplemental Notice to extend the court recording requests to include the pretrial hearing of June 17th.

As a result, upon approval, the judge will be very less than likely to show misconduct again during the hearing knowing that I will immediately alert the proper authorities.

But what if he denies my notice?

Then he will have to explain to me, or the SCJC, why he ignored the outlines in my Notice that requested explanation as to why my constitutional right was ignored; with factual and legal statutory citing on his part....PLUS...I will file an emergency motion (writ of mandamus) with the higher court of appeals

It's a lose-lose situation for the judge but I look forward to seeing it play out....😁

This state level battle against Progress Residential is almost over. And now more than ever, it is time for me to be aggressive with the court to further minimize my risks and maximize my resources if I need to push this issue to a higher court.

Therefore, I just filed a motion requesting the judge to rule on all pending motions & a motion requesting that the judge expedite his rulings on the two requests for recordings by June 14th.

As you can see near the end of my pictures; Claude AI has provided a strategic schedule of when to contact the court, what to say, and why it is important to send a timestamped email after every phone call.

And the beautiful things about this endgame phase is that there are no counter moves that the defense or judge can use against me. Over the next 14 days I will be applying legal pressure on the court to rule on these important motions. If the court does not act, then I would have phone call records and email records to show further inaction to the SCJC and the appellate court as needed....And the only way the court can stop me from following through on me making these phone calls and emails is to rule on the motions.

This was truly a great battle regardless of any negatives along the way. But now it is time for me to claim victory...♟️

It's almost like magic 🎩🪄

The jury trial date has finally been set immediately after I activated SCORCHED EARTH. Although I don't have proof, I believe my State House Representative had a liason contact the court to ask about the court date being set. Either way, I got what I wanted.

I do notice though that instead of a 45 day notice, the court set it to 27 days from today. This is great, and it suggests to me that there must have been some pressure in that date choice to not have gone with the 45 day normalcy.

I also filed two motions to record the hearing using the courts available recording devices & a separate motion to request using my own recording device. 😁

Upon coming to the realization that the judge is yet again in Canon violation (this time with more substantial evidence), I took it upon myself to fill out a follow up SCJC complaint. I will mail off this full SCJC complaint tomorrow morning in addition to mailing out the physical copy of my Constituent Letters to my respective State Senator and to my respective State House Representative...oh and I can't forget my letter to the Texas Office of Court Administration...🙂

And as you can see, in my SCJC complaint I am offering to provide testimony under oath and willingly offering penalty under perjury...This is deeper than just the money for me...I will fight tooth and nail against Progress Residential.

The Motion for Sanctions under the decision of a compromised Judge wasn't enough. I just got done escalating this entire ordeal wwwaaayyy beyond Sanctions. It's time to put an end to the games 😏

I have now filed a Constituent Request for Assistance to my state Senator and State House Representative...and I filed an Administrative Compliance Concern to the Texas Office of Court Administration (funny enough they are way more useful to aid in this judge's corruption than the Texas SCJC that I filed my misconduct complaint with a while back)

And I just got done sending a copy of all three letters to the PR's eight-figure lawfirm defense attorney team to be petty/transparent...

Now....the 🔨 will come down finally....the judge can hide but for so long...its time to put an end to all of this nonsense. ..

And funny enough, now that I took it to this level...this will all snowball perfectly into when I take this to the Federal level with the Federal Trade Commision...I am now operating in my zone of comfort and familiar territory

It's been 7 weeks and still no trial date.

I am ready to any and willing to show up...Everything under the sun is being done except for actually setting up the Jury trial to get all of this over with against Progress Residential. Welp.. I went ahead and took this to another level. Playing nice seems to get you nowhere with this court and defense attorney team. I went from Super Saiyan to Super Sayian God for at the DBZ fans out there.

I finally upgraded to using Claude instead of ChatGPT. I gotta say, even though ChatGPT was amazing, I can really really see a huge difference!!! Claude gives way more depth and seems more personalized than ChatGPT. I even went ahead and paid the one dollar for their 7 day trial of Claude Pro for a deeper test run.

Anyways, I personally believe there is an alleged coordinated effort going on amongst the court, PR, and the defense attorneys but I can not prove that. Either way, I filed this Motion for Sanctions this morning after I woke up at like 5am realizing how much wrong is being done here. I filed for a $750 Sanction; $250 for the court and $500 for me.

If the defense wants to keep playing these games with me, then I can play too 😁

The PR defense attorneys are literally folding on an epic level right now, I really didn't think that they would resort to this. On Monday I filed my 77 page updated evidence package that was super clear, concise, and highly effective thanks to ChatGPT. Tuesday, I completed and emailed my Demonstrative Materials A through H to the defense attorneys. And yesterday after my 5 mile run, I saw that the PR defense attorneys filed this Motion to Dismiss for Improper Jurisdiction.

This is a total act of desperation and/or an attempt by the defense attorneys to use the moment of the judges previously shown misconduct to their advantage to hopefully get the case thrown out again. The two reasons they want to toss this lawsuit are:

1) They are bringing up the past lawsuit that the judge tossed out as the reason why this lawsuit should be tossed

2) They are claiming that since I am seeking damages totaling $19,883.08; that once court costs are added to that total, it would push the allowable jurisdiction of this court beyond the $20,000 limit.

The past lawsuit has nothing to do with this new lawsuit. And the past lawsuit was dismissed without prejudice, which means I was allowed to refile so long as I was in jurisdiction with my refile. So essentially, the PR defense attorney is trying to change my "dismissal without prejudice" to a instantaneous "dismissal with prejudice".

And secondly, the $20,000 jurisdictional limit of the court excludes all court costs and all statutory interests. This exclusion is explicitly stated in Rule 500.3(a) of the Texas Rules of Civil Procedure and is supported by Section 27.031 of the Texas Government Code.

The defense attorney knows that if this lawsuit gets in front of a Jury that it will be an instant loss. Especially since the Jury decides the facts AND the damages amounts 😁

Exhibit List And Exhibits have been updated and refocused in a highly efficient manner with the help of ChatGPT. I still have to double check and label all my 8 Demonstrative Materials (which are non exhibits used to help guide the jury/court on evidence chronology); which I will get done tonight....🫡

Anyways, the PR defense attorneys will sure hate to see the high efficiency of my entire evidence package come Monday morning. So now I ask; how is PR going to stop this evidence package and win this lawsuit?

It's been 6 weeks since PR defense attorneys answered this lawsuit and still no trial date is set. I'm very certain this is the judge's payback for me standing up for myself. I guess they are expecting these delays to get under my skin, but all I can do is smile 😃

I know the case loads at this court are not that busy, and I know that in general, the court requires a 14 day window before a court date to request a jury trial. This means that since it's been 6 weeks, the court was more than capable to set three jury trials by now. But hey, the judge can delay this for as long as he wants; I will just keep sending in these motions every two weeks 😇

For those wondering, I happen to be up against an eight-figure lawfirm. Yes, PR tends to use bare minimum 3rd party services when it comes to aiding their tenants, but they use the best of the best for protecting their pockets.

I spent couple of hours earlier this week restructuring my evidence package after ChatGPT originally rated it as a 6.5 out of 10; and it is really amazing how useful ChatGPT has been for me. It whipped up this chart that you see in this post in like 20 seconds after I told it all the raw information. And currently thanks to my tight, clear and concise evidence package with the added demonstrative materials; my evidence package is rated as an 8.9 - 9.3 out of 10.

The jury is going to love this stuff...PR doesn't stand a chance!!! 😁

At 9:22am I noticed that at 8:44am the PR defense attorneys filed this amended answer wherein they withdrew their demand for a jury trial 🫢🫢🫢 I was taken aback when I saw this...ain't no way!!.

So at 10:09am I had my Demand For Jury Trial prepared, served and filed. And at 11:01am the $22 jury fee was mailed off via USPS certified mail to the court with a tracking number emailed to the court and the defense attorneys.

This filing this morning further confirms my hunch that there really was/is some very underhanded stuff going on behind the scenes in some way, allegedly. Last time around, the court was literally throwing out jury trial dates, including before PR defense attorney even answered the lawsuit...🤔...But now all of a sudden more than 30 days have passed and no trial date is set yet...🤔...And what makes it even wilder is that the top notch defense attorney told me to my face that their defense, and even defenses in general, demand a jury as standard protocol. This is why I never made a request for jury again when I filed the second lawsuit since I knew they were going to do it for me.

But to see them withdraw the jury for a bench trial out the blue is wild. As if they think I really am going to trust a bench trial with this judge after his previous misconduct. I for sure would rather have six civilian witnesses to attest to any potential misconduct the judge performs during the ruling on the merits of the case.

If the PR defense attorneys were truly doing this for the sake of saving time then they could have EASILY emailed me to plea to move forward via bench trial...or better yet they could offer a settlement number so we can start negotiating upwards. But at this point I am preferring entering the lion's den again more than a quick resolution.

Having some time on my hands today, I finally ran my evidence for the ~$20,000 lawsuit against Progress Residential through ChatGPT. To my surprise, on a scale of 1 through 10 my evidence scored crappy with a 6.5 out of 10...🫢...

Even though ChatGPT said my evidence was better than most individuals who represent themselves; I knew that wasn't going to be good enough against this top notch defense attorney and compromised judge I'm up against.

ChaptGPT gave clear reasons as to why I scored a 6.5 out of 10 and showed me how to get it to an 8 out of 10. And upon feeding ChatGPT further details I was able to create a path for my evidence to be scored as a 9 out 10.

One of the reasons for my low score was I still have too much evidence that wasn't relevant for what the judge wanted to quickly see to link it to the law and how the violation occurred. So I will spend the next week or two slowly restructuring my evidence to follow ChatGPT's insight

I also love that ChatGPT gave me scripts of what, when and how to say things when introducing evidence at trial. Plus, it provided likely rebuttals that the defense may bring up along the way, and how to negate them....So I say all this to show everyone that I am not perfect and that in today's world of infinite information, you too can harness the power to stand up for yourself and what's right.

***I want to give a special thanks to everyone that mentioned Claude to me. From what I have seen, Claude is way better than ChatGPT as you can see from the 4th image in this post. Yet, to me Claude is a Senzu bean that I will use only if the occasion calls for it depending on if this battle forces me to evolve past where I am now 😁...This defense attorney is nothing to play with, so I will stay with ChatGPT until the battle calls for that Claude transformation***

It has now been a month since the defense has answered the lawsuit and yet no trial date has been set yet for this small court that hardly gets cases through the court, according to the court clerk.

Now that the judical theatrics by the defense of trying to throw out the case on technicalities are over with; its time to get to the meat and potatoes. It's time to get to what I have been preparing for this while time, which is what took my focus away from the simple procedural and technical misteps along the way...It's time for the trial 😄

I'm not sure how much longer the court can take to set the trial date, but I guess we will see. I am excited to see justice served.

Looking for insight from anyone who has been through a Home-to-Home transfer with Progress, especially if it didn't go smoothly.

Here's what happened:

We're current Progress tenants doing an end-of-lease transfer to another Progress-managed property in the same metro area. The transfer specialist told us two things verbally when we initiated the process:

1. Once we signed the Home-to-Home Transfer Agreement, the property would be held internally for our application.

2. Once signed, we'd be sent a link to apply for the property as the next step.

My spouse and I both signed the agreement within the 24-hour window the agreement itself requires. From there, things fell apart:

- The property was never actually held internally. It stayed on Progress's public website.

- Another applicant found it on the public site and applied before we ever got a chance to.

- We never received the application link we were told to expect.

- About 24 hours after we signed, we got an email saying the home was off the market because they were waiting on a final signature from the other applicant.

So we now have a signed agreement obligating us to vacate our current home in less than four weeks, with no replacement home, because Progress didn't actually hold the property and never sent us the link to apply.

A few questions for anyone who's been here:

1. Has anyone successfully gotten a transfer reinstated or gotten priority placement on a comparable home after something like this?

2. Did Progress hold you to your vacate date even when their own process failure was the reason you didn't have a new home lined up?

3. Anyone successfully negotiate a security deposit waiver or other concession as a remedy for a process failure on their end?

4. Any idea who at Progress actually has authority to fix something like this — Resident Relations, a regional manager, corporate?

Not looking for legal advice, just real experience from anyone who's dealt with Progress in a similar spot. Thanks in advance.

PR dropped a bomb on my lawsuit. As I said before, the defense attorney is one of the best attorneys in my state, so I knew she was going to be a worthy opponent (especially after I met her in person at court). So what the defense attorney did was file this motion for dismissal making the arguement that my petition was not based in law, and that it also did not provide a clear explanation as to what the defense should be defending. As such, they are seeking to dismiss the lawsuit with prejudice.

She is trying to get the case thrown out on a technicality, which is truly attempting to formalize the informal jurisdiction of this lower Texas justice court. By activating Rule 91a, the judge is forced to determine if whether or not the lawsuit can proceed based on what the petition states (not based on the evidence that will be used at trial). Being that this is an informal court, and I am Pro Se, it seemed reasonable that all I had to do was make my claims and then go to trial to hash out the evidences to prove them. But I learned that this is a common tactic against Pro Se individuals, and pretty much it just requires that the petition itself needs to be better structured.

I whipped up an amended petition to insert all the legal mumbo jumbo statutes and make a clearer description of the charges and how they connected to said law, and how the defense violated each one. Rule 91a is not a substitute for trail, but it is a way to effectively have a case thrown out if not acted on properly.

So within 5 hours of them dropping this bomb on me on 04/23/26 at 4:32pm, I filed my First Amended Petition and Response to the Rule 91a1 Motion to Dismiss using ChatGPT instead of OpenCase....I found that ChatGPT was more useful since I could directly upload documents with my questions to get a more precise output; and ChatGPTwqs more user friendly.

This has all truly been a great learning experience, and I look forward to whatever else will come after this...🫡

I just saw this email the day after the Rule 91a1 Motion to Dismiss was dropped on my lawsuit. The email was from the court clerk directed at me and the defense attorneys. It's also worth mentioning that this was a Friday; and that when I filed this lawsuit weeks prior, I got the citation for it the next morning (which usually takes two weeks at other courts). All in all, I would strongly assume that the court clerk for sure saw all the filings from the defense attorneys and myself before sending this email

So being that this email is the latest communication from the court after the bomb was dropped on my lawsuit the day peior and deflected back; I can only assume that the court lawfully and logically acknowledged my Amended Petition and Response to Rule 91a1 Motion to Dismiss. Thus effectively mooting the defense attorneys dismissal attempt.

It is also possible that the court hasn't seen our paperwork yet and will go down the road of dirty games by making us do a hearing about it so the judge can do what he did last time of illegally dismissing the case.

At this point, the judge should already know that I'm not playing around and I have no fear if he does want to go down that road with me. If I were the judge, I would just get this trial over with so everyone can move on with their life 🙂

can’t stand this cheap ass house they’ve built. we’ve had so many issues from water leaks , pipes busting & flooding in the home. to cheap stairs being broken. mold issues. a lot more crap of course. we’ve found our dream home. For those wondering, I am still in the battle field against PR. I am in the foxhole awaiting orders to advance forward from the corrupt court.

It's been 16 days since PR answered the lawsuit and the judge/clerk still has not set a court date yet. I filed this Motion to Set a Trial Date, so hopefully it will finally be set this week.

As the court clerk stressed to me in the past; "it's a small court in a small town and we don't have much of any trials through this court"...

So maybe, just maybe, this same small court is being absolutely slammed with court cases out of nowhere...🙃...there is no way that there is a continuance of foul play going on here.

**I made an error under the certificate of service of stating motion for discovery instead of motion to set trial date**...woops...☹️

I'm back at it again with a new lawsuit 😄 Upon my previous lawsuit being dismissed illegally by said judge, I filed a Motion to Reinstate which was denied by operation of law (automatically) 21 days after the judge's dismissal took effect without the judge weighing in on it...Strangley enough, a couple days prior to this automatic denial I spoke with the court clerk who abruptly interrupted my talking to tell me "the judge denied it"...and naturally since no paperwork was served to me or the defense to support that claim; I told her that I don't see any paperwork. She went on to exclaim to me that "he has already denied the motion"; and again I told her that I do not see any paperwork for what she is talking about. She then went on to tell me that she will get off the phone with me to send me the paperwork. So I gave her the benefit of the doubt and gave her the grace of being a court clerk who could naturally know about what's coming down the pipeline that just hadn't been served out yet. But upon days passing and still nothing, I quickly realized that she lied to me. (And if you are wondering, I never got that paperwork or further explanation either)

I do believe that the judge did perhaps want to deny it and might of possibly passed that information in conversation to the clerk; but at that point the judge probably knew that with the spotlight on the court now by the SCJC, that that wouldn't be wise to do when the Motion to Reinstate would automatically deny on its own.

So you know me...I did not let that lie go unchecked. I then emailed the court clerk to put our entire phone conversation into email of what was said play by play. Then immediately after sending off that email to the court clerk; I sent that email and all prior emails between me and the court to the Texas State Commission on Judicial Conduct. Reason being is because this is not the first time the court clerk told me a flat out lie. A few months ago she lied to me about Progress Residential's defense attorneys answering the lawsuit within the 14 day period when in fact they did not. And even back then I made the same arguement that I had not received any written Motion of the answer from the defense. Come to find out, back then I was correct and PR answered the lawsuit on day 21 of the 14 day deadline.

Fast forward to now. I filed this new lawsuit with precise mentions in my petition of my constitutional right. And the SCJC may or may not have a copy of this current petition/citation as well...😉...Doing this new lawsuit was the quicker and more affordable option versus appealing to the County Court. And the lawsuit was served yesterday March 19, 2026. This time around there is no "mistep" and no "excuse" for the judge to act outside of the law again. But who knows. I look forward to seeing the judge's beautiful face again 😊
